HTML-код
- Опубликовано: 25 апр 2024
- The judge in Bryan Kohberger's case issued a key ruling this week about a survey of prospective jurors that was the subject of fierce debate during two recent hearings. The ruling from Judge John Judge came days after Kohberger provided additional information about his possible alibi. Kohberger maintains his innocence in the murders of four University of Idaho students in November 2022. Law&Crime's Angenette Levy talks with defense attorney Bill Gallagher and Idaho Statesman investigative reporter Kevin Fixler about the developments in this episode of Crime Fix - a daily show covering the biggest stories in crime.

So I guess they're going to go ahead and let all jurors and potential jurors read the probable cause affidavit and they're not going to dismiss jurors for reading or knowing the probable cause affidavit this is ridiculous public information is the exact information you want to keep away from potential jurors and shoving it right in front of their face is wrong and I think that the prosecution is 100% right here and the judge made a bad call. I don't care if it's a public you don't want it in potential jurors hands obviously that's the whole point

Your statements are over generalized and extreme. So I guess you’re part of the problem with this country. This is what the judicial system looks like. And this is why lawyers get paid a lot of money. This isn’t a circus, try going to law school to deepen your simple mind.

This judge seems to have no control of this case. Will they ever go to trial?
Even if it's not latah county he will be found guilty. I could prosecute this case and get an immediate guilty verdict. He clearly did it. Phone records. Onstar records where his vehicle was. He didn't think about that. He shut his phone off..but the gps in his car was still activated even if he wasn't paying for his subscription. That's how they tracked him. Dna on the knife sheath. His paranoia look when a traffic stops were performed. Wearing surgical gloves at 3 am putting stuff in other people's garbages. Closed case. Smh.
That’s what I thought too
I’m wondering about the same thing .
You think this case is bad?
Go look up the YSL Rico Case brought by Fani Willis

If the prosecution has a solid case to prove kohberger guilty it shouldn't bother them where the trial is held.
Of course it does. Witnesses; testimony, media coverage, and many laws all depend on the physical location
Wow, that is SO NOT how the prosecution of a case works! The location absolutely matters due to a plethora of reasons

A “mockery”?? “Toddlers”? Where are you getting that? This is very typical courtroom proceedings on points of law and tactics. The Defense is well within its rights to seek out a change of venue, and it is hardly a unique position to take. The Prosecution, of course, is trying to object with argument to keep it within Latah County.
I hardly see any “mockery” of our justice system, nor have I witnessed any behavior even close to that of a toddler’s tantrums.
What is happening is both sides putting forth vigorous defense and prosecution arguments to support their particular strategy. If that bothers you and causes you anxiety or stress, you should not watch it. But this IS watching our court system and the US Justice System in action.
@@elstongunn4277exactly!
Judge Judge, Please take back your courtroom..??
I am getting REALLY sick of this prosecutor...
this should be illegal to make the families wait this long for a chance at justice!!!
You can’t just hurry up and trial to give families peace. Their loved ones are not coming back. The accused is viewed as innocent until proven guilty. It stinks but that’s just the way it goes.
But it is illegal to not give a citizen their due process and ensure their rights are upheld. While we may not like it, especially with the evidence that makes him appear guilty, it is also to protect the victims and their families because they would be pretty upset if he wasn’t convicted or convicted then won an appeal due to a technicality and released.
They can’t rush a case like this, especially a high profile case. Even more so when it is an individual like Bryan who knows more than the average criminal about their rights, loopholes, technicalities, etc. I think he took a page out of Bundy’s book but also learned from his mistakes which is why Bryan is extremely quiet. If found guilty and convicted, I would not be surprised if he tried every appeal he could
I could not stress this harder , WELL SAID! Completely agree
No, that would be ridiculously risky. Most victims’ families want justice served properly not quickly. If justice is delivered in haste, there is a much greater risk of the killer being erroneously found not guilty or having the conviction be overturned on a technicality. Well done trials with convictions that stick, always take time. ⏳
If he is SO, "INNOCENT" , it should be that much easier and that much quicker to tell the "supposed truth" and be cleared! If your LYING it of course , will take longer. It's not rocket science. Get on with it already . These families and Moscow does not deserve this BS! @@pamelasmith6221

