Am I in the right or the wrong here? Has this happened to you?!

I was caught out a few years ago; the money they wanted to license the font was unreal. As the website gets more views, that number goes up that they get.
I changed my font to something open-source. Job done.

look man, you seem like a nice guy, but as a graphic designer one of the absolute first things i learned is font licensing. a good font takes an inordinate amount of time and work to put together even WITH a team working together. it's also notable that font piracy is a very real and rampant issue. of COURSE someone that invested their time into making a font family is going to seek legal coverage to make sure they're properly getting paid for the use of it. if you really don't want to deal with all of this just stick with OFL fonts (and verify that they are actually under OFL, and read the actual OFL license, and run it by your lawyer)

You can’t download the font and self host it. You need to pull it from adobe font kit. It’s quite simple. If you fuckup the greedy lawyers come to you.
The company I worked did the same, we got like 100k€ estimation cost for the misuse.

Hey Grayson. Not sure if this video is just a clickbaity joke so if it is feel free to ignore this, but here's some info in case it's helpful. I know you said you don't know what you're talking about so maybe this will help.
    - You aren't getting sued according to the email you screenshotted. That's just a kind letter asking you to stop doing something illegal.
    - Using the Adobe fonts on a website requires linking them from an Adobe Web Project (mentioned in the screenshot you put on screen), instead of hardcoding them into your site like you did. It just means that the font files are on Adobe's servers and your site is somewhat "borrowing" them on each load, so Adobe can control where they get used and the font designers get paid appropriately.
    - Font Radar does not claim to stop pirating of the font files off free download sites. They detect it being used in code and go after those websites. They can't detect that the font files are sitting on a free font site's servers, and even if they stumble across them like you did they don't have much of any power to go after those free font sites - there are T's and C's protecting those free font site operators from that very thing.
    - Font Radar likely has no interest in disseminating copies of fonts themselves, because they're already quite busy chasing actual font thieves like large companies that allow their licenses to expire, small companies that hire shady designers, and people like you who just want to get things done in a hurry and don't know what they're talking about.
Hope this info helps you on your design journey, at the end of the day it's never a good idea to download anything "free" unless it comes packaged with a verifiable CC0 license. Hopefully if you make money from this video you'll use it to pay others for their work in the future - the only thing more messed up than a designer ripping off other designers would be them also profiting off the story in a RUclips video. Cheers.

@samgordon Came here to read this. Good Analysys.
You simply cannot do a video about a theme and just say "i don't know shit about it". Just read, inform yourself. It's actually misinformation.

@@amk1108 Nope, just a designer with 16 years experience working directly with foundries. This video is actually the first time I've heard of Font Radar so I simply went to their website and read what they list as their services to understand what they do and don't do.

They can't pursue or charge for a product that isn't used. Accessibility by means of third party free downloads are important so designers (on old software or other software that does not include the font) can trial the font even without a license. There are no direct 'damages' for having it hosted by a third party distributor. In your video you said you paid your dues, but you should've mentioned how much approximately licensing cost, or how you came into compliance (hotlinking the font from adobe instead of hosting it perhaps)

If you're getting sued, I probably wouldn't have made this video. You essentially just admitted to misusing the font and that you were or are now aware of the limitations of the licensing terms outlined on the website.
I agree that you should be able to use it... but if you want any chance in fighting it, I wouldn't hand them evidence.

Make sure that if you are, you either purchase it or are using it through Adobe instead of downloading it and uploading it to your website.

This seems more like you don't understand how font licenses work, ran afoul of bad actors, did a piracy, then got outraged that you got caught doing a piracy, even if it was done more out of thoughtlessness than malice.
I do hope that if they are actually suing you, you ran this video by your lawyer or something because "Yeah, I did it, but actually you're in the wrong for catching me because that's the only way you make money, not by selling your product" sounds like a pretty bad defense to me.

  • @enricogheller6205

You are simply not using Adobe Fonts correctly.
No need to waste time on conspiracy theories, just inform yourself on how fonts license works... It's your job as a graphic designer.
Also, you better find some evidence to support what you are saying, these are strong accusations and could be considered defamatory...
    I hope I was helpful

All the better now, since Adobe's currently down for the count and everyone can kick them in the nuts for free!!!
