My husband was in Vietnam . We went through this process and it was nerve racking but at the end it was worth it of course. He went to counsel at the Vet center in Orlando for ten years before he agreed to apply. He received 100% p and t. We have gone through pure hell with ptsd. He deserved every bit of what he received, but of course 100% changed nothing with his ptsd. We have been married 50 years and it was a hard 50. It will never be over, heartbreaking . I have popping in multiple joints, I has arthritis in my shoulder, and elbow. I have knee pain on both knees the right knee is worse, I have ankle pain, and there is constant clicking, and popping. I joined the Elite program with VA claims insider. I was already 70% for all of my joint issues. My VCE helped me file for increases on all of my existing disabilities, and I was evaluated for SSD, went from 70% to 100 P&T recently. Wow. I've got popping and clicking in my feet and knees (just submitted my first claim for both,-bilateral) so the popping and clicking are considered additional issues? Damn. (Getting old is definitely not for sissies!)
If you are truly disable you don’t need any agency to file for your claims. I was part of the Wounded Warriors Battalion West. I open this facility with General Matis in 2007 Camp Pendleton CA. I’m at a P&T @a 100% and did all the paperwork by my self. I’ve been 100% P&T since 2014. Truly veterans all you need to do is go to the Federal building and the VA disability claim office is there. Then go to any VA facility and start or open a file. Make sure you follow up and attend your appointments. Also if your family doctor have been treating you for any medical issues found in your military medical records are compensated. I’ve help hundred of Veterans throughout the years for FREE and I’ve seen most of the got increase awards and compensated awards over 50% plus. I’ve worked with our wounded warriors and the VA for over 20 years. You don’t need any agencies to file for your hard own claims.
@Vince, every veteran should exhaust all of their free options like a VSO. But not everyones claims are the same and some just don't know how to get started. We are here for those who need the help.
I'm 43. Just got back my claim from last year. Increase to 50% migraines, prostrating. Got total combined increase from 10% to 80% in November dropped to 70%. Gave me tdiu p&t!!!
@@atthebrink74 so what I stated was very VERY abbreviated. To start, I did navy 12 years from 94 to 06. January 05 I had a mva that I & then gf, now wife, survived. We were both brought to same hospital. What had happened on the I-8 was we hit lose gravel, vehicle swerved & I overcompensated a few times before front end of my explorer turn from the far left lane, towards and across the freeway spinning slightly, just enough that as we were facing oncoming traffic we hit the College Rd on ramp, me in the driver seat slammed against the door AND my head onto & bounced off because if the window was down & not able to stop my head flinging to my right... I would have likely hit the gravel/pavement with my head or more, possibly killing me. Instead as it rolled, my left shoulder hit the pavement & glass, giving me nearly road rash full of pavement & glass. I only remember though my gf waking me after she said she woke up. Luckily she had only gotten a hairline fracture in a pinky finger from the airbag. She was then very insistent on getting out of the car. Neither door opened so I crawled out my window, some old guy came to help. We both help get climb out, as her hands on my shoulders, as she pulled back once standing looked at her hand and thought I would die. We waited for the ambulance & got to hospital. I never mentioned about my head hurting. I was only 28 felt saying something would affect me in 5he navy. I didn't know. Anyway a year and half later I honorably discharged after having discharged exam, marking almost all boxes as no problem. The ER question made answer yes. The examiner asked a few questions & essentially I got 3 disability ratings: cervical neck strain @ 0%, scar left shldr @ 0%, & headaches @ 0%. Combined I got a whopping 10% & I thought that was what I got for life. Only 2 years ago during a contract temp service a airforce vet asked once after listening to my issues, said, "Have you ever been back to the va? Apply for increases or secondary added conditions?" I about dropped my jaw...I said, YOU CAN DO THAT??? From that moment, April of 2017 I researched a little but not much. Thought I would print my private med records & turn into a vso. The one I found didn't know shit or he would have asked for more than med records. Do I told him to not submit, he said I could do an intent to file (itf), January, well he did not. May I see if my now 3 kids are on my record, nope. I go to add them & no change there. From roughly April of 2017 to September of 2018 I got referrals to specialist to get evaluated, sleep apnea, apparently rls very severe, my lower back had been increasing painful the last decade too, most if not all my claimed conditions were to be secondary to my TBI...that I never mentioned about. I had got buddy statements & other stuff like nexus letters & DBQs filled out. The just wasn't enough evidence to support that I had...not having...TBI. upon submitting my fdc in September 2018 my first c&p 3rd party, great pa doing my headaches, my neck, my back brought me to 80% only partially approved. Neck went to 30%, back 20%, I think too my scar went to 10%, & migraines to 50%. Combined 80% the next 9 months I guess. I had submitted a fdc, but upon doing more research found out about smc and different amounts. I applied for other things, this added more home to complete. My first ETA to be done was January 2019, it ended up last estimated September 10 but actually finished August 14ish. All new conditions except back was denied as no connections to my TBI that also got denied. I got the year to apply, but likely & finally going to use VACI. I've watched many of their videos as well as many others to. Learned a lot & applied. Oh yeah, so april c&p dropped my neck from 30 to 20, overall Combined to now 70, but I got back pay. Wtf right. Finally got va paperwork. The tdiu I applied or made a letter or filled a form, to have my migraines being that they are prostrating or really bad have lay down in dark bad, even if at work & many times did. I had to quit December 2018. The granted tdiu went al the way back to December 2018. Anyway I recently learned after quitting I could apply for ssa or SSI/SSDI. Did thay this last January 2019. Denied at 5 months & again not 2 months later for reconsideration. Now that I have tdiu p&t, I think should sway any alj to approve my ssa disability both ssi fir the first 5 months before ssdi would have kicked in, so more likely another back pay. If that helped, good. If not asked something specific. Ty
Agree with Brian. If you have doubts at all. Call the VA regional office and ask if your service connected disability are rated as Static. If so, your safe. It's permanent. No more exam.

