People on the tiktok shop are REALLY bad about it. Selling merch of licensed characters and there was several people who would turn fanfiction into hard cover books and selling them even tho it's pretty common knowledge that you can't sell fanfiction
I like seeing film clips interspersed into an original piece, usually in the form of a reaction, a gasp, a sigh, a laugh. Always helps with the pacing of a piece
Commentary and criticism of news stories and interviews etc is very important part of fair use as it doesn't let the news organisation control the narrative.
One of the hardest parts of starting a RUclips channel must be the patience required. I only started 2 weeks ago and it feels like forever without gaining any subs or views.

my friend had a channel like yours, in month 2 or 3 he got millions of views and over 3000 subs but when he applied for YT partnership... REJECTED for not adding enough value to the copyrighted content. If you cant do EVERYTHING this guy has said, EXTREME edits while using individual's content etc etc, then you have a problem come monetization time. Good luck though.
I think it's much easier having a faceless channel if somebody is a shy person. I am a bit like that so starting a personal channel was not an option for me. But with faceless channel everything is easier. I can focus on my content without being judged on my looks, voice, body, etc... (I can also recommend using some tools like Famester here and there, as it works best with this type of channel).

That's the way to do it. Some good stuff there! Subscribed. Only on one or two vids have I used external footage - and I've got written permission for that - and one coming in a few weeks with press released copyright free content. Might not be good stuff from me, but everything film/video and even 90% of the music is done by myself.
I'm not taking a side here whether it's good or bad to "transform" other's content. There are a whollllllle lotta people out there doing this now, so that's another conversation. That being said, there is a lot of very, very good & valuable (& common sense) info here. Thanks a ton! Great job!
Yea it all depends on what are you making. Prime Example of transformative content is Reaction channels. For other channels like science channel or some channels like education or explaintion type they generally use few seconds clip for refference purpose.
I will honestly say. Listen to anything these channels tell you with a grain of salt. They prey off of those who can’t seem to break out on RUclips. And they’ll continuously drive you away from creating what you wanted to.

I hada situation recently where I was using some music from a game in one of my videos. The developers are very cool with people doing this on RUclips (they've literally said this), it doesn't get flagged by the Content ID system and they don't make copyright claims. But I used a certain piece of their music that did get flagged by Content ID. I was confused, and it turned out that it got flagged by another company that I guess represents independent music artists or something like that. Turns out some guy had remixed the game's music into his song, causing the Content ID to flag it as owned by him. I tried to appeal it but, of course, RUclips just told me that the guy claims it's his and, as I'm not the owner of the music either, I can't really go further and say 'well, no it's not owned by him.' Just kind of sucks that the developers let people use their music and you've got a$$holes remixing it into their songs that are then copyrighted which prevent other people from using it themselves like they did.
Did you email the Game Developers about it all? Also say they need to do a basic licence to stop someone doing this. The thing is.. You are using the original not their remix. I suppose someone could get their remix and remix it again and then copyright them...
For all of you ripping on the person who issued the claim, they paid to use that source material. They have a right to defend their use of it the same as any copyright holder.
@@mySeaPrince_ I considered it but I was concerned that they wouldn't know how to handle the situation or what they could do (the claim is on my video after all, not theirs, meaning the option to appeal is only available to me, even though it's their music) and was concerned they might think the only response is to begin actively claiming and flagging all their music themselves to ensure no one else does, resulting in the same problem but worse. I might still do it though, I'm not sure. I'll continue to look into it.
Not really into making a faceless channel, but these tips are very useful to help getting some clips into podcasts and avoiding serious copyright issues.
No offence to VidIQ but this is by far the most value I have learned about content creation and fair use then I have learned in the 15 years i've been on RUclips. THANK YOU , I had one channel hit well a few years back but was nailed with copyright I couldn't understand the fair use policy it killed my channel immediately . I follow Noah on Twitter, and one thing that bothers me in these videos is that he never mentioned a case where he lost a buch of channels linked to the same gmail account, because of copyright strikes and lost about 20 000$ from ad revenue a month if I remember correctly. (He has a Twitter thread about it). The way he avoids the risk now is with putting the high risk content on one gmail account, and lower risk content on other accounts, so if he losses some of them, it's less of a problem. It's definitely an interesting topic. Not sure where Google stands with having multiple Ad sense accounts though, I think you can only have one connected to your own name? You could always open more from your family members and stuff but this whole topic is a bit shady and people should definitely be careful and decent if doing this...
Google told me in 2018 that you can have one Adsense Channel "per business entity". At the level he is at I'm guessing that there is more than one LLC, which would make sense.

