- A juror in the Parkland trial of Nikolas Cruz told Judge Elizabeth Scherer that they felt threatened by other jurors after revealing they wanted to recommend life in prison for Cruz. The prosecution filed a motion to have the juror questioned about what happened, and the judge was not sure if she had the jurisdiction to make such an order. The state said they were not attempting to set aside the verdict but wanted this looked into as a matter of safety for the jurors and court.

Wtf does Obama have to do with this? Do you think he caused jurors to decide life in prison?
he'd be alive if he got the death penalty too, except it would cost way more because of the endless appeals that would ensue by his lawyers.
If he gets put general population he wont enjoy it and will probbaly be killed, idk if he will still be protected or if they putting him there or not
Life in prison is NOT a joy my guy. It just means we will punish him for the rest of his life to let his sins haunt him instead of doing him a favor by giving him death. God still will handle it when he has his exit/entrance interview. In the interim, inmates will take his commissary. They will make his life a living hell every time they think about the fact that they can't see their kids when they miss a graduation, a marriage or a funeral of one of their own seeds.

Put him in a room alone with the victims' families for a few hours.

Why would you think a juror would come to you, the judge, to complain about parking? A juror wants to file a complaint and you don't think anything of it?? This judge is a little slow in the brain.
That happens all the time. The complain about the air conditioning. Etc…
The juror was trying to get her attention, and she ignored him. Then the juror requested to talk and she didn’t even inquire about what. She just blew the person off as a pest. Then the person requested a complaint form which was blown off again. Apparently 2 jurors were trying to get her attention so if nothing else that should have made her pay attention and a 3rd juror must have realized how useless this judge was and bypassed her and called the prosecutor instead.

The Judge absolutely cannot talk to jurors until the trial and sentencing are done. That juror could have talked to the Sheriff assigned to the jury room at any time. If a juror felt threatened it should have been brought to the attention of the Sheriff immediately.
She excused jury it's not her fault
I was not happy with her on this bench.
I knew this trial would be a Life In Prison verdict once the defense tried saying the Judge was unfair towards them. They had nothing to keep him from getting anything but the death penalty. That’s about the time I quit following this trial.
I knew it would be life in prison just in general there’s no way anything ever unanimous anymore
He should receive the death penalty for his crimes.
It was the second they started talking about him being mentally ill for me. Nothing else was going to matter from then on; there'd be some idiot in the jury who genuinely believed that this poor little boy just needed a hug and better care. It's how it is. It doesn't matter how many genuinely disabled people out in the world (who did not have rich adoptive parents) struggle through without ever hurting a soul. People still just love that defense.

