    Been through the exact same thing. Guy shot warning shots and said we were trespassing and he owned the arm of the lake we fished on. Ha... I called the police and the game warden. He lost the argument and got a ticket for threatening us. We did press charges and he eventually was hauled away in cuffs.

      @@halfknight2310 On that note, there's a disturbing amount of these sort of altercations against fishermen. If anyone wants to make the case against gun ownership it's interactions like these. Young men, going out fishing, decked out in geeky fishing gear, just talking about what a beautiful day it is and life in general and some land baron confronts them and pulling out a gun in less than a minute. I would understand if it was a sketchy looking person with no fishing gear and no reason to be walking around wooded areas but cmon. And the excuse is always the same, "Things have been going missing around here!" Oh yeah? Jerks.

    The Supreme Court ruled that navigable water ways existed before land owner ship. So the right the navigate water way is protected by the constitution. So you can own the property around the river but not the water its self

      @@sbeckstead In Texas you can be in the river in any manner or walk along the side of the river, and it wouldn't matter if the land owner's deed includes part of the river. I'm not sure if it is the same in Illinois though.

      @@sbeckstead Actually the laws allow for a certain encroachment accessible to the public next to all bodies of water that are considered public waterways. so they can be traveling along the banks NOT in the water and it's completely legal. Similar to how you only own the property up and to the power lines the easement in front of your house is owned by the states/cities which is the public.

    I know that creek and I took my 6 year old daughter out there. Never saw the sign but I'm glad that lunatic wasn't around to scare her to death over some harmless fishing.

    This happened to me. A guy threatened me and my brother while fishing with a shotgun. We called the cops and the game warden hauled him off. We pressed charges and testified at trial. He ended up with 4 yrs for felonious assault.

      The land owner stated there was a no trespassing sign. In some states you can own the land under the water. But in most states major rivers and lakes are owned by the Core if Engineers.

      No one owns the water, land rights vs land taxed. A persons land is valuable because the have 'access' to water, no one owns that water.
      Many idiots have been sued by the govt after they 'improve' a river and didn't get permission.

      @@willrogers1023 The laws apply to every state it is not state by state, what is state by state is what is determined navigable water and for fishing. Even if you do own the lander under the water you cannot prevent someone from traveling down it which includes walking.

    If the sign said trespassers will be shot on sight, a lawyer told me this day and age a sign like this can be used in court for premeditation to commit murder. The sign is legal to detour but it is not legal to actually shot someone unless in self defense.

      @Are You Serious “Navigable waters” is the standard, along w high water mark, because it’s treated as a road. Lakes & ponds it depends if they are connected to navigable waters. If not, they are often private, unless the state has interest.
      Within the last decade, per Agenda 21, states made claim to all water unless the people filed claim, thus the corporation (state) has claimed ownership of all water, including that which falls from the sky. Something that no corporate entity can actually own unless there is some group that can own the air, water & soil of the earth, which there is none, unless the people allow it.
      On top of that, there is the interpretations which rely on politicians & judiciary & govt servants acting like kings.

      the State and Federal laws tend to clash sometimes. But generally sounds like something that should be considered federal. I'm not a lawyer though. So just play it safe and don't trespass. You can find yourself in areas that are questionable when following watersheds and creeks. But in all, nobody owns the water besides for the state (or other states if they own water rights to the water in neighboring states).

    This reminded me off the time my dad and I met in Missouri, I wasn't living here at the time, and we went to bass pro and bought fly fishing stuff and spent the weekend fly fishing. I'll never forget that trip for the rest of my life. This video is really awesome and even though I don't know you personally, it's awesome that you get to spend time fishing with your dad.     I was on a public walking path when unbeknownst to me it turned to private property. I had already turned around and was (three feet from the property line). The owner came out hollering at me, chest bumped me, pushed me down, and kicked my dog.
    He was arrested.
    Private property does not give anyone the right to assault another.

      Wrong. In Illinois this is indeed trespassing. But you can't have property owners post signs threatening to shoot trespassers. That person is going to have that sign used against them in court one day should they ever do that.

    Had the same thing happened to us as canoeing down the river. People shot warning shots we answered with about 15-20 rounds in the air and the crap stopped. Rest of the three-day canoe trip was great.

    Here in Texas, as long as you are within the high water mark, you are on public property. People cannot own any section of a body of water that isn't completely enclosed within their property.

    I'm from Ohio and do a lot of creek and river wading fishing. The law in Ohio is if you're in any kind of "boat" you're not trespassing. but once you step out and touch the bottom that's trespassing.
    I've never had an issue wading a body of water with some ass hole. tell me I'm trespassing...lol

      In Ohio the water belongs to the state but the land underneath belongs to the property owner UNLESS it is a navigable waterway or if the land on either bank is owned by the state.

