  • In this video we will try to answer the question, Can you Apply for OPEN WORK PERMIT and SPOUSAL SPONSORSHIP together?
    So, through out this video, we will work under the assumption that you have already applied for permanent residence under spousal sponsorship. And within that we will cover these two cases
    1) you are an outland applicant - meaning applied from outside canada under family class spousal sponsorship and
    2) you are an inland applicant - meaning applied under spouse or common law partner in Canada class and
    for both cases we will understand how to use IRCC’s online tools and questionnaires to find out if you are eligible to apply for open work permit while you wait for your PR application to finish processing.

    You are life saver, my husband is a citizen and I will be moving over to Canada in Jan 2024. I have applied for permanent residency and approved in principle, hold a CSQ. For weeks I have been trying to apply for open work permit and kept on getting an error. I tried testing your method and it worked, so I will be applying when I arrive.     Hello Suyash! Thank you so much for helping us so much! It can get so complicated and confusing with so many processes, and waiting and forms. I have a questions as I am quite confused now. When I applied for my PR sponsored by my common law partner(inside Canada), at one point of the payment it was asking if I wanted to request the Open work permit while waiting for my PR application, to which I said yes and paid for that at that moment so I understand I do not need to do anything further for the OWP after, but now you are confusing me saying I need to apply for it after getting my AOR. So what would be the case for me? Thanks!! :)

      Follow up; do I really have to wait for the "stage 1" approval or can I apply for the open work permit at the same time I send in my sponsorship ?

      That is what the instructions say. That said, Some people have had success even applying at the same time. So its up to you. Safest option is to go by the instructions

    How’s about open work permit for spouse of PR’s holder? Not sponsor( because they don’t plan to stay in the country permanently, they don’t do spousal sponsorship)

    Hi. I have a questions, is there any conflict if you applied for spousal open work permit first (inside canada) & still no update until now and then submitted a permanent residency application after a month, coz’ my husband received an email that he needs also to submit my permanent residency requirements Since we got married last June 10, 2023 and my husband just update his marital status from single to married in his permanent residency application. And one last thing, the validity of my stay in canada will be on November 13, 2023. What’s the best option for that?

    If Principal applicant is already on workpermit which is going to expire soon. Can they apply for extension along with spousal sponsorship. Because I do see extend your stay imm5710 form under additional documents section in spousal pr portal. Or they need to wait for AOR as well

I have applied under inland spouse sponsorship and after 1.5 month I have received auto generated email with application number saying this confirms that your application has been received by CIC etc but there is no attachment(pdf) for AOR . Once the whole spouse sponsorship process went online since September, I heard that the principal applicant should make the account in the PR portal even though they are using their spouse as their representative.       Correct, your citizenship status has nothing to do with her eligibility to apply for OPW. Since you have already submitted an outland application for her, she cant apply for OPW as of now.

    I have a question,
    I am a Canadian Citizen, and my baby was born recently outside of Canada. My understanding is that she is eligible to inherit the citizenship through me.
    I am in the process of submitting my wife's PR, with my new baby.
    how can i address this? the baby is not yet a Canadian citizen, but eligible for it. She also does not have any passport, so even if she gets a PR, she has not travel document to use. Ideally IRCC should understand that the Wife is applying for PR, and the baby is eligible for Canadian Citizenship. However the system does not seem to have any integration for this. Please help. thank you.

      So the baby would need a passport to travel to canada. I think you can apply for the baby’s passport from outside canada at a Canadian embassy. But that might need a proof of citizenship so this is tricky. I am not aware of how long the citizenship certificate process takes. But there are people that share the same situation as you. So this can be done. Best option is to talk to a regulated professional to figure this out. Mean time check facebook groups on spousal sponsorship may be some one shared details there

    Nowadays you can apply for an open work permit on the PR portal together with your in-Canada spousal sponsorship without receiving Acknowledgement of Receipt and it saves a lot of time. You can upload IMM 5710 in pdf. file on the PR portal together with other documents. So you don't have to wait for AOR to apply for an open work permit. I don't know if this is possible. Some friend tole me this.

