I don't think, with the evidence shown, that any lawyer could deal with this case on her favor, even if it was just to get a draw. I know the uk did not go in his favor because of their laws, but my god, sure there are lawyers who could not look like clowns, but I dont think any of them could win it.
I’m actually a lawyer in Fairfax. I work in the same building, but have nothing to do with the trial. My two cents: This looks like a circus to me. You should NEVER object in front of a jury unless the answer to a question will be hugely prejudicial to your client, because endlessly objecting to everything sends the jury an implied message that you are hiding the truth from them. Objecting to everything diminishes your credibility, and your client’s credibility. It paints you as an obstacle to the truth.
it also makes these lawyers look completely incompetent when objecting while Depp answer his questions. I'm not a lawyer but it doesn't take a rocket scientist to realise that they're grasping at straws. can't wait till she takes the stand so she can incriminate herself even more.

Even before it was revealed that Amber Heard was a lying manipulative cunt and everyone had to accept the fact that Johnny Depp was "abusing" Amber Heard I really found it hard to believe Johnny Depp frequently laid his hands on women. From going to childrens hospitals dressed as Jack Sparrow to his numerous roles as a calm laid back funny guy, its kind of hard to fake some genuine character moments in my opinion if you are actually going home and laying your hands on the one person you are supposed to love. I know they are actors and other actors have done horrible things before, but the last person I ever expected to do something bad was the guy who played Willy Wonka if you know what I mean.

You can't "object" to a witness answering your questions, what you can do and what Rottenborn should have done is "Move to strike" because this was indeed hearsay. (That's also his fault for asking an ambiguous question in the first place.)

Probably both. Amber Heard has been through, I think, 3 legal teams during this whole thing. She wants something, her legal team doesn't get it for her so she fires them and hires another one. There was one incident where Depp's lawyers and her lawyers signed an agreement on what would and would not be disclosed, she fired that team and hired another one and the new team demanded more information from Depp that was not in the agreement the previous legal team had signed and tried justifying it that the previous agreement did not apply to them because they were not her lawyers at the time it was signed. Do this a few times and Amber has a legal team who will bend over backwards trying to do everything in their power to enact her will, no matter how stupid it is.
Good lawyers don't want this case because it would damage their reputation, contrary to popular belief lawyers do pass on obvious cases were the client is clearly guilty.
So as far as I can find, Rottenborn is actually an incredibly successful attorney with some pretty impressive wins under his belt. I think what we're seeing here is a man who knows he has absolutely nothing to work with and his client is crazy. Even crazier is that he might genuinely pull out a win here.
The lawyer is incompetent, but Johnny's mental fortitude is quite impressive. I imagine they hoped needling him and interrupting every second question, coupled with the stress from being in court, would cause him to have an angry outburst during the questioning but he's been very patient, hasn't done anything childish... The most telling thing to me is how in every piece of testimony, and in every recording, Johnny is desperately trying to get away, trying to leave, trying to avoid conflict, and Amber Heard is getting in his way and INSISTING that they fight it out. I haven’t been in a situation like this, but two of my friends have. And them and a lot of other women who have been abused by partners all say that they don’t like talking about the abuse while in the relationship and even after it’s over is because they feel embarrassed for a number of reasons. Embarrassed for being abused, being in the situation to be abused, “letting” it happen, not being able to do anything about it, being stuck in the relationship and so on. They don’t broadcast it like Amber did immediately after it happened. She told Isaac the day after it happened I think? Like, women don’t do that. Men in situations don’t do that. It took Terry Crews yeeeaaaars to talk about his abuse and it take a lot of other people many years to be open about what happened. People who have been in this situation hate Amber because they know she’s lying On top of that, she’s still abusing him and saying she’s in charge while they’re in court without her even saying anything. The issue at hand is that Depp is suing Heard for defamation. Since Depp is a public figure, he has to prove that the statement is defamatory, meaning that it harms the plaintiff or the plaintiff’s reputation. Johnny Depp's defamation lawsuit stems from Amber Heard's 2018 WaPo opinion piece. So, basically, the lawyer is trying to prove that the WaPo article couldn't have defamed Johnny Depp because Johnny Depp's reputation had already been tarnished, and that's all the lawyer really has to do. It's absurdly difficult to prove defamation as a public figure.
I'm an artist (and I struggle a lot like with parents wanting me to do a "real job" etc or working part time and doing art on the side etc) and hearing what Johnny did for Isaac made me so teary cos I know (I think we all know) how much that would mean to just be given the opportunity to pursue your dreams and not have to struggle, just be free to make your art. Yeah im a young artist too just entering the actual 'industry' side of it now (entering into uni whilst still working parttime and doing commission work is killing me but hopefully itll pay off) and honestly its amazing how johnny was so willing to basically give his friend a great space to work and live without finincial worries. Artist or not they were just mentioning that detail to further express how they somewhat further understand what a big gesture johnny made to his friend by helping support him in his ART career (we all conciously/subconciously relate personal experience to universal topics to further be able to further understand them, thats just human).

