Charis Kubrin, a renown specialist in criminology and law, shares with passion and mastery a story of Rap on trial that elucidates the fundamental issues our society faces in relation to freedom of speech, liberty, equality and justice.

    Charis E. Kubrin, Professor of Criminology, Law and Society at the University of California, Irvine researches and teaches about crime and justice. In addition to publishing five books and dozens of journal articles, she is a frequent media contributor whose writing has been featured in the New York Times, Los Angeles Times, Forbes, CNN.com, Seattle Post Intelligencer, OC Register, and American Banker.
    She has received many awards including the Ruth Shonle Cavan Young Scholar Award from the American Society of Criminology, a national award given to recognize “outstanding scholarly contributions to the discipline of criminology.”

    Excellent talk! Very useful to point out the covert racism that our society, specifically the socio-legal system continuously uses, yet ignores. My only point of criticism is regarding the notion that with rap "the more violent, and misogynistic the better", I think this is only true for mainstream rap. That is the rap that reaches the masses, which is through record companies, largely owned by older, white, males. There is rap out there that challenges stereotypes and misogyny. However, these artists are probably less likely to receive million dollar contracts, unless they change their music to fit what the companies want.

    Friendly reminder. Every time you listen to music that speaks violence, anger and resentment, you are chanting a mantra 🎶 Manifesting your reality. If it's true that a community speaks violence, homophobia, and chauvinsm to get respect, than the community is committing self sabatage collectivelly creating a negative reality that persists.     Everything this woman argued is 100% true. The hard part is what do you do when you shoot a music video with lyrics like this and the artist is arrested 2 weeks later for first degree murder (like we have).     All Im going to say is this. Lyrics of any genre of Music are genuinely made from the thought like Movie or TV lines or scenes. Also Im going to touch the whole Gun thing Black+Rap+Gun Does Not = Thug It just means another person who have a fuckin gun. Its almost like black people can't be part of the Second Amendment. So I guess when a white person has a gun, its all good? Our whole government forgets that Guns are Tools. Yall having such a big problem with them know you should get rid of them.

      Brandon Jackson most people who have guns are convicted of murder, that is why people can't have guns. Most shootings use automatic guns or assault rifles. Both of those guns are meant to kill. You only need a basic pistol to defend yourself.

      TheTroll Mastah - Completely wrong. The violent crime rate has halved since the early 90s despite making rap and other forms of violent entertainment main stream. Rap is an outlet for emotions society expects young men to suppress. You can tell people to suppress emtions, but that doesn't mean they don't still exist.

    Dang free speech is free speech! It should be defended! I got in trouble once for drawing a gun in school. I got pulled aside and asked questions by the school counselor with the campus cop in the room and I was just thinking about James Bond when I drew it, no bad intentions lol.Bringing race into the picture gives you the disadvantage though. I remember ICP the rap group got really big for a year in my neighborhood and my parents worrying about it lol. It's not about racism. Rap is the most prominent right now so of course it's going to trump other genres in the stats. I definitely think you should have won the case but much of the research you mentioned focused on the race card where we lost steam on the right to speech. Honestly there will always be racists! I hope that there will always be good hip hop though! If theres no freedom of speech than technically we couldn't have either. Again though, awesome talk. Made me think... Thank you

      Freedom of Speech doesn't extent to violent threats. If you say you are going to harm someone that is a verbal assault. That's against the law. A crime.

      As I said, Republicans and their allies in academia stopped criticising violence in white music in the 1990s around the time of the Republican Revolution. The same is true of movies, if to a lesser degree perhaps. The goal was to attract poor whites who were extremely resentful of blacks possessing even basic political and other rights (as far back as the Fifteenth Amendment) but who nonetheless disliked the economic policies of the Reagan and Bush Senior administrations. That this policy has been a resounding success for the Republicans there can be no doubt, because it has allowed them to pursue extreme right-wing policies for over a quarter of a century and at the same time solidify their base on a basis of racial fear.

    6 years ago I may have agreed with her but today... The music especially gangsta rap has a different kind of ring to it and they are dying by these lyrics and the youth are agressively trying to mimic these words! This generation of music and the young brothers are different breed! That's my 2 cents.. Peace

    I completely agree with this woman overall, and what she's arguing, but not so much on some minor points. Eminem would be an obvious example of a white rapper being taken to court, and this happened quite a few times. The "study" that was brought up was also a bit ridiculous, as a rapper is always going to be considered more of a threat than a country singer. Lyrics like that are also more expected in rap songs, and just instantly come across as funny when pictured as the lyrics of a country singer. A lot of rap does also come from areas that are high in violence, with many rappers having a track record, so it does have more "threat" behind it... especially when some pride themselves on being "real". But freedom of speech and expression should be protected, as opposed to landing a person in jail because of "what if".

      True.
      Moreover, heavy metal is usually seen as even more fictional than country. I have never noticed anything that could potentially be viewed as autobiographical in heavy metal songs - indeed heavy metal has drawn massively from fantasy literature ever since its beginnings in the early 1970s. That may mean that conservative rap critics, if they do notice violence in heavy metal lyrics, see it as a form of fantasy, or a depiction thereof.

    I agree that no one should be arrested and condemned for any artistic work (especially draft). How a case was handle with a white man with similar circumstances? Do someone have specific case that I can look into to confirm that “If a white man was doing the same thing it would be different”? Still, great TED talks.

    We need more talks like this and more people like Charis. We go to galleries and pay millions for the art of Dali and Goya. The homes of horror films scriptwriters are not searched by police. But the people of color, especially young men, and especially those who aspired to be rappers are viewed as thugs. She is right, until we acknowledge that the racism is alive and rampant in the good old USA, we won't be able to move forward as ONE nation, in liberty and justice for all.

    Seems like these comments either have people in strong support or poised rejection of her arguments. The critics seem to be trying to pick apart her argument by choosing one thing she said that they didn't exactly like, whereas the supporters aren't discussing or contributing relevant arguments/information, but simply stating support.

    Rap music in itself is not the cause of crime. A lot of rappers come from crime-ridden communities and their lyrics represent that reality. Also, as someone who is a conservative who happens to listen to quite a bit of rap music, there are some misconceptions about rap music which are there. Some false convictions may have come about due to rap lyrics, but there are many more instances in which rap lyrics is autobiographical. In those instances, the lyrics should be used as evidence.
