- Officer Joe Gutierrez of the Windsor Police Department in Virginia, who held a Black and Latino army lieutenant at gunpoint, handcuffed him and doused him with pepper spray during a violent traffic stop last December has been fired, officials said. Bodycam video of the incident shows Lt. Caron Nazario attempting to deescalate the situation, which was apparently confusing to him, as he asked what was going on several times. He was released without being charged, and is now suing the town. #InsideEdition

@McArthur Nah bro. The cop was behind the vehicle at the beginning of the scene, telling him to get out and get on the ground. There was space between them. He should have gotten out and laid on the ground. Boom! Instantly deescalated.
He should have been scared the moment after he decided to stay. The officers were already committed to the detaining. Since he didn't get out, they had to go get him out which instantly makes it more dangerous for everybody.
Would you feel more safe listening to a cop while he's ten yards away that told you to exit the vehicle or would you feel more safe having the officer pull you out?
Since he wasn't listening, he should be afraid, yes, because now the situation has escalated and not because of the cops.
The citizen shouldn't be the one trying to de-escalate the situation, this just shows you how bad police training is.

There was a time long ago where the base commander would have dealt with that directly with the mayor. It would typically begin by canceling any leave off base after hours. Eventually the police would have apologized and made some restitution.
Imagine being in the Army, making it through a potentially deadly mission in a warzone country, finally being able to fly back home to see your family, and then nearly getting shot by cops while wearing your uniform. wow.

the guns got drawn because the suspect was evading a stop. You would get charged for it if you did it, the only reason the officer did not was because he was a ranking officer in the military. He had political sway. There isn't a right for you to get into a well lit location. You hear the sirens you're supposed to stop.

people don't understand, the door was locked and in order to unlock it, he had to reach his hand where the cops couldn't see, so really he couldn't get out of his cars unless he wanted to be a corpse.

Uhhh. In any high risk stop situation similar to this one, the officer would instruct the driver to open using the outside handle not inside. The officer handled this situation poorly.
Hearing a authority figure suggest that you "don't ask any questions" and "hopefully you'll be aware of what you did while you're getting detained" is repulsive and baffling, the fact that she meant it is just sad.
But I agree with the point she is making, that the side of the road is not the place to fight the legality of the stop. If your going to be arrested, take the path that's less likely to get you killed. This fight belongs in the courtrooms, not the traffic stop.
I agree. That’s a violation of a persons 6th amendment rights. These rights exist so you can be afforded them, not so you can spend years in court trying to get them acknowledged AFTER they’ve been trampled on.

However the officers not communicating whatsoever beside making conflicting demands is what let to a "fight". you should be able to fight the legality of a stop immediately, the moment you go against the law they can enforce it but if they don't disclose what you did to warrant the stop than why let them do anything. I agree on not fighting the cops on the streets though, if they do anything to harm you or is a clear violation of rights then the battle is in the courtroom, don't go running from them or try to attack them (obviously). But what they did to this guy was beyond excessive, he wasn't violent at all, he tried multiple times to just talk, and he's serving in the military.

This is why military personnel (and police officers) all get peppered sprayed during training ahaha. My brother is in the navy and he had to get pepper sprayed as part of training. The pepper spray is usually stronger than stuff in the civilian market.
