    We received another disturbing warning from the HOA, they are stating that if we don't replace or remove our dead bushes, we are going to be fine $1,000 per bush. I decided to take matters into my own hands and have my wife pickup some supplied at the hardware store and I can't wait to hear the HOA's response once we paint these bushes.

      The HOA is fake. It’s a Karen in your neighborhood that is used to being the president of the HOA and thinks she is still one. Contact the city and ask about HOAs in your neighborhood. Then contact the mortgage company and tell them what’s going on and then the last thing is to contact your lawyer and give him all your information and then have them send a letter to C&D order and then also issue a harassment report

    If the HOA isn’t listed in your deed, you don’t live in an HOA. You would have received a copy of the rules and had to have received and signed paperwork when you purchased the property. You need to hire a lawyer to end the harassment. Tell them to pound sand.

      Yes. This. Apparently this has become a thing where HOAs try to bully people who aren't actually a part of the HOA. When you buy a house, apartment, condo, etc that is part of an HOA you will have to sign paperwork and be given a copy of the rules and regulations. If you weren't then you are not part of the HOA. An easy test is to force them to produce paperwork proving you are a member. They obviously won't be able to if you aren't part of the HOA.

    My dad always said, "never clean the creek banks".
    He said the vegetation helps control flooding, it gives shade to the fish ,salamanders, crayfish and anything else living in the water. Vegetation also provides habitat for birds, rabbits, and other wild animals.
    As a kid playing on a creek bank was hours and hours of pure fun. I'm 67 now and still smile at the memories.

      You can also check to see if there are any endangered species in the area that come to that creek. If so, then clean the sides of the creek could put them in jeopardy

    As others have said, if there was nothing in your mortgage paperwork, you are not in an HOA and you don't need to worry about anything this person says to you. If it keeps up, sue them for harrassment.

      Agree, county will have record concerning HOA on your property. They should also have a copy of the bylaws that stated how property is to be maintained. If you can confirm no HOA, it’s lawsuit time!!! I hate HOA’s

      It's not necessarily in the mortgage paperwork itself, but there should have been a HOA declaration in the closing, or HOA paperwork signed within XX amount of days after the closing (the amount of days depends on what town/county/state your in), and the deed will reflect if the property is in an HOA or not.

    It’s actually pretty easy to fix this one! They sent you an email stating they were going to harass you with petty fines until you move out due to the unwanted attention your channel brings! That statement alone is enough to take them to court and win, basically they’ve screwed themselves!

    I just came across this video. The thing that caught my eye first was the first note that stated they would keep harassing you until you moved due to your presence on YT. That is an admission that this is all for harassment purposes. Have your attorney send a Cease and Desist letter to the sender, then file harassment charges if it continues!

      These emails are not from an HOA. Most HOA's have to send a written warning letter and it has to be signed. Find the nearest person who fits the description of a Karen and that will be the one. It could be a man but normally it's a stay-at-home mom. There have been a few studies that show most complaints made in HOA neighborhoods are made by women that have nothing else to do. This all changes if the HOA is in a Florida retirement neighborhood. Then it's the old men whose wives are sick of them sitting around the house all day watching the Game Show Network.

      @@Jonathan.D As far as I know you are correct. When I ran an HOA we had to do everything through the USPS any notifications or packets or letters all were mailed out. My current HOA does nothing through email all regular mail.

    Sounds like you have a neighbor who's harassing you. If those letters were from an HOA they would be written on the HOA's letterhead, containing a return address and these letters would be signed.

      Not necessarily. I've had more than one idiot think they could use private resources for public business. Think of all the foolish cops and other agents who use their private cell phones to conduct public business. In WAshington, that moves them into the public realm and, at the least, to where a court can do what's called an in camera review of the phone contents.

    HOA= you intentionally signed all the rights to your property away. If you're a busy body neighbor and can't keep you nose in your own business an HOA is for you. If you could care less what your neighbors do, never buy an HOA property.

    Sorry am late to the party. Don't forget, friend, if it's not stated in the hoa bylaws, YOU CAN DIVORCE YOUR HOA!!! If nothing about a hoa is in your mortage paperwork, ignore them! Also you can sue them for harassment. If I were you, I'd sit down with a real estate lawyer and have a nice long chat with them! Hoping you're all over covid & doing great.     You, as a homeowner in a HOA, have the right to review financial records of the HOA. Ask them for the records and tell them they are going to be reviewed. Make them scared.

    When I was looking to buy a house, I found 5 or 6 places that were "perfect" for what I was looking for, but they were in an HOA, so it was a no go. Ended up paying $20k more for a smaller house with less of the stuff I wanted, but at least it wasn't in an HOA, and I don't regret that decision for a second.

