    I'm not a lawyer, but it seems that calling a lawyer to the stand without attorney/client privilege waived, is the height of desperation.

      No. It is done to ASK those questions. You don't necessarily need answer. Jury have already heard a bunch of a very suggestive questions. According to law it is useless but it have some influence on jury.

I think more what is going to stick in people's minds is the even toned reasoned responses and reasons why they can't be answered and shouldn't be asked to begin with rather than evoke any particular suggestion of the questions.

      @@missaisohee no seriously, I know nothing about the case or who this guy is outside of watching the trial (I never watched any TUG videos for example). And the imagine I had in my head was of a loud mouth jerk who was spouting off all over the place. Heard’s team brought him up a lot in a negative way. Plus I knew for some reason that he wasn’t representing Depp anymore.
      I’m sure the jury had their own version of this guy imagined in their heads…but then they just dispel everything and show he’s a pretty chill dude.

    Elaine is the perfect example of why you need to find a lawyer that has knowledge in specific cases. Elaine's bread and butter is business, employment, and discrimination/civil rights not defamation. The reason that Adam is not working with JD on this case currently is because his specialty isn't defamation either. JD was smart enough to hire a firm that does this type of case.

    You can tell Waldman knows how the show works. He pauses long enough to give Chew the opportunity to object, but not long enough to seem evasive or defensive.
    Also, you'd have to be a real boomer not to realize that a Twitter suspension doesn't mean shit because their rules are arbitrary and enforced by ideologues.

    I love how respectful Johnny’s lawyers are to ALL of the witnesses time as opposed to Ambers lawyers. This full hour was almost all Ambers lawyers asking questions they knew he wouldn’t answer.     This strategy of asking clearly objectionable questions has a huge negative effect on the jury. They have already spent an enormous amount of time sitting there day after day listening to testimony. The jury isn't even paying attention to the questions after being asked 5 sustained questions and they start to feel this line of questioning is a waste of time. It's important to build a likable image as a lawyer with the jury. It's hard to believe the jury isn't showing impatience at some point during this testimony. Terrible move by the defense. It's also noteworthy the duration of each objection. Prolonging each objection for as many reasons as possible was also a brilliant move.

      I wonder whether they left the objections in as a strategy they believed would play favorably for them, (objection = something to hide) which we all know the court cannot infer from objections. Or Amber's legal team is actually as bad as people have claimed, Eliane not realizing she's asking unanswerable questions. So either a futile idiotic strategy or oblivious questioning.

      I assume a lawyer has reasons for doing this, maybe to frame the debate without any counter arguments? As a layman, I think this is bizarre. I don't get why else you'd ask a lawyer questions that clearly violate attorney-client privilege.
      And not only that, she follows up already objected questions with all imaginable variations of the same question (did you talk with Depp about x, did you talk with Depp before action x, did you talk with Depp after action x, did Depp know about action x). Such a waste of time.

    This is why I’ve been saying from the start that Amber’s counter-claim was bullshit. Going after his lawyers for doing their job and protecting their client is asinine, because even if you get it to court, like now, you can’t get any evidence because of legal obligations to stay confidential, like now. It’s just so frustrating. By Amber’s logic, Depp can sue her because her lawyers repeated abuse claims when trying to prove her case. It’s ridiculous before you even look at the $100 million damages attached.

      I think Amber's counterclaim isn't just bullshit, it's counter productive to her defense. She could have kept her mouth shut and not have to prove she was abused, it would have been solely up to Depp to prove there was no abuse - she really shot herself in the foot being spiteful and petty, going tit-for-tat against Depp.

I was wondering why Elaine would ask these questions when she knows well that he can't answer them due to Attorney privilege. Amber's Team has 8 Hours left, and Johnny's Team has 18 Hours left which is suicidal because if Amber's Team has no time left they can't Cross Exam Johnny's Witnesses which is hilarious. In that case, I would bring up Kate Moss and the Policewomen who witnessed the DA between Amber and her Ex Girlfriend.

    The Adam Waldman testimony was hilarious, I don't know what the hell Amber's side were doing bringing him on. He literally brought in a load of evidence that was probably inadmissible due to their open ended questions & also let him say he had his own reasons for believing Amber was a fraud. I burst out laughing when they asked, "so when you found out Amber wasn't being investigated by LAPD for Perjury did you post a correction?" And he calmly replies, well no it wasn't the LAPD that was investigating it was the LA County Sheriffs department that was investigating her for Perjury and the desk sergeant told me!".
    Because it was Amber's side that asked the question they then couldn't object to it & the testimony comes in - what a total own goal the jury just heard Amber is being investigated for Perjury!! She's done after that.

