    The biggest flaw about this scene is that the Colonel is still a member of the armed forces. Which means even if he was outside of the country, he's still subject to the Uniform Code of Military Justice.

      I did some background reading on this, and while he was at one time a colonel at the time of the movie and during the "court" the colonel was retired and therefor no longer subject to UCMJ

      @@mikeredrugger "Retired military officers are subject to the Uniform Code of Military Justice (UCMJ) under Article 2 of the UCMJ, which extends the jurisdiction of military law to “[r]etired members of a regular component of the armed forces who are entitled to pay."
      This is an excerpt from a quick search. I don't pretend to understand military laws, but it seems he'd be under UCMJ. In this clip, they said that the joint chief and a dozen other powerful/highly placed individuals are protecting the colonel; the attorney general is a domestic authority, so, without the military allowing prosecution under UCMJ, I take it he would have no jurisdiction to prosecute on his own. That said, a quick news comment by him would have enough pressure on the military powers to make them throw the colonel under the bus. But yeah, it mostly makes sense.

      @@Sunless1337 That's correct, retired military personnel remain subject to the UCMJ as they can be recalled to active duty at any point so long as they are alive. Yes, their age and any medical conditions at the time of the recall might lead to them being disqualified from further service and returned to retirement status, or put on a limited set of duties for as long as they are recalled for. This also applies to separated military personnel (those who left the service, but did not retire from it), but only for a limited number of years from the date they left the service, with certain exceptions. If you happen to have a certain needed skill set to fulfill the military needs, exceptions can be made for separated personnel to be recalled, provided the separated person(s) agree to it (not 100% certain on this last part)
      Now typically, the only time retired and separated military personnel get prosecuted under the UCMJ is if they commit a crime on or around a military or federal installation, commit a crime involving military or federal personnel either as victims or as accessories to the crime, if they commit a crime against the U.S. government itself, or if they commit an international crime and become repatriated to the U.S. BUT, the relevant service (Air Force, Army, Marines, Navy, Coast Guard) judicial branch and the state and federal attorney generals determine what will be the easiest way to prosecute the individual(s) involved prior to deciding if it will be a civilian or military trial.
      Now the colonel in the movie as a retired military person, involved in an international incident on U.S. soil, conspiring with a former foreign agent, would most likely have been charged under the UCMJ, and in federal court as well. Yes, that is another lovely aspect of being in the military, you can actually be charged and found guilty twice for the same crime, three times if both the state and federal court systems file separate charges. Typically however any prison time from the separate charges is served concurrently.

    Couple of things:
    1: Haven't the bad guys in this movie learned that you never........NEVER taunt a man who could put a round through your brain stem at almost a mile away?
    2: I absolutely love how the AG pretty much gave the Gunny here a free pass on going after the Colonel and everyone involved. "This isn't the Wild West where you can clean up the streets with a gun......even though sometimes that's exactly what's needed." Swagger's look at the AG was pretty much him reading between the lines. If the AG would open the newspaper a week from now and notice a cabin burned up with the Colonel and Senator dead, he probably wouldn't bat an eye.

      I have a theory that in any genre of movie, in the universe/world in which said movie takes place, that genre of movie does not exist. In action movies, the bad guys break EVERY rule of action movies. Don't taunt the guy that killed every single highly trained professional that you sent after them. Don't kill their fucking dog. Don't sexually assault or murder a woman they are attached to. Same goes for horror movies. If you find a mysterious leather bound book with weird symbols in an attic, leave it. If you have a locked door in your basement with six padlocks on it, don't open it. If there is a rumor that you watch a tape and die seven days later, and it has literally happened to people you know, don't watch that fuckin tape.

      Personally I think the higher ups asked him to let him go. That Colonel became a liability and a big one. he needed to be taken care of so let some with the funny’s skills to take care of it. No one is going to deny the Colonel had it coming or Gunny had an ax to grind....saves us a trail and bad PR

      He's Brian Markinson, a bit-role player in a lot of shows and movies. I remember him best in a couple of episodes of Arrow's first season; he plays Adam Hunt, the first guy the Arrow takes down (and who is later killed by Malcom Merlyn).

      and thats why they still did believe the weapon was used, since he swapped the pins, not just removed them, the firing pin base was still visible in the rear of the bolt. If swagger did remove the firing pin, the FBI evidence management section would have seen that there was no firing pin.

    This movie is underrated. Sure, it's a pretty shallow action movie, but it moves well and is nowhere near as cheesy and pathetic as other action movies, like recent DC productions for instance.