Seeing this case unfold more and more leaves me with less and less faith in the justice system and how it is carried out. Major waste of time for the court and Heards lawyers to keep asking the same questions in different ways. Attacking character only made things worse with Heards case and the fact Heards lawyers used and continue to use this tactic not just on Depp but also his long time friends and colleagues shows how little they actually have on him.
asking the same questions in different ways is a way to determine if someone is truthful and fairly common in courts as far as i know, hard to remember a lie in detail compared to the truth. other than that i completely agree with you.

It is actually not uncommon. I have personally seen seasoned lawyers end up objecting to their question (or rather the immediate response given to the witness on the stand). This is because in the heat of moment lawyers sometimes slip up and ask an ambiguous question and realize it once it comes out of their mouths (remember they have think about dozens of things at once). However, though what he did is not incorrect, what the lawyer should done to not make himself look like a fool is motion the court to strike the witnesses answer to the question and allow him to rephrase the question.

Johnny fighting to get these cameras in the court was an excellent idea. The sheer number of eyes on all of this footage and evidence, the number of people hearing every recording and objection, observing the body language of each party, and each party's legal teams will surely reveal the truth; and as this video shows, probably do a better job of it than these legal teams can. Which to me is the smartest thing he could've done for one reason: Amber's legal team is relying on puff-piece articles that are the DEFINITION of hearsay, leading questions trying to paint Depp in a negative light, and not allowing witnesses to answer questions with full context, whether they are the ones doing the questioning or not. Depp's legal team lets the evidence speak for itself.
To everyone who don't know the context behind the kissing question: She's not actually trying to make Isaac seem like a creep. They were dicussing about what he saw the day after Amber claimed Johnny attacked her. She said he threw a phone at her face so you'd expect bruising on her cheek. She's asking Isaac basically if he noticed any bruising or anything when he did his kiss greeting. He had seen her every day, with and without makeup, etc living at the penthouse(s). Its a very long trial so I don't recall a lot but when she switched to that topic I thought she was attacking his character at first too.

My dad just got done going through something like this, only problem was that she won, and it's basically ruined his life, he's only recently been able to get out of the gutter with help from me and my sisters, and support from old friends. The judge and my mom's lawyer looked like buddies when they talked and were super stern with my dad, my dad couldn't even afford a lawyer. He got labeled with domestic abuse, and as her kids we could tell most of her stories were made up. But none of us could do anything.

A lot of people have been taking note of the general decorum and presentation of anyone giving their testimony, and for good reason of course. Some say that Depp being this sarcastic, theatrical, and cracking this many jokes is unprofessional and is an indicator that he doesn't care enough, etc. etc. I don't agree, but THIS MAN: his lack of decorum, his constant pausing, his heavy accent, his blatantly non-biased answers. He's just... too real to be lying? He seems like the guy who won't shut up about something he's pissed about during thanksgiving dinner. Whether or not you agree with him one thing is for certain, he REALLY REALLY believes what he's saying and doesn't give a shit if you disagree because he KNOWS he's right.
The thing that gives away to me that he's speaking truth was when he 100% knew the answer, there was no pause. It was a straight from the gut response. A hard no, I'm not from Europe, I moved in the next day. The responses are fast and his accent comes off even harder than usual because he's speaking completely normally for him. No extra thought about how to phrase it, just immediately spoken.

