  • Pretty upsetting. 4wd 24/7 went out of their way to take down our latest video because it had 10 seconds of 4wd Action footage in it. Now we have a copyright strike on our channel. This wasn't an automated system, this was them going out of their way to take the video down.
Sharing this because you guys deserve to know the truth, thanks for sticking by us 💛

Mate, as a big 24/7 fan, I have to agree with most others here in saying poor form 24/7. There is more than enough room in this market, especially for a young bloke just starting out. This is the problem with getting big and becoming "trending". The business ends up with more staff and more costs and before you know it, you have a whole production team and part of their job is smashing all competition to their product. i.e. Shauno, Graham, Jocko and the boys. I think you hit the nail on the head when you said, "don't get up Shauno etc...". You are more then likely right about the reason for the strike.
Having said that though, with the small amount of footage you appear to have used and the fact that you were using it to COMMENT on the 4WD industry over the years in Australia I would say that you have a very good case of fair use.
In its most general sense, a fair use is any copying of copyrighted material done for a limited and “transformative” purpose, such as to comment upon, criticize, or parody a copyrighted work. Such uses can be done without permission from the copyright owner. In other words, fair use is a defence against a claim of copyright infringement. If your use qualifies as a fair use, then it would not be considered an infringement.
Either way, good on you for the effort and for taking a leap on something you obviously passionate about. You get a sub from me:)

Thank you Ro! really appreciate you taking the time to write that, ! yeah look it sucks but its just a bit hard to try and fight this legally which is what i would have to do to get the strike removed. i definitely believe its fair use, just a bit scary trying to take on a huge media corporation with actual legal teams etc. but thanks alot for your comment and support Ro, it means the world to me :) cheeers

Like the ricer owner with a huge turbo with 20lbs of boost and nitros bagging a stock V8 and the ability to beat one... cool, put a huge turbo with 20lbs of boost on the V8 and see what happens: motorcycles much the same, Harley’s are for plodding along and enjoying a slow pace, they don’t go fast, don’t handle or even stop all that well, sports bikes are for hooning and even a 600cc will flog a built 2l Harley engine, there’s no comparison and there shouldn’t be... You buy you like, want, can afford and enjoy and then when you’re old like me you’ve likely had a bit of everything and maybe still do: point, you or at least “I” don’t enjoy my vehicles any less because I’m 65 years old, I’ve actually enjoyed them more over the past five years than at any other age and they all get used... and abused as intended.

I've been into 4X4's my whole life and the worst thing that's ever happened to the scene is it getting popular, it's what's brought all the negative attention and led to closing tracks ect. I think the thing that's really wrecked it is these modern 4X4's that drive like cars, it used to be that you only drove a 4X4 if you really wanted one and were prepared to live with the compromise, now you don't have to, a new 4X4 drives as well as a new road car meaning far too meany people have them are far too meany people are out in the bush and along with them come all the inevitable regulations that go with the popularization of it. The popular RUclips channels and the associated media also have a lot of the blood on their hands in this regard too and i cant see it going anywhere but further down the negative road from here.

As much as I've only got into 4wd/camping, in the last 3 years, I have to agree with you.
I deliberately go to remote places to camp and enjoy the beauty and tranquillity of the Australian bush in a pretty much stock standard 76, and arrive at a camp site to find young (and old) dickheads revving the shit out of their vehicle, along with their stereo system blasting out whatever bogan fm station .
Leaving shit all over the place, and yes I do mean SHIT.
When they do leave the camp site, they usually have to let everyone nearby know how small their dick is by the over compensating wheels and massive phallic UHF antennas .
The same types that rip up and gouge out all the tracks, thus making it inaccessible for others.
You get the picture, I'm sure.

Great video. Well done. One other major contributor to the younger group switching to 4WDs was the introduction of the hoon laws. People quickly learnt that there wasn’t the level of scrutiny out in the bush and they can have more fun legally with all their mates out in the bush.

