- Judge Juan Merchan issued a ruling today detailing which of Trump's prior "bad acts" can and cannot be brought up in court. Hey Harry. On his podcast I heard David Pakman describing a potential problem with the current juror #2, about whom there are rumors that he is a stealth trumpian dedicated to acquittal. This juror is getting their news from truth social and X, the ramifications of which are very clear. I'd love to hear from you about this potential problem.

Hi Harry. I'm a lawyer and I keep wanting to hear about what the second crime is that makes this a felony. Noone seems to be focusing on this and I was very surprised that the prosecutors didn't address it yesterday in opening statements. Isn't that troubling? I thought Blanche's "It's called democracy" quip from yesterday got to the marrow of the defense. Sorry to say, it's a good point (and a good line). Without hearing the State articulate that second crime (or crimes), I'm inclined to agree. With two lawyers on the jury, they aren't likely to get away with vague references to "election interference" or "lying to the voters". Not enough...."cite please!". I'd love to hear you do a vlog on this. Keep up the good work! 👍

You cannot bar bias. It’s a human condition that can’t be undone, unlearned or stricken from a legal preceding. Good luck getting 12 people to unpack their biases.

In essence you can’t convict someone for crime B simply because that person is known to have committed crime A - but you can provide the jury with the context in which crime B was committed and if crime A is part of that context - then the facts of crime A are permissible as evidence for crime B.

Why prohibit the E. Jean Carroll adjudication for sexual assault as allowable evidence? It seams like some of the more relevant, adjudicated information.
For the same reason that whether or not he had sex with anyone in these cases is not particularly relevant to this prosecution, it’s his actions after the claims that are.
The “credibility and character” parts are about the lying and law breaking around words, not the rapes or infidelity.
The judge is protecting himself and the prosecution from the real likelihood that “prejudice” will be raised as grounds for appeal.
While this is not “any old case”, it still has to be tried by exactly the same means and standards as any other case.
All he has to do is keep quiet and not testify. Lol