It's weird that they are trying to prove he's an abuser without evidence instead of trying to prove that the article wasn't about him. Everything they have shows that he is the type to run from conflict and his exes all vouch for him being non-aggressive. It's a defamation case and the article was at least vague (though it's still obvious who she was trying to ruin the reputation of), so trying to set him off in court when he has a history of not taking his anger out on people in even worse situations makes no sense.
The article isn't even objectively about him, it is about him, so it would be wasted effort to fight that point. If they can prove at any point there was physical *abuse on his behalf then they win. I agree though, absolutely failing to prove that at this point. *forgot to add the word abuse.
Amber Heard's lawyer's opening statement did state that the article never mentioned Johnny Depp by name and this was also brought up during some of the cross examination. Maybe these arguments will become more prominent when Johnny's team rests their case and it is the defense's turn. But they might also just be trying to throw everything at this. In opening statements they also argued this was a 1st amendment free speech issue.
but in some ways the prosecutor is worse, because prosecutors actually have authority within the justice system, the prosecution can always chose to drop a case regardless of what even the LE department brings to them
Here's the thing. I'm fairly certain that Rottenborn is using a strategy to get a rise out of Depp to make him worse and the abuse allegations more credible. It's not working because Johnny is too damn chill, but it's all Rottenborn has to work with. The prosecutors for Rittenhouse were just morons. That could have been a slam dunk win and they absolutely fucked it.

All those witnesses are called by him and direct examined by his lawyers and they are not allowed to lead the witness by asking questions that suggest the answer. On cross examination, by the defendent's lawyers, Amber Heard's lawyers, leading the witnesses is allowed.

First rule as a lawyer: never ask a question you don’t already know the answer to. And, as someone already pointed out, these lawyers being aggressive is not a good choice in this case. This case is going to come down to who the jurors like better. That may be unfair, but it is what it is. These lawyers are making themselves, and, thus, their client, very unlikeable. Their client can do that all by herself.
Yeah, they might lose the case because they are so unlikable even though, to be fair, their case is actually quite weak legally speaking. This is not a case on domestic violence, this is a case about defamation. It doesn't matter whether she abused him or not or that she lied in 2016 for this case. The only thing that matter was the op-ed of 2018 and they have to show that it: * Was factually false. * She knew it was false. * She acted with "actual malice". That's a legal standard that is very difficult to meet. * Her lies in the op-ed damaged his reputation and cost him money in terms of lost business opportunities. To this one, they have actually a very good argument. It's not her lies in the op-ed in 2018 that destroyed his reputation. His reputation was already destroyed by her lies in 2016 and these are not relevant to this case. I love that the best argument for their case is that she couldn't defame him in 2018 because she'd already done it before and he can't sue her for the first defamation.

@@AdamTuxTengler Actual malice is determined by the jury. They will get jury instructions. Basically actual malice means that she acted purposefully in order to hurt him. For example, if the jury finds that her state of mind at the time was to make a PR stunt. To bolster her career. Then that's not actual malice. They must find that it was a vindictive act. And I'm not sure it's that clear cut for the jury that she knew it was a lie. It might have been her perception that she was abused, even if that's not factually correct.

It either happened or she lies and there is little left to interpretation. I would argue that she is full aware of what the truth is either way. And while it's easy to imagine her statements being a PR stunt, it is at the same time very hard to imagine she was not fully aware of the damage it will cause to his career and reputation as fellow actor. Imho she was looking to "kill two birds with one stone" - helping her career while ruining his at the same time. But we'll see what the jury thinks later.

