      Brian Waller the first income tax was a flat 6%. we need to go back to that and just privatize most government functions so we don’t need to collect too many taxes. the top 1% pay 40% of all taxes while the top 50% pay 90% of taxes while 25 million people didn’t make enough or work at all to pay taxes yet they collected 63 billion$ worth of government funds. freaking mooches

      Drew Pierpont How I was raised if I did work for you and you accidentally overpaid me I’d give it back to you. I didn’t earn it and your mistake isn’t my gain. Also if I discovered you underpaid me I’d expect you to pay me what we agreed to. And aside from this, if I shook your hand and agreed to do something that I later regretted, I’d finish the job even at a loss .... because I promised you. It’s just old school; that’s all.
      Don’t get me wrong, I know that most people would agree with you and have no pride or moral standards. It’s just the world we live in today. You weren’t taught better.

      I had a similar thing happen to me. I noticed my check was up a bit and I called my boss. She told me that I'd gotten a cost of living raise. I was happy with that and I went and got myself a dollar burger over it.

      amended return. 3 years with federal so beyond that too bad. also increases your chance of being accused of fraud so be very careful.

      Reimbursement or mileage is not taxable. So, they didn't pay income tax on that. And there is no way these folks didn't realize they were getting paid too much every single month.

      Her pay is probably not regular. She more than likely got an irregular amount and it threw her off. This is not the first time this has happened to people. It may be different if her pay all of a sudden doubled.
      Her $68,000 per year is $5600 per month and a $800 change on this probably did not seem unusual. Especially when taxation and contributions are thrown in it really gets confusing.

      That might work with a private employer. This is the county government. They'll get the money back one way or another. It's a question of how do you want them to go about it, working with you on a payment plan or using the force of government to seize your property? If you fight the repayment you lose your nice county government job with 21 paid holidays, 4 weeks paid vacation, and probably a government pension. Risk versus reward doesn't compute in this instance. Regardless of who made the mistake, it's also the right thing to do.

    I got overpaid by a massive fast food restaurant when I was 18. They accidentally put my hours worked, as my hourly wage. I was a kid who didn’t know any better so of course I was stupid and spent the money. They had a lawyer contact me like 6 months later when I didn’t even work there anymore. He said you can either pay it to me now, or I’ll see you in court. I didn’t have the money so I said ok see you in court. I never heard from their lawyer again, so they are either didn’t have a leg to stand on about the mistake or didn’t want to bother pursuing it. That’s all I can say from personal experience without knowing the law.

      It's usually the company at fault for these things where I live I believe the line is reasonable so if it's say 3x your wage that's not reasonable but and extra hundred is that said from my understanding most employers take it as their fault and treat it like stupid tax as long as it's within reason

    You paid taxes on that 30K.....I would deduct the taxes from it and let them figure out how to get it back from the gov't. BTW....the FICA taxes dont show up on your 1040.

      If might depend on how she was paid... he said it was some sort of reimbursement (i thought he mentioned mileage but then later mentioned retirement), and i think some mileage reimbursements may not be taxed, with the caveat that you cannot claim mileage deductions on your taxes.
      I mean, it's pretty likely that she paid taxes on it, but maybe not.
      Also though, this was effectively a zero interest loan... so she kinda won there...
      If we are going to consider taxes though, that extra $10k each year might've pushed her past the limits for all kinds of deductions, especially on state taxes. I wonder if they'd benefit from just refiling for those years, and if the tax break could offset paying this all back in 1 year (so she'd only make $38k this year... which is livable if he's working too)

      Because they knew all along what was going on and how much they were overpaid. But instead of bringing it up and getting it straightened out, they just took the money. Bonus points for spending it instead of saving it just in case they had to pay it back. I bet they'll be... err... wonderful parents.

    I was overpaid 3 months in a row at a small mom and pop supplier. I worked 100% commission based so checks would always vary. The owner called and he said, “How about we split the difference from my mistake?” So I repaid him half and got to keep half and thought that was a fair deal.

      Lindsey Costa that simply means that you cannot present the pay advice at a bank for cash or deposit. When you deposit/ cash a check, you have “negotiated” it.

      my boss mess up on my check 4 time in a 5 years,
      3 time they underpaid me, my boss took 4 hours to call me back.
      when they over paid me, and I call them it took 30 second to get a call back.

      If it was reimbursement for car expenses, that would not be taxed. The caller is going all over the place so it is hard to follow. However, I do agree that Dave often underestimates what some people have to pay in taxes.

      I agree but Dave was saying that when you actually do your taxes, your w-2 will clearly list your income. If she makes $68,000, that means her w2 clearly stated that she made $78,000 that year, not including overtime. I get the first year but not 3 years in a row. They knew. Lol but you are right. They obviously meant after tax.

    I remember once I was looking at my cable bill and I saw that the cable company was charging me monthly for a box that I had long since taken back. I started checking my cable bills and saw it had been going on for several years. I called the cable company and they researched and saw I was right.       How many people do you know could accurately calculate their taxation. Most people take it that their paycheck is correct.
      I am guilty my self of doing this in the past. My wife once got over paid by $8000 over a few months because she was doing overtime all over the place and it confused her. She just took it for granted. We got a lawyer and accountants involved. The initial claim was that it was $15000 over payment.
      The hospital director informed my wife that they would write the amount of but we insisted that the full amount be paid that was owed.