I went to VFW for VSO and they sucked. Switched to DAV and they are fairly decent but they don’t seem to be staffed well enough. If my appeal fails I will be coming knocking on your door. Thank you.
I went to VFW, by the time they called me, the person representing me went on Medical leave. Right now I am working with a VSR to help with my current claims since the ratings board sent me a letter saying "We need further clarification on exactly what you are claiming.". The VSR has no idea why they are asking as everything was documented...lol! The VA is trying to drive us insane!

I am rated 50% for anexity plus MDD . I have seeing a va psychiatrist for over a year now. Iv actually had 4 in the past year . my newest one has diagnosed me with PTSD and told me to file for connection and i have. What you do think will happen?? Can this interfer with my current rating??

Nobody who? Just asking for a bit more specifics? Your Va doctors or private pcp? My private was initially excited to help but gradually seemingly got annoyed because of how the wording was not stated correctly. Eventually I just stayed to keep my meds available. I even have a va pcp.
Right now I am doing all the va evaluations, but to get any help with the GI bill, regarding learning disabilities that I developed from head injuries etc. I dont qualify for a single program without a va rating. And the va has been taking their sweet time like they do with everyone. Ended up dropping certain classes and having to take others just to buy time.
Have to be tdiu with p&t. You would need a lot more ratings to reaching 100% alone or another big one. 70% depression 60% skin 30% ibs 10% back 10% knee/shin (bilatteral boost) 10% knee/shin (bilatteral boost) I am just at 95 or a little above which puts me at 100% with the round up.
My question based on what you've said and what I am reading/hearing is this: Say someone is 28 years old and was pushed out of the service through a medical evaluation board. The VA rated them 100% P&T right off the bat. Does this mean, the only way that this can ever be taken away from them is if it is found as fraud OR the member decides to try and submit for something else (which they should not because it will make no difference unless they are reaching for SMC). In short, if they are 100% P&T, they are good for life outside of fraud or reopening a claim. Is that correct?

I just got the p&t on my va letter and chapter 35. I have been 100 for 2 years and got the p&t after my re-eval for two that werent rated perm when first rated. I did read im not safe until 20 year because they can still look at my stuff and lower my ratings.
I have service connected COPD. I also have severe sleep apnea with a bipap. Have you ever done OSA secondary to COPD? I know COPD doesn't cause OSA but it does make it worse. It's called overlap syndrome.
Hey Boss! I am now 100% P&T, however, I have an appeal waiting to be reviewed by a judge im like 125,000 in line! When the judge sees my appeal can they revoke my 100% ? if so can I cancel my appeal so it never has to actually see the judge? Thanks!
@@VAClaimsInsider haha naw its legit, ive just heard horror stories of people appealing certain things, even things they arent rated for and the VA looking over the entire file and setting up more exams for stuff already claimed, but it appears that doesnt happen quite often if really ever.
If I move to another state, and the dr. at the new VA thinks I am better, can I be reevaluated if I am 100% p&t with no future exams scheduled? Also, if I quit going to my mental health appointments and/or quit taking my medications can they take my 100% p&t benefits away from me?