Just wanted to make a second comment addressing copyright on RUclips. Basically, its complicated
I know people only think I have been around for a little bit but trust me i have been heavily interested with what RUclips is about from the early days. RUclips copyright is interesting and I am no expert but I have really tried to stay up to date.
So the RUclips copyright system essentially works as an honesty system, it works well but its never perfect. So essentially if someone has put a video on RUclips and someone uses that footage for fair use. 100% legal and fine.
So the issue is not copyright but more what classifies as fair use. There was a huge case that went on for years between H3H3 and another content creator, H3H3 ended up winning in court which was a huge step for defining what fair use is.
You know those reaction channels? The ones that dont offer a lot of their own original content along with the original video itself, technically that's not fair use due to them not adding enough editing, original content or using them to develop a discussion.
In regards to this specific video I believe he is well within fair use as he used the content to further develop the discussion and strengthen his points, he also used very minimal. I also didnt see the original video so im not sure if there was direct credit to their youtube channel but it seems like there would of been.
A strike is VERY different from a claim. A claim is someone saying hey you used something of mine, id like to get all the revenue you earned from it and youtube will also not promote this video as much. A strike is saying you 100% ripped their content and you're channel gets a bad name with RUclips themselves meaning they will not promote you're videos or your channel as much as they used to. Also 3 strikes in a month and your channel is gone forever. Not really fair if they are not legitimate strikes.
4WD Action is not 4WD 24/7. 4WD Action is owned by a media company, 4WD 24/7 is something else.
To me its concerning that they have claimed this, I hope its just a mistake (Which it very well could be) and not a company thinking they can walk over individual creators.
This is the RUclips game, it's very different from TV

    • @MrJoshItIs
      @MrJoshItIs 4 года назад +3

If that is the case then a strike is super harsh, over-reaching as it were and a claim would have been sufficient until the OP edited the content. Poor tactics I'd say.

I didn’t see the original video, but if such large chunks of the content are used with the original sync sound and minimal voiceover during those parts like this new version, I can understand why they would arc up. Some of those commercials may be old, but used in their entirety. Music etc. too many things in this video seem to go a bit too far. But yes, agree, probably 4wd247 could have just chucked the boy’s a message and it could have solved a bit of heartache.

Saw the vid first time round, and thought it was nice of you to give them credit for inspiring others and increasing the popularity of 4WDing. Which is what they say they are trying to do.
I thought you were giving Supacentre a bit too much credit. But with the number of Kings awnings I see rollin around...(sigh)...maybe you're right.

You're absolutely right! It's pretty interesting that having a fast car was the aim for those getting their first car 15 years ago, but now the 4WD/large ute is so much more popular for those age groups. I think the Hilux or similar are popular for people a little older (30s) because they make a great work vehicle as well as an adventure vehicle for the weekends.
Maybe it's because we're feeling more cramped in the cities, with increasing populations and smaller houses, we feel the need to "get away" more often. There's got to be a bit of a measurable shift. A very interesting topic!

Your timeline coincides with our "4x4" time as well. Late 80's and Early 90's people in South Africa started exploring Botswana, Namibia and Mozambique and they needed modification. They started building things themselves and other people see the mods and also want similar things. And right there you have a new industry...
After this Covid is sorted, myself and my family will be leaving South Africa for a better place and Ozzie is one place we are SERIOUSLY considering. The lifestyle is similar, people have the same idea about outdoors and we would fit right in. I think it would be a great place to live 😁

Guys... 4WD 24/7 sold their soul long ago for the corporate buck. They are now cliché and boring, but they did recently demonstrate that the GQ patrol is worth more consideration. You and your content is currently so genuine it has given me reason to believe that there is actually some in the newer generation that still get it. How you decide to travel on the cash cow train in the future will write your script. For now, I would really enjoy a fire side chat with you and your crew. In fact, I would love to meet your Dad. He did a great job exposing you to opportunities, but at the end of the day, you are what you chose to be, so enjoy the ride. Your perception of the planet is not shared by many around you, but it suits me to a tee. Stay genuine. It is the trait so many others lost along the way, and it is the most saleable trait there is.

Great content mate. The copyright complaint isn't surprising. Something to keep in mind is Businesses like these have built a business on advertisers not having the expertise, staff and resources to create their own content. This landscape is changing as young people like yourself are learning about content creation, being creative and entertaining and as you enter the 4WD industry, opportunity to create commercial content at very little cost opens up. Think about this, a business spends say $100k on trips and advertising with them, what could a business do with that money and you as an employee? I present and make content for a living as a full time employee, in 2 years we've produced hundreds of video tutorials, marketing content etc etc for a fraction of the price in house, that we would had to have paid if we used a production company. You mate, are part of the future of commercial in house content creation, for every young person like yourself that ends up working for a business in the industry and given a chance to create content, there's one less business reliant on production companies and productions like theirs. From a business sense, you're a lot more than "just some guy that borrowed 10 seconds of video".