      @@philipcatuogno2968 For those type of things, you have a town / city council. We do not have HOA's in the uk , as far as i know , but every town , or village has a council. they are nowhere near aggressive as these hoas , because even a council has to follow the law.

    All items placed in a US postal box must actually be processed by the US Postal Service. If these notices were put in your mailbox and there is no canceled postage stamp or metered stamp this is a Federal Offense. File a complaint with your Post Master General. Follow the process and let us know what happens.

      First of all, are you even a member of an HOA, and how did that happen? You didn’t mention wether you were or weren’t. These violation letters are not signed. Obviously these COWARDS don’t want you to know who they are, because they don’t want you to retaliate. It’s time you found out the letter writers are. If they are just dropping them in your mail box, it’s time for a surveillance camera. What they are doing amounts to harassment and should be treated as such.

    They sent a email stating they have the intentions of making your life difficult until it is financially beneficial for you to move. Anything they do after that is harassment and illegal. Get an attorney and let them handle it.

    Okay, there are a couple of things: First, from what you said, you are not in an HOA. This is someone who is being vindictive; to the point of harassing you. Look up your state's harassment/stalking laws. Here in NC this would certainly qualify, and it's a crime. If so, file a police report, then contact an attorney. They can trace the IP and find out who this is. Once that has been determined, press charges for the harassment and file a civil suit on top of it.

    If you lived in a legitimate HOA, you would have been given a copy of the CC&R’s when you purchased the property.
    Also, if a person gets a “nasty gram” from the HOA, it’s lists the specific rule that’s being violated.
    This seems like letters from disgruntled neighbors.
    As someone who calls out my HOA on their bs, I strongly feel someone is just harassing you and your family and you should contact an attorney ASAP to end this.
    Sorry you’re dealing with this but at least it’s not legally binding and you can’t be fined because I don’t believe you live in a legitimate HOA .

      You have 2 clear options.
      #1 Get a very good attorney go fire back at them so hard they will be too busy to mess with you.
      #2 use the money you would have spent for an attorney to bribe or become the president of the HOA. This is the easiest option if you can swallow ur pride and realize it’s a small price to pay.

    I’ve owned 3 homes in my lifetime. Not once did I purchase a home subject to an HOA for just these reasons. One home was on the edge of an HOA and I received several letters regarding complaints about landscaping. I just threw them away because I had already done my research after the first letter and knew they had no authority over my property. There was much crying and gnashing of teeth by the HOA but their hands were tied. I would never buy property within an HOA or Compact.

    I'd retain an attorney before I'd send a dime to those crooks. Sounds like a scam to me. If no info is stated in your contracts, property deed/zoning desvription... it could be a group of idiots that moved into the area and decided to create that crap on their own, without any legitimate legality. In that case, YOU would have a lawsuit that could send THEM packing up and moving out.

      Should be part of his closing. If there's an HOA, the closing attorney should have uncovered it during the title search. If it's not disclosed, there's a good chance there isn't one that's registered with the city.

      This is ONE neighbour masquerading as a HOA for reasons of their own. Law enforcement CAN subpoena the details of the email address the threatening, harassing emails were sent from from the relevant internet service provider. That's how you'll find that neighbour.
      Whether or not these emails are related to the trespassing going on in the wooded parts of the property is another question - they may be or they equally may not be. And the only way to sort that out is to find out who sent the emails.
      As far as that trespassing is concerned is their a "right of way" or an easement of any kind on that property. It's possible there may well be and the estate agent who sold the property either wasn't aware (yes - a possibility) or was aware but didn't disclose same. If such an easement does exist - there's not much that can be done. If not - & the HOA threats & trespassing are NOT linked - again, I don't know that much can be done sans fencing (which keeps out the wildlife).
      I have 436 sq m in suburbia and no front fence. And I've had people on my property in the dead of night. I live in a dead end court

    My mother is a US postal worker and delivers mail in a neighborhood where the HOA nitpicks on everything. She says she literally delivers certified letters from the HOA on a daily basis.
    I think there should be a petition to end all HOA's in the United States... Some of these HOA people have nothing better to do in their lives but to make yours harder.

      Our HOA is appx 1,000 single family homes, broken up into sub-HOA's of apx. 200 properties each. YES, we have 2 sets of HOA rules, and dues to pay. We bought into this arrangement, most try to follow the agreed to rules, always some who want to contest the rules. I've been on our Board of Directors for 15 years now serving in each BOD officer position.

    Sorry this happened to me. I grew up in a small farm in Missouri. My husband grew up on Long Island NY. We are now located in Tennessee. When we started searching for land to build we purposely determined no less than five acres. We found 12 acres, built clear to the back and NO ONE can see our house. Of course we have no trespassing signs everywhere. Tennessee has a Castle Law. We will defend and we are both veterans. Thankfully all our neighbors have acreages and we all feel the same. We don’t have an HOA and never will.