Until you reach 20 years with the same rating there is always the possibility they can lower your rating. P/t only stops scheduled evals. If you file for more disabilities they can look at your other ones and lower your rating.
I'm currently rated at 40% VA disability for seizures . Now I am working on VA rating increase for this service connected disability. Is it possible that the VA will increase my rate to 100 % for this disability?
Can TDIU P&T be reevaluated if costochondritis is treated with medication showed improvement but not cured I am 63 years old. I have a combination of disabilities.

I have a 70% P&T rating for PTSD with a combined rating of 90% with IU. With P&T on one condition, does that make my overall rating P&T when I finally get 100%? Thanks I love the info you are sharing.
Hello Brian, my situation is different. I was just awarded a combined rating of 60% for VA disability. My largest percentage comes from ED, OSA secondary to hypertension at 50%. I think I deserve more for OSA because my condition is so severe with paralysis, insomnia etc; that my Doctor said I was at risk of a cardiac arrest without my CPAP. MY left knee is secondary to service connected right knee was deferred although my VSO Representative faxed two Doctors nexus letters to the VA on my behalf. Here is what I want to say. My uninjured left knee is now worse than my service connected right knee. My Orthopedic Surgeon said that he cannot operate on my knees due to a recent blood clot I had behind my service connected right knee that lead to a pulmonary embolism. He would have to stop my blood thinner which would put me at risk. I also have two other serous conditions rated at 0%. that causes stress and anxiety.
A couple of huge errors that the va does and few pick up on. First IU is NOT 100%, in the older schedules IU ( the J rate) was termed as TOTAL. So when you see the word total you are talking IU which is less than 100%... a true 100% is the SMC L rate. Secondly, the VA uses the combined rating table for everything now, when in fact that table was for combining service and non service disabilities. The third mistake is that a 50% disability make you eligible for IU, not a 60% or more

@Jose, if you're already at 100%P&T there would be no advantage of getting unemployability added. 100% is paid the same whether it is 100% rated, 100% P&T or 100%TDIU.
We help vets here in Ohio with claims. One thing that drives us crazy is vets think they are 100%if they are drawing IU. No they may be 60, 70 80 or 90% and granted the J rate and deemed unemployable. That’s the Total rate.

Air Force 83-92, I was rated at 50% ervice connected combined in 2004, I just stopped going to the docs because it was 50 to 70 miles and I never felt any better. I haven't worked since 2007, bad back legs and neck, all muscle damage and arthorities in my joints and spine. I'm 55 I don't have much medical history. Because they only want to give me pain meds and I won't take them. I'm not a dependable worker, I have to many bad days. What are my chances of a I U claim? Ty

Weird question. I have a pending claim that will likely come back at 0% (once this comes back I’m going to sign the contract with y’all for other things) for a bilateral retinal disease. It’s genetic and the VA rarely gives compensation for genetic diseases which is what I’m basing my assumption on. The weird question is this- can someone with an incurable disease that’s rated at 0% be P&T? Figured it’s a solid no, but you only get answers when you ask.
I have 80% TDIU since Dec 2011. I was just awarded P&T last week and still getting paid at 100%. My letter says P&T no future exams. So my question is if I go to work one day will they take the TDIU away and only pay me the original 80%?
@Shaun, TDIU and P&T are different. You say you were awarded P&T last week. What does ebenefits say on your rating? If you filed new claims to get to 100% P&T then the TDIU would no longer be needed.

I received a 100% P&T but the VA deferred my sleep apnea, it looks like, because my sleep study was 2 years ago. I got a permanent profile about 2 years before I came off of active duty. My VSO told me not to appeal because I received 100%. I just received my decision letter a week ago and I still see the "pending" in my eBenefits to add documents. Is it worth it to get a new sleep study to get this service-connected? All of my time is active. I did a BDD claim before I retired. I use my CPAP every night and it does help. I am not at all overweight and I still have the issues. I had to get on BP meds because it was so high. I read the connections to cardiac and neurological issues like dementia and Alzheimers.
@Adam, If you are already at 100 P&T there is no need to worry about your sleep apnea claim as it wouldn't have any effect on your overall rating. Congrats on getting the rating and compensation you deserve!

