The Mercedes in the crash is most definitely at fault. No doubt about it. They one, passed on the right in a bike lane, second if they claim they were going right then, the speed wouldn't have been so fast.
The Mercedes driver could argue that the Prius wasn't moving and thus was an obstacle. As such they went around the obstacle. Also while the Prius driver did take a little while to get going, Hiren really should have just been more patient and waited for the Prius driver to go and this whole thing wouldn't have happened. Likewise the Mercedes driver should have been more patient and not gone around the Prius. I think the Merc was the bigger jerk and should be responsible, but Hiren should have also just waited...

Here it would be "Illegally passing a car to the right", "Illegally driving on a bicycle lane" and since he also crossed into the turning lane it would be "Illegally going straight from a turn lane" plus offcouse "illegally crossing a solid line".
I bet here, the police would give the Merc driver 100% fault but the insurance companies would probably split it, so they could hike up both drivers insurance premium, especially of they both have the same insurance company.
And he didn't use his blinker which makes him in deep water
@@jdub2k997yeah was gonna say the same. Prius was sitting there, and theres an extra light or two, im gonna guess and say that theres a left turn arrow. It didnt show up, so technically the prius has the right of way, thereby impeding right of way.
Mercedes at fault for using the bike lane and passing through a turn only lane
Considering the Mercedes made an illegal move going into the intersection and the Prius was in the actual lane, it should be the Mercedes’ fault. The Mercedes is not a bike.

@@Playingwithproxies You could just as easily say if the Tesla hadn't made an illegal turn, the Mercedes wouldn't have had a problem. The instruction is Left Turn Yield. It doesn't say Left Turn Yield Unless You Can Go Fast Enough Because the Other Driver Is Being Slower Off the Line Than You Would Like.
In some places, fault is actually determined by who had the last chance to prevent the collision. In this case, the Mercedes most likely had the ability to stop in time, or at least slow down , while Hiren was in the middle of the turn and had no such ability. If not using that rule, the Mercedes is still at fault. How would Hiren expect the Mercedes driver to go through the bike lane, which is illegal? The Prius was still stopped, so he did follow the sign to yield for that car. If you closely watch the video, Hiren starts his turn while the Mercedes is sill behind the Prius, either looking like it was going to stop behind the Prius or rear end it. I guess Hiren could take some fault for not yielding to a car that was in a not-legal lane, but the Mercedes should take at least 75% of the blame.

Actually one better......in most if not all states it is illegal to pass on the right on all roads...thus making the mercedes driver completely at fault not only for the the pass but he was also completely in the bicycle lane when he did it which is another infraction in a lot o US states...not to mention the Mercedes was passing at an intersection - another no no {No comment for other countries, as each country as their own rules on incidents like this}
The officer investigating should have caught all of these and started writing tickets for the stupidity involved

Don't lean or sit on a car if it's not YOUR CAR. Years ago, I was at work and going out to my truck for my lunch break. It was parked no the side of the building. I turn the corner to see a group of people standing behind it and three of them sitting on my tailgate. I immediately lost it and started yelling at them. "We were just sitting!" They got in their cars anf left.
How do people even feel comfortable doing it? SMH. So entitled.

Ugh yeah! Can’t relate given I own a small sedan, but I’m very possessive of my property. No touch! As a kid I rode my bike to a neighborhood party. I caught my brother’s friend leaning on the kickstand side of my bike. I told him to get off and stay away from it. He ignored me, I heard a sound. Unsurprisingly my bike fell. Caused a hole in the handlebar grip. Fine, whatever. However, this bike had gears. On the opposite side from the kickstand. Next time I rode it, went up hill and changed to a lower gear. That fall had damaged the gears, and when I changed the wheel locked up. Got it repaired. Years later I started riding it a lot and very hard, and that issue arose again. So yeah. Same principle lol, just not a car. Yes I’m still bitter, and it has to have been at least 10 years
I had a homeless man sleeping on the hood of my car while I was at work I looked out the door when I was about to go on lunch and saw him just sunbathing and sweating down my hood I just hit the alarm and watched him jump up and run 🤦🏾♀️ I had matte paint on my camry with his body imprint left like I hit him 😮💨
You are funny. You have kids? Do you allow the neighbor kids on your lawn? Do you allow people to ring your doorbell? You had a chance to converse with them and maybe you would have found something in the future you could use. Not that you would use anybody. You are just portraying a type of road rage and entitlement we see so much on this channel. Watch out for the store that says you touch you buy. If the cops didn't make the mercedes 100% guilty, clearly those cops are incompetents or have been bribed by someone connected to the mercedes side.
The mercedes wasn't on a lane, he made an illegal move being on the green path.
Lets assume he was on the mandatory right turn lane, but he went forward throught he intersection.