    I read these about these HOA terrorizers and realize how lucky of a SOB I am. I live on a lightly traveled country road with a large farm field across the street from me that grows winter wheat, then alfalfa, then a crop of corn. Behind me is a field for a few grazing cows. On one side of me is a family of farmers and their 7 kids. They could not be nicer. On the other side is a young couple but they are around 300 feet away. Again, never an issue. No HOA. No nasty neighbors. Just the sounds of chickens. OH! They are my chickens and I free-range them. The neighbors have chickens also. Plus cows, goats, pigs and chickens, and one Collie. I plan to be carried out of this house in a body bag. I mean, I'm staying here until the end.

    When I lived in Texas,I bought "depressed" properties,fixed them up while living in them,then sold them. I acquired a house in a "fair" neighborhood,meaning to do the same with it. After starting to do repairs,I was hit with all kinds of demands,such as mowing the yard every week,needed or not [sometimes it didn't rain for months]. I planted Bluebonnets,the State flower[illegal to cut] interspersed with the Bermuda grass and let it grow. The HOA threatened to cut the yard and charge me for it. I sent them a copy of State law. I found out that there was no HOA,legally,so I incorporated a legal HOA with several other victims and wrote our own "laws.

    From what I took from this video, there was no agreement to an HOA when you bought the property. And if one formed afterwards and you didn’t sign a binding contract/agreement to be a part of the HOA, their claims to fines can be considered as fraud and harassment. And around the 3:07 mark, you said there is no mention of an HOA. So, unless I am missing something, you are not part of one and you can legally take them to court for trying to defraud you

      grathdragon In October 2020 New Jersey made a law that basically says, ok we cannot make you JOIN an HOA if none existed before. However an HOA by state law CAN NOW make you pay maintenance fees, just the same as an HOA member would.

      HOA’s are tied to developments by the developer: condos, subdivisions. Someone(s) just unhappy you crossed them. Besides the whole personal safety issue and harassment, beware the Sovereign Citizen tatics of paperwork terrorism filing liens on your property too. Better to get legal advise than potentially creating your own problems trying to fight this solo and having it backfire.

      I opted out of the POA in my subdivision.
      It wasn't mandatory to join.
      Some new residents moved in and attempted to enforce old deed restrictions that hadn't been enforced in years.
      It went to court and the Judge sided with us.

    No one moves into a HOA neighborhood not knowing that it's a HOA. One of the first things that occurs when you purchase a house in a HOA community is they give you a copy of the HOA by-laws, which you can also request in advance. If you can't abide by some of the basic rules and regulations, look elsewhere for a home. I have been on a HOA board and have served as its president. The board members can be as obnoxious as some of the community members. My recommendation? Avoid HOAs altogether. The concept is good. The execution is often bad.

      As a letter carrier I can tell you that no one should touch your mail box but you and your letter carrier. If they put something in your mail box without a stamp turn it into your carrier to send them a bill. Also call the Postal Inspector and turn this in to them to handle. It's a Federal Offense with $10,000 in fine and two years in prison. Try to use one of type trail cams on your mail box to get the proof you need.

    I lived in a house that was in what was considered an HOA one problem was that the HOA was form to maintain a community spring for water . My property was not in the HOA because my home had its own spring but all the houses around mine were they couldn't say anything. Sounds like you can be in a similar situation if you were part of the HOA you should have be advised upon purchasing the property and you should have received a printed copy of the rules and regulations.

    My experience with an HOA: I had a nice, clean 1958 Willy's Cj5 when I was livin outside of Anchorage, Alaska...we had an HOA, I didn't really learn what that meant until the day I was checking my oil and coolant in my Jeep's V6 motor....I had lifted the hood, laid it back against the windshield, and then was called inside to take a phone call from my Dad, leaving the hood up...it was almost a 40min call, and I came back out, my hood was down and latched shut, with a lime green sticker stuck on my windshield right in front of the steering wheel...the adhesive that sticker left on the glass took half an hour to scrape off with a razor blade...according to the green sticker, it was against the rules to not only lift the hood of a vehicle without it being in the garage, but it was made worse cuz it was parked on the street, directly in front of my house...I was so pissed off that someone touched my Jeep I couldn't even speak, but after my exwife read the violation to me, not only did I lift the hood, I jacked up all four corners, removed every tire, and set the Jeep down on mismatched jackstands...and left it...overnight...when the Pres of the HOA banged on my front door at 7am the next day, which was a Saturday, I opened my storm door and grabbed him by his throat...now this was in 09, I had just returned stateside from my last deployment to Afghanistan, so I was in no mood for this nonsense and if there hadn't have been a cop there that I didn't initially see, I would've put a hurtin on that liberal piece of s*^+....instead the cop made me let go, it then turned into a big deal with that dude tryin to press charges and have me arrested on the spit, but the cop was an Iraq vet so that dude was outta luck on that....we sold that house and moved 90 days later....I was only 35yrs old then, I'm 47 now, but I don't care, I'd handle it the same way now as I did then....never again will I tolerate an HOA....never....