Rashard Dennis It isn’t about being 100%. If you are entitled to SMC under the law then you should go for it. Of course you will want a good strategy in place

@Lucien, the only time the VA will reduce a P&T rating is if they file a new claim since anytime you file a new claim the VA can re-evaluate any of your currently service connected disabilities and find that it has improved. Or, they find evidence that you filed a fraudulent claim.
My paperwork says My paperwork says "You are considered to be totally and permanently disabled due solely to your service connected disabilities" with a 100% rating. So are you saying it's temporary?

Hi Brian, So I just retired in November 2019 and got 100% p&t right out the gate. So now what? Just sit back and collect my benefits? And how long it'll take to receive the compensation. I got my VA packet on December 15 with a pay date of January 1. But I didn't get paid. Does it take a couple months to kick in or what?

Nice, thanks! I came to see your video for the first time. Can you help me get my back pay? I was injured in 2001 and broke my arm. VA gave me such a hard time and caused me trauma that I gave up on them. A couple of years ago, I reopened my case and now am a 90%/94% disabled veteran. I had opened a case regarding my benefits to go back to 2001 but they closed my case and said I had not gone for the C&P examination in 2001. I never got that letter. How Can VA take away 21 years of benefits by saying that you didn’t show up for C&P Exam in 2001?

I'm looking at the same, to get a brain scan. Will you be a ct or mri or???? I had researched & found Cerescan that do nuclear brain scan that could point out the where's & what conditions you have. They don't do nexus or DBQs but I'm trying to have va take care of the 2700 bill. What's your TBI Neurologist testing being done. I have 1 sleep specialist/pulmonologist, 1 Neurologist for my migraines, a pain management dr for my neck & possibly eventually my lower back getting neck shots that all have lasted less than a day pain free or even less. I had appointments with a counselor at va. She noted in record mixed anxiety & depression but she wouldn't write a nexus or DBQ. I'm hoping to see a vaci provider that can hopefully level the field against some of these local & regional examiners that seem like we just matter. They see us for less than 10 minutes & can judge with the very slightest conversation. Why is it not allowed to have a camera recording a c&p exam again???
Advice for any c&p ecams... know the DBQs that should apply & know the answers to those questions. You should know if the examiner skips a question. If va c&p exams, wait a few days give or take & you can request copy of examiner's report. If 3RD PARTY, you have to wait to get from your c-file after final decisions of your claim.

Currently rated 70 percent from the VA. The VA denied me 70 percent for unemployability. I have to go in front of the regional board on 11/27/2019. I need help to win my claim!
I am 100% scheduler with one of my conditions being 50% sleep apnea rating as well. Is sleep apnea considered a Permanent and Total condition. Just asking because I want to file for P&T. Im also rated at 70% for my anxiety /adhd and I’m also 28 years old. I have many multi skeletal and other conditions service connected that all adds up to 100% scheduler.
I think you’re going to have a hard time convincing the VA that at such a young age there isn’t a possibility that some of your issues can improve your mind
It is possible, but I’d recommend having as much medical evidence as possible. You would definitely need a medical nexus letter to tie the secondary. My question is, I had already been at 60% combined, 10% for left knee and recently awarded 50% in November 2019 for Adjustment Disorder-Anxiety. I had Leah help me with Nexus for Gerd, Left knee degeneration Migraines and OSA, all of course well documented with Va for years. When I submitted those new claims a little over a week ago with all Leah's DBQ's and Nexus, I also noticed my claim stated I wanted an increase in Anxiety but I did not turn in a DBQ, only buddy letters and sworn statements. I have serious SSD because both knees are bone to bone and I need total knee replacements which I have to avoid as I am only 51 yrs old. My aim is to be 100% P&T. Should I wait for the verdict of the submitted claim then aim for P&T ? Thanks for all you do, God bless you brother. Rob L

Make time. You know the difference between 60% and a 100%? As long as you have the medical evidence and diagnoses Brian and his team will take care of the rest.

MrLegacy59 Sir the problem is not the money the problem is that too many vets think they deserve something for their service many have nothing wrong or the military did not cause their problems. I have soldiers that can’t receive the service they need, not want, because the system is bogged down. Two soldiers have already taken their lives do to lack of help. For example why is there fat vets trying to claim 100% disability for diabetes?

