No, it wouldn't. There are countries where as a suspect you have to be represented by a lawyer and not represent yourself. It's a gross miscarriage of justice to let a rapist and attempted murdered further traumatize their victim.
@@v_doll This case takes place in the USA, where everyone is given more rights than most other countries. The man in question is allowed to represent himself and actually have a defense, not merely be silenced and considered guilty from the very beginning. It's called giving everyone a fair trial and allowing the victims to face their perpetrators in a safe court of law. Sure it could potentially add more trauma, but it could also help them face their trauma and help lock up their tormentor. I'd rather have everyone be given a fair trial, than to be given judgement by the biased emotional minority, where you can get put in jail for merely disagreeing with someone. The UK is a prime example of how severely abused that mentality can be and how it's perpetuated by emotionally fragile people in power.

It's to ensure a fair trial; but the flip side is he dug himself even deeper. Remember the decision isn't determined by the defendent, it's determined by the jury. And he showed the jury the kind of man he is.

Parents, mother or father, who use their children as pawns against their partner/ex partner disgust me. My father was not a physically abusive man, but he & my step mother tried SO hard to convince me that my mom was a bad parent and constantly asked me, as an 8-11 year old, to spill secrets they could use against her in court. All while my mother tried her best to shield me from the grown up issues. I cut my father off at 15, I told him to get his shit together and then we could talk but I’m 25 on Monday and still haven’t heard from him. He lives 10 minutes from me. I am so glad this family got justice and that the REAL bad guy is in prison. Bless this family and bless you Unseen for always telling victim stories in such a compassionate way.

This woman is incredibly strong. With all the odds, even her own children stacked against her she kept on fighting. Even when staring into the face of the monster who kidnapped and r*ped she stood her ground and made sure she would finally be heard!
Am I the only one thinking if this monster had good intentions to bring the family together, would he go through the window in the middle of the night or through a door in broad daylight? Also would a good father get his 14 yr old to illegally drive all the kids to his place? There's no way out of this one buddy!
At age of 10 I had to testify in my parents divorce court, which included me having to tell the abuse I witnessed at home. It was horrible. Both parents were disappointed with me. One for saying too much, the other for not saying enough. Loving them both, I couldn't please either. Both parents were watching my testimony, staring at me - I was horrified !!! Children should never testify like this. Statements can be taken with child psychologists present and attorneys, and what not, but to be forced to speak while the perp is watching you is most horrific. Laws need to change.

Jury pools are often randomly selected, and each party has a set of "preremptory challenges" which allow them to strike a juror for any reason. It's likely that the (un)luck of the draw resulted in a jury pool with very few women, and then the rest were stricken by the defendant.
@@totallytubular618 Weird since in trials surrounding racial issues they magically have no problem making half the jury black when they're only 13% of the country. Women are half the population and not ONE out of the 12 they figured should be a woman...in a case of a man using the court system to try to screw over a woman. Pretty strange coincidence...
And THIS IS WHYY you always involve your kids. You tell them details about dangers and why you do what you do. Keeping secrets from them doesn’t protect their innocence and childhood, it keeps them dumb.

I'm so happy it wasn't a murder case.. i can't imagine the trauma the eldest daughter would've gone through if it had been one since she already regretted helping her evil father, so happy she got her justice.❤
Same here. Her mother being killed would’ve likely destroyed her and her siblings lives, luckily that monstrous excuse for a father was no match for Elisa’s will to survive for her kids 🩷

The judge summarized it perfectly, monster in all the sense of the word. How could he be so low by manipulating his own children into helping him to that to their mother... He almost killed her... At least the judge saw through his lies and delusions and put him in his rightfull place.
I applaud the judge for asserting Arden she should not feel guilty and telling this man he’s a monster ….! Good job, judge…😊!

How many times has this happened?! Some clueless judge with no real insight into a case, allows a father access who then commits horrific crimes against children, wife etc. Poor woman was ignored, made out to be a liar, forced to send her kids to him, forced to watch him manipulate the children against her. Then using his daughter to try & kill her mother, shockingly disgusting. Judge should feel shamed. All his delay tactics, narcissist behaviours etc to hols up the trial...who allowed this to happen??? So lucky it didn't turn out with all of them dead, he obviously was on that path.
How could a victim being interviewed by their own abuser ever be allowed. That is so wrong.
Unfortunately it does happen, I was cross examined by my abusive ex and it was a horrible 2 weeks but just about everything that man said made him look like a monster. I can't even count how many times the jury gasped in horror.
It's to ensure a fair trial; but the flip side is he dug himself even deeper.
Remember the decision isn't determined by the defendent, it's determined by the jury. And he showed the jury the kind of man he is.

