Good for this guy. Ended up winning 100k in damages. He genuinely seems like he’s telling the truth. Seems like PHX was rushed in closing this case and were narrow visioned on this one guy.

There are countless people who have given false statements, and confessed to crimes they never committed because of the methods used. @@te8828 I have no stats on the number of innocents jailed but I guarantee you a small number of prosecutors among the those thousands of jurisdictions want convictions and aren't too particular about who goes down as long as it's a fellow scumbag. The system is imperfect but it's the best we have.
@@avelinaosborne32 I believe it’s roughly around 4-5% which is way to high. And you’re very correct. There are plenty of inmates who weren’t able to afford a lawyer, and got a public defender. Someone who works for the state, and free to his client. They often take the route most traveled which is a plea deal. When someone is facing 20 years for something they didn’t do but there isn’t much evidence to prove it. They take a plea deal and take a fraction of what’s being offered. It’s sad that there are people in this country that believe every single person in jail/prison is guilty.

DPS' missteps in the investigation, chronicled in Merritt's lawsuit, drew scrutiny.
Shortly after the shootings began, investigators tapped the state crime lab to try and identify the type of gun that had fired bullets recovered from four of the crime scenes - a Hi-Point, 9 mm C9 handgun, the crime lab reported.
It's a model with about 286,000 firearms in circulation.
On Sept. 17, 2015, a rookie detective went to various local shops, including Mo Money Pawn in Phoenix, and collected a Hi-Point, 9 mm C9 that had been pawned by Merritt Aug. 30, 2015.
At the time, it seemed the detective had hit the investigative jackpot. Investigators who analyzed the four crime-scene bullets said with “100 percent certainty” they were all fired from Merritt’s gun, according to the lawsuit.
But detectives soon learned there was a snag in the theory: According to shop records, Merritt sold his gun at 5:31 p.m. Aug. 30, but the final shooting his gun was linked to occurred four hours later.
“In other words, DPS recognized that only one of two scenarios could be true,” attorneys wrote in the lawsuit. Either "a) the crime lab had botched its identification or b) Incident D did not occur when Merritt’s gun was at the pawn shop.”
Ducey was among those named in a notice of claim filed by Merritt's lawyers who sought $10 million. The governor was left off the eventual lawsuit, Lamm said previously, because they didn't think it was "appropriate for the taxpayers to have to foot the bill for basically what amounts to a split-second error in judgment.”
Merritt remained jailed until April 19, 2016, even as he and others highlighted gaps in the investigation - most notably that shootings continued even after he pawned the gun that investigators said linked him to the crimes.
He was released from custody after a ballistics expert challenged the evidence that led to his arrest. Maricopa County prosecutors dismissed the charges against Merritt without prejudice, leaving open a window for prosecutors to refile charges in the future.
They have seven years to decide whether charges will be refiled against Merritt.
To date, investigators have not named any other suspects in the freeway shooter case. The Department of Public Safety has remained mum about any work being done on the case.
On September 11, a man and woman driving a car were taken into custody in relation to the shootings. The woman was later released, but the 19-year-old male suspect was kept in police custody, as sources stated that he boasted about the shootings to friends. He was later arrested on an unrelated marijuana charge.[7][4]
Road debris shattering windows also played a role in the investigation, as shattered windows were often investigated as being part of the spree. For example, on September 16 a driver reported his windows being shot by a car that he was seeking to pass, but police later stated that road debris caused the window damage.[8]
Three 18-year-olds with a slingshot were arrested on September 13 on claims that they had been making copycat attacks,[9] and the three admitted to targeting cars and pedestrians. They were later released.[10]
Leslie Allen Merritt, Jr., age 21,[11] was arrested in Glendale on September 18, 2015.[12] Police initially claimed that Merritt held anti-government and anti-police views.[1] One day after his arrest, police claimed that they had linked the first four shootings to a pistol owned by Merritt.[13] The weapon in question was later shown to have been in a pawn shop at the time of the 4th shooting.[14] He was charged with fifteen felony counts, including carrying out a drive-by shooting, aggravated assault, unlawfully discharging a firearm, disorderly conduct, and endangerment; prosecutors also considered filing terrorism charges, but ultimately did not, as terrorism-related laws focused primarily on protecting public utilities and did not encompass freeway shootings.[15][16]
All charges were dropped in April 2016. Merritt was formally cleared of all charges and records were sealed in an August 2020 proceeding with Maricopa County Superior Court Judge William Wingard presiding, who stated "Leslie Allen Merritt Jr. has been cleared of any allegation or charge, and such a finding is in the interest of justice."[17]
Merritt filed a lawsuit against state officials,[18] which went to jury trial in the fall of 2020.[19] The jury returned a finding for the defense, which Merritt appealed in April of 2021. The appeal was denied by the Arizona District Court.[20] Merritt ultimately received a 100,000 dollar settlement concluding the countersuit.

I gotta say this dude really embodies an American. Trying to help authorities, open to questions, works a hard labor job, and practices good gun safety to protect his kids. Honestly all around decent dude. Really sucks he got treated this way, and tbh his 100k seems a little on the low end of being falsely charged for over a year. Especially because we've all seen people get millions just for getting yanked out of a car too hard.

