That guy could(and probably should) go to jail for that. In pretty much every state you are only allowed to use the threat of lethal force, or actual lethal force, if you or your loved ones are being threatened with bodily harm. You can’t shoot at people for theft, or in this case standing there obviously fishing. Those things are not considered threatening enough to use lethal force. He’s an irresponsible gun owner, and at the very least needs to be confronted before he actually kills someone.
Not in castle states. There is no duty to retreat. There was an incident with a guy who shot a trick or treater and didn't get any criminal charges or anything because he was within his rights and there were multiple no trespassing signs up. So if this was in a castle doctrine state and he actually hit him it wouldn't matter. He was on his property which in castle states encompasses all of your domain. It's fucked when people abuse it like these cases. But it beats having to literally wait for someone to break and enter into your house, retreat, and only then protect yourself. That guy was let off, but because of instances like that one the laws in most states were changed because it was recognized that someone’s presence on posted property isn’t enough justification to use deadly force against them. Sometimes people have legitimate business with you or your property, and posted trespass signs don’t apply in those instances. I know about this because I live in a castle state. The castle boundary is normally only extended to include the front and back porch with a thin perimeter around the home. If that. A lot of castle states still only consider the “castle” to begin at the door way. And even then you are supposed to use “reasonable” force. That can include deadly force, but there have been plenty of instances where home owners have gotten in trouble for using excessive force over what the situation called for. Also, posting trespass signs doesn’t give you license to shoot people. That’s a common misconception. What it means is if you catch someone on your property that you have posted those signs on then you can have them arrested for criminal trespass because they were already warned by the signs. I've always struggled to understand how mad people get about people fishing. Certain instances are obvious small stocked ponds, ponds close to a a house/shop/building etc. I have a creek/canal on my property that runs into a large 8k acre lake. Lake is less than 100yds away & people fish my creek from time to time & the ONLY time it bothers me is when they are making a mess, being loud or just disrespecting my property & i have a hard time with people that get so pissed off at fisherman when a simple no trespassing sign would peacefully alleviate %95 of the problem. I usually come out& ask them if they're biting & what they're using for bait & then wish them luck & leave it alone.

Trespassing is not a capital offense. If a reasonable person was to perceive that someone was trying to kill them, they can protect themselves by using deadly force.

My every day carry is the FN Five Seven. 21 rounds in the gun, 40 on my side. The Five Seven drops 3” at 100 yards. Gary would have found out what accurate return fire does. He committed assault with a deadly weapon which justifies use of deadly force in defense. He’s have been perforated.
Some years back ,I was fishing with my Dad and we were fishing different areas along the River that I grew up fishing in. I had a few months earlier gotten out of the US Air Force and I wanted to do a little fishing with my Dad seeing how it had been quite some time since the last time I fished and really wanted to get back into fishing. We hadn't had much luck at the spot I called " the Swimming Hole " so moved upstream about 200 yards and were going to try a promising looking area where the water ran past a huge boulder and was quite deep. We no sooner got our lines in the water when ... Kra- POW ! Somebody was shooting just across the River from us . Judging from the "sharpness " of the shot and how it echoed , I presumed it to be some kind of rifle ( 308 or a similar caliber ) I tried to see if I could see anyone but couldn't . Another shot rang out and We were thinking about leaving . I told my Dad to start going ahead of me as I was still trying to see who was shooting ,but still couldn't see anyone . I was turning to follow my Dad who was a few steps ahead when another shot rang out and I saw clods of dirt and plant fragments explode no more than three feet to the left of my Dad. I took a couple of quick steps and made certain to be between my Dad ( I wanted to at least block any rounds from hitting my Dad if at all possible or at least slow the bullet down if I got hit then maybe my Dad stood more of a chance from the HOPEFULLY greatly decelerated bullet) and whoever the ASS HOLE was that was shooting towards Our position. Once We both were up the steep bank and into the woods , we were much more relieved and safely behind large densely growing trees and moreover, a small hill that ran alongside the trail added effective cover. It was a very long time before I went to that spot again and even longer before both my Dad and myself went fishing there. Looking back on this, it may have been some STUPID FUCK-HEAD that was drunk or "trying to scare us". Whetever the motive or the condition of that shooter was, there is nor DAMNED reason or cause to be shooting so recklessly ! Frickin' scary SHIT getting fired upon , I tell Y'all WHAT !

