These Montana Kids Are Suing the State Over the Environment

  • An unusual provision in Montana’s state constitution guarantees a “clean and healthful environment” to all residents. Now, a group of children in the state are suing the state - saying that their investment and reliance on fossil fuels actually violates their constitutional right.
    In June, Held v Montana will become the first youth-driven climate lawsuit to make it to trial in the entire country, and could set a precedent nation-wide when it comes to how governments need to handle the climate crisis. Vice News met some of the plaintiffs in this landmark case to find out how suing your state could be a new approach to accountability.

    I love how these kids and their organization were labeled as “people taking money from out of state” insinuating that that is somehow a unique or special thing, when the politicians probably take money from out of state as well

    Hell ya. As a guy who grew up in Montana and was involved in my cities politics starting in high school I will say that its probably one of the only states where our voice actually had the chance to change things bc you can so quickly be directly talking to those who enact legislation. So this has a good chance of actually making some impact, albeit going against the fossil fuel industry is the ultimate David v Goliath

      So no complaints about cutting down the trees to make the ski runs. Nor making the electricity to operated the tows. Nor energy and mining to make the steel. Picking and choosing ones preferred virtues and vices is the rock solid foundations for all moral pedestals. It might be more useful to question why an 'OPINION' about the effects of GLOBAL WARMING morphed into a SCIENTIFICALLY PROVEN FACT about climate change, without there being any intervening proof?????? Repeating something loud and often, whilst proclaiming "it must be true, because many other people say so" is not proof. 10,000 so called climate experts repeating other so called experts opinion, actually means that 10,000 so called climate experts have been unable to find the actual evidence they keep pretending exists. If you are REALLY concerned about climate and GLOBAL WARMING you should be wondering why the AEW weather system is operating at about 60 per year, when all the evidence is that there would have been about 100 p.a. pre 1900. Do some actual scientific research, rather than just repeat other peoples opinion. 10,000 people repeating an unfounded opinion, means that it is still ONE unfounded opinion.

    I spent 7 days in Ashland, Montana. It was shockingly beautiful. I can understand why these kids are so passionate.

      It's beautiful for a reason. Montana is a state that is clean despite what these kids say. They keep mentioning climate change. NOTHING on how the area is being polluted. Nothing on how the water ways are dirty. NOTHING on how the air is hard to breath. Just "Boo hoo we're getting more fires and rain and wind :c BAD FOSSIL FUESL!!! Wind/solar energy will make the bad weather go away!" Lmfao No!! Do these monkeys realize even if Montana got rid of ALL the fossil fuels and converted entirely to electric or clean energy...the REST OF THE WORLD STILL EXISTS!! Clouds don't just go "Oh no, that's Montana and they have a clean energy law. We can't do our usual climate change business there."

      For this to change people need to stop doing what other generations have told. Like if you live somewhere bike friendly then choose a bike and there is plenty of cheap ride services such as on demand which are available. I sold my car 6 years ago and chose to bike everywhere because it keeps me in shape and cuts my carbon footprint. Even in the hot Florida sun I will chose biking over the cost and maintenance of having a vehicle.

    Civil servants should be federally required to take interviews on topics immediately impacting the people (w/ times and amount limits per topic) done by journalists. They are supposed to work for the people, not for corporations. And even though Citizens United said corporations are people, corporations can't vote. Letting them avoid culpability shouldn't be an option.

      Not deregulation, but reconsideration. Deregulating means no zoning laws at all, which will encourage harmful types of businesses to open up in places they shouldn’t.

      The kids would have no chance of getting the state government to discourage animal agriculture or encourage a more plant based diet. Montana is one of the top beef producers. On the other hand, basically everyone can boycott animal products. Going vegan is the single most effective way for each of us to minimize our environmental footprint.

      ​@@someguy2135 you know when all those farms that grow h your vegan food, are setup they totally destroy the originating habitat, killing or displacing all the wild life, planting monoculture crops. Spray it with pesticides killing every bug, and animal, while exposing the farmers to carcinogenic chemicals. I love how vegans think they are somehow not destroying the environment because what they eat its plants. Do you know how bad for the environment growing rice is? And the amount of water used. Plus nothing lives where your food grows. Farmers and people don't like bugs. You pay just as big a role in all this as everyone else. Get off your vegan high horse, and stop throwing meat eaters under a bus. There is almost nothing that we do that doesn't destroy the environment. And it's ignorant to think that you don't, or do it less than everyone. And that your some how morally better than people who aren't vegan.     Man, I'm 45, I say all the time, my generation built a lot of the tools that the newer generations are using to subvert the lies that were first told to us, and we didn't know how to overcome, so we built platforms and such. I feel like the generations after us, and then our kids, are all taking the torch that those of us who suffered from the boomers, and keep passing it along.