The screaming both ways, his anger, a few bruises. Then she shows the notes of her therapists at the time who told her she was a victim. Then, that would have been reasonable to think she believed that she was a victim. I don't think her lawyers advised her to do that. They know it's a bad defense. But she's histrionic. She needs the world to see her as perfect. After watching part of the trial yesterday I had to pause and look up what all the objections meant. I truly hope he gets his reputation and career back. As an aged fine artist I can say that the patronage part is still real today. Very rare though. Melts my heart that this came to light. And may get it started again. Right on for explaining it for others.
I think everyone can see how incredibly fraudulent these allegations are, but the reason this is being tried is because he lost the original case. She really has already won once in court. She also won in the court of public opinion originally. No matter how well things appear to be going for Johnny, it isn't over till it is over.

However it is rare as most federal judges believe having the press, electronic broadcasting, etc while a trial is going will poison the case.

Let me clarify: If the opposing lawyers do not raise an objection the examination goes on uninterrupted. It does not matter if it is compound, hearsay, relevance, asked and answered, leading or anything. Only when the opposing lawyers raise an objection is when the judge gets to sustain the objection and have the examining lawyer move on. I think the only time I've seen the judge jump in the 3-4 cases I've watched was when there was a possible 5th amendment violation. Which is.. a bit more than a simple objection.
Another lawyer mentioned the lawyer has probably much experience, but as a civil lawyer most of the cases end up settling before trial so not a lot of trial questioning experience

Honestly, what I think we're seeing here is a successful and well paid lawyer who has realized he has absolutely nothing to work with. This whole trial has been like watching a comedy starring Johnny Depp and he's nailing the role.

His larger goal isn't to get a verdict in his favor (although that would be great for him clearly) it is to air EVERYTHING about Heard and get his side of the story (including interactions with companies like Disney that dropped him) on the record in a court of law.
I mean, it's a defamation trial. It's insanely hard to prove defamation when you're a public figure. Regardless of what Amber Heard did or didn't do to Johnny Depp, the point of this trial is to prove that the WaPo article that Amber Heard released in 2018 damaged Depp's reputation. It's an extremely hard case to win legally, but Johnny is getting his story out, and winning back public opinion. Win or lose defamation case, Johnny is getting his story out.
He likely won't win honestly, it's hard to prove defamation. But that doesn't seem to be his real goal anyway. He just wanted to get his side of the story out in front of the public (he's the one that pushed for cameras), and I'd say in that he is winning in that regard. The man doesn't care about money or lost roles, he cares about the world thinking he's some abuser when in reality he was a victim.

The fact that assumption exists is partly why Depp, and so many other men, is in this situation. Doubt is good, it's literally the foundation of any decent justice system.
The problem comes with needing a place to start. You need to be open enough for victims of any gender or sex to come forward and tell their story, and there also needs to be room for investigation to ensure the allegations are true. Just saying "there shouldn't be an automatic assumption of innocence" can lead to not believing any victims and victim blaming. Not allowing an investigation to see into both sides leads to false accusations and manipulation. You should believe victims until there is a reason not to. That's my two cents

I’m actually a lawyer in Fairfax. I work in the same building, but have nothing to do with the trial. My two cents: This looks like a circus to me. You should NEVER object in front of a jury unless the answer to a question will be hugely prejudicial to your client, because endlessly objecting to everything sends the jury an implied message that you are hiding the truth from them.
Objecting to everything diminishes your credibility, and your client’s credibility. It paints you as an obstacle to the truth.

There was one incident where Depp's lawyers and her lawyers signed an agreement on what would and would not be disclosed, she fired that team and hired another one and the new team demanded more information from Depp that was not in the agreement the previous legal team had signed and tried justifying it that the previous agreement did not apply to them because they were not her lawyers at the time it was signed.
Do this a few times and Amber has a legal team who will bend over backwards trying to do everything in their power to enact her will, no matter how stupid it is.
Good lawyers don't want this case because it would damage their reputation, contrary to popular belief lawyers do pass on obvious cases were the client is clearly guilty.