      Seriously, Anchorage is the nastiest place. Enough of a little slice of the 48 to keep real Alaskans from moving out, but it serves a nice place to store 48ers on their short visit (most 48ers bail out pretty quick, can't handle Alaska) to great Alaska

    My experience with buying and selling homes is that HOA documents MUST BE disclosed during the buying and selling process. The buyer must sign the HOA document stating that they will abide with the rules.

    When we bought our house I had only one thing that I demanded, whatever we buy can’t have an HOA. Also, check your deed, if the HOA isn’t listed then you don’t belong to the HOA and they can’t enforce 💩. I’ve seen where some older houses were surrounded by newer houses that did have an HOA but they refused to sign and join the HOA and there’s was nothing they could do.

    The continued notices from an HOA that your property isn’t in is a violation of the Federal Fair Debt Collection Practices Act. Alleging that you owe money falsely is a Federal crime. If whoever is sending you these notices has any assets, they are risking losing everything by violating Federal law.

      Not All HOA's have a monthly or quarterly or annual bill - you need to read the Associations Rules & Regulations and you need to go personally and chat with a member of the board. Find the name of the association and look it up online and then communicate with them asking for the website where you can learn what the rules are --- also --- while reading these documents, look for information about all the committees. Because it is the committee that either has or does NOT have the ability to issue a financial penalty.

      hoa's are needed in communities with common grounds.. like park, playground, building, and maintenance and insurance. the other stuff are just things to keep the neighborhood looking nice, and you agree to those rules when you buy, so no complaining after you sign.. without hoa's neighborhoods couldn't have any common ground amenities..

    There was a case recently in Florida, I believe where some older guy (92 I think) was being harassed by an HOA for petty stuff like that. He started buying community houses at action and the next time they sent him a notice he went to the hearing and made the announcement. I'm now majority share holder and your all fired.

      Another person in Florida was hit with HOA fines because she and her husband parked their police cruisers in their drive way. Not parked on the street or undesignated parking spot, they literally parked their police cruiser in their very own drive way.

    Step one: hire a real estate lawyer to formally research if your property falls into a HOA and if you ever signed an agreement to join the HOA.
    Step two: assuming you have no legal obligation to an HOA, plainly post no trespassing signs IAW state and local laws so there is no need to issue a trespass warning.
    Step three: set up a few game trail cameras and Ring/SimplySafe style cameras to document who is trespassing.
    Step four: next time the HOA issues you a citation, have the local LEO or sheriff issue a trespass citation (not warning). If nobody trespassed but they are issue if the HOA fines, write them a cease and desist letter sent signature delivery.
    Step five: get a lawyer and bankrupt them in court.

      @@brentfarvors192 The issue with that is even if the Realtor or Closing Attorney did not disclose the property being in an HOA, that does not absolve the property owner from adhering to the HOA Declaration of Covenants, Conditions, and Restrictions (CC&Rs) if the property is actually in an HOA.
      All that means is that the homeowners have a legal issue with the Realtor and/or the Closing Attorney.
      We had a neighbor in our old neighborhood that continued to claim that they never received them and refused to pay the dues which were relatively minor at $200 per year but they continued to let them accrue until they reached over $1800, mainly from monthly late fees. They eventually realized they were fighting a losing battle. The HOA waved about half of the late fees and allowed them to get on a payment plan but they still owed the money.

    My house sits on 30 acres which I bought in 2002. In 2008 a subdivision with an HOA was built behind my land. These jokers folded my property into their subdivision. I never signed an HOA agreement and I was there long before the subdivision was built.
    I was harrased and threatened and hauled their ass into civil court which ruled that my property was not part of the subdivision.
    They knew this but were hoping to seize my property to build a "clubhouse" on my 12 acre lake/pond that was promised by the HOA. This came out in court.
    Now the HOA is being sued for millions by the members.....😂

    I would go to the police. From my experience with HOA you pay monthly to them. If you never signed a contract with one or it wasn’t mentioned in the buying of the property this is illegal. File a report this Margaret is committing a felony.

    I would definitely report that HOA to the EPA.
    An EPA audit ussually results in a finding that mowing, fertilizing near a creek or wetland will be a violation of the Clean Water Act.
    Mowing next to a creek should never be an HOA requirement. The Eco system of a creek extends inland for many yards.

    My wife and I looked at 3 acres of land in the country. Nothing around but gas wells and trashy houses. Land was part of a 100 year trust, they had HOA type restrictions and covenants. None of which the trust families followed. I told the realtor to tell the trust to pound sand. Always read the deed/title before you buy.