You need to talk to a VSO maybe they can help or call the DAV stop whining solider get off your ass and get busy ! And the Military does have 1trillon budget get the help you need and quit whining !
@@ronelioagcopra3279 Not really even sure what you're talking about but you are mistaken in any case. A 100% rating is only protected in the sense that the medical evidence must show "sustained material improvement" in order to do a ratings reduction proposal. P&T status does not ensure or guarantee any additional protection above or beyond this. It only means you are not scheduled for an RFE. If they get evidence you have improved you can be scheduled for a C&P exam. The only ratings reduction protections are given at 5 (static) 10 and 20 years unless fraud is proven by the VA. My husband was in Vietnam . We went through this process and it was nerve racking but at the end it was worth it of course. He went to counsel at the Vet center in Orlando for ten years before he agreed to apply. He received 100% p and t. We have gone through pure hell with ptsd. He deserved every bit of what he received, but of course 100% changed nothing with his ptsd. We have been married 50 years and it was a hard 50.
It will never be over, heartbreaking .

I have popping in multiple joints, I has arthritis in my shoulder, and elbow. I have knee pain on both knees the right knee is worse, I have ankle pain, and there is constant clicking, and popping. If you are truly disable you don’t need any agency to file for your claims. I was part of the Wounded Warriors Battalion West. I open this facility with General Matis in 2007 Camp Pendleton CA. I’m at a P&T @a 100% and did all the paperwork by my self. I’ve been 100% P&T since 2014. Truly veterans all you need to do is go to the Federal building and the VA disability claim office is there. Then go to any VA facility and start or open a file. Make sure you follow up and attend your appointments. Also if your family doctor have been treating you for any medical issues found in your military medical records are compensated. I’ve help hundred of Veterans throughout the years for FREE and I’ve seen most of the got increase awards and compensated awards over 50% plus. I’ve worked with our wounded warriors and the VA for over 20 years. You don’t need any agencies to file for your hard own claims.
@Vince, every veteran should exhaust all of their free options like a VSO. But not everyones claims are the same and some just don't know how to get started. We are here for those who need the help.
I'm 43. Just got back my claim from last year. Increase to 50% migraines, prostrating. Got total combined increase from 10% to 80% in November dropped to 70%. Gave me tdiu p&t!!!

@@atthebrink74 so what I stated was very VERY abbreviated. To start, I did navy 12 years from 94 to 06. January 05 I had a mva that I & then gf, now wife, survived. We were both brought to same hospital. What had happened on the I-8 was we hit lose gravel, vehicle swerved & I overcompensated a few times before front end of my explorer turn from the far left lane, towards and across the freeway spinning slightly, just enough that as we were facing oncoming traffic we hit the College Rd on ramp, me in the driver seat slammed against the door AND my head onto & bounced off because if the window was down & not able to stop my head flinging to my right... I would have likely hit the gravel/pavement with my head or more, possibly killing me. Instead as it rolled, my left shoulder hit the pavement & glass, giving me nearly road rash full of pavement & glass. I only remember though my gf waking me after she said she woke up. Luckily she had only gotten a hairline fracture in a pinky finger from the airbag. She was then very insistent on getting out of the car. Neither door opened so I crawled out my window, some old guy came to help. We both help get climb out, as her hands on my shoulders, as she pulled back once standing looked at her hand and thought I would die. We waited for the ambulance & got to hospital. I never mentioned about my head hurting. I was only 28 felt saying something would affect me in 5he navy. I didn't know. Anyway a year and half later I honorably discharged after having discharged exam, marking almost all boxes as no problem. The ER question made answer yes. The examiner asked a few questions & essentially I got 3 disability ratings: cervical neck strain @ 0%, scar left shldr @ 0%, & headaches @ 0%. Combined I got a whopping 10% & I thought that was what I got for life. Only 2 years ago during a contract temp service a airforce vet asked once after listening to my issues, said, "Have you ever been back to the va? Apply for increases or secondary added conditions?" I about dropped my jaw...I said, YOU CAN DO THAT??? From that moment, April of 2017 I researched a little but not much. Thought I would print my private med records & turn into a vso. The one I found didn't know shit or he would have asked for more than med records. Do I told him to not submit, he said I could do an intent to file (itf), January, well he did not. May I see if my now 3 kids are on my record, nope. I go to add them & no change there. From roughly April of 2017 to September of 2018 I got referrals to specialist to get evaluated, sleep apnea, apparently rls very severe, my lower back had been increasing painful the last decade too, most if not all my claimed conditions were to be secondary to my TBI...that I never mentioned about. I had got buddy statements & other stuff like nexus letters & DBQs filled out. The just wasn't enough evidence to support that I had...not having...TBI. upon submitting my fdc in September 2018 my first c&p 3rd party, great pa doing my headaches, my neck, my back brought me to 80% only partially approved. Neck went to 30%, back 20%, I think too my scar went to 10%, & migraines to 50%. Combined 80% the next 9 months I guess. I had submitted a fdc, but upon doing more research found out about smc and different amounts. I applied for other things, this added more home to complete. My first ETA to be done was January 2019, it ended up last estimated September 10 but actually finished August 14ish. All new conditions except back was denied as no connections to my TBI that also got denied. I got the year to apply, but likely & finally going to use VACI. I've watched many of their videos as well as many others to. Learned a lot & applied. Oh yeah, so april c&p dropped my neck from 30 to 20, overall Combined to now 70, but I got back pay. Wtf right. Finally got va paperwork. The tdiu I applied or made a letter or filled a form, to have my migraines being that they are prostrating or really bad have lay down in dark bad, even if at work & many times did. I had to quit December 2018. The granted tdiu went al the way back to December 2018. Anyway I recently learned after quitting I could apply for ssa or SSI/SSDI. Did thay this last January 2019. Denied at 5 months & again not 2 months later for reconsideration. Now that I have tdiu p&t, I think should sway any alj to approve my ssa disability both ssi fir the first 5 months before ssdi would have kicked in, so more likely another back pay. If that helped, good. If not asked something specific. Ty