And you can tell he’s lying because he’s on the defense, dropping F bombs and raising his voice which are indications of a cover up. How crazy would it be if someone from the pawn shop used his gun and then put it back before anyone notices.
In car dealerships, some car sales men and managers use customers cars sometimes and I even saw on live Pd a mechanic who drove a customer’s car and he was arrested I think he was intoxicated. Never trust anyone
That only explains the last shooting that they say was at the pawn shop. From my understanding the other 3 he had the gun at the time.
@@ThePurePlayaz The question is, did they actually have ballistics evidence that PROVED his gun was the 1 used in the shootings or did they lie ? It's not illegal for cops to lie in interrogations. Ballistics evidence isn't always as cut and dry as cops and prosecutor's often claim.

It seems all they had was images of his car on i9 and some facebook posts..... and perhaps that a 9mm was used in the shootings (but not proof that it was his 9mm).

He lost his court case, it’s in the description. Appeal was a no go as well. The $100,000 was a settlement so he would stop his pursuit in court. He probably didn’t have time or money to keep fighting in court. I feel he was railroaded. The cops and the courts messed up here.

pretty scary stuff, contrary to what the detectives are saying, it is supposedly very hard to pull fingerprints from a fire arm due to the oil on it.....as far as the rifling on the bullet, that has been shown to not be that reliable is what I have read, but maybe I am wrong.....as a machinist, tool marks are unique, but with 350,000 of those pistols, it could be possible to have a very similar pattern of marks, because the tool used to make the marks might be the same tool....Poor guy sure is taking some BS from those guys, he probably thought getting a lawyer would just keep him there a long time and he wants to go home at 10:30 at night......not realizing they are digging a hole to put him in......as every one else has written, get a lawyer they have to supply.....and do not say anything...he also might have thought he did not have the money for a lawyer, as he was pawning the pistol every week......I feel for him......bravo for winning against the state.....

This is a perfect example of how law enforcement are absolutely terrible at reading body language and judging when someone is lying to them. Law enforcement who believe they are great at judging people's lying and body language have absolutely no idea what they are talking about. It is scientifically proven that police have a cognitive dissonance when it comes to reading body language or gauging someone's reaction to a tragedy or crime that happened around them. Police should not cannot and will not be objective judges of lies or character or body language or reactions or grieving or any of those things.
Body language reading is mostly bunk and should not at all be used in determinations of guilt or innocence. There are a few aspects that can be useful, but that is mostly in the application of body language in a psychological manner. For example when conducting an interview (positioning and stance taken when interviewing), and in using it as a soft coercive technique, in telling a subject they look like they need to get something off their chest etc, in that case though it is deception based, as people can react very differently in different situations. Other than that kind of thing it it bunk science, and we need less bunk science in law enforcement, not more.
@@adoredpariah I don't know if you read my comment or not but I fully agree. Body language is not science. It was proven to be inaccurate and unreliable thus discrediting it. There is now a consensus among the majority of peers in the field saying that body language is not good science thus excluding it. You are absolutely correct though it can be used mostly by the FBI during interrogations of almost certainly known to be guilty subjects.

The entire point of my comment is that police believe that they are experts at reading people's body language. The police believe they are expert at telling when people are lying. The police believe these things to be scientifically accurate and valid. Police believe that their gut feeling is also scientifically valid because police are often uneducated or very low IQ and not scientifically or intellectually curious individuals. Unfortunately law enforcement does not exactly attract the most intelligent of individuals.

People that believe they can read body language are just fooling themselves because you have biases that come through that you can't control and don't even know exist. Science proves body language is not a credible or reliable source of information. The FBI uses body language analysis as part of a package of tools but never on its own and alone. When you mix multiple tools together you can get an accurate picture of a subject. Using only body language analysis you cannot get a accurate picture of the a subject. It is just science go ahead and Google it for yourself you don't have to take my word for it. It has long been thought that body language analysis was a credible source of information but it has been shown to be inaccurate.

I apologise if I misunderstood, it's just there are a lot of people who put way too much faith in body language, so I was being comprehensive in my response.
On the point about low IQ cops, that's a bit harsh (and I am no great defender of police either). I think there are a lot of good and intelligent cops but these interviewers in particular were relentlessly applying some very dirty tactics in a bullheaded manner. I have serious problems with that kind of approach when it comes to obtaining confessions.

Lazy cops putting heat on a poor guy. This happens all the time. I worked graveyard at a popular wealthy neigborhood. I robbery happened at the shopping mall were the dinner was. A cop came in with a picture of the suspect. They asked me if I recognized him. I said not really. They wanted me to testify this guy was at my dinner the night of the robbery. I told them I could not confirm it. He looked familar but not certain. This cop said we know this guy did it, we just need your help. This cop kept pressuring me to sign a statement that this guy came in that night and to help them because they knew this guy did it, they were certain of it. I was in my mid twenties. I should have reported them, but I was young never trusted them anyway and didn't want blowback if I did report them. Alot of Cops are lazy, they lie , they don't care they want a easy life. Not all are like the movies. Corruption of cops should be NOT acceptable. This is two cops, not one, its recorded the supervisor or someone should have seen this. Good cops need to clean UP their work place . Its on the good ones to say NO MORE

I went through an experience back in April 1, 2016
6 days in Parker County, TX. Jail and NOT booked in ! Sting operation, came and got me in a completely different county on my way to work. Searched my car with the K9 . Nothing. I was the wrong person! Same name as mine But, spelt differently, she had a lot of tattoos. I have none! And to top it all off She was a big time dope dealer with a big rap sheet! I’m just a simple NOBODY!! The twist in this jacked up situation I was put into is the fact that they already had her in jail! It was insane looking back especially when I see stories of innocent people getting accused of something that they had absolutely nothing to do with!🤬 They tried hard with me but, when you’re innocent you’re innocent!!!!!
