‘Thrown Under The Bus’: Defense Slams Case Against Former Parkland Officer in Opening Statement

  • “My client was sacrificed, thrown under the bus,” defense attorney Mark Eiglarsh said to jurors as he began his opening statement in the trial against former Parkland school resource officer Scot Peterson. The defense claims Peterson has been used as someone to point the finger at - someone to blame - for the deadly massacre that killed 17 people at Marjory Stoneman Douglas High School in February 2018. The state argues Peterson didn’t follow active shooter training and could have saved students’ lives the day of the gruesome crime.

    The "evidence will show" this man was, is and will always be the coward who STOOD outside hiding for 40 minutes and NEVER entered that building to even CHECK to see if it was coming from inside!!! EVEN after backup LE arrived!!!

      even if he did not want to use his gun which makes it hard to believe he still could have put the school into code red that other guard who hid in the cupboard on the second floor instead of warning the teachers and kids on on the 3rd floor that the was a shooter into the school is much to blame has well

    Keep in mind that there are usually no objections during an opening statement. If the prosecutor objected that much, just imagine how much they will object during the evidence phase. That shows that they really have no case.

      With Uvalde I can see many officers thinking someone else should do it. In this case, he was the only one that could help and he didn't. I don't see how an old "brave" man with a gun that was officer of the year just a year or so prior could just run away. Leaving helpless children to face that monster.

      Please he's a coward who didn't do his job. He stood outside while people died. What's the point of having armed police there if they do nothing. People advocating for gun ownership claim a good guy with a gun is the solution not gun control. They're wrong because like Evalde police are only worried about themselves.

      This was clearly a trail to put blame on someone like the SRO. An SRO is only as effective as the information he receives. Also SCOTUS has ruled that police do not have a duty to protect. And one more thing, the charges of child neglect was not put into law for incidents like this. In fact , everything that happened at parkland falls at the feet of the shooter and ONLY the shooter.

      For sure the Uvalde police officers did act cowardly and deserve to be held accountable. However, "what-about-ism'" isn't a valid argument when your dealing with different states with different laws and policies involving police officers. 🙄

    This man served his community as an officer for over 30 years and is on trial for his life because some sick murderer decided he wanted to kill innocent children. It is ridiculous. Cruz and the people who ignored his mental health problems and signs that he was a psychopath are to blame for this tragic event not this officer in my humble opinion. Yea I’d like to think I would absolutely run in and give my life to save those kids but no one truly knows how they will react when the time comes.

    Watch the videos of him hiding outside. The defense says he didn't know where the shots were coming from. Then listen to his radio transmission. He knew exactly where the shots were coming from and refused to even try and save anyone.

    Yes, the other security/officers "did not go into the building either" (10:58) because they were not armed with a gun. However, the only officer who was armed with a gun (the defendant) chose not to go in. And, yes, it took SWAT 30 minutes to clear the floors (@44:40 to 45:00), but there was no more active shooter at that point, they did not hear any shots. And that has nothing to do with what Peterson DID NOT do. Peterson was trained to run toward the shots in an active shooter scenario. But he did not even try to find out where the shots were coming from. He heard the shots. He heard the active shooter. Yet, he stood in one spot the entire time. He did not even try.

    They need to get a mathematician in there to give the jury a clear understanding of the odds of him making a difference if he were to enter the building blind without hearing where the shots are to choose the exact right floor, and happen to turn the corner in a favorable angle to get a decent shot off against the shooter during the last 2 mins upon when he actually arrived at the scene. Likely he would’ve died, next he probably wouldn’t have made any difference as the damage was already done and he would’ve had to climb the stairs and find the shooter which would’ve taken additional time. If he blindly entered the building and happened to come across the shooter in a stairwell he may have had an advantage with close quarter combat in killing the shooter but if he came out of the stairwell and turned the corner and met the shooter from the other side of the hall he would’ve been toast going up against the shooters mid-long range AR.

      Police are trained to intervene in active shooter situations. He could have at least gone inside to check rather than doing nothing.

      @@casienwhey Which building? Nowhere in active shooter training does it say you should run around like a chicken with your head cut off. If he had run into the wrong building it would have been even worse.
      The person that thought a system where the only cop on site didn’t need to get the information about where the active shooter was and should have to figure it out on his own on a 45 acre campus should be the one punished.
      This was a systemic failure….they need to fix their system. Maybe they could have used some of the millions that they used to investigate and try this case!

    I'm on the defense side. even if Scot had gone straight in the right direction (which is not to be expected) it is not certain that he could have saved lives. Cruz acted too quickly for that.

    Scot Peterson wouldn’t have stopped Nicholas Cruz, who had an AR 15 and body armor. Scot Peterson had a pistol and no armor. A little over 6 minutes was all it took. This case was BS.

He told multiple LE and others exactly where they came from! THAT is what the evidence will show! It does NOT matter what happened days AFTER the shooting.     Im surprised by the comments saying the prosecution has no case. Whether he knew where the firing was coming from or not (which is something the jury would determine) didn't he have an obligation to find out and then intervene? Otherwise why did he come over in the gulf cart at all? What purpose would having an armed SRO at a school serve if he was not expected to help? The students were required to be there due to truancy type laws and so the state has an obligation to care for them while they are there. The SRO was hired by the state to help do that.