Agree with Brian. If you have doubts at all. Call the VA regional office and ask if your service connected disability are rated as Static. If so, your safe. It's permanent. No more exam.

I went to VFW for VSO and they sucked. Switched to DAV and they are fairly decent but they don’t seem to be staffed well enough. If my appeal fails I will be coming knocking on your door. Thank you.
I went to VFW, by the time they called me, the person representing me went on Medical leave.
Right now I am working with a VSR to help with my current claims since the ratings board sent me a letter saying "We need further clarification on exactly what you are claiming.". The VSR has no idea why they are asking as everything was documented...lol!

Nobody who? Just asking for a bit more specifics? Your Va doctors or private pcp? My private was initially excited to help but gradually seemingly got annoyed because of how the wording was not stated correctly. Eventually I just stayed to keep my meds available. I even have a va pcp.
Right now I am doing all the va evaluations, but to get any help with the GI bill, regarding learning disabilities that I developed from head injuries etc. I dont qualify for a single program without a va rating. And the va has been taking their sweet time like they do with everyone. Ended up dropping certain classes and having to take others just to buy time.

My question based on what you've said and what I am reading/hearing is this:
Say someone is 28 years old and was pushed out of the service through a medical evaluation board. The VA rated them 100% P&T right off the bat. Does this mean, the only way that this can ever be taken away from them is if it is found as fraud OR the member decides to try and submit for something else (which they should not because it will make no difference unless they are reaching for SMC).
In short, if they are 100% P&T, they are good for life outside of fraud or reopening a claim. Is that correct?

I just got the p&t on my va letter and chapter 35. I have been 100 for 2 years and got the p&t after my re-eval for two that werent rated perm when first rated. I did read im not safe until 20 year because they can still look at my stuff and lower my ratings.

I have service connected COPD. I also have severe sleep apnea with a bipap. Have you ever done OSA secondary to COPD? I know COPD doesn't cause OSA but it does make it worse. It's called overlap syndrome.
Hey Boss! I am now 100% P&T, however, I have an appeal waiting to be reviewed by a judge im like 125,000 in line! When the judge sees my appeal can they revoke my 100% ? if so can I cancel my appeal so it never has to actually see the judge? Thanks!
@Christopher, first off congrats! Second once you're P&T the only way they can revoke a rating is if it was obtained fraudulently
@@VAClaimsInsider haha naw its legit, ive just heard horror stories of people appealing certain things, even things they arent rated for and the VA looking over the entire file and setting up more exams for stuff already claimed, but it appears that doesnt happen quite often if really ever.
If I move to another state, and the dr. at the new VA thinks I am better, can I be reevaluated if I am 100% p&t with no future exams scheduled? Also, if I quit going to my mental health appointments and/or quit taking my medications can they take my 100% p&t benefits away from me?
I would never recommend quitting your meds or changing anything without your doctors consent.

Until you reach 20 years with the same rating there is always the possibility they can lower your rating. P/t only stops scheduled evals. If you file for more disabilities they can look at your other ones and lower your rating.
I'm currently rated at 40% VA disability for seizures . Now I am working on VA rating increase for this service connected disability. Is it possible that the VA will increase my rate to 100 % for this disability?

