    He is just following the standard sovereign citizen script, interrupting as often as possible, claiming that your name is a fake etc.
    They claim that if they say "understand" that means they stand under the jurisdiction of the court, that's why they will never say that they understand.

      Since he has been found competent to represent himself, it rules out any evaluation for insanity in future appeals I do believe.

      @@pyregazer9210 competency and insanity are 2 different legal concepts. Competency is whether during the legal proceedings the defendant understands the charges against him and can aid in his own defense. Not guilty by reason of insanity defense focuses on the defendant’s state of mind at the time of the alleged crimes and the defense argues the defendant didn’t know right from wrong at the time he committed the crimes.
      Brooks’ attorneys were planning on mounting an insanity defense but they withdrew the insanity plea a few months ago. Since he is not arguing the insanity plea at this trial, it’s not something he could later bring up on appeal.

    Judge made the right call IMO. She recognizes his behavior for what it is - a deliberate and knowing attempt to delay and obstruct. His refusal to say he "understands" anything isn't out of ignorance, but is a common sovereign citizen quirk. They believe that the word "understand" secretly means to "stand under," to declare yourself subject to authority. In their mythology, refusing to "understand" keeps police and courts from having power over you. The judge cleverly short-circuited that by asking him if he was "aware" instead.

      She should have asked him if he comprehends instead of understand. Someone can be aware or informed, but still not understand/ comprehend. A future lawyer could claim he didn't understand the proceedings and choices in an appeal.

      The issue with your argument is that "understand" and "aware" have completely different meanings. Allow me to enlighten you and banish some of your ignorance. The word "understand" etymologically derives from Old English "understandan", which conveys certain ambiguities. "Understand" could be understood in the sense that it means "to comprehend an idea", but it could also mean "to view something in a particular way." These two meanings are not mutually exclusive. Because the suspect reasonably could have interpreted her question to mean the second sense of the word (in which it case it'd be completely reasonable of him to disagree because he does not see things the judge's way), then his answer to the question could easily be in the negative, whereas if the judge meant to use "understand" in a literal sense, then his answer could be in the affirmative. This is the judge's fault for not appreciating the nuances of language and anticipating how her audience might react to interrogatives that contain polysemous words such as "understand". Sometimes this happens when you hire a woman.

      @@Zenigundam I'd “buy” the argument of the etymology of the word if the meanings of words stayed constant. Meanings of various words have an can change over time. Example: the word shambles. The original meaning was that of a meat market. The most common current meaning is a jumble or mess. Quite a change in 500 years or so. While meanings other words may not be so divergent, over time the fact remains that very often meanings of words do change in time. The etymology is still there but the meaning is not necessarily constant.

    Marie Pereira doesn't know what a sovereign citizen is apparently. Marie, he's playing word games with the "understanding" thing. That's his way of inanely saying that he doesn't acknowledge the court's jurisdiction over him. It has nothing to do with comprehension. He comprehends just fine.

      SovCits will argue about jurisdiction for hours..or state that they are planning to plead guilty BUT they need something explained a hundred times and then start with the jurisdiction again. They learn that script and its virtually impossible to get them off it.

      She is a respectful judge, because that is our system we give everyone their direct right to defend or be defended. But this man has shown that he has absolutely no remorse for his actions in killing six or seven people.

    They're missing the "sovereign citizen" aspect of this. I don't think that he actually thinks he's a sovereign citizen, but is instead planning to use that as a way to fight the case. If you ever hear someone say that they are sovereign citizen, things are about to get _buck wild_ and it's in your best interest to completely remove yourself from interaction with them. I say this from experience in a employment and human resources capacity and it was one of if not the worst situations I've ever had to deal with

      This is _so_ important. There's a difference between incompetent and recalcitrant. He's trying to be so difficult using the SovCit nonsense that she appoints counsel against his will, so he can claim she violated his right to self-representation. That puts the judge in a wonderful catch-22, where the argument if she _doesn't_ appoint counsel will be that he clearly doesn't understand the nature of the proceedings and required appointed counsel.
      A real SovCit would've have asked for her oath already, as well as contested jurisdiction (and probably commented on the flag).

He asked on Thursday, "is this a military court, admiralty court, what is this? Where is your proof of juridicial sth sth ...i forget the English word for it, basically her oath and if she is even allowed to practice as a judge. He is something else.
      But i get the impression that some people told him about that because he only knows the very basic things, like the name in capitol letters, that that's not him, the court question and her oath, but there is so much more to it, no? I remember hearing about that years ago, so i forgot most of it, but he doesn't come across as a guy who really believes in it and knows his stuff, it is just headline knowledge and he throws everything in the hope sth will stick.
      He is the most insufferable person i have ever seen i am pretty sure.

    I think he is competent - he can understand and communicate. He is going to cause problems regardless of whether he represents himself or had council. If he had been forced to keep council, then could he not have used “misrepresentation” as appeal grounds?

    He is doing this to create a spectacle. He is using the Sovereign Citizen “script”. When he says he “doesn’t understand” what he is inferring is that as a free man, he doesn’t stand under the law, the court or the state. When he says that he wants to represent himself “pro persona”, he thinks it means as the person. That’s why he doesn’t agree to the phrase pro se, event though they essentially mean the same thing.
    They should change the language from “ do you understand” to “ do you comprehend “ so that he can’t play word games with the court.
    Or better yet, revoke his right to defend himself and reassign his public defenders. Restrain him and muffle him so that the court can proceed to mete out justice to this man instead of allowing this person to continue to create a spectacle in the court room.

    If a defendant asks to defend themselves they may be capable. It does not mean they should. He will interrupt and disrupt this process every step of the way. It has NOTHING to do with his competency...he CHOOSES to be coy, argumentative and CHOOSES to live as a SovCit.

    I believe the RUclipsr Irish Demon pointed out, the term "I Understand" to Sov Cits means I stand under your Authority, no matter how many times we you try to sparse words with Sov Cits, they will always play semantics with words. He is using the Sov Cit in Court Play Book at this point and the purpose is to delay and work towards a mistrial. They love to misinterpret meanings and request fictitious documentation and paper to try and disqualify every judge that rules on their case.

    When his own mother warns us that we need to get ready to “see manic”, I think it’s pretty clear it was a fair warning. My court watching schedule is going to be packed what with this trial, the Nickolas Cruz sentencing trial,and the cluster-f that is going on with Chad Daybell and crazy Lori Vallow Daybell. Oh, and the Pike County Ohio Massacre trial. Seriously, I am not complaining because I have no desire to follow politics right now!

    The judge has exercised all due diligence and an abundance of caution. He was already evaluated by FOUR mental health experts. She informed him that the trial would not be delayed due to his firing his attorneys. She informed him he would not have access to standby counsel through the PD office. She informed him that self-representation was foolish, and he decided he knew better. I'm sure he read something on the internet about it that he thought made sense. He made his little bed, and now we can all enjoy watching him crawl into it, kicking and screaming.

    He's a sovereign citizen and to them "understand" means "I stand under" which means they agree to your authority -- which they never do. He does not accept her authority as judge, he won't acknowledge his own name because it's spelled in capital letters. No surprise at ll he demands a copy of her oath and then he's going to demand proof of her "bond" -- these people have endless weird distortions of the English language and legal theories that are just plain bananas. It doesn't make him incompetent in the legal sense it makes him incorrigible.