Since we're assuming, let's assume the Prius was broken down and the Mercedes was driving around the disabled vehicle in the empty bike lane. Now it's the responsibility of the Tesla to yield to oncoming traffic, which he failed to do.
Since this was in ca, the Mercedes can argue that the car in front was not moving and they only moved to the bike lane momentarily; the tesla failed to yield regardless if the traffic was moving or not. The driver wasn’t patient. Neither were, but if we’re going per ca rules then Tesla is at fault
@@ricardon8869 Also consider that the act of driving around the Prius created a blind spot for the Mercedes in the form of the Prius. So blind spot rules apply here.

In some areas, a basic rental car is 90+ bucks per day now. In the Dallas-Fort Worth area, the average price for the smallest rental car class is now around $60 at this time of year. With taxes and 'airport rental fees' it can be even higher. Some policies or local laws around the world require the at fault driver's insurance provide the same or a similar car if at all possible, so that's going to be way more expensive.

There is no doubt that the Mercedes driver is 100% at fault. He broke the law and that is what caused the accident. Even if the Prius was broken down he would have had to stop behind it and then, after making sure it was safe to do so, use his indicator and slowly and safely passed the Prius. The Tesla driver in all probability could not even see the Mercedes since it was behind the Prius from his point of view.
Left Turn Yield on Green.
You could completely see the approaching traffic and your reaction time at a light over another driver does not negate the instruction to yield. Half the reason for yielding is because cars are crossing the intersection regardless of if you like how they are crossing or not.
@@AveragePicker I think that ur missing the fact that the car he was supposed to yield to was letting him pass, and the mercendes flew thru a BIKE lane, he don't look no bike to me.
I'm willing to bet the "confusion" the police are having figuring this out probably has to do with the fact that the Mercedes driver is a cop or a VIP to a cop....im guessing lol

4:30 "David" Car scratch. This was in Squamish, BC, Canada. Not sure why they only included Canada. Thank you for taking a look! This keeps happening on trails in the local area, it be great to catch the vandals and save other peoples cars from similar damage.
Does it happen just to Tesla’s, or all kinds of cars? That woman looked Chinese, and there are a lot of Chinese in Canada. China also is trying to make Tesla look bad because their EV cars are well received compared to domestic EV’s.

The repair costs are absolutely wild for these teslas.
A big part of it is price gouging by "Tesla Certified" repair shops that have limited competition.
Then again, collision repairs on any modern cars can be quite expensive due to all of the sacrificial crash structures involved...
Even relatively minor fender benders can "total" a modern car if there is full airbag deployment.
Personally, I'd rather have the car be totaled and to walk away from a crash alive, with no serious injuries, than leave behind an inexpensively repairable car.😉
It's why we shouldn't buy them. On top of the environmental issues that come with the manufacturing of the batteries.

Clearly you have not seen repair bills for any car. My woman's KIA was hit in a parking lot. Just dinged the front finder and crushed the headlight. Total cost? $3200 on a car worth just over $6k. They almost totaled it. Biggest surprise? Paint matching cost was $1200!

While Herin had a duty to yield, the Mercedes driver's unexpected and potentially illegal action was a major contributing factor to the collision. I think the final determination of responsibility would likely apportion some degree of fault to both drivers.
Kudos to Tom for sharing and being honest about his mistake. It takes a lot to share something like that. Sometimes, we all need that reminder.
If he had FSD, the car would’ve stopped at the red light for him.
In Ontario, Canada...running a red light will cost you $325.00 + 3 demerit points against your driver's license. If you reach a total of 15 demerit points, you receive an automatic 30 day suspension! Not to mention that with demerit points, the cost of your insurance rises drastically.
Insurance cost is rising in Canada none the less . Matter of fact you just have to own a car , insurance companies will do the rest
In germany you can get a maximum of 8 points, and your licence is gone for good, after 6 month you can get a new one, but just when you pass a difficult test that should prove you are able to follow the rules of being roadworthy again...

@@IIGrayfoxII yeah, some years ago you could collect 16 points, but when you got new ones, the old ones being erased later. Now the points disappear after 2-5 years (considered the seriousness of the offence) what is better. You can get for instance 1 point when you exceed the speed in the city over 21 km per hour.
In the first clip, the Prius driver was being courteous and allowing him to make his turn. The Mercedes, coming from behind the Prius conducted a pass on the right and through a bike lane, both of which are illegal actions. If I were writing the tickets, they'd all land in the lap of the Mercedes driver.
Another driver being "courteous" (and personally I think they were just slow to react) doesn't negate your responsibility. We see that later in the video where the person turns left through a line of cars. Someone waves you to go, you better double down on your alertness. The point of the yield is for traffic passing through the intersection, doesn't matter if they are passing through it in a way you like or not.
@@AveragePicker That was single-lane traffic, so the Mercedes acted illegally. It has nothing to do with like or dislike of his driving. He had NO business passing on the right, where a traffic lane didn't even exist. Let me know when you're driving so that I can stay home to avoid your stupidity.
@redrider7730 It doesn't matter if they used it or the right lane. The instruction is to yield on green. The scenario where there's no accident is where the tesla yields. If the Mercedes crossed and turned right, they have hit as well. And when driving you should expect the unexpected. If he'd probably yielded, no accident.