Hello Brian, my situation is different. I was just awarded a combined rating of 60% for VA disability. My largest percentage comes from ED, OSA secondary to hypertension at 50%. I think I deserve more for OSA because my condition is so severe with paralysis, insomnia etc; that my Doctor said I was at risk of a cardiac arrest without my CPAP. MY left knee is secondary to service connected right knee was deferred although my VSO Representative faxed two Doctors nexus letters to the VA on my behalf. Here is what I want to say. My uninjured left knee is now worse than my service connected right knee. My Orthopedic Surgeon said that he cannot operate on my knees due to a recent blood clot I had behind my service connected right knee that lead to a pulmonary embolism. He would have to stop my blood thinner which would put me at risk. I also have two other serous conditions rated at 0%. that causes stress and anxiety.

A couple of huge errors that the va does and few pick up on. First IU is NOT 100%, in the older schedules IU ( the J rate) was termed as TOTAL. So when you see the word total you are talking IU which is less than 100%... a true 100% is the SMC L rate.
Secondly, the VA uses the combined rating table for everything now, when in fact that table was for combining service and non service disabilities.
The third mistake is that a 50% disability make you eligible for IU, not a 60% or more

@Jose, if you're already at 100%P&T there would be no advantage of getting unemployability added. 100% is paid the same whether it is 100% rated, 100% P&T or 100%TDIU.

We help vets here in Ohio with claims. One thing that drives us crazy is vets think they are 100%if they are drawing IU. No they may be 60, 70 80 or 90% and granted the J rate and deemed unemployable. That’s the Total rate.

Air Force 83-92, I was rated at 50% ervice connected combined in 2004, I just stopped going to the docs because it was 50 to 70 miles and I never felt any better. I haven't worked since 2007, bad back legs and neck, all muscle damage and arthorities in my joints and spine. I'm 55 I don't have much medical history. Because they only want to give me pain meds and I won't take them. I'm not a dependable worker, I have to many bad days. What are my chances of a I U claim? Ty

Weird question. I have a pending claim that will likely come back at 0% (once this comes back I’m going to sign the contract with y’all for other things) for a bilateral retinal disease. It’s genetic and the VA rarely gives compensation for genetic diseases which is what I’m basing my assumption on. The weird question is this- can someone with an incurable disease that’s rated at 0% be P&T? Figured it’s a solid no, but you only get answers when you ask.

I have 80% TDIU since Dec 2011. I was just awarded P&T last week and still getting paid at 100%. My letter says P&T no future exams. So my question is if I go to work one day will they take the TDIU away and only pay me the original 80%?
@Shaun, TDIU and P&T are different. You say you were awarded P&T last week. What does ebenefits say on your rating? If you filed new claims to get to 100% P&T then the TDIU would no longer be needed.

I received a 100% P&T but the VA deferred my sleep apnea, it looks like, because my sleep study was 2 years ago. I got a permanent profile about 2 years before I came off of active duty. My VSO told me not to appeal because I received 100%. I just received my decision letter a week ago and I still see the "pending" in my eBenefits to add documents. Is it worth it to get a new sleep study to get this service-connected? All of my time is active. I did a BDD claim before I retired. I use my CPAP every night and it does help. I am not at all overweight and I still have the issues. I had to get on BP meds because it was so high. I read the connections to cardiac and neurological issues like dementia and Alzheimers.
@Adam, If you are already at 100 P&T there is no need to worry about your sleep apnea claim as it wouldn't have any effect on your overall rating. Congrats on getting the rating and compensation you deserve!

@Lucien, the only time the VA will reduce a P&T rating is if they file a new claim since anytime you file a new claim the VA can re-evaluate any of your currently service connected disabilities and find that it has improved. Or, they find evidence that you filed a fraudulent claim.

So I just retired in November 2019 and got 100% p&t right out the gate. So now what? Just sit back and collect my benefits? And how long it'll take to receive the compensation. I got my VA packet on December 15 with a pay date of January 1. But I didn't get paid. Does it take a couple months to kick in or what?

Nice, thanks! I came to see your video for the first time. Can you help me get my back pay? I was injured in 2001 and broke my arm. VA gave me such a hard time and caused me trauma that I gave up on them. A couple of years ago, I reopened my case and now am a 90%/94% disabled veteran. I had opened a case regarding my benefits to go back to 2001 but they closed my case and said I had not gone for the C&P examination in 2001. I never got that letter. How Can VA take away 21 years of benefits by saying that you didn’t show up for C&P Exam in 2001?