    In NM there are some well-known trout streams that run through private land. The landowners can't prevent you from wading up the stream, but if you're walking on the bank alongside the stream, then they can get you for trespassing. There are flyfishing books that spell out where to legally enter and exit the streams, and where you have to stay in the water.

      In Missouri you can go on a bout but if you touch the ground you're trespassing even walking in the river. I know right of way on the river is a myth. You stand up in the water you're trespassing. Maybe not all states. look it up

    It all depends on how you access the river. If you enter at a public location, like a bridge, you are legal. However, if you cross private property without permission, then you have trespassed.

    Indiana rivers that have been designated by statute as "navigable" are open to paddlers. “Navigable” rivers and their river beds are held in trust by the State of Indiana and can be used by the public.
    On streams that don’t have a navigable designation, the bed remains in private ownership, but the public may use the surface of the stream for paddling.
    The traditional law of navigability in Indiana says that a river is navigable if it could have been employed for commercial boat traffic when Indiana became a state in 1816.
    Keep in mind that the banks of all rivers in Indiana should be considered private property. Only a very small part of the riverbanks in Indiana are in public ownership. Please do not trespass on private property. Riverbanks are designated by the ordinary high watermark (defined by 312 IAC 1-1-26(1)).
    When on the river, the Ordinary High Watermark (OHM) is generally easy to see and should be used as the boundary between private land and the streambed on navigable rivers.

    Fished this canyon area hundreds of times in Northern Illinois! Great for trout & smallies! A portion of the stream is owned by the DNR as they stock it in the spring! There are portions privately owned marked with signs! Not sure who the Karen might be!

    Come to Finland! Here you can fish anywhere you like if you just pay the permit what is collected to take care of the environment, lakes and the fish. You can collect berries and mushrooms where ever you like if you dont walk closer than 150 meters from housing. The land owners here dont really own the land or the lakes or the rivers its for everybody to enjoy. Landowners got the right to cut wood from the forest but they must plant samplings after they cut full grown trees on their forest. We keep our nature healthy and people too. No man should own the nature. We also dont shoot people or call police while they are fishing or enjoying their day.

      I was just in North GA and was told they own the river bottom so no you're not legal. Many signs were marking property with threats of arrest if crossing those lines while in the river. In TX and MT you can walk a river if accessed via public land but stay in the river.

      Not all water ways are considered such, and may be considered private property.
      If you have to portage a canoe or kayak in normal conditions, even a short distance, it may not be public.

    In Ohio : The waters of Ohio’s public waterways (streams and rivers) belong to the state of Ohio, however, the land beneath the water belongs to the landowner(s) on either side of the stream, whether owned publicly or privately.
    A stream is considered navigable if it is open for navigation to the end and considered navigable even if some obstacles or natural debris is present.
    In situations of incidental use, such as taking breaks or wading, it is important that boaters understand that they may be trespassing when they leave their watercraft and access the stream bank or bottom of the stream. Prior permission may be necessary. It’s best to plan ahead or use public access areas or public land to leave your boat.
    There are times when it may be necessary to leave the boat, such as the need to portage around an obstacle or wade thru a stream due to debris. This usage is permissible, but boaters are encouraged to do so quickly and respectfully (don’t leave trash, don’t venture far from shore).

      in Wisconsin we have the 'keep your feet wet' clause for rivers and streams, ie so long as your feet are in the stream, you're on public stream/land. And you're allowed to briefly use the shore to only move around a very deep area or an area that is blocked. (say a big tree fell across the stream and you really don't want to climb over it or swim under it or you hit a deep pocket thats over your waders or will require you to swim to cross, you can get to shore and move around the tree /deep hole to the other side. )

      @@creekhopper3153 Nah, the laws are different. Maybe similar in some ways but absolutely different. A stream in Illinois is consider navigable specifically if barge traffic or boats can travel the waterway which this stream isn't going to cut it. Kayaks and rowboats don't meet the definition of what is considered a boat for such travel.
      In Wisconsin there is none of this "own the riverbed" bs on navigable waterways. They have something called the state's public trust doctrine. One of those places where if your feet are in the water, you're not trespassing but if you're on the shore it is possible you are.
      50 states, 50 different laws. A complicated mess. One thing for certain in these states - You cannot kill trespassers legally if they aren't a threat to you. This isn't castle doctrine where someone is entering your domicile where their mere presence is viewed as a threat, this is outdoor space.