Hi there - great job on this video!! It is hard to get the truth sometimes - I have always felt that with any process, people try to beat the system and potentially ruin for it for other creators. You help us and it is appreciated. In my own businesses I was fair and honest.
This guy is literally trying to beat the system and trying to squirm away from copywrite laws. Another poster even said he has lost a ton of channels due to copywrite strikes.
I'm not sure what VidIQ's intention is with this video. But it strengthens my resolve to not watch any videos on channels of this type. If they're not monetized and just sharing what is actually allowed to be shared, that's one thing. But to give counsel on how to skirt the laws and reduce your risk of getting caught, well, it just proves this guy's morals.
I think some people are very mistaken about what 'public domain' means when it comes to copyright. Just because it's on the internet, or even published on a site that claims it is 'copyright free' does not mean something is 'public domain, thus copyright free. To be public domain a piece of content must indeed be copyright free, and it isn't unless expressly stated as so by the creator, or owner of the copyright, and the owner of the content isn't always the owner of the copyright. This is why, as a commission artist, I originally started taking my own reference photos. I then owned the copyright on the photos, and the art.
Exactly, people cannot be bothered to actually search out the CC license (and double check to make sure that someone hasn't lifted it then put it out under CC themselves.) It's too much hard work. People find your angle too much hard work, going and taking your own photographs. It's an angle I always admire. When I began in Motorsport journalism I found CC images were usually too poor quality (shots of F1 races from the 70s aren't generally good for publishing!) Modern CC shots from motor races taken by fans actually broke the condition of entry if used even editorially - rendering them unusable (even if rights holder don't enforce - not worth the risk) and press release images were very limited - eventually went through the process gain accreditation to do it properly myself. Life would be so much easier if I could just lift content......

Well according to law public domain means usually the owner Donated it for free or the copyright has expired. For books its usually till the authors death. And for music- its till 50 uears after owners death. Well for photos its 70 years after owners death. Also Copyright free photos or Videos which one usually get they are not in public domain but Technically in Creative commons license but they don't usually bother to ask
Informative. I think the best way to ethically and legally do this is to act like a reputable news network. Treat it like such by giving credit and adding value! The only way to avoid is to strictly not use anyones videos or copyrighted stuff.
Ah yes, the Dark Arts....a.k.a. theft. As a small creator who is working his butt off to get to 1000 subscribers, I can't help but think it will be much more rewarding to find success without stealing from other creators.
Under US law there is no “legal doctrine called fair use” as this foreign national kid lectured about US law. There is the Copyright act of 1976 which name was not changed to “the Fair Use Law” by Wikipedia despite the Wikipedia page title. They don’t arbitrarily alter half century old legislation by the results of X Polling that say ‘theft should now be a right, but only for ME.” Fair use is not a “legal doctrine” and even if it were a legal doctrine that doesn’t override the law, no matter who wants it to. Fair use refers to an exception that can be allowed by a judge on a per case basis. That it is often allowed is not determinative. Any judge can refuse to consider what you’ve done to fall under the fair use exception. Like if you’re not the NYT for example, using an unauthorized screen grab in a story. Then you’re just another thief. There is no right justified as “fair use” for anyone to steal. This “transformative” test is now what’s being determined in cases like Getty Images vs Dall-E. Fair use has become a defence strategy. If your lawyer says “we’re going to plead ‘fair use’” that’s because he knows you will just look like a thief to the judge. If you buy a fancy enough AI hedge trimmer (or you do it by hand) that it “transforms” the part of your neighbour’s hedge facing you to resemble Mt. Rushmore, does that mean a Judge will then move your neighbour’s property line away from you award some of your property to your neighbour? Because that’s what all these “transformative” people are saying should happen. ‘I copy pasta’d a special prompt so that should give me some legal rights in your property.’ I don’t think so, Tim. There’s a LOT of Silicon Valley money whining to judges about this but under law I personally don’t think it’s going to work over the long term. Because eventually a case will go to the US Supreme Court and no Supreme Court is going to say “ownership is only 1% of the law.” You can diminutize what I’m sayings by cordoning it off as “opinion” but then your opinion is going to change when somebody like this man steals your original content from you. Opinions can invert based on experience. Opinions can also be objectively right wrong. Calling something an opinion doesn’t magically change the moral nature of that thing from objective to subjective in nature.
I do very transformative and educational music analysis videos. The bulk of my content is listening to a piece of music, stopping often to reflect and breakdown what is happening composiontally and rewind to go over again. This process is repeated over and over throughout the piece. 95% of my uploads are claimed. I have made sure to stay very true to transformative and educational content my entire time on RUclips. I dispute most of the claims and lose most of the claims. The rejection notice is almost immediatly. I think in a year and a half of disuputes I have won maybe 7 total and that was primarily because they didnt respond within the 30 day window. I was REALLY hoping this video would go over the process of when you DO get claimed and how he handles disputing and IF he issues an appeal after the dispute. Thanks for the video!
Really interesting. the whole system is a bit ridiculous. It would be so much better if they can just calculate the royalty due to the content creator and send it to them instead. Like they do with radio. Any licensed broadcaster can play your song and you just get a payment. Embed the watermark system into the video editing apps so that the metatagged revenue share breakdown is uploaded along with the video, everyone can use everything and everyone gets their share. So if your video has 30 secs of someone else's song, and its the only thing playing, then they get 30 secs worth of the $$$. Just an idea but I hope something like this would happen in future.