I haven’t been in a situation like this, but two of my friends have. And them and a lot of other women who have been abused by partners all say that they don’t like talking about the abuse while in the relationship and even after it’s over is because they feel embarrassed for a number of reasons. The issue at hand is that Depp is suing Heard for defamation. Since Depp is a public figure, he has to prove that the statement is defamatory, meaning that it harms the plaintiff or the plaintiff’s reputation. Johnny Depp's defamation lawsuit stems from Amber Heard's 2018 WaPo opinion piece. So, basically, the lawyer is trying to prove that the WaPo article couldn't have defamed Johnny Depp because Johnny Depp's reputation had already been tarnished, and that's all the lawyer really has to do. It's absurdly difficult to prove defamation as a public figure.

Attacking character only made things worse with Heards case and the fact Heards lawyers used and continue to use this tactic not just on Depp but also his long time friends and colleagues shows how little they actually have on him.

It is actually not uncommon. I have personally seen seasoned lawyers end up objecting to their question (or rather the immediate response given to the witness on the stand). This is because in the heat of moment lawyers sometimes slip up and ask an ambiguous question and realize it once it comes out of their mouths (remember they have think about dozens of things at once).
However, though what he did is not incorrect, what the lawyer should done to not make himself look like a fool is motion the court to strike the witnesses answer to the question and allow him to rephrase the question.

Johnny fighting to get these cameras in the court was an excellent idea. The sheer number of eyes on all of this footage and evidence, the number of people hearing every recording and objection, observing the body language of each party, and each party's legal teams will surely reveal the truth; and as this video shows, probably do a better job of it than these legal teams can.
Which to me is the smartest thing he could've done for one reason: Amber's legal team is relying on puff-piece articles that are the DEFINITION of hearsay, leading questions trying to paint Depp in a negative light, and not allowing witnesses to answer questions with full context, whether they are the ones doing the questioning or not.
Depp's legal team lets the evidence speak for itself.
To everyone who don't know the context behind the kissing question: She's not actually trying to make Isaac seem like a creep. They were dicussing about what he saw the day after Amber claimed Johnny attacked her. She said he threw a phone at her face so you'd expect bruising on her cheek. She's asking Isaac basically if he noticed any bruising or anything when he did his kiss greeting. He had seen her every day, with and without makeup, etc living at the penthouse(s). Its a very long trial so I don't recall a lot but when she switched to that topic I thought she was attacking his character at first too.

My dad just got done going through something like this, only problem was that she won, and it's basically ruined his life, he's only recently been able to get out of the gutter with help from me and my sisters, and support from old friends. The judge and my mom's lawyer looked like buddies when they talked and were super stern with my dad, my dad couldn't even afford a lawyer. He got labeled with domestic abuse, and as her kids we could tell most of her stories were made up. But none of us could do anything.

A lot of people have been taking note of the general decorum and presentation of anyone giving their testimony, and for good reason of course.
Some say that Depp being this sarcastic, theatrical, and cracking this many jokes is unprofessional and is an indicator that he doesn't care enough, etc. etc.
I don't agree, but THIS MAN: his lack of decorum, his constant pausing, his heavy accent, his blatantly non-biased answers. He's just... too real to be lying?

The thing that gives away to me that he's speaking truth was when he 100% knew the answer, there was no pause. It was a straight from the gut response. A hard no, I'm not from Europe, I moved in the next day. The responses are fast and his accent comes off even harder than usual because he's speaking completely normally for him. It's weird that they are trying to prove he's an abuser without evidence instead of trying to prove that the article wasn't about him. Everything they have shows that he is the type to run from conflict and his exes all vouch for him being non-aggressive. It's a defamation case and the article was at least vague (though it's still obvious who she was trying to ruin the reputation of), so trying to set him off in court when he has a history of not taking his anger out on people in even worse situations makes no sense.
The article isn't even objectively about him, it is about him, so it would be wasted effort to fight that point. If they can prove at any point there was physical *abuse on his behalf then they win. I agree though, absolutely failing to prove that at this point.