    I hate it when prosecutors or defence start their opening statements with actual evidence instead of just explaining to the jury what evidence they can expect to see and what it will prove. Leave the actual evidence part for witness testimony. This is rather painful imo.
    I remember a prosecutor recently on a high profile case (can’t remember which one exactly) that went on n on in her opening statement showing n explaining away for 4 WHOLE HOURS and she kept correcting herself n mis-speaking several times. It was by far the most brain-hurting opening statement I’ve seen to date.
    This guy doesn’t go on for that long, but he’s definitely entering into evidentiary testimony n it’s frustrating. No wonder there’s so many objections to his opening statement 🥴

I remember commenting that she needed to shut-up before she destroyed the whole case with her opening statement, with the amount of mis-speaking’s and self-corrections she made, cos she would probably confuse the jury and come across as not credible with all her mistakes.
      You would think she’d have her opening statement memorised and constructed in a way that every single word she spoke was impactful considering how much time she had to prepare for trial 🤦‍♀️
      The best opening statement I’ve ever heard (and I think should be used to educate those pursuing a career in law) was that of prosecutor William Brown in the Chandler Halderson trial. That was compelling, effective and succinct.

    Parts of his opening statement can be unironically be defeated by arguments from Tim Heidecker's case on adult swim. "Yeah, i said i had a good time, but if people start dying around me and choking to death, the good time that happened before that kinda doesnt matter anymore". He is an officer trained to eliminate the threat instead of containing the threat, and yeah, its cool that he was an examplenary officer earlier when things was at peace, but does that really matter if you don't engage and take a defensive position when the real threat pops up? The first officer at Uvalde only had a pistol too, and he charged toward the gunman, actively looking for a good cover location while his three coward teammates with rifles hid on the far side of hallway. In this case, unless he con provide sufficient evidence that it was reasonable for him to say there is a sniper on the roof after he radio'd in shots in the building, he should get charged.
    Law Enforcement's DUTY is to put their life in front of a civilian in an active shooter operation. Thats what they are paid to do. If thats not your thing, you shouldnt have that badge. This is the one moment that matters. Those kids cant just get fired when you choose not to engage. Those kids are dead.

    It warms my heart to see the comments in this chat. I fully expected everyone to rip Mark and Scott apart but, I am happy to say I was wrong. I feel for the families and I am outraged the Cruiz was able to commit this horrible act with as many red flags as they had. The way the officers handled the shooting wasnt enough because they dodnt have what they needed. They had made the district aware of the issues with the radios, 911 systems, and other issues that handicapped the officers on scene. Maybe more students could have been saved but, its not fair to blame one man and make him the one to be punished. What about the people in charge who knew the short comings of the department for years and choose to do nothing? The sheirf was in the hot seat and gave the mob a name to get them off his back. He could have said we will investigate the response extensively and go from there. Instead he threw his officer under the bus and ruined his life. Im not gling to get angry at the parents for wanting someone to pay but truly Scot did the best he could. He never had a mark against him, he wad officer of the year, no one ever had a bad word to say, and suddenly he turns into a coward? Im sorry i dont think thats what happened and i am pleased to serve pther people in this chat agree with me. I hope one day Scott is able to have a life again. I also hope the parents and families of those killed find some peace. And i hope the evil demon NK has a long miserable life in prison. Death would be too easy for him. He should live a long life of misery and after decades of a miserable existence only then do i think he should answer for his crimes before god.

    We forget how easy it is to judge when we’re on the outside looking in.
    The problem i have with this guy is that he literally just stood there. That’s simply unacceptable to me. Five minutes, 10 minutes, fifteen minutes… doesn’t matter. This idea that because he couldn’t determine where the shots were coming from was just cause for him to not act at all. The point being he didn’t even try to help.
    Mark is an amazing attorney no doubt but he also has an unsettling abrasive arrogance to him that i think would serve him better as a prosecutor rather then a defense attorney.

    Scot Peterson is certainly not responsible for what happened at Parkland. But he is responsible for his inaction, his dereliction of duty. It’s what he signed up for. It’s unfortunate that he found himself in that situation, but it is a distinct possibility in that career path.
    However, police do not have any legal duty to protect citizens, or even children. I do not imagine he will be found guilty, it will be very surprising if he is.

      I just ask that you hear all the facts of this case before making your final opinion. This is not as cut & dry as you think. There was confusing, incomplete & inaccurate information being relayed to Scot Peterson. Being told tut shooter is outside, that there could be more than one shooter. He started off of the complete opposite side of the campus that the shooting took place. And EVEN IF he had all of the correct information from the get go, he, as one officer could not have checked the first floor, second floor & then finally the third floor of the 1200 building in the 6 minutes that the shooting took place in. It took a complete SWAT team 35 min to do it- with multiple people.

    School officers in this country need to literally treat each and every day like it could be THE day a sicko goes into a school and commits this kind of crime.
    This nation is clearly going to choose guns over children and so they need to choose the people with guns who will be prepared to do what must be done and not back down.
    Getting in the middle of a fist fight is one thing, but guns cause quicker devastation than fists do, anyone with a brain knows this, and when it really mattered, this coward allowed those babies to fend for themselves

      i COMPLETELY agree!!!
      #1 cause for child death is guns but republicans will NEVER even regulate guns…
      they don’t care abt their kids.
      if they did care abt their kids, they wouldn’t vote for trump the p3do &/or anti gun-control.
      this man needs to be found GUILTY, GUILTY, & GUILTY!!!!!

      If people are going to choose guns to be one of their most important ideals in the US…they are just going to have to accept that people are going to continue to shoot their kids schools up. Cruz did all that in less than 7 minutes. Even the best response probably wasn’t going to have stopped much of it.
      There is bad that comes with the good. This is the consequence of prolific gun ownership.