@@colleen0229dude common sense for a minute here. Tell me how could the sheeth that held a knife end up in a house he didn't know nor live in?
@@Denozo88touch DNA ends up in places we've never been before every day
@ThatGuy-tg7cv that still doesn't explain how the knife that was his ended up in.the bed of one of victims. Furthermore his alibi is do weak its laughable.
There have been media reports saying BK's phone could be located within approx 50 feet circumference, even if phone is turned off, Has this been confirmed? If So, the prosecution wont need land based cell phone tower pings/data
No, the metadata on his phone will prove where he was and it wasn't in Moscow
There will be a venue change! There needs to be a venue change! I mean people actually called the prosecutor about the survey🤦🏼♀️🙄 Now anyone reading this if someone calls you with the survey about a crime are you going to contact the prosecutor?!? Only a tight knit community with LPD would do that.
Imagine the Chagrin experienced by the Governor when he realises his money has been placed on the wrong horse
It is absolutely not his money
Bill isn’t very respectful to the judge in the courtroom
The Goncalves family is missing the part where the defence is claiming he didn't turn his phone off, but that there just isn't reception in that area. That's why it took BK a year to come up with an alibi or "I was on a hike at 4am alone" They had to find an area with no phone reception so he could make this BS excuse
The park closes at Dusk, it was cloudy that night. Facts so easy to find out.
Nancy mentioned that the Goncalves lied by showing a fake profile and saying that BK was stalking Maddie
@@nellym.6555 And that is relevant how?
Just to be clear, the total population of Latah County is about 40,000-that’s everyone from new born infants to the oldest of the elderly. Potential jurors have to at least 18 years old and be registered to vote in the county. These facts shrink the pool considerably. I live in Moscow and wouldn’t mind a change of venue even though it would raise costs a great deal. I don’t believe a change venue will meaningfully mitigate the problem of juror bias and will certainly not eliminate it. Some people will lie to get on the jury; some will lie to get out of jury duty. It’s going to be a tedious marathon of a trial. And think of this possible result-a hung jury. Those of us who are leaning toward the defendant’s guilt have only the solace of knowing BK will remain locked up in the event that the jury hangs. Regards from Moscow.
My sympathies for your community, for having to endure the possible sh*÷show!
That is literally the worst alibi ever hahaha
The most ridiculous alibi is that of Kaylee's ex-boyfriend, who according to him was sleeping and it is known that he was at the bar with Maddue and Kaylee, and he also never answered any of the 8 calls made by Kaylee and Maddie.

@@nellym.6555 what a crazy alibi, a drunk 20 year old, left the bar, got home, passed out and didn’t wake up for phone calls. If he was so much of a threat, he wouldn’t be getting called. It’s hilarious if you think it wasn’t Kohberger
Are we supposed to do an OJ and pretend this guy didn’t do it? 🙄
How do these defense attorneys convince themselves?
Those survey questions were loaded and inappropriate.
And you're the expert with the PhD?

Oof!! Mean!
Why should Latah County pay for a trial if it's moved to Boise or elsewhere?
Ann Taylor is pathetic and incompetent imo.😅😅😅😅😅
AT Is too emotionally involved in this case. She believes he is 100% Innocent. BK is running the trial. He is enjoying his position in this whole ordeal way too much.
Courtroom Video and audio need a massive upgrade. Gives a clown image to a truly tragic case. Even Judge Judge is frankly distracting, call him "his honour John Judge"...seems a circus.
“Not today judge!”
I know for a fact that judges are bought all the time! Makes me wonder about this judge.
This judge drinks alot, it appears, he is bewildered and confused
he could have given his phone to an accomplice and switched cars with that person. but still: he didn’t stalk the victims but yet he chose to go into a house with 6 cars parked in front of the house without observing it before and just went in straight and knew where to go and killed 4 people in 9 minutes without getting seriously hurt by himself. and there is still an 8 hours gap where anyone could have gone into the house and these 2 roommates are sus af. if they were men they would have been arrested immediately.
Thank you. Well said. I just can't see one single man do all that. Reasonable doubt. If all the DNA they have is "touch" DNA? Give me a break.
He knew the house interior and layout. He stated himself he had been there in the past..joined parties there.