When you’ve had a copyright claim placed clearly by analysis on your entirely original work multiple times by huge mega holding companies long enough to observe that they actually have a market in trading copyright claims, you will be even less impressed by the moral position on theft that VidIQ has apparently decided to take here about how to sneak away with ill gotten gains in your career as another IP appropriation abuser. The key purpose of “Fair Use” under the U.S. copyright Act of 1976 ushered right in and placed in the seat of highest honour in this video as “a legal doctrine” without the slightest challenge by VidIQ in this piece (presumably because that would tend to upset the soothing pro-theft narrative and negatively impact AVD in this video) is to identify evidence, not to provide meme cred as B-roll in any random scheme uploaded. Big companies have done this (to me for one example) since many years ago. Calling the recipe “faceless” doesn’t ennoble it or change the ingredients list. And VidIQ is apparently working hard now to spread the exact knowledge of precisely how you too, kids, can become a successful internet pickpocket. Start out by choosing targets well: no big companies with legal departments! You want to stick with DEFENCELESS targets. But careful you don’t do anything wrong while you’re pickpocketing. Years ago I had an Internet cafe in Bucharest -Romania. Games, OS software was licensed or open sources. One day, we had a guy for Romanian Copyright Association who come to check if we are respecting the law, and we bought OS and software. But we put music all the time there. An online radio. And the guy told us we have to pay for that. It wasn't a penality. is was a contract between our company and Romanian Copyright Association - entitled to collect that money and distribute to authors. Is was something realy cheap like 10 or 20 dollars for one year. After that, the guy told us: "I am a musician and I know this copyright is just a trend. Also less that 30% of that money are going back tu creators" I will be happy to use YT music and pay for it if that money are going 90% to the creator. Unfortunately is not like that.
I just film everything myself and don't use music so I don't have to worry about any of this. Creating videos (regularly) is enough to worry about for me thank you very much 😂
I was using common creative licenced videos for one of my channels, but the content under that licence is often old and of low quality. This is useful information.
Sometimes it's really hard to find right type of content. This thing happened specially for education, explaining , science type channels. I also struggle many times to find the right video but sometimes we were not able to do.
Here's something I will tell from my over 10+ channels over 13 years experience here in YT which is also something I discussed with other content creators and it's not even mentioned or hinted once here, in this video or others talking about this topic. - No matter what "outsource content" you use, once your channel gain repercussion and certain amount of numbers starting to make you some interesting money.. you will be targeted by companies as individuals that will run a bot or manual check all your channel listing all possible "clips, memes, sounds, music" you may have used and start to massive report your videos but not to take down your channel but to take away your monetization. - There were cases, that even if you create your own visual meme, emote or whatever, a company or individual may take that visual and register it's copyright then copy strike all your YT videos claiming ownership over that single element and YT will not help you but give all monetization to that shady company or individual. - Just be aware, whatever content you do here on RUclips, if you get lucky enough to make love with the algorithm and grow your numbers into millions, you will run into this kind of problems and will be forced to hire lawyers and mentally prepare yourself for an infinite fight in this issue.
One piece of advice as a long-time pro motorsport photographer right now. Don't go lifting F1 photos under the control of Motorsport Images. Their legal agents are on the hunt again. The last RUclips hunt a couple of years back almost cost Aiden Millward his house (he has a video on his channel about it, search it out if you're a creator - lessons to be learned there.) A few people were hit then. I'm not bothered when people lift my photos of UK racing (which happens often - all I ask is to be credited) but the official photos from the series I mainly cover (British Touring Car Championship) are being cracked down on with creators - they are released with a caveat that only drivers/teams can use on socials/youtube) and with it being UK based entities vs UK based creators the Fair Use terms quoted from US law appear to not be a protection. Intriguing stuff.
top comment. Fair use is a lot flimsier than people think when it comes right down to it: I take the view that if you are monetizing the content, it's generally not going to be accepted. I got hit with a claim over a 300x300px image (not motorsport) that I grabbed over 10 years ago for an informational website... which had been uploaded to flickr and turned out to be owned by mirror pix. Super aggressive and they didnt GAF about the fact that I "thought it was usable" due to someone else's misattribution. I settled for $500 out of court. It's only going to get more intense as AI tools to recognize lifted content - images, fonts, etc becomes more advanced.
@@BenFormula1 It's strange. If you'd launched your channel five or more years ago the video footage you've used would have rights holders coming after you. But I'm not sure what their view is at the moment. It is breaking their terms, but they seem to be leaving things alone for now. If you channel grows and you're still using their content they'd probably be interested in you, and possibly getting some videos taken down.) However, some of the photos you've used are owned by Motorsport Images subsidiaries (LAT, Sutton, Schlegelmilch etc) if you come up in the search by the agency they've contracted then they'll probably try a takedown if you're not monetised, but if you do earn they'll want a BIG chunk of cash.
The original rightsholder (or their local subsidiary) could potentially sue you outside of the RUclips ecosystem under the law of the country you come from. It's unlikely, as they will probably just have the video deleted and move on, but they could sue you for copyright infringement.
I miss the old RUclips, the site with real videos made my real people who actually shared knowledge. This new RUclips is an AI-generated nightmare, just thousands of lazy, talentless hacks re-posting millions of garbage videos that say nothing.