      It's actually 2 Bob Lee Swagger books combined. The BLS series is a good read. Haven't read all of them but the ones I have, great books. Starts out in Vietnam and keeps going

      Ro Tyler His arrogance and overconfidence are his weaknesses. He thinks he is untouchable as he has powerful people backing him up. Also the massacre is committed on a foreign soil, making the case outside of American legal jurisdiction. Glover's character never expects that Swagger in the end hunts him and his supporter, killing them along with their men and blows up the house which serve as their retreat.

    Can't believe how good this movie ended up being from such a generic premise... Seriously, this was a fucking pleasure to watch! And its not everyday you see Danny Glover playing the villain...
    Edit: And by the way, most neutral and fair government prosecutors ever portrayed in film! Holy fuck... I was just trying to imagine the amount of times I would have gotten shot if I tried to do exactly what Mark Whalburg did in this scene. My final count was around 3 times that I would have been definitively shot and killed, but its a badass movie so whatever.

    the book for this scene was way better, having all of this high rank officals that were making Bob Lee Swagger look like the bad guy up to the point in which he demonstrated that the gun wasn't capable of shooting pretty much making everyone look like a bunch of idiots

    Y’know what the AG is my favourite character in this film even if his screen time was short.
    He knew exactly what kind of a monster the Colonel was but he couldn’t do shit about it, fortunately for him Bob didn’t have that problem and basically told him to go and put that asshole six feet under. Also I love that he’s so savage too.

    I know very little about guns. How does this prove his innocence?

      I know this is a late comment, but firing pins are relevant to the firearm they're used in. Basically, by swapping the pins amongst his weapons, Swagger ensured the guns couldn't fire if used, at least until the firing pins are swapped back into the correct weapons.
      And because the FBI didn't do a ballistic test (they didn't think they needed to), they relied on the fact the bullet was a straight metallurgical match.
      Laymans terms - The bullet used WAS fired from that particular weapon, just a week prior - at a can of stew. Swagger then swapped the firing pins, therefore making the weapons inoperable. The Colonel and his cronies didn't know this before setting Swagger up.

    Thankfully the military doesn't work like that, every action you take outside of your country in service to it is subject to the laws of your own country. So if you commit a crime out of the country while in uniform, you are still held accountable in a court of law. Hence the captain who was charged for killing a wounded prisoner in Afghanistan. Not in this country, but accountable to it. So that Colonel would be screwed in the real world.

      In this scene that bald guy didn't have enough authority to arrest that colonel at that moment, but the colonel certainly would face the legal system in the appropriate instance and in a federal court. It's just that in the movie Swagger decided to eliminate them and make justice with his own hands, but I believe that colonel was going to face charges for war crimes and all other shit he did, but Swagger New he had corrupt connections in high positions, so he knew it wouldn't do anything to the colonel, so he decided to act make justice before the colonel got away

      Ro Tyler you think so? because if the attorney general possibly knows a few good friends in the DOJ, DCI, or the FBI then maybe he could've helped swagger by telling them to lay off the case. because when a gas leak causes a blast and kills the occupants and the firefighter find a busted gas line in the house they'll likely deem it as suspicious

    So what's the rationale behind swapping out the firing pins in all of his guns for shorter ones? It would be very easy to tell what the issue was after 1 shot. You'd look at the primer see it didn't strike and make the adjustment.

    Why would you need a micrometer to tell if the firing pin has been removed from the BCG? Not to mention, taking out only the firing pin is needlessly complex when you could just remove the bolt. Another movie where they really don't know guns.

      I don't know much about guns, but maybe it would be more visible if you removed the bolt ? What I can say is that if you *absolutely* need a micrometer to tell if the firing pin is shorter, the gun would most certainly fire, not sure what alloy a firing pin is made out of, but I'm pretty certain it expands and contracts more than a couple of micrometers within the range of temperatures it normally fires at.

      A group of villagers were killed, butchered, massacred, or exterminated?
      It's a sophist's tactic in a discussion / debate / argument - something a lawyer would say in a courtroom, or a politician would say in front of the press, to further make the subject / target look bad (above and beyond the alleged crime he committed)...
      NOTATION - Of course, I haven't seen the film, and presume that Danny Glover's character was not seen on screen pulling the trigger in killing the villagers, or giving the order...
      OR, for that matter, secretly observed by people who witnessed this action...
      I presume this happened off screen and we are told to BELIEVE...

    The two lines that they skip from the movie Shooter that they really should have put it on it... Are both from Julie Fen. The first is where she is told that he's hold up on top of the hill and under attack and she looks at him and says if he's on top of the hill that's where he wants to be! Second of all is the line where she looks at them and says you're not hunting them he's hunting you!