    As a 29 year old male who also grew up in Montana, it’s great to see the younger kids getting more involved…Montana has a-lot of problems…Extreme climate change and an economy based on fossil fuels and tourism….if your not working in the mines, logging, or construction….your working for the tourists and other rich people who exploit the land and it’s experiences. Housing has nearly pushed me out of my of my home state…looks like climate change will make the final blow.

    You go for it. Keep on pushing. Your voice counts. Governments need to change in a big way, it needs to stand by its citizens and not huge corporations. If law was changed that all new and existing businesses had to have a solution to the waste created by manufacturing or at the consumer end and this was a step added on their business model it would have a big impact. No licence or business registration or legal operations would be granted unless there was a sound, viable solution was part of the business, period. From water, power usage, the source of that and the end footprint of that business. It would totally change the way people did business and thought about business. By entrenching sound policy would mean people would have to actually think about what it is they are doing rather than being profit driven. Governments today are deeply invested in harmful business practices so they can keep their elected seats and keep their wallets full. It's a vicious circle that needs breaking.....badly.....and now.

    You might wonder why this lawsuit wasn't on behalf of adults. Adults are the ones with jobs that often depend on the fossil fuel industries or are connected too intimately to go against. Also, kids don't usually own stock in anything, let alone fossil fuels.

    I’m happy to hear this, I worry about young folks. I wonder how they are going to get through this. They will need to start fighting for themselves and the children they may have. It’s sad we are leaving such a mess behind.

    The past 20 yrs have been extremely depressing for me. I got my geology degree the yr Bush got a second term. Zoomers give me hope because us millennials couldn't get enough gen Xers and boomers to care. As more and more young ppl graduate - we might actually have a chance to fix this mess. Older generations assume they'll be dead by the time things get a lot worse.
    As an FYI - the number one driver of climate change is military movement (Not just in times of war).

      as a gen x-er, I have cared my whole life. getting people to overcome the marketing myths: recycling and electric cars are not solutions -- is hard. Contact companies, tell them you won't buy their single use plastics when so many alternatives (foil, waxed paper, novel palm, seaweed, fungi based materials) exist; look into energy sources and production impact, and your local laws.

    Good luck to everyone involved! Actually surprised I haven’t heard about this case because my dad is a plaintiff attorney in Great Falls. Greg Gianforte is a plague to our state and should lead the way for Californians like himself to go back to where they came from.

      That was my thought too. It’s great what they are doing yet,it takes a lot of energy to run that chair lift so skiers can don their petroleum based trendy clothing to hit the slopes. Real change has to be across the board. It would be easier to take these people seriously if their lifestyle reflected actual change and accountability.

    Montana has lots of remote land and relatively little existing development, the State should become a national leader in safe, affordable nuclear power and state-of-the-art electrified railways.

      @horace sheffield actually there are proposals right now for a rail line that will run in the southern part of the state, connecting all the main cities from Missoula to Billings to SLC and Minneapolis. There wouldn’t even be any construction needed because it would just utilize currently existing rails.

The fallacy of clean energy by way of solar and wind stored in batteries can fix all energy issues all while being ecologically friendly and cheap shows no foresight for how this particular industry works. Look into which rare earth minerals are needed in the manufacturing of solar panels and lithium batteries, then you will see how slave labor is used for a "cheap solution" .

Would you like to mine with tools or should we just use laborers? Tools need oil Katie. Wind-mills need oil and batteries, solar requires batteries and also has byproduct heat potential. Not seeing how any of these options are currently more eco friendly or less expensive. If you can't make alternative energy solutions work without fossil fuels it is not alternative to anything, it's just another form of costly energy that can be used "with" or "because of" fossil fuels.

      The alternative is going back to basic needs. Every person needs to plan out their week more consciously. Could they bike or bus to work that day, make a list so your not making as many trips to the grocery store, start a basic garden to get your feet wet, think about exercising running from your house or on bike instead of going to the gym. If a family needs to have more then one vehicle because their work makes them then I understand, but if you don't then there is no need for excess cars. Another sad aspect of this is really determining if you want to have a family. I think a lot more millenials are debating having kids because of inflation, possibly gen z as well. It's not so much of a political issue, but an everyday issue for every person.