@redrider7730 Well I would yielded and not been in an accident. Don't care if someone else is using a wrong lane. That's part of why you pay attention and do things like yield. So 🤷🏽♂️ say what you want, never once been in an accident.
In many areas the white line is considered a "traffic control device" and crossing it to pass on the right is considered a violation. Also, passing on the right is often a violation.
9:49 The Fireballs are shot in the air by Crown Casino Melbourne at the turn of the hour. It's a beautiful photo to take
#1 11:15. The casino is Crown Casino in Melbourne and ever since it was built in the 90s it has had the gas jets to cause fireballs every 30 mins each evening for special effect. They make quite a roaring sound for the couple of seconds that they operate. The road he's driving on is Kings Way, which passes through the middle of the casino, then across the Yarra River which flows through the middle of the city, right next to the casino. The view from the city side (opp. the casino) is quite spectacular as the fireballs erupt.
I've been to that casino, that fireball show is pretty cool.
If you go to the Casino Floor level there is an outside bar/balcony. The heat from those towers can be felt and not in a little way. Great place for a few Bevvies.
That remote fart sound effect is a hillarious way to get people to stop leaning on your Tesla. Even more so if there's people around: "It wasn't me... it was the car!" 😂
It’s totally the other guys fault. The Prius was letting the guy turn.

If you have the right of way (prius) you are obligated to take it. If an accident occurs you are at fault for not taking it.

I had a brain-fart myself when turning left on a red light at an intersection. The green light was unusually long for the opposing traffic due the large amount of people needing to turn on their left (we have traffic-aware lights in Ontario). When there was an opening from straight opposing traffic, I turned not realizing my light was still red! Bound to happen statistically. We are imperfect creatures.
I was working in a bank IT department near that casino during its construction. After the towers were built birds nested in the top. They didn't check before they did the first test and it ended up raining down flaming birds.

I remember when we had bumpers, not bumper covers. There was a reason for the former and no reason for the latter.
A good ol' chrome plated steel bumper was a wonderful thing. I have an old Jeep Cherokee and they came with normal bumpers, but they're thin metal. I replaced mine with custom made, 1/4" steel square stock that's mounted onto the frame. I pity the fool who pulls out in front of me and gets centerpunched. An old man commented that the front was a "Deer Slayer."
The latter is to improve aerodynamics, to get better mileage.

Number 15: Tesla is not at fault, the Prius might of been on cell phone and wasn’t paying attention to the green light had change; however, if you notice on the Mercedes, he wasn’t suppose to do that at all so the Mercedes finds it at fault!!
@0:30 Cleary the Mercedes was at fault. It's illegal to overtake other vehicles in a turn lane. Also, the Mercedes was mostly in the biking lane.
The Tesla entered the intersection before the Mercedes.
However, if the Mercedes was making a right hand turn and there was a collision then right of way laws apply.

Tom is a stand up guy. Mistakes happen, and glad that all of us can learn from them.
Every time I see the cost to repair the Teslas seen in accidents, it makes me definitely want to stay away from owning one. Those repair costs are just insane compared to most other vehicles.
While the repair costs really are high, there's no substitute for vehicle safety. Right now, the safest cars on the road are all Teslas. If it means my family has the highest survival chance, I'll put up with the higher repair costs. Oh wait, no I won't... I have insurance to pay the repair costs.
Some insurance companies do charge higher rates for Teslas, but a lot of them don't, as the higher safety scores offset the repair bills. My insurer charges the same to insure a top of the line Honda Accord as it does my Model 3 Performance.

1:48 first dash cam now teslacam!? thats two episodes back to back that have featured my home town! i dont know what to say except thank you to the submitters and the wham baam crew for featuring our fine city
Definitely the Mercedes. My son was in a similar situation, though there wasn't a second car on the oncoming. He was turning left and when the light changed the oncoming car just sat there. So, after a bit he started to turn and then the other driver started to go and hit my son. The police found the other guy at fault. He admitted he had been looking at his phone at the time and didn't see my son's truck.

