The character is not actually non-binary. Their backstory is that nobody knows who they really are. The lack of gender is due to nobody knowing what gender they are, not pandering. Non-binary people just saw a character that doesn't have an ascribed gender (for legitimate in-universe reasons, not identity politics) and are trying to claim it as representation.

According to developers at Respawn, EA had no say on how Apex Legends came into being. Probably why it had literally no marketing for it and dropped the same day when it was announced.