    Great way to spend a day. If I had a dollar for every hour my dad and I spent wading the creeks and rivers here in Indiana, I would be rich. But, I am even richer by having all the memories. I cant drive across a creek or river, or by a lake without thinking of dear ole dad. I miss him daily. That is a nice looking creek, they always say, "fish lives in beautiful places."     A good rule of thumb is if a boat or floating device is ok on the river, its considered "navigable" and property rights go to the high water mark and no farther. The only rivers I've ever fished where property rights went to mid stream were "non navigable" .

    Snakes don't hate, they don't have the capability to feel emotions (no limbic system). They just want left alone. Stay out of strike range and leave them be and there will be nothing to worry about. A lot of what people think is "chasing" is them just trying to get past you because they know there's a place to hide and you're in between it.
    Water snakes sometimes will come up and investigate because they eat fish, they can smell the stressed, wounded fish, easy meal. They don't want to bite or attack you though. Always remember you're in their home, you'd be upset/scared if some giant stranger came stomping through your house randomly too 🤷🏻‍♀️
    You don't have to like them, just respect their place in nature and leave them where they lie, just walk around them.

    you can legally float through someone's property without trespassing but as soon as your foot touches the bottom or the bank its trespassing. I own land and cant see why you would be upset with outdoorsmen fishing as long as they are not leaving a mess or damaging the property.

I too have been shot at with a shot gun and it was so close the bird shot hit me, so I didn’t make any mistake about the definition, but neither did he cause I shot back... kinda like a barking dog, if you run he’ll chase ya. I didn’t run and he quit shooting after about 3 volleys and backed away and so did I. No words were even spoken, never knew who the guy was or anything. But I was squirrel hunting on public land in Texas back in the 70’s.

    In my state this would absolutely be trespassing. You can float a boat on "navigable waters" but if you touch the bottom or the shore you are trespassing. Be careful out there, laws vary by state.

    Check your navigable water laws. Make sure the waters and the ground up to the high-water mark is public. It can vary a bit state to state but I work for the DEPT of Natural Resources in another state and land owners can face criminal charges for fisher and hunter harassment.

      It's because most fishermen don't shoot back. If someone had returned fire with effective shot placement the land owner wouldn't be shooting at anyone anymore and the local news would let all the other land owners know that if you shoot at someone, they are allowed to shoot back.       I remember looking for houses in Colorado a few years ago. It is indeed legal to own a creek or body of water of some sort. If you think about it in government terms, a country owns jurisdiction of certain waters. It can apply to acres of land, or in this case, bodies of water.
      This is my own speculation. I've lived in Alaska, so I have have basic knowledge of how it could work. Meaning lots and lots of lakes. You could take a look at the map of Alaska. People own C-Planes, and they take off from water pretty often. It would be no surprise that any one individual could own bodies of water. I'm really into real estate and houses, so I understand the concept of owning that type of genre. Anyone could correct me if I'm wrong tho. There are housing regulations and many different foundations and higher ups who facilitate and make sure anything involving the ownership of some sort of body of water is kept clean (although Americans suck...). It's like that guy who comes to your house and says your fence is too freaking high for some reason.
      And in no way am I condoning shooting at a fellow before making yourself known and if the trespasser is not an obvious threat to their land.
      Fishing is supposed to be peaceful man... these guys could have approached differently.

      Where I live you own to the center of the creek, not sure about larger bodies of water sorry but this is very true, it shouldn't be like this , but how else can it be if the body of water is on someone's property? However we have to remember the kind of society we live in today, its near impossible to fish or hunt anywhere anymore, because of liability, too many home owners are liable if their is an injury sad to say, but just look up the laws , have proper paperwork, ask permission if need be, keep your cool (if possible) and stay in deep water. Try not to leave your boat if you can help it, I think my best advice is to stay away from any land where there are a lot of houses , hope this helps, btw im on the fishermen's side😉

      @@cjsadman3750 as for the larger bodies of water, if you think about it in terms of owning land like the both of us had said, then take for instance those who own Lake Resorts. Camps started by families who turned their Lake house into some sort of luxury resort over the course of several years warrants that they own that body of water. There's only the regulations that are in place.
      That's why most fishing places are owned by the public, and if you fish in a private area, you usually have jurisdiction for it.

    Is it alright if I ask where this was at? I absolutely love the limestone and shale cliffs next to you. I'm wondering if you're somewhere in the Tennessee/Kentucky area based on the foliage and geology. Also, everything below the high water mark is usually public access land even if it runs through private land. If you're in any state that's not Arizona or West Virginia you're perfectly legal to wade the rivers and fish. You could've gotten that dude on some pretty serious charges for negligently discharging a firearm like that.
    Property laws and trespass laws are one of the major things I discuss in my defensive pistol/rifle courses.