      I heard a similar case with a state employee in CA, the employer ( the State) told her that they overpaid her for 15 years and made mistake with her retirement contribution. She received a letter starting that they will be garnishing her paychecks to get the money back. At the time, she hired a lawyer and I don’t know what happened with her case....

It is going to depend on how it was paid out on her paystub. I'm guessing it wasn't regular pay but a separate line item ie. Reimbursement and without question they knew it was wrong.

      Government pay stubs aren’t that straightforward, especially if you have travel expenses and if you get a bit of overtime here and there. I’ve worked for the government for 13 years, and I honestly don’t know what my base salary works out to exactly (net) every two weeks. I have a pretty good idea, but if there was an extra 100 on there I wouldn’t pick up on it for a while.

      @@Preservestlandry the itemization is usually complicated, there are dozens and dozens of pay codes. To read my stub I have to login to a government server and access a master sheet of pay codes that is enormous. There's a lot of employees that don't submit for pay for a lot of little things due to the complexity,.so I've always wondered if they do this on purpose. If I traveled regularly for I would have difficulty keeping track of whether I was getting paid correctly or not just due to the complexity.

    I think Dave is forgetting taxes, 401K,HSA, FSA, additional benefits coming off that recurring error payment. $10,000 a year $384.61 per paycheck. And she is getting maybe an extra 90 a week.

    Most people nowadays are getting paid via direct deposit, it’s quite possible that they didn’t notice especially since it was a recurring mistake. I don’t know why everyone assumes they knew, the employer should have paid attention too!

    My former coworker told me they overpaid him by like two thousand. He spent it. They had him on a payment plan like he was at Walmart trying to get something for Christmas. Same thing happened to me. The accountant did my taxes (and maybe he was wrong when he did the math) but the IRS gave me $300 more than the accountant told me I would get. I notified him. He told me to leave it aside until April. If they don't argue that I was overpaid by $300 by April, then I believe I get to keep it.

    The first thing you used to do after boot camp in the Navy was a personal finance class, and my instructor insisted she knew a guy who got two extra zeroes on his paycheck one month. Thinking it must just be his lucky day, he went and bought a new truck in cash and then had to pay it back to Uncle Sam with interest and penalties for the next two years.
    It's funny, because the main takeaway from the class was "DON'T BUY A NEW CAR." turns out that was the first time a lot of kids had ever had a steady paycheck and they all wanted to buy a new car. Sort of like professional athletes, but with a much smaller salary.

    I was overpaid by $50 week this past year. This went on for 19 weeks. It was during a time when my paycheck was fluctuating due to a position change in the company. They needed me to cover another employees job that was terminated and that's when they discovered the mistake. They didn't even have the courtesy to pick up the phone and call me. They just adjusted my salary down and I only caught it when I got my check stub and pending deposit. They thought they had leverage over me to force me to work the higher paid work for my lower salary. Nope. I told them to take every penny out of my next check. I didn't want to OWE them anything. If they felt I didn't earn it, I didn't want it. I went back to my lower paid position and salary and told them good luck on covering the other work. I also let them know that I no longer trust them to do the right thing concerning my salary compensation.

      Generally speaking, federal and California law allow employers to garnish your wages to get repayment. It's possible a good play is to sign an agreement with the longest possible payback term and then change jobs however, because they may not be able to chase you down for a bill, only garnish your wages.

    This is no different than the bank inadvertently depositing someone else’s money in your account, If you go out and spend it as a windfall, the bank will eventually come back after you. You can say “ f the bank - their fault” all you want. If it winds up in court, you’ll lose.

      Her pay for those three years was $204,000. It would be easy to be out by 14% most people simply do not have the ability to calculate there taxation. They are probably jointly filing and on top of that her mileage is not taxable.
      It is very easy to be confused by this.

    It's WAAAY more complicated than simply repaying $30K. You have state income tax, federal income tax, FICA and a number of other paycheck deductions. She really needs to see an accountant to figure out what all of the implications are since they may have over paid on taxes and need to refile their taxes based on the new (reduced) gross.

      ​@Beyond Tribalism I don't believe that would happen. The employer is prohibited from retribution in this situation and the fines and penalties for wrongful termination are severe. As a California employer I would never be inclined to fire a good employee for following labor law. The person who created the problem, however, might be disciplined in some form depending on the reason for the error. I have actually experienced a similar situation in a company I was brought in to help solve some management issues. The manager had made several payroll advances to employees without a signed agreement to repay. We wrote off the advances and the manager was terminated.

    I remember when I left my.job at the state and they continued to pay me biweekly. I racked up $8000 and didn't touch it one bit. I hoped maybe they wouldn't notice but they eventually did. I gave it back to them the same day.

    If the company overpays you how is it the individuals fault? The company should have checked beforehand.

    I remember I got overpaid for my first job. They asked for it back after I had quit. I told them to go suck a lemon. Never heard from them again

    They knew. How can you not notice thousands per year extra. They just hoped they wouldn't be noticed. Should have banked the money in case Boss Man came calling. A one time mistake, ok, but when this is happening week after week you better say something because someday someone will notice.

    When he explained that she got a lump sum payment for reimbursement and other things and it just kept going at that rate- they definitely knew.

    She really enjoys working for the ‘county’. Imagine the government screwing up, go figure.