I received a Strike from a content owner after following the Remix Option that was operational. It was a bait & switch that cost me a Strike & 90 days of probation. I love how Formula One is mentioned here a few times as I have a formula one channel. I always use clips shorter than 8 seconds and switch it up with pictures. I rip F1 footage from other creators , usually zoom a little and I never had a copyright claim for it. I have other issues with growing the channel. How would I go about and ask them to Vidiq?

Question about narration. I narrate classic ghost stories - out of copyright - and write my own, then I add sound effects & artwork, but there are very large channels that upload narrations of in-copyright stories/books with no sound effects or original artwork. Does simply narrating something add sufficient value?
I don’t believe this is a good idea. The channels that do this, just haven’t been caught yet. Think about it. If I found a channel that just narrated Stephen King books, then I wouldn’t have to buy King’s books or audio books. I’d just listen to them for free on RUclips. The RUclipsr would basically be stealing money away from the original creator.
I got a copyright strike on a parody video, Eyebrows, where I took the opening to Eva and added Ethan's eyes and eyebrows to every character. It was HILARIOUS, but even though it was transformative, it wasn't enough and that's because Japan doesn't have any copyright laws...It doesn't matter if the content is transformative, they can still go after your videos...
Better to make a faceless channel that is always original footage and your own story or narrative, no need to worry about copyright claims, and the only problem you may run into is if you record game music or logos that are not allowed. Might take longer to monetize but when you get monetized you get to keep it.
I have 3 faceless channels , I create my own art and music , sometimes copyright free music with proper artist links , info etc on description , I'm not making any $money yet lol , one of my channels has 515 subs and 9k watch hours though👍

I like seeing film clips interspersed into an original piece, usually in the form of a reaction, a gasp, a sigh, a laugh. Always helps with the pacing of a piece
sounds really intellectual. you wouldn't want to overwhelm your attention spam without proper pacing you goldfish.
Commentary and criticism of news stories and interviews etc is very important part of fair use as it doesn't let the news organisation control the narrative.
One of the hardest parts of starting a RUclips channel must be the patience required. I only started 2 weeks ago and it feels like forever without gaining any subs or views.