Are you talking about your disability rating? You can find it on VA.gov under disabilities tab

I'm looking at the same, to get a brain scan. Will you be a ct or mri or???? I had researched & found Cerescan that do nuclear brain scan that could point out the where's & what conditions you have. They don't do nexus or DBQs but I'm trying to have va take care of the 2700 bill. What's your TBI Neurologist testing being done. I have 1 sleep specialist/pulmonologist, 1 Neurologist for my migraines, a pain management dr for my neck & possibly eventually my lower back getting neck shots that all have lasted less than a day pain free or even less. I had appointments with a counselor at va. She noted in record mixed anxiety & depression but she wouldn't write a nexus or DBQ. I'm hoping to see a vaci provider that can hopefully level the field against some of these local & regional examiners that seem like we just matter. They see us for less than 10 minutes & can judge with the very slightest conversation. Why is it not allowed to have a camera recording a c&p exam again???
Advice for any c&p ecams... know the DBQs that should apply & know the answers to those questions. You should know if the examiner skips a question. If va c&p exams, wait a few days give or take & you can request copy of examiner's report. If 3RD PARTY, you have to wait to get from your c-file after final decisions of your claim.

833 ratable conditions and it does not include the most common heredity condition in these United States.
Sean The VA has their reason for these things. They may not make sense to us but there must be some type of reasoning.

I am 100% scheduler with one of my conditions being 50% sleep apnea rating as well. Is sleep apnea considered a Permanent and Total condition. Just asking because I want to file for P&T.
Im also rated at 70% for my anxiety /adhd and I’m also 28 years old.
I have many multi skeletal and other conditions service connected that all adds up to 100% scheduler.
Individual ratings are not considered P&T. Unless you are scheduler rated at 100% P&T then any condition could potentially be lowered.
I think you’re going to have a hard time convincing the VA that at such a young age there isn’t a possibility that some of your issues can improve your mind

It is possible, but I’d recommend having as much medical evidence as possible. You would definitely need a medical nexus letter to tie the secondary. My question is, I had already been at 60% combined, 10% for left knee and recently awarded 50% in November 2019 for Adjustment Disorder-Anxiety. I had Leah help me with Nexus for Gerd, Left knee degeneration Migraines and OSA, all of course well documented with Va for years. When I submitted those new claims a little over a week ago with all Leah's DBQ's and Nexus, I also noticed my claim stated I wanted an increase in Anxiety but I did not turn in a DBQ, only buddy letters and sworn statements. I have serious SSD because both knees are bone to bone and I need total knee replacements which I have to avoid as I am only 51 yrs old. My aim is to be 100% P&T. Should I wait for the verdict of the submitted claim then aim for P&T ?

Make time. You know the difference between 60% and a 100%? As long as you have the medical evidence and diagnoses Brian and his team will take care of the rest.
You are going to have to find the time to see a doctor. It will make the difference. We have doctors as well but to be straight up with you, you will have to put in the time so we can help you.

MrLegacy59 Sir the problem is not the money the problem is that too many vets think they deserve something for their service many have nothing wrong or the military did not cause their problems. I have soldiers that can’t receive the service they need, not want, because the system is bogged down. Two soldiers have already taken their lives do to lack of help. For example why is there fat vets trying to claim 100% disability for diabetes?

You need to talk to a VSO maybe they can help or call the DAV stop whining solider get off your ass and get busy ! And the Military does have 1trillon budget get the help you need and quit whining !
P&T is not a "protected" rating.
The only protected ratings are given by time (5,10&20 years) You can be reduced from P&T, happens all the time fella.
Unless you are static on all your service connected disability. Check your records with the VA call 18008271000.
Not so, you must be a Schedular. P and T is different all of us are rated STATIC.
@@ronelioagcopra3279 Not really even sure what you're talking about but you are mistaken in any case. A 100% rating is only protected in the sense that the medical evidence must show "sustained material improvement" in order to do a ratings reduction proposal. P&T status does not ensure or guarantee any additional protection above or beyond this. It only means you are not scheduled for an RFE. If they get evidence you have improved you can be scheduled for a C&P exam. The only ratings reduction protections are given at 5 (static) 10 and 20 years unless fraud is proven by the VA. Get into the actual CFR man... Do some reading brother.