@@scottbeck7762Too right Scott. What does Gray Hughes call these people “whack jobs or whackos”. It seems its only people with more than 3 brain cells that think it’s possible/probable he committed these crimes.
Innuendos, false narratives and conspiracy theories are not evidence. Along with the idea that multiple police departments, the FBI, and prosecuting agencies, have all been taken in by, and joined into, a vast conspiracy. Of which should all be seen for what they are - completely contrary to the current charges and evidence.
Further, they are a baseless and deliberate attempt to reassign the possible guilt of a currently charged and accused person (a potential mass murderer committing heinous crimes).
And in the very least warranting a trial and a decision of a jury whereby legal and competent admissible evidence (under the rules of evidence) will be produced.
Rather than what some others (including CT’s) are baselessly and wilfully ignorantly, speculating it won’t be and with such certainly it’s ludicrous and absurd (including where the currently charged person has even refused to plead “not guilty”).
Furthermore, it is the job of the defence team to defend (in any/all areas) the currently charged person and not members of the public.
The conversation ends there to any reasonable minded person.

It will be interesting to find out if the knife sheath was ripped and torn from the belt. Kaylee watched True Crime an article said. She or Madison may be the one who solves this case. Wonder if the light in the room was on? She could have seen the sheath on the killer and ripped it off the belt.
Who cares, his phone didn't stab those kids. Wasn't the phones DNA left on a knife sheath at the crime scene.
No there was touch dna. If i give you a hand you shake someone else hand and that person opens a door all 3 our dna will be on that doorknob. (Unlike direct dna like blood sweat etc)

Move the trial!!!
LET'S GET ON WITH THE TRIAL
Not till prosecution hands over ALL discovery bruh...not till then
Why not just let loose this “innocent” monster and save the taxpayers money ! After all, we don’t need to watch a trial that’s so fraught of incompetence and a rigmarole justice system 😤
All that money and they have the wrong guy, jmo.
I agree. Would not surprise me in the least if the cops framed him.
Of course there’s always the possibility that we have the right guy?
If I was innocent, I would take a polygraph
I wouldn’t. There’s a reason why polygraph tests are not admissible in court. They’re completely subjective and unreliable. It’s just another tool that law enforcement uses to badger suspects. Oftentimes the test will show no deception but they’ll tell someone they are interrogating that it said they lied in order to try and force a confession out of them. It’s responsible for many false confessions. The only word I’ll ever say if I’m being questioned is lawyer… That’s it.
😂😂😂😂😂
This isn’t a tv show.
I agree. I’m thinking Chris Watts…..
Polygraphs are inadmissible in court, kiddo. Stop watching TV shows and read a book.
Everyone has the right to defend themselves in the court of law.
This the dude from challengers? 😂
I man slaughtered 4 young adults and the roomates slept thru it?
I knew from the start when they tore that how down over the feels they were destroying exculpatory evidence.
But they didn't. We know at least one heard crying and other noises and saw the killer. We just don't know what happened between the sighting of the killer and the 911 call. The police have more info and a more complete picture of what happened but that has not been disclosed yet and probably won't come out until the trial.
@@vholland6785 Roommates never called 911. Guests called, using their phones. No roommate is on a 911 tape and will not be on a 911 call at trial.
This guy def did it..
Where is your proof? 😂 Because he was arrested? Example. If someone told you that the guy down the street is the person who knocked you mailbox over. You’d just want him charged? If they said they saw him with a dented fender that would be all you’d need to convict the guy of knocking it down? I wouldn’t think so.
Didn't gps place him at the scene of the crime?
Probably cast data. And several cameras on the street
Nope
Also we really don't know much due to the gag order. There's alot of evidence we dont know about. We just have to wait
No
GPS shows him in Washington