It could be up to months or years without any results, we should be prepared for that.

I think it's much easier having a faceless channel if somebody is a shy person. I am a bit like that so starting a personal channel was not an option for me. But with faceless channel everything is easier. I can focus on my content without being judged on my looks, voice, body, etc... (I can also recommend using some tools like Famester here and there, as it works best with this type of channel).

Yea it all depends on what are you making. Prime Example of transformative content is Reaction channels. For other channels like science channel or some channels like education or explaintion type they generally use few seconds clip for refference purpose.

I will honestly say. Listen to anything these channels tell you with a grain of salt. They prey off of those who can’t seem to break out on RUclips. And they’ll continuously drive you away from creating what you wanted to.

I hada situation recently where I was using some music from a game in one of my videos. The developers are very cool with people doing this on RUclips (they've literally said this), it doesn't get flagged by the Content ID system and they don't make copyright claims. But I used a certain piece of their music that did get flagged by Content ID. I was confused, and it turned out that it got flagged by another company that I guess represents independent music artists or something like that. Turns out some guy had remixed the game's music into his song, causing the Content ID to flag it as owned by him. I tried to appeal it but, of course, RUclips just told me that the guy claims it's his and, as I'm not the owner of the music either, I can't really go further and say 'well, no it's not owned by him.' Just kind of sucks that the developers let people use their music and you've got a$$holes remixing it into their songs that are then copyrighted which prevent other people from using it themselves like they did.
That's probably the scummiest thing I've read. Hope those "independent artists" get their karma served...

For all of you ripping on the person who issued the claim, they paid to use that source material. They have a right to defend their use of it the same as any copyright holder.
@@mySeaPrince_ I considered it but I was concerned that they wouldn't know how to handle the situation or what they could do (the claim is on my video after all, not theirs, meaning the option to appeal is only available to me, even though it's their music) and was concerned they might think the only response is to begin actively claiming and flagging all their music themselves to ensure no one else does, resulting in the same problem but worse. I might still do it though, I'm not sure. I'll continue to look into it.

Not really into making a faceless channel, but these tips are very useful to help getting some clips into podcasts and avoiding serious copyright issues.
No offence to VidIQ but this is by far the most value I have learned about content creation and fair use then I have learned in the 15 years i've been on RUclips. THANK YOU , I had one channel hit well a few years back but was nailed with copyright I couldn't understand the fair use policy it killed my channel immediately . I follow Noah on Twitter, and one thing that bothers me in these videos is that he never mentioned a case where he lost a buch of channels linked to the same gmail account, because of copyright strikes and lost about 20 000$ from ad revenue a month if I remember correctly. (He has a Twitter thread about it). The way he avoids the risk now is with putting the high risk content on one gmail account, and lower risk content on other accounts, so if he losses some of them, it's less of a problem.
It's definitely an interesting topic. Not sure where Google stands with having multiple Ad sense accounts though, I think you can only have one connected to your own name? You could always open more from your family members and stuff but this whole topic is a bit shady and people should definitely be careful and decent if doing this...
Google told me in 2018 that you can have one Adsense Channel "per business entity". At the level he is at I'm guessing that there is more than one LLC, which would make sense.

Hi there - great job on this video!! It is hard to get the truth sometimes - I have always felt that with any process, people try to beat the system and potentially ruin for it for other creators. You help us and it is appreciated. In my own businesses I was fair and honest.
This guy is literally trying to beat the system and trying to squirm away from copywrite laws. Another poster even said he has lost a ton of channels due to copywrite strikes.
Body camera footage is public domain: IE, its typically royalty free. Its really that simple, don't steal commercial work.
I'm not sure what VidIQ's intention is with this video. But it strengthens my resolve to not watch any videos on channels of this type. If they're not monetized and just sharing what is actually allowed to be shared, that's one thing. But to give counsel on how to skirt the laws and reduce your risk of getting caught, well, it just proves this guy's morals.