Amber Heard's lawyer's opening statement did state that the article never mentioned Johnny Depp by name and this was also brought up during some of the cross examination. Maybe these arguments will become more prominent when Johnny's team rests their case and it is the defense's turn. But they might also just be trying to throw everything at this. In opening statements they also argued this was a 1st amendment free speech issue.

All those witnesses are called by him and direct examined by his lawyers and they are not allowed to lead the witness by asking questions that suggest the answer. On cross examination, by the defendent's lawyers, Amber Heard's lawyers, leading the witnesses is allowed.

And, as someone already pointed out, these lawyers being aggressive is not a good choice in this case. This case is going to come down to who the jurors like better. That may be unfair, but it is what it is. These lawyers are making themselves, and, thus, their client, very unlikeable. Their client can do that all by herself.
Yeah, they might lose the case because they are so unlikable even though, to be fair, their case is actually quite weak legally speaking. This is not a case on domestic violence, this is a case about defamation. It doesn't matter whether she abused him or not or that she lied in 2016 for this case. The only thing that matter was the op-ed of 2018 and they have to show that it:
* Was factually false.
* She knew it was false.
* She acted with "actual malice". That's a legal standard that is very difficult to meet.

For example, if the jury finds that her state of mind at the time was to make a PR stunt. To bolster her career. Then that's not actual malice. They must find that it was a vindictive act.
And I'm not sure it's that clear cut for the jury that she knew it was a lie. It might have been her perception that she was abused, even if that's not factually correct.

It either happened or she lies and there is little left to interpretation. I would argue that she is full aware of what the truth is either way. And while it's easy to imagine her statements being a PR stunt, it is at the same time very hard to imagine she was not fully aware of the damage it will cause to his career and reputation as fellow actor. After watching part of the trial yesterday I had to pause and look up what all the objections meant.
I truly hope he gets his reputation and career back. He could care less about the money… he just wants people to know he’s not abusive. Hopefully when this Is over can start getting his roles back. Thankfully it looks like he won in the court of public opinion finally.

I think everyone can see how incredibly fraudulent these allegations are, but the reason this is being tried is because he lost the original case.

However it is rare as most federal judges believe having the press, electronic broadcasting, etc while a trial is going will poison the case.

Let me clarify: If the opposing lawyers do not raise an objection the examination goes on uninterrupted. It does not matter if it is compound, hearsay, relevance, asked and answered, leading or anything. Only when the opposing lawyers raise an objection is when the judge gets to sustain the objection and have the examining lawyer move on. I think the only time I've seen the judge jump in the 3-4 cases I've watched was when there was a possible 5th amendment violation. Which is.. a bit more than a simple objection.

Honestly, what I think we're seeing here is a successful and well paid lawyer who has realized he has absolutely nothing to work with. Yup, seems like quite a commonplace way to do it. I mean, it's a defamation trial. It's insanely hard to prove defamation when you're a public figure. Regardless of what Amber Heard did or didn't do to Johnny Depp, the point of this trial is to prove that the WaPo article that Amber Heard released in 2018 damaged Depp's reputation. It's an extremely hard case to win legally, but Johnny is getting his story out, and winning back public opinion. Win or lose defamation case, Johnny is getting his story out.
He likely won't win honestly, it's hard to prove defamation. But that doesn't seem to be his real goal anyway. He just wanted to get his side of the story out in front of the public (he's the one that pushed for cameras), and I'd say in that he is winning in that regard. The man doesn't care about money or lost roles, he cares about the world thinking he's some abuser when in reality he was a victim.

The problem comes with needing a place to start. You need to be open enough for victims of any gender or sex to come forward and tell their story, and there also needs to be room for investigation to ensure the allegations are true. Just saying "there shouldn't be an automatic assumption of innocence" can lead to not believing any victims and victim blaming. Not allowing an investigation to see into both sides leads to false accusations and manipulation. You should believe victims until there is a reason not to. That's my two cents
