The man shot him with a desert eagle chambered in .50 Action Express, three times, in a shot placement that would have had a 100% mortality rate at that caliber. Since supes don't exist in the real world we don't have laws around this, but, I would imagine this would not be charged as murder considering the man fully intended on murdering him for what, harassment at best? Also keep in mind this wasn't the first time he tried to murder him.

@@TehPesky To be fair it's established they're all assholes though, and while he was just a kid a kid in Nicaraga he shot down allies on his own team with the mini gun and was having a blast doing it. But yeah Butcher killed him when he really didn't have too, and Gunpowder had no involvement in Soldier Boy's betrayel so he may have found that out.

I get that they wanted to make Billy's powers thematically like Homelander's to show how he's becoming what he hates, but when Homelander's kid is already developing the same powers, we have too many Superman clones running around. It's too late to do anything about it now, but I think it would have been interesting to the Butcher frost breath instead of heat vision, so still a superman style set, but coldblooded to counter Homelander's hotheaded nature. Also, every butcher needs a freezer.