I think some people are very mistaken about what 'public domain' means when it comes to copyright. Just because it's on the internet, or even published on a site that claims it is 'copyright free' does not mean something is 'public domain, thus copyright free. To be public domain a piece of content must indeed be copyright free, and it isn't unless expressly stated as so by the creator, or owner of the copyright, and the owner of the content isn't always the owner of the copyright. This is why, as a commission artist, I originally started taking my own reference photos. I then owned the copyright on the photos, and the art.
Exactly, people cannot be bothered to actually search out the CC license (and double check to make sure that someone hasn't lifted it then put it out under CC themselves.) It's too much hard work.
People find your angle too much hard work, going and taking your own photographs. It's an angle I always admire.
When I began in Motorsport journalism I found CC images were usually too poor quality (shots of F1 races from the 70s aren't generally good for publishing!) Modern CC shots from motor races taken by fans actually broke the condition of entry if used even editorially - rendering them unusable (even if rights holder don't enforce - not worth the risk) and press release images were very limited - eventually went through the process gain accreditation to do it properly myself.
Life would be so much easier if I could just lift content......

Well according to law public domain means usually the owner Donated it for free or the copyright has expired. For books its usually till the authors death. And for music- its till 50 uears after owners death. Well for photos its 70 years after owners death. Also Copyright free photos or Videos which one usually get they are not in public domain but Technically in Creative commons license but they don't usually bother to ask

Ah yes, the Dark Arts....a.k.a. theft. As a small creator who is working his butt off to get to 1000 subscribers, I can't help but think it will be much more rewarding to find success without stealing from other creators.
Under US law there is no “legal doctrine called fair use” as this foreign national kid lectured about US law. There is the Copyright act of 1976 which name was not changed to “the Fair Use Law” by Wikipedia despite the Wikipedia page title.
They don’t arbitrarily alter half century old legislation by the results of X Polling that say ‘theft should now be a right, but only for ME.”
Fair use is not a “legal doctrine” and even if it were a legal doctrine that doesn’t override the law, no matter who wants it to.
Fair use refers to an exception that can be allowed by a judge on a per case basis. That it is often allowed is not determinative. Any judge can refuse to consider what you’ve done to fall under the fair use exception. Like if you’re not the NYT for example, using an unauthorized screen grab in a story. Then you’re just another thief.
There is no right justified as “fair use” for anyone to steal. This “transformative” test is now what’s being determined in cases like Getty Images vs Dall-E.
Fair use has become a defence strategy. If your lawyer says “we’re going to plead ‘fair use’” that’s because he knows you will just look like a thief to the judge.
If you buy a fancy enough AI hedge trimmer (or you do it by hand) that it “transforms” the part of your neighbour’s hedge facing you to resemble Mt. Rushmore, does that mean a Judge will then move your neighbour’s property line away from you award some of your property to your neighbour?
Because that’s what all these “transformative” people are saying should happen.

There’s a LOT of Silicon Valley money whining to judges about this but under law I personally don’t think it’s going to work over the long term. Because eventually a case will go to the US Supreme Court and no Supreme Court is going to say “ownership is only 1% of the law.”
You can diminutize what I’m sayings by cordoning it off as “opinion” but then your opinion is going to change when somebody like this man steals your original content from you.
Opinions can invert based on experience. Opinions can also be objectively right wrong. Calling something an opinion doesn’t magically change the moral nature of that thing from objective to subjective in nature.
I do very transformative and educational music analysis videos. The bulk of my content is listening to a piece of music, stopping often to reflect and breakdown what is happening composiontally and rewind to go over again. This process is repeated over and over throughout the piece. 95% of my uploads are claimed. I have made sure to stay very true to transformative and educational content my entire time on RUclips. I dispute most of the claims and lose most of the claims. The rejection notice is almost immediatly. I think in a year and a half of disuputes I have won maybe 7 total and that was primarily because they didnt respond within the 30 day window. I was REALLY hoping this video would go over the process of when you DO get claimed and how he handles disputing and IF he issues an appeal after the dispute. Thanks for the video!
Really interesting. the whole system is a bit ridiculous. It would be so much better if they can just calculate the royalty due to the content creator and send it to them instead. Like they do with radio. Any licensed broadcaster can play your song and you just get a payment. Embed the watermark system into the video editing apps so that the metatagged revenue share breakdown is uploaded along with the video, everyone can use everything and everyone gets their share. So if your video has 30 secs of someone else's song, and its the only thing playing, then they get 30 secs worth of the $$$. Just an idea but I hope something like this would happen in future.

