In the case of Sreenijan, he is a millionaire unlike other ordinary Harijan and lead a royal life but never heard that he has helped a poor Harijan by making.a pucca house for him. Politicians use this label to get undue advantage.
Dr Ambedkar suggested to give reservation for only a limited period but power greedy politicians never allow to withdraw this facility even after 75 years of independence and people like Sreenijan would demand reservation till indefinite period. BJP made in their manifesto that they would remove article 370 from Constitution which they did They should now remove SC ST reservation only on the basis of annual income so that rich people from this category would be out and privilaged people will have to give up this label.

1... If Motive For Crime Is Not Casteist Attack, Provisions Of SC/ST Act Can't Be Invoked: Karnataka High Court Reiterates... Update: 2021-11-02 ... The Karnataka High Court has reiterated that provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (SC/ST Act) cannot be invoked in every crime where the victim happens to be a member of the SC/ST community. .. If motive for crime is not casteist attack, the accused can only be charge sheeted for any of the offences under Indian Penal Code that can be appropriately invoked in the background of the incident of crime or under other law which can be applied as the facts and circumstances indicate.. The primary requirement for invoking any of the offences under Section 3 is caste based attack or hatred towards that caste.
Most significantly and also most remarkably, what forms the cornerstone of this brief, brilliant, bold and balanced judgment is then envisaged in para 13 wherein it is stated that:
Unless the investigation indicates or reveals intention of a person not belonging to scheduled caste or scheduled tribe to commit any of the offences under Section 3 of the Act, in order to oppress or insult or humiliate or subjugate or ridicule a member of scheduled caste or scheduled tribe as such person merely belongs to that caste, the offence under Section 3 cannot be invoked in the charge sheet. It is not as though in every crime, if victim happens to be a member of scheduled caste or scheduled tribe, an offence under Section 3 of the Act has been committed.. If motive for crime is not casteist attack, the accused can only be charge sheeted for any of the offences under Indian Penal Code that can be appropriately invoked in the background of the incident of crime or under other law which can be applied as the facts and circumstances indicate. While the Act is essentially meant for protecting the members of scheduled caste or scheduled tribe from atrocity or oppression, at the same, it cannot be allowed to be misused. Therefore there is greater responsibility on the investigating officer to take decision wisely before filing the charge sheet.. In a nutshell, the Karnataka High Court in this judgment has made it absolutely clear that if motive for crime is not casteist attack, the provisions of SC/ST Act cannot be invoked. All the courts must certainly abide by it. It is the crying need of the hour also to ensure that the provisions of SC/ST Act is not abused or misused rather is used only for the purpose for which it has been enacted.
Section 3(2)v of SC/ST Act will not apply automatically: Supreme court... On Monday, the Supreme Court reiterated that Section 3(2)(v) of SC/ST would not be attracted automatically just because a victim belongs to such and such category, and the prosecution has to establish ingredients of Section 3(2)(v) are made out.
As Section 3(2)(v) states that whoever, not being a member of the SC/ST tribe, commits an offence under the Indian Penal Code, which is punishable with imprisonment for ten years, because that person belongs to SC/ST tribe or if the property belongs to such member, will be punishable with life imprisonment and a fine... The petitioner was tried for offences punishable u/s 376(1) of IPC and u/s 3(2)(v) of SC/ST Act for ra*ing a girl(20) who is blind since birth and was sentenced to life imprisonment. The accused filed an appeal in the Andhra Pradesh High Court. However, the Court dismissed his appeal..
When the case reached the top Court, the Bench took note of its judgment where life imprisonment awarded to a murder convict was reduced to the sentence already undergone. There is not enough evidence to suggest that the crime was committed just because the victim belonged to SC/ST group.
At the outset, Hon’ble Justice remarked that the Bench will confirm the conviction but will modify the sentence as Section 3(2)(v) was not established; therefore, the convict was entitled to the benefit of the doubt.. Hon’ble Justice stated that it must be alleged in the FIR that the victim belonged to SC/ST caste, which is why ra*e was committed. Only then Section 3(2)(v) can be attracted, and it cannot be attracted just because the victim belonged to that particular caste...
