      Good day sir...ano po pwede nmin gawin if may union samin at nag paratify sa rank n file employees at need nila makuha ang 50+1%. This is what happend they submitted the ratification for registration ans certification...the csc grant thier ratification and issued a certification to the management...question sir as an interested party we found out that thier list of signatories is fraud/falsified. .they did not reach 50+1% sa csc or sa labor po ba kami dapat mag file ng petition? Pwede po ba ma revoke ang certification nila...meron po kaming ebidensya ng list of signatories nila..

    Thank you, Atty. for sharing your online lectures in YT. Your lectures in PIL helped me perform well in my PIL class this sem.
    Sir, I have questions regarding labor. Are contractual employees working in LGUs or other government institutions entitled to security of tenure when the functions of said contractual employees are necessary and desirable in their designated offices?
    I am a job order employee in LGU for almost 2 years, with every 3 months that my contract is renewed. I work as a writer and researcher and I perform tasks that are necessary and desirable in the functions of the office where I am assign to.
    Also, what law covers job order employees working in the government sector in terms of their rights and welfare, is it the Labor Code, or CSC?

      JO and COS in govt including LGU's are sui generis not covered by cs law or labor code. if they have a contract then its governed by civil code. the enforcement of which belongs to the regular court. that is a sad reality they do not have security of tenure

      @@CDDukaLaw Yes Dean. Thanks. Dean, with all due respect po, meron lang akong kunting comment dun sa pagbanggit mo in the lecture that the soldiers, policemen, firemen and jailguards are not allowed to strike, which is correct naman. Ang concern is not on the proscription but on the term that is used to refer to us. We are jail officers po kasi, not jailguards. Mali po kasi yun. One may argue that it is what has been used for long. Maaring ganun but it doesnt mean na tama na ang isang bagay dahil matagal na ginagamit ito. Why is it wrong? It is wrong po for the followings: 1) I know that you know RA 6975, the same law that created the DILG and the agencies under it, including the PNP, BJMP and BFP.. Nowhere in that law that referred to us as jail guards, 2. The term is limiting.

By philosophical definition, we all know that terminology is a discipline that systematically studies the "labelling or designating of concepts" particular to one or more subject fields, ideas, groups or domains of human activity. Corollary to that, the use of standard, common, particular or right terminology is essential to ensuring efficient, clear communications and proper dissemination of meaningful messages. Anyway, thank you po for not using it, in fairness, in a derogatory manner. We appreciate it. Stay safe and God bless.

    A and B filed a petition for certification election. Their petition was granted but they lost in the election as majority of the employees voted for “no union”. The next day, they failed to report for work. They claim that they were barred from entering the premises. They filed a suit for illegal dismissal and back wages. The company denied these allegations and alleged that A and B refused to return to work despite their attention being called. Were A and B legally dismissed?
    What is the answer?

    What is possible answer
    Company Y is engaged in road construction projects of the government. It engaged the services of certain workers to work on various projects on different dates. Several of its workers joined Union A as members. Union A filed a motion for certification election with the regional office. Company Y opposed stating that the workers were project employees and not qualified to form part of the rank and file collective bargaining unit. Later, Company Y terminated the employment of the workers due to the completion of its projects or the expiration of worker’s contracts. The affected workers claimed they were dismissed because of their union activities; and thus staged a strike. The strike was declared illegal and the workers were deemed to have lost their employment status. Were the workers validly dismissed.

      wala sa labor code yan. sa sss law may death at burial benefits sya. check din kung may company policy or collective bargaining agreement tungkol sa death benefits

      una hindi ako madam... lalaki ako at abogado hindi abogada ok? pangalawa kung nagresign kayo at voluntary eh wala kayong mahahabol sa agency nyo. kung sa tingin nyo napilitan lang kayo magresign at hindi kusang loob eh pwede ka at mga kasama mo magfile ng reklamo sa national labor relations commission ng kasong illegal dismissal

    Art. 299. Disposition of pending cases. All cases pending before the Court of Industrial Relations and the National Labor Relations Commission established under Presidential Decree No. 21 on the date of effectivity of this Code shall be transferred to and processed by the corresponding labor relations divisions or the National Labor Relations Commission created under this Code having cognizance of the same in accordance with the procedure laid down herein and its implementing rules and regulations. Cases on labor relations on appeal with the Secretary of Labor or the Office of the President of the Philippines as of the date of effectivity of this Code shall remain under their respective jurisdictions and shall be decided in accordance with the rules and regulations in force at the time of appeal.