I’ll never understand how a defendant representing themselves in court and questioning victims/witnesses/etc isn’t witness intimidation.
Average constitution hater 😂 shut your dirty mouth
Unfortunately it’s in the defendants constitutional rights but honestly it’s terrifying to see him questioning his daughter when he’s the reason why she’s gone
It's called constitutional rights, which our justice system follows for fair trials and to ensure everyone's rights aren't violated. If they didn't allow him to be his own attorney and defend himself, he could easily have the case dismissed and be a free man.

how the hell is asking a rape victim to respond to questioning from her attacker in front of a jury of 12 men and 0 women a fair trial?
It'd be denying a cross-examination of testimony.
That's what makes this a fair trial.
@@littlegiantj8761 dude this is just abuse toward victims and its NOTHING FAIR about it.
You are seriously disturbed if you think its okay
@@morganablackwater2017 picture this: you're falsely accused of a crime, but you're not allowed to plead your case during trial (and by extension, get an attorney to represent you appointed and provided by the court). You just have to sit there and accept whatever sentence you're handed with a legal gag over your mouth. You want the right to an attorney and cross-examination? He gets it too, that's how rights work.
I'm not disturbed. I don't like it either, and I wonder if the prosecution at any time could have called objection for "badgering/Intimidating the witness"; but we have the right to face our accusers and testimony against us to be cross-examined. When my mother left her first husband, my brother's mother, she moved in with my grandpa. One day when everyone was out of the house, he showed up and kidnapped her. It should not be possible to postpone a court case for five years. And it should not be possible to question your own kids in court and doing so, continue to manipulate them…. This man manipulated his environment for years and he is even given the opportunity to continue with it in court…..😢!
It is so screwed up that defendants are allowed to interrogate the people they're accused of abusing or raping. It's strictly a power move to scare them into submission. It's sick.

Can’t I,anyone the misplaced but monumental guilt Arden must feel. It’s EVIL to use a child like that. Arden did nothing wrong. That girl literally just loved her parents. That’s her “crime”. Loving her parents, and trusting her father. Something every child should be able to do. And he used that trust to use her as a pawn in his game. Arden… you are guilt free in this. You hold zero blame. You literally just loved your family and trusted your father. That is literally all you did. Your father CHOSE to use you. He chose to put you and your siblings lives in danger so you couldn’t interrupt his plans to assault your mother. I just feel awful that along with all this also comes the mental health issues associated with being so betrayed by your own parent like that… I hope therapy is a constant in your life as long as you need it. I hope you have a great therapist.

Wow… imagine using your kids as a way to get into the house so that you could do horrific things to their mother….. that has to be the lowest thing a person could do.
How the hell did the jury end up being exclusively men?
I was thinking the same thing tbh
Jury pools are often randomly selected, and each party has a set of "preremptory challenges" which allow them to strike a juror for any reason. It's likely that the (un)luck of the draw resulted in a jury pool with very few women, and then the rest were stricken by the defendant.
"Jury of your peers" my a$$...
@@totallytubular618 Weird since in trials surrounding racial issues they magically have no problem making half the jury black when they're only 13% of the country. That monster loved NO ONE but himself!
And THIS IS WHYY you always involve your kids. You tell them details about dangers and why you do what you do. Keeping secrets from them doesn’t protect their innocence and childhood, it keeps them dumb.
What on earth leads a man to behave this way? 🤯 He had a lovely family and he destroyed it. I hope someone is conducting research into how and why this occurs.
these videos always terrify and intrigue me at the same time.
I can't understand why the judge got away with this without being fired * or in jail *
I can relate to Arden so much. My father was extremely abusive towards my mum and when we went to a women's refuge my mum was ordered to let my dad see me ( court ordered) and my dad told me that we were going to play a game of hide and seek and if I showed him where my mum was I would win a prize. Being a kid I didn't know what he was doing but I felt so guilty and I still have moments where I blame myself. As an adult now I know realistically that my father was the only one to blame and the stupid court system we have in my country. And after all of that I didn't even get my prize😅
This man is pure evil. Allowing the child to be interogated by the father is appalling.