I take it by "snap" you meant that I didn't hear the shock wave from the bullet(s) flying in close proximity to my Dad and myself ? This reminds me of a time I went to deer hunt on a fellow workers land in rural Virginia and this guy comes up to us after we parked and were getting ready to hike in to the stands.He pulled out a pistol and aimed it at us.I leveled my loaded shotgun at him as did the other 2 guys and we gave him a choice.Lower your gun or die.He retreated and the cops showed up shortly.The guy claimed we were on his land.We had written permission and called the owner who showed up a few minutes later and proved he did own the land.Law asked us if we wanted to press charges but we didn't as nobody was shot.A few years later at work the owner/fellow worker told me the guy turned out to be one of the best neighbors he had.Seems the guy was fighting druggies and thieves so he should have looked us over before jumping to conclusions.Ed,the owner talked him into carrying a shotgun if he had to confront anyone because that pistol wasn't scaring anyone better armed.lol

I've always struggled to understand how mad people get about people fishing. Certain instances are obvious small stocked ponds, ponds close to a a house/shop/building etc. I have a creek/canal on my property that runs into a large 8k acre lake. Lake is less than 100yds away & people fish my creek from time to time & the ONLY time it bothers me is when they are making a mess, being loud or just disrespecting my property & i have a hard time with people that get so pissed off at fisherman when a simple no trespassing sign would peacefully alleviate %95 of the problem. I usually come out& ask them if they're biting & what they're using for bait & then wish them luck & leave it alone.

Some years back ,I was fishing with my Dad and we were fishing different areas along the River that I grew up fishing in. I had a few months earlier gotten out of the US Air Force and I wanted to do a little fishing with my Dad seeing how it had been quite some time since the last time I fished and really wanted to get back into fishing. We hadn't had much luck at the spot I called " the Swimming Hole " so moved upstream about 200 yards and were going to try a promising looking area where the water ran past a huge boulder and was quite deep. We no sooner got our lines in the water when ... Kra- POW ! Somebody was shooting just across the River from us . Judging from the "sharpness " of the shot and how it echoed , I presumed it to be some kind of rifle ( 308 or a similar caliber ) I tried to see if I could see anyone but couldn't . Another shot rang out and We were thinking about leaving . I told my Dad to start going ahead of me as I was still trying to see who was shooting ,but still couldn't see anyone . I was turning to follow my Dad who was a few steps ahead when another shot rang out and I saw clods of dirt and plant fragments explode no more than three feet to the left of my Dad. I took a couple of quick steps and made certain to be between my Dad ( I wanted to at least block any rounds from hitting my Dad if at all possible or at least slow the bullet down if I got hit then maybe my Dad stood more of a chance from the HOPEFULLY greatly decelerated bullet) and whoever the ASS HOLE was that was shooting towards Our position. Once We both were up the steep bank and into the woods , we were much more relieved and safely behind large densely growing trees and moreover, a small hill that ran alongside the trail added effective cover. It was a very long time before I went to that spot again and even longer before both my Dad and myself went fishing there. Looking back on this, it may have been some STUPID FUCK-HEAD that was drunk or "trying to scare us". Whetever the motive or the condition of that shooter was, there is nor DAMNED reason or cause to be shooting so recklessly ! Frickin' scary SHIT getting fired upon , I tell Y'all WHAT !

We were near a fairly loud river as some rapids were only twenty or so feet upstream from where we were fishing so, I am not sure that "a snap" could've been heard, quite honestly.
This reminds me of a time I went to deer hunt on a fellow workers land in rural Virginia and this guy comes up to us after we parked and were getting ready to hike in to the stands.He pulled out a pistol and aimed it at us.I leveled my loaded shotgun at him as did the other 2 guys and we gave him a choice.Lower your gun or die.He retreated and the cops showed up shortly.The guy claimed we were on his land.We had written permission and called the owner who showed up a few minutes later and proved he did own the land.Law asked us if we wanted to press charges but we didn't as nobody was shot.A few years later at work the owner/fellow worker told me the guy turned out to be one of the best neighbors he had.Seems the guy was fighting druggies and thieves so he should have looked us over before jumping to conclusions.Ed,the owner talked him into carrying a shotgun if he had to confront anyone because that pistol wasn't scaring anyone better armed.lol