That casino is Crown Casino in Melbourne. On the hour in the evenings, the casino does a fire show from large pillars. It's really cool to stand next to and feel the heat. I actually thought they had stopped this fire display a few years ago, shows how long I have not been to the city.
2:00 - If you find yourself having to brake hard, make your car bounce.
Pressing down hard on the brake pedal and releasing it several times will get the attention of the people behind you much better.
I don't know about bouncing but I find that if I have to make sudden brake at night, I'll tap my brake several times quickly before braking so the people behind me get the hint. We're trained to pay attention to flashing lights.
The 5th one was foolish if you see cars stopped in front of you in another lane you should slow down and check why that is I always see these videos of this happening just like the 4th video people moving so fast past cars that are stopped not thinking something may pop out in front I always slow down and when I get to a intersection I stop like it's a stop sign to avoid this 😅

You'll get a warning about running a red light if you're in AutoPilot. Being a security feature, it should be in all mode, including manual driving in my opinion.
The fireballs at the casino (Crown Casino, Melbourne) are a show that lasts a few minutes and occurs on the hour every evening.

The single most important thing I've learned from watching your channels is that Tesla's are Fragile. You can praise their power and features all you want but they are like a boxer with a glass jaw, one good hit and they're down for the count.
You do know that the more of the kinetic energy a car can absorb through deformation and so on, the less kinetic energy you as a driver will be subjected to.
The whole idea is to make the car absorb the energy to protect you. It is a lot easier to get another car, than it is to get another you.
So yeah, the car sustains a lot of damage, which could be viewed as "The car being weak" but in reality it is the car "protecting the people inside".
Might also be why the Model Y has the best EURO NCAP rating of all cars ever tested right now.

@@JohnDoe-bd5sz Most if not all modern cars have crumple zones designed to take damage so the occupant doesn't. However, only Tesla's are totaled after a minor bump or scratch.
That fender bender looks to me like it could have been buffed out but it needed a new tire and SUSPENSION!!!??

I truly think this channel was all I ever needed to know that I'll never own a Tesla. It's nice to have the cameras... but a minor fender-bender often costs $20k in repairs and more often than not means a 2+ month wait to have your car back from the shop. He would probably have a lot more luck if he posted the video to some local facebook sites, if she was local i bet she would be found quickly.
Offcourse where i live that would be very illegal, you are not allowed to post stuff like that, it would violate the perpetrators rights and it seems their rights are a lot more important than the right of the submitter to not have his car scratched.

I am a retired accident reconstructionist for a PD and in most states you cannot be expected to yield to a vehicle breaking the law. In Hiren's case the MB would be at fault because it passed on the right, in a right turn only lane and crossing into a bike lane. Hiren cannot be expected to know the other driver would break the law and yield to it or no traffic would move. If he struck the Prius, it would have been different. I would have cited the MB driver for passing on the right, failure to obey a traffic control device (right turn only sign and bike lanes), improper passing and failure to control speed to avoid collision.
I'm no cop, so I can't say for certain, but I'd call this a split fault. Hiren by law technically was supposed to wait despite the Prius not going, the Mercadies on the other hand illegally entered the intersection using a non lane. I for one wouldn't have turned, I may have even honked to get the Prius's attention, main reason is I wouldn't have wanted to be crossing when the Prius decided to wake up, especially if they were trying insurance fraud.
You don't have to wait if some dummy is sitting there picking his nose, out of gas while delivering his wifes baby at the light!
Case 1 is simple. Police issue a citation for Hiren for Failure to Yield (the other car not moving does not give you permission to turn) and multiple citations to the other car 1) Passing on the right, 2) Failure to turn in a turning lane, 3) Reckless driving . Then let the drivers challenge them in traffic court and let the judge decide.
The other car not moving, does in fact give you permission to turn. That's what yielding is! Yielding is not stopping and waiting for the next person to go. It means to slow down, check your surroundings and continue when safe and clear. If the prius was not moving, it was safe to turn.

For the first clip, all parties involved share responsibility for the accident. Tesla for failure to yield right-of-way (even though rational people will proceed when whoever has the right-of-way will not go), the Mercedes for utilizing an improper pathway, and the Prius for impeding at a green light
In the first clip, the Merc is at fault. Over-taking in the bike lane and going straight on a right-only puts the Merc at fault.

Yes, the Tesla was expected to yield to oncoming traffic - NOT turning traffic. The Mercedes was A- Speeding. B- Utilizing a bicycle lane. C- Utilizing a right turn only lane for through travel. D- Failed to use turn signals (unsafe lane change). E- Reckless driving.
Ergo, as the preponderance of action on the part of the mercedes causes the resulting collision they should carry the greater liability for the collision. The Tesla driver should then sue them in civil court to recoup their 30% responsibility (failure to yield to through traffic, legal or otherwise) and 2x costs to repair their vehicle.