"The impact" on the Copyright holder. It's obviously detrimental. We see non stop these thieving channels get waaay more views than the original. That's facts. And so in that case the original uploader should be entitled to a portion of revenue. I don't understand why this whole system is so complicated. There's such an easy fix to all of this. The ORIGINAL owner or uploader should always be getting some fixed portion of any works remade. whether its 1% or 5% or an amount we could eventually all agree on. I don't see how that's difficult to register with content id? But no....let's rather let thieves steal literally thousands from creators or uploaders that aren't even monetized in the first place. SMH....the whole system is broken

When you’ve had a copyright claim placed clearly by analysis on your entirely original work multiple times by huge mega holding companies long enough to observe that they actually have a market in trading copyright claims, you will be even less impressed by the moral position on theft that VidIQ has apparently decided to take here about how to sneak away with ill gotten gains in your career as another IP appropriation abuser.
The key purpose of “Fair Use” under the U.S. copyright Act of 1976 ushered right in and placed in the seat of highest honour in this video as “a legal doctrine” without the slightest challenge by VidIQ in this piece (presumably because that would tend to upset the soothing pro-theft narrative and negatively impact AVD in this video) is to identify evidence, not to provide meme cred as B-roll in any random scheme uploaded.
Big companies have done this (to me for one example) since many years ago.
Calling the recipe “faceless” doesn’t ennoble it or change the ingredients list.

Years ago I had an Internet cafe in Bucharest -Romania.
Games, OS software was licensed or open sources.
One day, we had a guy for Romanian Copyright Association who come to check if we are respecting the law, and we bought OS and software.
But we put music all the time there. An online radio.
And the guy told us we have to pay for that.
It wasn't a penality. is was a contract between our company and Romanian Copyright Association - entitled to collect that money and distribute to authors.
Is was something realy cheap like 10 or 20 dollars for one year.
After that, the guy told us:
"I am a musician and I know this copyright is just a trend. Also less that 30% of that money are going back tu creators"
I will be happy to use YT music and pay for it if that money are going 90% to the creator.

I was using common creative licenced videos for one of my channels, but the content under that licence is often old and of low quality. This is useful information.
Sometimes it's really hard to find right type of content. This thing happened specially for education, explaining , science type channels. I also struggle many times to find the right video but sometimes we were not able to do.

Sports compilations are big on copyright, I’ve managed to avoid them without transforming or having a partnership with the Association.
Here's something I will tell from my over 10+ channels over 13 years experience here in YT which is also something I discussed with other content creators and it's not even mentioned or hinted once here, in this video or others talking about this topic.

No matter what "outsource content" you use, once your channel gain repercussion and certain amount of numbers starting to make you some interesting money.. you will be targeted by companies as individuals that will run a bot or manual check all your channel listing all possible "clips, memes, sounds, music" you may have used and start to massive report your videos but not to take down your channel but to take away your monetization.

There were cases, that even if you create your own visual meme, emote or whatever, a company or individual may take that visual and register it's copyright then copy strike all your YT videos claiming ownership over that single element and YT will not help you but give all monetization to that shady company or individual.

Just be aware, whatever content you do here on RUclips, if you get lucky enough to make love with the algorithm and grow your numbers into millions, you will run into this kind of problems and will be forced to hire lawyers and mentally prepare yourself for an infinite fight in this issue.
One piece of advice as a long-time pro motorsport photographer right now. Don't go lifting F1 photos under the control of Motorsport Images. Their legal agents are on the hunt again.
The last RUclips hunt a couple of years back almost cost Aiden Millward his house (he has a video on his channel about it, search it out if you're a creator - lessons to be learned there.) A few people were hit then.
I'm not bothered when people lift my photos of UK racing (which happens often - all I ask is to be credited) but the official photos from the series I mainly cover (British Touring Car Championship) are being cracked down on with creators - they are released with a caveat that only drivers/teams can use on socials/youtube) and with it being UK based entities vs UK based creators the Fair Use terms quoted from US law appear to not be a protection.

top comment. Fair use is a lot flimsier than people think when it comes right down to it: I take the view that if you are monetizing the content, it's generally not going to be accepted. I got hit with a claim over a 300x300px image (not motorsport) that I grabbed over 10 years ago for an informational website... which had been uploaded to flickr and turned out to be owned by mirror pix. Super aggressive and they didnt GAF about the fact that I "thought it was usable" due to someone else's misattribution. I settled for $500 out of court. It's only going to get more intense as AI tools to recognize lifted content - images, fonts, etc becomes more advanced.