They burned through so much of their own time, their client was shown to be being investigated for perjury and Adam Waldman comes across as a choir boy rather than some malicious bully. Elaine was bad but Rottenborne totally sunk AH's case with the open questions, they sabotaged themselves. If JD had brought that stuff in it would have been a miss trial, that's how bad it is for AH.

      Against amber grew strong the beginning of 2020 because of the recordings right before COVID hit.
      The trial is almost over so ambers team brought Adam because of ambers countersuit.

The problem is that her testimony, cross examination, redirect, and the witness testimonies had done very little to build up her defense. They should have just realized the countersuit was a Longshot and focused on just defense against Johnny's claims.

      AH credibility went to zero when Adam said she was being investigated for perjury & listed the evidence and witnesses that contradicted her.
      Adam also has a legitimate reason to make the claims in the newspaper on his own accord because of the evidence and irrespective of what JD may or may not have told him.

      Damn, how did you manage to get through the entire thing without falling asleep... You should count the amount of objections Camille made against elaine after Camille finished questioning amber and elaine took over. elaine asked questions for like 30 minutes straight and only 3 of them managed to actually get through, the rest were all objected and amber wasn't allowed to answer, she even stormed out of court before the jury which is a big no no, that's how pissed she was because of how bad it went but someone needs to provide an actual count of the objections...

    this was pretty amazing to watch. Mr. Waldman was calm and polite, Ben didnt lose his shit, kept his professional obligations all the while Elaine tried her best to break every rule. I am beginning to understand why Heards side did not want these to be live witnesses. Not to mention, this looks great on Depps lawyers.

      She could have just walked away, paid the charities like she said she would and moved on with her life.

      Correction, Amber's team pushed for a complete media blackout and JD's team successfully argued against it. The judge has not personally been in favor or against media. If your comment was based on her stance against cell phone useage in her court room it is common for judge's to be against them in general.

      With Amber's personality, I don't think she is allowing them to make good decisions on her behalf. they are just her representatives and she is likely taking that to the hilt, Demanding that they do things and ask things that they probably advise against but she demands they do anyway, and since they don't outright break laws they are just doing their client's wishes. Sometimes it's worse for a lawyer to have a bullheaded demanding client than it is to just plain have an incompetent and guilty one.

      Important to point out the client has ultimate decision making power. Amber Heard's team could have told her this testimony is devastating to her case and she should just give up her countersuit and not show it. Heard could likely see herself and her witnesses performances as believable enough and not understanding the damage of this testimony could have pushed for it, knowing that establishing a link between Mr. Waldman, Depp and the statements were the only way to win her counterclaim. Remember with her possible BPD, she could easily dwell in such a delusional fantasy world and convince herself her case and her "truth" was the "truth". And I think it quite likely she lied to her legal team about multiple things and delivered coerced witnesses along with her own continually changing and embellished disaster of a testimony....

They are listening to an even toned and reasoned. "This is a question that we cannot answer even to say we don't have an answer." over and over again. They are outright being told repeatedly like a jackhammer, not "i'm refusing to answer the question" but "Because of Legal and Fairness reasons I am completely barred from actually even trying to answer the question even if I wanted to." That is very different from. "No, I don't want to answer." He answered everything that he could and wasn't barring from even trying to answer.

    What's interesting is that Waldman's statements seemed like a good explanation at the time-but it turns out that reality is even more bizarre. The body cam footage from the 2nd police visit shows that the AH and her friends didn't realize they needed to fake the evidence and spill the wine and place the photo frames on a bed until AFTER all the police had left. IncrediblyAverage (ThatBrianFella) has the best explanation for this-they weren't expecting to have to go through with the hoax so they did a sloppy job prepping for the extortion attempt. So appalling that Josh Drew had the gaul to purger himself by testifying that the police officers stepped over glass when entering the PH. Clearly he didn't know about the body cam footage either. In any case, Walman was right in spirit in his statements about the hoaxers

    Not answering questions due to attorney-client privilege doesn't look evasive or "hiding" to me, just as if you have a security clearance, it's illegal to disclose controlled information (you can even get in trouble for insinuating you have knowledge of something controlled) without proper authorization.       Most people are not represented by a lawyer and some lawyers are better or worse than others.
      By repeatedly asking the questions rephrased you can sometimes trip a person up. Sometimes the other side's lawyer can miss the similarities but most the time they wouldn't.
      Investigators do this all the time but slip other questions in between. You can usually tell if someone is telling the truth or not based around subtle differences in the answers. But some liars often start adding lots of unsolicited details like framing a scene in a book thinking you didn't get their story the first time. It's almost as if Elaine is larping as a detective for a police department or something. Maybe she took the criminal justice how to be a private eye class at the local community college as part of her continuing education requirements.

