Witnesses Convince Cops the Wrong Guy Did It

"On 11/17/2021 I responded to the Circle K in reference to a theft.
Upon my arrival, I made contact with victim who advised his cell phone was stolen. The victim advised he is a regular customer at the location. He advised he left his iPhone 12 on the counter of the “Polar Pop” station and entered the restrooms. The victim advised before entering the restroom, there were only three people in the store, to include himself and the store clerk. The victim advised he does not know who the suspect was.
The victim valued his Apple iPhone at $1,280.
Upon reviewing the store’s video footage, I observed a white male suspect, later identified as the defendant, take the victim’s iPhone from the counter and place it into his pocket. The time stamp the defendant took the phone was at 0238 hours on 11/17/2021.
On 1/20/2022, I identified the defendant by sending photos from the store video to this agency’s Intel Unit. The Intel Unit identified the defendant, as well as I was able to compare a recent booking photo of the defendant to the store video footage. I positively identified the defendant as the suspect who stole the victim’s phone.
I responded to the homeless camp, where the defendant is known to frequent in an attempt to make contact with him. I located the defendant.
During a Post-Miranda interview with the defendant, he acknowledged he remembered the iPhone at the “Polar Pop” station at the incident location. He advised he found the phone, to which he believed belonged to his friend “Mike”, who he advised was also at the store. The defendant acknowledged the phone did not belong to him. I then asked the defendant if he asked “Mike” about the phone, to which the defendant advised “Mike” told him the phone was not his. I then asked why the defendant did not turn the phone into the store clerk to which he advised that “Mike” was supposed to do it., The defendant advised “Mike” turned the phone into the store clerk before they left the location.
When I reviewed the store footage, the defendant nor did “Mike” return the phone. I placed the defendant under arrested and transported him to the Marion County Jail.

I’m betting the guy that lost the phone (Robert?) needs an assault and battery charge for putting hands on and roughing up the kid he thought stole the phone. Being from Southern California it's crazy to me to see an officer respond for a stolen cell phone. Out here they just tell you to go file a report online lol.
I had $50,000 worth of plumbing tools and equipment for my business stolen and we recorded the guys doing it, it was a group of homeless guys with weapons. We called the cops and they told us to file a report online, literally was asked 1 question: "do you have insurance sir?" Yes. "well we don't typically respond to these types of calls, you'll have to get online and do a report. That's it, even though we have all the evidence. I couldn't imagine calling for a cell phone lol, LAPD dispatch would probably laugh at me

That’s a felony… maybe no investigation for misdemeanor $500 worth of tools but $50,000 is the equivalent of a bank getting robbed or someone being held captive for a year of their life. I hope you get a lawyer and seek quality legal help. That is so messed up..

It's amazing what people leave behind at the airports, from cell phones to tablets, laptops and even their bags at times. The found items are locked in a safe for a period of time waiting to see if anyone calls in regards to the item as most of the time, there no way to know who to contact.

I could have gone to jail for trying to be a good person. I found a phone in a parking lot, had no idea what store they had gone to so I held onto it to try and contact the owner some how. Turned out the son called the phone and I was able to return it to the guy’s house. I didn’t do anything other than answer the call with the son. This was like 13 years ago. I really ONLY wanted to return it to the owner because I would want someone to do that for me.
No, you could not. This cop is very likely to be fired over this false arrest. If you bring a valuable item into a gas station and leave it behind, that is legally known as 'abandonment of property.' It makes no difference that you did it mistakenly or that you only left it for five minutes, it is abandoned at the moment you walk away from it. If someone else picks it up, legally, they now are the owner of that item. They found an abandoned item. That is not theft and is not illegal. That is 100% legally the finder's possession, whether it's a paperclip or a briefcase containing $2,000,000.

I lived in Florida, these 7/11 clicks are legit. The poor kid has some obvious developmental issues, and I feel the guy tried to convince everyone else to point fingers at him, which is imo reinforced when the guy whose phone was stoleb feigned wanting to be so apologetic to the kid

That " special forces " guy which I don't believe should be charged with assault, he had no right with out proof to attack that disabled kid. The case dropped? Is the Prosecutor lazy or what?
The prosecutor recognized that they were wasting thousands of dollars on an iPhone that was considered abandoned property.