    Had the same issue with, of all people, Ted Turner. Fishing in North Georgia. We enter a river at a public area close to 20 years ago. I have some moron trying to cut my line when I hook into a huge trout. Still land the trout and get some pics. Says he is calling game wardens, we said go ahead. We asked sheriff if we are allowed to fish there due to signs we saw hanging across the river. Walk back down to where we walked in to have Ted Turner there yelling at us. Speak with game wardens. Advise we spoke to sheriff at their office who said we could. They gave us a ticket stating they wouldn't have but it was Ted Turner there complaining. He was at the lodge or close by when this all occured. 3 kids, just trying to fish. The Game wardens pointed to the fishing regulations and one line saying it is on you to know whether you need to seek permission to fish there and that they can close it down to Public if not navigatible. I advised them I could get a kayak or boat through there and the only reason it may not be navigatable is due to changes made. It's is big money maker in North GA. People paying thousands to fly fish rivers made into fish tanks with trophy trout. It's pathetic. They have barriers made to keep trout in areas the further upstream you go. Less than 100 dollar ticket.

      Better understand the GA law. Mr. Turner can own both sides of the river and the riverbed. He can't own the water that flows through it, or the fish that freely swim in it, so you can do your kayak thing, just can't anchor on his riverbed or pull up on the bank without his permission.

    in Illinois if you access a body of water in a boat from public land or some place you have permission you may go anywhere on that body of water if your in a boat. if your wadding you cant, the land owner does not own the water but he does own the land beneath. you cant touch the land

    there's a section of river in my state where landowners claim a Crown Right and prevent fishing. Yes. a land deed from King George II (obviously pre-Virginia). Highly disputed thing where no wading, anchoring or fishing is allowed on that stretch.

      @@dj13579100 I agree, but it's not always the case. In Idaho, you can be within the high water mark while on private property. In Utah, you're only allowed to float with the flow of the river, no touching bottom, anchoring, or using a motor on private property.
      I think that if people don't allow fishing on their land, they should not get stocked by state hatcheries or programs. They should have to pay for fish to be stocked.

    I just go by the parcel maps and most streams become ownerless once they reach ~20M in width, I still don't leave the bank-full mark anyways. Recently had a gun range ricochet land 5 feet from our boat on a more than public river with boat ramps, soooo that was fun haha.

    In Tennessee it depends on your ability or, the depth of your pockets, to take someone to court and let a local judge decide. The law says you can fish, but old deeds say the land owner owns the waterway. The TWRA knows to stay out of the argument, so they say "ask permission of the land owner". So unless you know the local judge your chances are slim that your expensive lawyer is going to win any thing in your favor. If that isn't a correct summarization of a similar situation in Tennessee. I like to hear a truer one.

    i'm no legal expert, but everything I've been told on this matter is that water is state or federal property, and private property only extends to the shore. So as long as you aren't on the land around the water you cant be trespassing.

      You have to be able to Access the waterway from a public point and be able to Navigate it with getting out on the banks . Other words if you have to get out your boat and pull it or something like It will be Deemed none Navigator and the owner of the property owns the water from what I get .

    I think the law says-if you step foot on dry land it’s private property. In Montana the officers told us you CANNOT step on dry land you have to be in the river as long as your going through private property.

    If a creek runs through your property you can not prevent people going down the creek, but they can not drop anchor if they are floating in a boat of some type. This goes for walking in the water as well. creek bed = land.

    I don't live in Illinois, but If I'm not mistaken, private property laws apply to the ground under a waterway or river, but not the waterway or river itself. Such as floating a river is legal where it crosses private property, but if you stand or walk on the bottom, then you are trespassing. At least in the state I live in. Similar to a public roadway across private property, You are legal if you stay on the roadway.

    In many states like Tennessee the water itself is State Public Property but the land underneath it is private property. The second you get out of a boat, canoe, or tube and stand on the Creek floor or shore you're trespassing on private property.

    It is not legal for a property owner to fire a weapon at a trespasser. If he fired on your direction you can have him charged with agg. assault.

    I remember an incident here in Michigan where a land owner decided to fire "warning shots" at a teenage boy fishing in the river. His father was further upstream. He heard the shots, came back to where his son was fishing, pulled his .45 and killed the land owner. Teenage boy was fishing legally. The boys father did jail time for 2 felonies. Landowner went to the morgue. Lesson : when you pull a gun and fire "warning shots" you may very well draw return fire. THINK ABOUT THE POSSIBLE CONSEQUENCES BEFORE YOU DECIDE TO TAKE THE LAW INTO YOUR OWN HANDS
