      Well established law that photography of government officials in performance of their duty. Well established law 10 ft is the min distance you have to be. Qualified immunity does not apply in this instance.

    We all know damn well, they cop is getting a paid vacation on the taxpayers dime.
    He clearly assaulted and battered that guy, which should result in loss of qualified immunity, termination and a criminal charge.

    The whole time they were trying to intimidate this guy to move there was another citizen (female) with a camera phone and coffee on the easement filming as well. No one went and told her to move.

    This wasn’t their “accident scene” it’s a public easement. They literally said in the midst of the argument the accident was over. This was ,once again , cops on a power trip because someone didn’t bow down to their imaginary AUTHORITAAAY (Cartman voice)

I am seeing an opportunity for authoritative officers to separate themselves from authoritarian police behavior....Especially when a citizen is exercising a constitutionally protected right such as remaining silent, refusing to allow a search, or collecting information or recording from a place they are legally allowed to be...Unfortunately, I see police policies that allow it and prosecutors who act on the complaints by the officers....

      @@stephenmartinez1 BTW.. What I am truly hoping for is a change in police culture where authoritative officers outnumber the officers who tend to respond in a more authoritarian way... Simply put... I think when a certain number of contempt of cop charges are levied, it needs to trigger some type of watch list or report to command staff.. The reason for this is that the officers who tend to cause lawsuits also tend to get into multiple lawsuits (repeat offenders, frequent flyers)

    Mendoza clearly said the event was over, so it's no longer a scene. The vehicle's being removed so there's no further investigation in relation to physical evidence that could be disturbed, removed, or contaminated... Plus where he was standing wasn't taped off so that area wasn't a "scene" anyway.

      @@John.Flower.Productions You mean he was where pedestrains should be so as not to be in the road, in the place where people can freely walk and stand at any time. The public easement is open to anyone and everyone and is public land for use as foot traffic in the same way as the road is for vehicle traffic.
      Do you honestly believe the cops thought dashcams are illegal? If not, then they were lying by claiming recording of plates is illegal and their intent was to violate him.
      Had he moved further away from the road he could then potentially be beyond public land and on private property. At which point it would be easy to imagine that these 2 would suddenly claim he was commiting a crime by trespassing (they'd have more reason and evidence than they did when they beat him up for no crime at all).
      Your grasp of reality is so weak that you shouldn't even begin to pretend to grasp the law.

    The Supreme Court has ruled that a person can film whatever they can see with their own eyes while in public. The Supreme Court has also ruled that a person has no reasonable expectation of privacy when they are in public. Instead of going to the gun range, many cops need to go to the law library and learn which laws they can enforce and which ones they can’t.

    The fact that this cop turned a truck being towed into trips to the hospital only underscores why that man has absolutely no business being in law enforcement. He just proved why he's a danger to the community and a liability to that city. It's absolutely baffling and mind-boggling how that individual was ever certified as a police officer.

      That is one of the reasons you'll almost never hear the cop use the word public property. They always say "police property, city property, state property or federal property", hoping the citizen will not understand it is publicly owned and thus leaves/obays the ofc.

    They never cease to amaze at how bad they fail every single time. His ignorance started with the whole “taking pictures of peoples license plates is illegal” then escalated to a blatant, felonious attack and ended with the officer claiming that he was injured so that they could add charges for those injuries, against you.
    This should be a slam dunk for internal affairs as well as any civil rights attorney.
    How do they not understand why the public hates them?

      1. I have qualified immunity, so he won't be able to sue me.
      2. My fellow cops will always support what I've done because of our thin blue line code.
      3. If all else fails, the FOP has million dollar lawyers who will get me out of trouble.

    Should be easy to find a lawyer to represent him.
    He has documented medical reports of his injuries. He has the cop on video stating ‘it’s illegal to take pictures of cars & plates’. But mostly he has video of the helmet cop stating ‘the accident investigation was over’.
    Assault on a police officer? Cop went to hospital by ambulance?
    So now the cops are charging us because they hurt their fist punching us?
    Next the departments will send a bill to the families of the people the murder, seeking compensation for the cost of the bullets they used to murder the victim.
    It’s really too bad. The helmet cop appeared as if he would have behaved himself. But instead he chose to be influenced by the older cop.
    This is a true depiction of today’s law enforcement. 1 decent cop & 1 bad cop. The problem is that because of thin blue line gang mentality, it’s the bad that wins out influencing the good.
    Even if it was 1 bad & 10 good, that 1 bad is the deciding influencer.
    *Shown in the incident with the out of control senior cop that the female cop tried to prevent from harming a detained suspect. The senior cop attacked her choking her, while the other cops did nothing to protect her.
    *Which also resembles heroic Ofc Carol. She dove on her suspect to prevent her partner from continuing to choke the suspect. Ofc Carol was fired and disgraced for many years. Only recently getting justice.
    *and of course the Chauvin/Floyd fiasco.
    Not 1 of those clowns attempted to stop Chauvin from killing Mr Floyd.
    The idea of ‘weeding out’ bad cops? Too late! It’s time to use roundup and spray the whole crop. Start by dismantling the thin blue line gang. Serious penalties for any cop that displays that gang symbol while on duty.

    Wouldnt proper protocol be to tell you to turn around your under arrest. Pretty sure they dont just get to tackle a citizen who is not being threatening. Seems like a no brainer lawsuit. But you never know with these corrupt people.

      It even looked like that dirty cop's first move was a punch of some sort. He just moved in and punched the poor guy. If a member of the public did something like that to a cop, they would have been arrested for assault and battery. But the cop just gets suspended (probably with pay). Disgusting.

    Back in the 80's, my cousins would ride their bikes to epoxy cars and dummy spike the tires. Years later I was told they were doing this to cops, judges, and city hall employees that were crooked. They were notorious for driving out officials w/in 2 weeks. I was always skeptical of their hooliganism, but after I got beat up by a cop and lied to in court... i understand the peoples reason to fight back.

    Mr. Reyes, in addition to a formal complaint and potential civil suit you might bring against these officers, you should consider swearing out a criminal complaint for assault either with the Sheriff’s Dept or at your local Federal Court.       Hmmm, in a lot of states, police scan license plates on a regular basis for no reason at all. They claim they use it to identify stolen cars. However, this information can be cross referenced to determine your comings and goings but citizens can't film in public where they might, in the course of filming, capture license plates? Something is off here.

If they weren't, running plates would be a violation of your Fourth Amendment rights. Police just decide that it's fine for them but not for the public because they're so used to having privileges that citizens don't--access to automatic weapons, the ability to violate traffic laws with impunity, the ability to commit assault and theft without fear of retribution, etc. Why _wouldn't_ they be the only ones allowed to photograph license plates?

    This is my hometown & I have Cagles in my family but I don't know this tyrant officer. I did see on another video where the PD confirmed he was suspended with pay while they investigate. I'm sure they are just waiting for this to blow over before reinstating him. He needs to be fired.

    During the internal investigation or the interview by the plaintiffs civil rights attorney they should ask these police officers if they’ve ever received training on your case turner versus driver I believe or Terry versus Ohio or any of the other civil rights case if they have been instructed or obtained these cases to review then I believe they’re qualified immunity should be abolished as they gnu caselaw they should also sue the ambulance company as they obviously realized the police officer was in deep shit and lied about his injuries and they decided to take the police officer first instead of the citizen sure the police officer could’ve been driven by his cohorts this should be quite a good case for any good civil rights attorney and personal injury attorney