  • @nissan_tb48
    @nissan_tb48 4 года назад +14

Loved the video! but I really wish the important aspect of picking up your own rubbish when out exploring and camping was mentioned in this vid. One of the biggest issues with the rise in 4x4 popularity in recent years is the pollution being left at campsites all around Australia. We know its only a small percentage of 4WD owners and I'm not saying its the fault of "P platers" because dickheads of all ages are the cause of this, but it definitely needs to be addressed more often to promote responsible 4wding and camping habits. Not just because its the right thing to do for the environment, but because no one wants to see 4x4 tracks shut down by the local governments. Another one I'm sure you boys would agree on is hooning. Too many dickheads wanting to impress on social media, are out there trying to do wheel-lifts around corners on roads and ripping donuts on tracks tearing them the fuck up. I mean its all good if you wanna do donuts on sand where the wind and water will erode the sand anyway, but that kind of behaviour is why cops are targeting and issuing hundreds of yellow stickers a year to innocent 4wd owners, as we are all sadly being put into the same demographic. Heres me hoping maybe yous legends will make a separate video to address those issues 👍

DPF issues, who cares about the teething issues of carbon burning? Toyota have a fix and/or replacement warranty of 10 years and even so, the dpf has no bearing on anything serious.
The Ranger will (and is) have more issues and on record you would say that's a fair educated guess that it wont last as long, but its not a crap 4WD and should get through to at least 250k. The hilux is different ofcourse, everyone knows Toyota don't build for 250k, they build for 400k+.
Both are improved on previous models and built tougher than the 4wd's of yesterday, from improved chassis strength to mechanics right through to the diffs. The bodies on these new utes however are as soft as tissue boxes and thats probably an issue to you, but its not to blokes like me.

@@roshanchitan1997 Gen 3, 3.5L Petrol V6. Videos of it on my channel. I had to replace my timing and being on a pension I simply could not afford it. I was originally told the Clutch bearing was the issue so spent $1500 getting a new clutch installed only to have the same problem. I eventually got the money together and purchased a full timing kit including water pump, New set of Lifters, New spark plugs and leads etc etc and had a mate help me replace it all in my driveway. Also had to replace both front hubs so it all got done at once. I still have to replace the suspension as Ive added some new mods and the suspension has sagged (Battery, Fridge etc). Good part is now I know how to fix a lot of the stuff myself so if Im touring or even local I can buy the parts myself and fix many of the issues.

Great times, but I would say that the 4x4's were still 'mass produced' well before the 90's as I remember them. Hell, even our old 2 door Jackaroo was a beast way before the Ford Territory. Being a country kid where every farmer had a vintage Land Rover, wether a IIA or a III 109” with the stout 2.25l petrol 4WDs we’re always a practical tool on the farm. To this day an adventure is pointing that stubby Birmabright clad nose west and pushing down the yellow lever. And yes, I’m still young but these old non synchro mechanical rigs are my passion. Still shows these new fancy pants rigs how it’s done even after 50 years!

In my opinion I think one point you missed was that road laws have gotten stricter and stricter and the people who were thrashing JDM nuggets and Aussie sedans (and wagons 🤙) have gotten over the police crack downs and harassment and for many years 4wds were over looked. Also many of the young guys who were driving Silvias, skylines, wrx’s, commodores, falcons and so on have now got family’s and their interests have changed. Thus adding to the 4wd market. At least that’s my experience

The 4wds of today wont be anywhere near as sought after as the 4wds of yesterday. The 4wds of yesterday were over engineered reliable and easy to fix. Todays 4wds are thin pieces of crap with paper thin chassis piss weak small over stressed motors and to many electronics to be reliable long term. They also rust at the drop of a hat
With the explosion of 4wding more places and tracks will be shut down, especially with the flogs of the "send it" generation. The tracks are being ruined at a rate of knotts that parks and wildlife will be forced to shut things down. You only need to look at where the houses are being developed all gated off... yet some flog 4wd owner has smashed the fence down to access an area. May as well enjoy 4wding it while it lasts....