@@iluvutube4886 why cause he didn't get the death penalty?
She's made it quite clear from the beginning that it is public record and that a juror has the right to withhold or tell their story of what happened in the deliberation room. So they signed on for this.
@@EM-tg4ft because 1 juror lied and sat in on a capitol case where the DP was an option but they were never going to consider it. That's why dumdum.
I called this. I said that reddit would find the jurors that denied the death penalty. Now this is happening. It probably won't stop until he is dead.
Some tough guy threatening a juror. If you're really tough...threaten the defendant!
How about not threatening anyone. Way too much violence in this country.
@@ThruAWiderLens Works for me.
Agreed, 😡
That judge seems completely out of her element.
Why is she saying their names?
She said there full names yesterday aswel while reading verdicts which was weird
Cause she is dumb or, she loves putting herself in trouble. There will be, one day, consequences about that
Because they deserve to be outed so they can face justice from their neighbors
Why wouldn’t the jurors make a complaint before finalizing their verdict? They could have told the baliff. That would have been the way to handle it.
Right. 😑 Dumbasses. 'Stead of asking for a "complaint form" 🥴???????? lol.
I think they tried but the judge said the bailiff didn’t tell her about it.
a juror who voted for life was threatened. An investigation is already done and it wont change the sentencing outcome anyways, as the person who was threatened was voting for live and one other juror put her under pressure to vote for death, but she still voted for live- obviously nobody was pressured into voting for life as one juror is sufficient to get a life sentence. So , yes that juror who threatened one other juror for saving Niks life should be punished, but it wont have any effect on the verdict, because 3 jurors still voted for life.
That woman has no business being a judge.
This judge is one of the worst in the country. The jury was begging for help & she just didn't want to be bothered, not to mention a lot of the other shenanigans she pulled during the trial.
Agree 100% she feels so entitled and above everyone and the law.she needs to be fired she's a very good example of abusing the power she swore under oath to never abuse .
UM she’s following protocol. Jury members aren’t supposed to talk to a judge.
@@Nursegirlalexandra bug how should this matter be resolved
@@Nursegirlalexandra its people like you and her why our country is such a mess .shes following her ego not the law she promised to obey.
She wasn't begging for help. Ms. Cunha just wanted to say that her vote was a fair one and she didn't make up her mind to vote against the death penalty even before the trial began.
The juror who was threatened was not named. Please go back to 8:25. The prosecution explained that Mr. Benbow, the note passer (Ms. Cunha), and the juror who was threatened are not the same person.
What is wrong with this damn judge!
Nothing is wrong. STFU
Too much makeup maybe?....
Wow. ..the judge should have talked to juror when they requested to do so ...
she's not allowed to
Double Jeopardy doesn't apply. The judge has the ability to accept or override the juries verdict.
Sure hope so
????
Floridia passed a bill that abolished judicial override. the judge cannot override a jury's verdict in death penalty cases.
BS, she can not.
Double Jeopardy does apply here, because the jury already issued a verdict. The judge has no power to override.
Shameless people. Dirty courtroom. Wasted time, money, and energy.
What a hurtful process for victim's families.
So there were actually 3 juries that voted life in prison, but 2 eventually switched? Where they the ones who were threatened? This doesn’t sound like a case in favour of those asking for the verdict to be overruled.
The hell is wrong with this judge?!?!?
what???
Its public record to name the jury!!!!!
@@patriciaquinonez8629 the courts can rule against making the jurors names public
This should not fall in that category. When a juror is threatened that changes everything. This case has turned into a circus show.
Jurors need to be protected. Period .
@betty dunne Because they were forced there and of course not all Americans truly understand weight of consequences and care enough to make a right decision.
They made a wrong decision tho
Jurors do need to be protected but they also need todo their jobs which means following the law without their personal viewpoints they are supposed to be able to view the facts and act accordingly and if they know they cant vote for the death penalty in a death penalty case they need to ask to be removed - I highly doubt if in jury selection this juror really told the truth about their ability to vote for death.
@@Jjboujie the thing is you don't get to decide whats right and wrong. That is specifically the jury's job to decide. So your opinion just simply doesn't matter and neither does anyone else's who wasn't a juror in the case
@@bradrhoades1305 ahh so the majority of the jurors who agree with me where wrong ?
Why tf are they saying the jurors name in public? Isn’t it suppose to be anonymous??
I totally agree
No, after the case the jurors names can become public record if the individual jury member allows it.
@@TeaTimeThrillers jurors' names have always been public in trials
The jurors allowed their names to be public.
I’m amazed of how little people do any study or research about anything before complaining… stick to Tictoc that’s where you feel comfortable….
How can judges in the US just blurt out the names of jurors? Is that normal over there? Even for controversial high profile publicly aired cases like this one?
Depends on state laws. Florida is public record.
if you had paid attention to what she is says youd have your answer
" the names are on public record, thats why im using the"
@@gsja2342 It’s very different here in the UK… In high profile cases the identity of jury members is never disclosed to the media.
This shouldnt even have needed a jury !
This kinda bs is why it keeps happening !
She is revealing their names !?!?! WOW. How about you refer to them with numbers ?
She already named them yesterday there full names aswell while she read the verdicts which was odd
Being miserable for the rest of your life thinking about what you have done. Or just killing him. Life sentence everytime.
He doesn’t have remorse. It doesn’t affect him. Out of sight out of mind. They death penalty would have been justice for the victims and their families. I don’t believe he cares about what he did.
@@bootsie1212 so you're the judge jury and executioner. You're no better than him. You give him no remorse as much as he gives back.
So the families saying that they want justice are no better than him? Go say that to their face!
Ohhh my goddd….this makes me so sick!! This whole entire trial is a HUGE disrespect to the victims and to the families.
This really was a complete failure by the jury. 17 people killed and no death penalty? Really? Absolutely despicable job by those jurors.
The judge blatantly & purposefully ignored the 1st jurors complaint. Then, assumed (failing to properly addr the prosecutions motion) that it was re: the same juror. Smh! Even after being told her assumption/jump to judgment was incorrect, she still shrugs it off & refuses to look into the motion. Or heck, even just apologize for her failure/ incompetence of ignoring the juror (s- now x2) request & complaints. All she did was give reason to question her overall competence. Shameful. She's the responsible party for this. All she had to do was take 2 mins to addr the 1st jurors request. If so, likely both jurors concerns could've been privately handled & quickly resolved. The need for this motion could've been eliminated & never filed. The jurors minds both eased & settled, knowing their concerns & safety were of the utmost importance. IMO, as a 15 yr paralegal: she should be embarrassed & ashamed for her (lack of) action. 😡✌️
For those commenting that the judge is endangering the lives of the juror, as she already mentioned, the juror’s names have already been made public. The names are already apart of the public record and therefore if anyone wanted to find the information (for good, for bad, to interview, to ask about a book deal, etc.) all they have to do is look it up. Juror’s names are always released after the verdict and apparently their addresses are also often made available. I think that’s weird and it should all be kept private, but they obviously have their reasons since anonymous juries are rare.
For sure. Kept private.
But she also had a choice to seal their names for years especially a case like thia
This is why I keep saying death penalty is useless. Look what it has done. It has jurors threatening each other to kill. On another note , this is a horrible and incompetent judge
How did she even become a judge?????????
How stupid! If a jury member was threatened is should automatically void the jury decision.
My 'god.....this judge!" I didn't foresee it was something about the trial." She thought maybe the jurors (whom she shouldn't have named), were going to complain about parking. Her self importance coupled with incompetence is mind boggling.
She wasn't "really sure why the juror wanted a complaint form." Wouldn't it have been sagacious to ask questions -- and find out why the jurors wanted to not only speak to her, but then to request complaint forms? I cannot wrap my head around this.
What's wrong with the judicial system? Don't they have special set of rules for reporting inconsistency between the jurors regarding the outcome of a trial? What kind of impartial stance is that? The judge and all involved should be aware and fix the issues.
In a death sentence case, the jury must be unanimous on a death verdict. If even one juror dissents---no death penalty. Three jurors dissented in this case---no death penalty. Now, if it turns out that anything threatening happened in the jury room, those who threatened need to be punished. We have seen so much juror misconduct in the past year, I think they are going to have to get much stricter and start seriously prosecuting jurors who do not abide by the rules. A court proceeding is much too important to let these things slide.
@@fulanichild3138 Well, they probably did not read their responsibilities carefully and the consequences for breaching the juror conduct.
I believe that the judge was naive to think that the juror wanted to complain about parking when they were about to reach a verdict on a mass shooting
I think she is haughty and just doesn’t care.
The Bailiffs didn't want to interrupt the judge?? What the....in one of the most televised and watched trial of the decade and you think she'd be upset if interrupted?
Well this will make people so happy to be willing to be on jury on such a big case names should be private .