      @@dyanalynn6698 All you have to understand is that the guy is part of JD's legal team and that elaine keeps asking stupid questions that he's not even allowed to answer because of client privileges. Her line of questioning is trying to prove that JD forced him to write the "slam articles" about amber, that depp is directly responsible for his actions and that his actions are defamation, untrue statements that ruined her reputation and made her lose out on jobs and by extension money. This line of questioning was for her $100 million dollar defamation countersuit against JD and elaine knows she's not allowed to ask and he's not allowed to answer but she's asking them anyway in an attempt to plant the ideas in the juries mind. It's a stupid move tho because it just shows how incompetent she is and puts half the jury to sleep having to hear all these questions getting denied.
      It's like asking them "is it not true that he held a gun to your head and threatened to kill you while calling you a POS and asking you think you're so tough motherf***er", that question will undoubtedly get objected but the jury will still hear it and it'll leave doubt in their mind like "wow did he actually say that" and they also might think "why are his lawyers trying to silence them from answering, maybe it has some credibility", that's elaines whole strategy, ask questions that make JD look bad even if the judge tells them to disregard it. That's what her whole line of questioning was with amber after Camille was done with her and that's what she's doing here. A good example was when she was saying "isnt it true you visited a doctor and they told you you had scar tissue in your nose", even though amber couldn't answer any of those questions it still plants the idea in the juries mind and leaves them wondering "how did she get that scar tissue in her nose?"
      It's extremely underhanded and unethical and that's why Camille was getting so pissed off and trying to object to get her to shut up. Same when Camille presented those text messages as evidence and elaine was like "your honor I object she's leaving out the last 2 lines that would provide context", you're supposed to ask to approach the judge to mention things like that, she could lose her license for underhanded tactics like that by basically telling the jury "hey guys she left the context out of this so take it with a grain of salt", you'll notice that elaines team kept playing 3 second audio clips of JD yelling obscenities while leaving out the context like when he was yelling "you make me fucking sick" after he had his finger chopped off and only played that specific part out of like an hour long audio, Camilles team didn't object and say "well you left the context out and we should show the jury that too" because they're supposed to go up to the judge and talk about that in private. Elaine is grossly skidding the line of ethics and she should have her license removed for these attempts and you can visibly see the judge pissed off at her for trying this shit... Even her catchphrase "what if any", she got into multiple arguments about it because she's asking leading questions and thinking that fixes things. I really hope she never gets another job ever again and gets barred from the practice because it's disgusting...

      Elaine was trying to prove it was JD who 'forced' the attorney to post those "defamation posts" against amber on JD's behalf. She's trying to counter sue him for $100 million dollars but to do that she needs to prove JD was responsible which is hard to do when JD hardly spoke about the matter, it was all this guy whos being questioned that 'leaked' everything to the public. She's never going to win the countersuit tho, those statements have to be untrue for it to be defamation and it needs to have been done in gross and neglectful disregard for the truth and purposefully done to hurt her career.       The fact that he apologises the to jury implies that he would like to answer the questions asked, but AH's team are just so incompetent in understanding the legal reason he cant he has to keep rejecting their questions.
      This is further impacted by the fact that he doesnt have a single question asked by JDs team that gets objected to in regards to the attorney client privilege.

    You’ve gotta feel kind of sorry for Heard’s counsel. When your client is a pathological liar and a toxic narcissist running out the clock is pretty much all you’ve got left. I really don’t think having another defense witness impeach their client’s testimony is going to be a winner in the end.

      My theory is that she hopes the jury will think JD is hiding something and not grasp how important attorney-client privilege is. She knows that attorneys are subject to disciplinary action if they break attorney-client privilege and she is counting on the jury not knowing that. All of which makes Elaine a condescending a**.

    The fact that Team Amber have wasted so much of the court's and the jury's time with these fucking interminable fishing expeditions must, in and of itself, have pissed off the latter enough to have biased them against Heard by now. Well played. Paid by the hour I guess, so they want the trial to go to its time limit. And this might be totally ad hom, but Elaine Bredehoft does NOT have a voice that's pleasant to listen to (sounds like she just never had the pipes that would endure all those years talking publicly in court), for hours at a time it would drive me nuts.

    I don't have all the info from outside the trial, so now I'm glad to finally understand why Amber's team is so intent on constantly mentioning Marilyn Manson. It seemed so strange for them to constantly pull out this guilt by association weirdness, but now this fine gentleman just made sure I know that Manson has provided compelling evidence. Not sure who Amber's lawyers are even helping at this point, but that is a useful little tidbit