    This should be interesting to see whats going to happen. Montana folks love their meat 🥩 & lets see how much dear & elk can support peoples meat habits? Bet it will not last long bc theres going to be an increase on people hunting & fishing licenses & they will be more expensive.
    Reality is everyone will have to put in solar-power in their homes & that cost is higher then power stations. I battary cost ove $1,800.00 for one lithium battery & for a 2 bedroom house the solar system was going to be over $100,000.00. Who has that kind of money seating around in their bank accounts. I do not bc I'm on a fixed in come of $1,500.00 a month & theres older adults that make less then $600.00 a month & they have to choose from either their medicine or there food for that month. Think about it do or would you want to eat beans fixed 7 times a week 7 different ways for that month or 30 to 31 days. Not me bc I have diabetes & then it's going to cause a hole lot of different problems for people & older folks that have to have a certain type of diet.
    Diabetes have to eat a crazy diet & i can not afford fresh veggies or fruits on what I make in a month being on a fixed income. All my medications i have to take cost me over $700.00 a month. I can prove this. By the time i pay all my bills for the month I'm luck if I've got $50.00 to my name. I do not go out to eat, go see any movies, go on a date night with my husband of 33 years of marriage & it sucks, but we play cards, board games, watch a movie & do things around the house. We do not even buy our grandchildren presents for Christmas or their birthdays. Really when you have to take 5 insulin shots a day @ $170.00 a month & your husband takes 3 shots a day, you just don't have money to spare for a solar system or a $120,000.00 electric car.
    Do these kids know how the lithium batteries are produced anyways. It will cost you well over $150,000.00 dollars to have just a half of a cell wall to power your house with no A/C thru-out the evening & remember temperatures are rising. This also means your going to have to have a 2nd solution to heat your houses in the winter time bc it gets down very cold temperatures in the winter months.
    Well wood takes gas to cut it unless you & a friend are going to buck the wood. Don't know what bucking the wood means. Oh wait you will not have electricity to run your computers or cell phones to use google or a surch engine. Oh my God you kids will be lost without your games.
    Guess you kids better study up on how hard it was durning the great depression when your great grandparents couldn't find a job or pay for food & medications. A lot of people died, even kids & babies. Bc they had to have them out of hospitals in their homes with no floors & no running water. They used oiled lamps, put out & grew their own gardens & milked their own cows with no automatic milkers. Only with their 2 hands & then had to walk to school in cold weather.
    Yeap i hope this lawsuit doesn't come back to bite these kids, suing the government, in their a** called "KARMA" I'M JUST BARELY MAKING IT ON WHAT I GET THRU-OUT THE MONTHS NOW.
    Just hope you all think your doing something good for your family & stare!!

      @@tccragun MT has had a state energy policy since 1993. It's sets out the goals for energy development in the state. It includes fossil fuels, renewable energy sources and up until last session, climate change goals. While it isn't a regulation or law that is enforced against anyone it did serve as at least a little guidance for achieving a sustainable energy mix for the state.

    Another thing that needs to happen is to make solar more feasible. Right now they are expecting everyday people to take out loans for 40k+ solar panels systems on their house which isn't realistic for most people. They need to do massive grids that are subsidized by the government. Also, carpooling should be less stigmatized we live in a society where people drive around selfishly to show off their ride, but if jobs had more carpooling it wouldn't necessarily cut the amount spent on gas, but would cut down the need for cars and maintenance which would indirectly cut down the need for fossil fuels.

      The only clean and safe nuclear power plant we need is located 93 million miles away. Cooperatively owned solar photovoltaic combined with pumped storage is the only long-term viable solution.     I wish they’d ask what their ACTUAL plan is if they got their way. Montana’s economy is reliant on fossil fuels, if these people got their way you’d economically devastate the state and others like it. It’s also one of the coldest states so battery life on EVs would be cut in half for most of the year.

      Montana's carbon impact clearly is not at the detriment as much as cities are which need to start valuing community gardening, ride services, and exercising at the basic level (doing it from home or leaving their house on foot or bike not using a car to go to the gym and get exercise). This would all cut down on the need to drive excessively which will directly reduce the need for fossil fuels.

    Great job. I sell fuel for fire places and wood stoves and soft sulfur coal I dig on the river banks. No natural gas for heating or cooking in Montana. Cutting trees and erroding river banks and burning sulfered coal and wood is so much better for climate change than nasty ole natural gas plus I'll make a lot of money and I'm completely unregulated in a state that has long very Cold Winters 🥶. Thanks again for the boost in business