      There is no set number mentioned in the instructions, you can provide as many as you feel necessary to justify your case. I provided 6 when i sponsored my wife

    I am a Canadian permanent resident and my wife is a US citizen.
    If I apply her Canadian PR in the "spouse or common-law in Canada class" category and if she receives her AOR can she go outside of Canada i.e. to the USA? if not then if she gets AOR and gets her Open work permit can she go outside of Canada i.e. USA considering her PR application is in the process?       Short travel is ok I guess, 2-3 weeks. But the spouse or common-law in Canada class requires the PA to stay in Canada for the entire application duration. So, keep that in mind. Travel after Open work permit is relatively less risky. Try to Check with more people who might have done this and see if you find more information.

    Hi Suyash, I would like to know how to upload imm5707 family information form. CIC guide states that 'this In the Family Information form (IMM 5707) part of the document checklist, upload the Family Information form and your marriage licence or certificate' but there is no spot for imm5707

      You can but the chances of getting accepted are slim. You need to prove quite strongly that the principal applicant will return to their home country. Look into “dual intent” and see if you can make it work

And I want to apply for an OWP as soon as I receive the AOR, if I apply for OWP and it is in process, will I have to extend my visa to stay here? Or will I automatically get a maintained status?

      @@mastergee84 No one gave me a clear answer. However, it says that when you apply and having a pending application, you may apply for her visit. The approval depends on the stage of your original application. The more advanced your application in the stages, the more chance you will get your visit visa approved. I hope this help.

      You will have to pay again. But you can request a refund of the previous one. they will issue the refund

    I am still confused , hoping to get a reply. I am in Canada(work permit), my wife is in India. I applied for PR in Nov 2022 and added my wife as well to the PR application. Got ITA , medical and biometric updated for both of us. Can we apply for a SOWP and bring her in to Canada? I guess it is NO? please reply.

    Hello Suyash. I have sponsored my spouse as overseas application and I’m currently on “Eligibility” stage and have been there since 22nd September 2022. I have sent the medicals, biometrics, RPRF, and all documents. How much do you think the “eligibility” and “background check” last each? How was on your case? It has been almost 4 months for me in the “eligibility” do you think it could take more?

    Hi Suyash. Thank you for your wonderful videos. I have a question. I have applied for my spousal PR inland. My visitor visa has expired. When i try to apply for open work permit , there is a question “when does your status expire in Canada?” As my visitor status has already expired in Canada, what should i do? I am not able to apply for open work permit without answering that question. Please help me I am really worried about it. Thank you in advance 😊

      if its expired, you must be truthful and answer with the date of expiry. also attach proof of how you intend to maintain status now so the officer knows that you are not overstaying your visa limits.

      @@Stories99 Hi, As I entered the date lesser than today and applied for my open work permit. They rejected my work permit saying that as I applied for my open work permit after my visitor visa expired, I am not eligible for work permit. So I would say You should only apply for open work permit before your visitor visa expires otherwise it puts a negative impact on your application. If you have already applied for visitor visa extension, you should wait for that while staying in Canada until they respond. I hope it helps!

    Hi, I have applied for the spousal PR from inside Canada and at the time of submission, the website asked me if I also intend to apply for the work permit. I said yes and I paid the extra fee for that. This means that I have already applied for the SOWP and there would be no need to do it again from the way you mentioned in this video?

      Hmm, this is tricky! Since you have already applied outland, technically you dont qualify for SOWP. Since that option is for inland applicants or Spouse or common law partner in canada class. So even if you might come to canada on TRV, you’ll still be considered an outland applicant(Family class) so I don’t think you can apply for spouse open work permit.
      But, my information may be outdated so double check on the IRCC website or ask around and see if it’s possible.
      Also, congratulations on getting the TRV with an already ongoing outland application. It’s one of the hardest visas to get with a pending sponsorship application. So you must have really gone the extra mile to get it done!
      Would you mind sharing how you got that done? What documents did you submit? You can either post here or email me/DM me on instagram with a message. and then I’ll make a video so that it will help other applicants in understanding the dual intent process.

      @@HitSubmitCanada Veere my case is very different from others. I was in Canada on study visa and got married to my Canadian wife after her university when she turned to 19. She applied for my Inland PR Unfortunately, I left my college and got 1 year removal (Expired). First of fall, my Outland Spousal PR is in process and in TRV we added my wife's physician letter which is 100% true that her Indian Visit can be harmful for her health due to horrendous air in North India and Sponsor Letter was Notary Attested. Even we have all Canadian Papers like Joint Car Ownership, Tax Papers, Joint Bank Account and living proofs which clearly declare that our relationship is true, added in Outland PR Application.
