Idaho Student Murders: 5 Reasons Prosecutors Seek Death Penalty for Bryan Kohberger

  • Prosecutors announced they will seek the death penalty for Bryan Kohberger if he’s convicted of murdering four University of Idaho students. The state alleges Kohberger brutally stabbed the four college students to death in their off-campus home in November 2022 and left behind a knife sheath containing his DNA. The Law&Crime Network’s Jesse Weber breaks down five reasons why prosecutors are seeking the death penalty for the accused killer with Professor Jules Epstein, the director of advocacy programs at Temple University Beasley School of Law.

      Fwiw, I'm so old I recall when Politano didn't shriek or do virtual Kabuki when on air.
      Jesse does a great job and Jules Epstein is a brilliant scholar. I wish crime TV/podcasts etc would raise the bar, as well.

      If Kaylee suffered more than the others - as her father told - then the others were casual and not extra viol and won't make it through the jury. Because they were - according to Mr. Goncalves - less viol than that of his daughter.

      He went into MMS room, BK was focused on her. I think KG heard noise from Her bedroom where Murphy was, and interrupted his plan, she fought with him, and got stabbed in her chest and abdominal area. Then, he goes downstairs to ZKs room, she was another intended victim.
      He could have left the house after murdering two upstairs, but he went the opposite direction of the slider, to Z’s room before leaving.

      Death penalty goes against God's law.
      Families decide if the death penalty is pursued.
      They go with majority .
      I know because 4 serial killers attacked me around 1965, and killed two other children. Those families wanted the death sentence, my family didnt.
      The only man caught turned out to have been abducted at age 8 years earlier. He was put to death in Maryland by the electric chair . His death prevented law enforcement from catching the other 3 murderers.

      Yes to Epstein's brilliance. I'm against capital punishment tho, which probably puts me in a minority here.
      It's certainly not a deterrent: look at Texas and Florida. I just have strong feelings about it based on moral principles. (I'm not implying those who disagree are morality-free. It's about as personal as it gets as far as opinions go, I guess.)

    Informative. Hope that whatever happens, justice is served. The one thing that I can't stop thinking about is, there were 6 people in that house and four of them are dead. Those murders were motivated by hatred. THAT kind of hatred is impossible to extinguish.

    What more would you have to do in order to qualify for the death penalty than what alleged killer Kohberger did? Some crimes are so horrific in nature that death is honestly the only genuine form of justice.

      @@backagain5216 even if he's guilty, they for sure have to explain the lack of DNA evidence in his car, apartments and offices. They also need to explain the lack of evidence of cleaning found, because they had no explanation for the lack of DNA.

    This Professor is FANTASTIC!!! As someone who is clinically terribly ADD I’m stunned at how mesmerized I was listening to him. This man is a truly gifted educator. I desperately wanted to go to law school but had serious doubts that I had the chops for it and all I keep thinking is how different things might have been had I been taught by this man. It’s definitely a gift to be able to teach and being raised by a lawyer/judge who was extremely intelligent but was very open about not having the patience for people that weren’t as “sharp” and couldn’t understand when someone couldn’t understand. I hope that all of the students that had the good fortune to be taught by this man know how blessed they were to have this man educate them because I truly believe things may have been different for me had I been blessed with him as a leader and educator.

    Wrong. If he's guilty, he IS evil, and should be dealt with accordingly. This ideology that, "evil doesn't exist" is exactly what's pushed these soft on crime policies that have dramatically increased crime and more victimization. People who don't think evil exists have never seen it firsthand.

Taking into consideration all that I have heard, he was a tortured soul even as a teenager and probably could never find, for whatever reason, the help he needed.     Anyone killing or sexually assulating a child should automatically receive the DP.

      They weren't kids, they were adults. But, when you have 4 stabbings in this manner the DP should definitely be pursued. However, the evidentiary bar needs to be very high. There's zero victim DNA found in Kohberger's car, apartment, or office. And the Prosecution's motion says that there's no explanation for the lack of victim DNA in his car, apartment, or office. This is legal language for there being no detection that anything was cleaned. If for instance, he had used bleach to clean out the car, the motion would have said that. It would have said that there was a lack of victim DNA and bleach was detected. In other words, there's zero victim forensic evidence linking him to these murders. The only forensic evidence they have is touch DNA, which travels and is easily transferable, on a sheath and one latent shoe print. There's no evidence here to support a conviction let alone the DP...

    The death penalty is for those who commit heinous crimes along the lines of what Bryan is accused of committing. If he's proven guilty, the jury convicting him with a death penalty, then he will have a long wait to be executed. There's around 8 people on death row in Idaho, average time they've spent waiting for execution is around 27 years. Last execution was in 2012.

      @chocol8milk Totally agree. In addition to convicts waiting years on death row, many executions are called off due to the shortage of lethal drugs and undersupply of other execution methods.

      I'm from Calgary, remember that student that stabbed to death 5 fellow friends at a Halloween party???, that Degrude kid, his father was a retired police chief, he got 5 years in a psych hospital, hes out now...???, CORRUPTION??? Calgary is BAD for crooked cops, crooked courts

    This country has weird sentencing laws: there’s a case in Pennsylvania. (Herbert Baker: if you wanna look it up) Baker killed someone and got the death penalty. He was released on parole in 2005. His co-defendants who were sentenced to life are still in prison. 40 years and counting.

      Baker's conviction was thrown out based on faulty jury instructions and a deficient defense lawyer.

      If he doesn’t get the death penalty he’ll get life sentence and he probably won’t last long alive in jail Idaho is one of the worst and don’t take kindly to murders of young innocent (college) adults. Probably why this is taking so long Bryan wants this to take as long as possible because once he sentenced without solitary confinement he’s a dead man. He’s already a dead man walking with the hits already put on his head he’s just lucky he’s being protected while court goes

    What an amazing interview here by both of these men. There is so much evidence it should be easy to get a conviction. My personal opinion is as it gets closer to the trial the defense will have no choice but to ask for life in prison without a chance of parole in exchange for a guilty plea. I do not know if this should be accepted or not and I do not want to make a judgement on the death penalty. Both Pullman and Moscow are two of the most peaceful cities in the world and to have this happen saddens me. May he get the punishment he deserves in order to be held accountable for these horrific crimes. Thanks for such reasonable and rational explanations. I am always learning.