@@BenFormula1 It's strange. If you'd launched your channel five or more years ago the video footage you've used would have rights holders coming after you. But I'm not sure what their view is at the moment. It is breaking their terms, but they seem to be leaving things alone for now. If you channel grows and you're still using their content they'd probably be interested in you, and possibly getting some videos taken down.)
However, some of the photos you've used are owned by Motorsport Images subsidiaries (LAT, Sutton, Schlegelmilch etc) if you come up in the search by the agency they've contracted then they'll probably try a takedown if you're not monetised, but if you do earn they'll want a BIG chunk of cash.

Yes. Technically, RUclips applies the laws from around the world. But it ends up mostly being the US since that is where most content is from.

Copyright law is unique per country, but it’s international in scope through treaties and agreements.
The original rightsholder (or their local subsidiary) could potentially sue you outside of the RUclips ecosystem under the law of the country you come from. It's unlikely, as they will probably just have the video deleted and move on, but they could sue you for copyright infringement.
I miss the old RUclips, the site with real videos made my real people who actually shared knowledge. This new RUclips is an AI-generated nightmare, just thousands of lazy, talentless hacks re-posting millions of garbage videos that say nothing.
So after telling people to exploit their team. You teach them to steal content from other people and even precise them to use the one from people that cannot fight back... Your an inspiration to all of us @vidIQ

What are the rules for using the remix option
You can turn the option off under create/clips in yt studio
@@localtravelcouplejams what I mean is: Are creators protected from copyright infringement if Remix Options are turned on.
I received a Strike from a content owner after following the Remix Option that was operational.
It was a bait & switch that cost me a Strike & 90 days of probation.
I’m suffering from a case of the “ Remix🌪️Twisties “.

I Have 17.3k Watch hour but
When im trying monetize it says "We will ket you know when you're Eligible" Cause there is only 875watch hour
Would definitely contact youtube support. I have 6k watch hours and not even 600 subscribers and already have monetized channel memberships. Might be an issue with youtube u need to sort out
😢As someone who's creative content has been taken and appropriated by others, this video actually rubbed me the wrong way. I love VidIQ but Basically this is the kind of guy that keeps taking my viral videos, blurs out my Tag and laughs like a villain as the views roll in. VidIQ I thought you knew better.
I have been on this plane, and seriously, I plan on suing.

You missed a pretty big question which is whether to do the counternotification to remove the strike or not.
I love how Formula One is mentioned here a few times as I have a formula one channel. I always use clips shorter than 8 seconds and switch it up with pictures. I rip F1 footage from other creators , usually zoom a little and I never had a copyright claim for it.
I have other issues with growing the channel. How would I go about and ask them to Vidiq?
So your just blatently stealing content from other creators. Guarenteed your time will come for a copywrite violation.

Sorry to hear. I began making those same type of shorts as you, but took them all off my channel after a week as I figured out they were low-value and not what I wanted to represent me.

Question about narration. I narrate classic ghost stories - out of copyright - and write my own, then I add sound effects & artwork, but there are very large channels that upload narrations of in-copyright stories/books with no sound effects or original artwork. Does simply narrating something add sufficient value?
I don’t believe this is a good idea.
The channels that do this, just haven’t been caught yet.
Think about it. If I found a channel that just narrated Stephen King books, then I wouldn’t have to buy King’s books or audio books.
I’d just listen to them for free on RUclips.
The RUclipsr would basically be stealing money away from the original creator.

I got a copyright strike on a parody video, Eyebrows, where I took the opening to Eva and added Ethan's eyes and eyebrows to every character. It was HILARIOUS, but even though it was transformative, it wasn't enough and that's because Japan doesn't have any copyright laws...It doesn't matter if the content is transformative, they can still go after your videos...

VERY informative... I'm a faceless channel!
Better to make a faceless channel that is always original footage and your own story or narrative, no need to worry about copyright claims, and the only problem you may run into is if you record game music or logos that are not allowed. Might take longer to monetize but when you get monetized you get to keep it.
I have 3 faceless channels , I create my own art and music , sometimes copyright free music with proper artist links , info etc on description , I'm not making any $money yet lol , one of my channels has 515 subs and 9k watch hours though👍
