Police Officer Uses Taser on DoorDash Driver After Resisting Arrest

    Collegedale, Tennessee - The Collegedale Police Department have concluded that an excessive force claim filed against one of its officers is 'unfounded," and that Hamilton County District Attorney Neal Pinkston wrongly chose to involve the U.S. Department of Justice in the matter. On March 10, Officer Evan Driskill used a Taser on Delane Gordon in an arrest during a traffic stop. Gordon and his attorney questioned why he was stopped and why he was tazed. Collegedale officials say that Officer Driskill asked Gordon multiple times for identification and he refused. That’s why he was arrested. They say that the officer only used the Taser after Gordon emphatically refused to comply, many times.
    The full video shows that Officer Driskill properly identified himself and the reason for the stop. Gordon was argumentative and immediately asked the officer for proof of his stop, as well as his supervisor. The officer correctly advised Gordon to argue his objection in court. Officer Driskill asked Gordon for his identification 5 times, but Gordon refused to hand the officer his information and the officer made the appropriate decision to arrest the driver for failing to identify himself. The officer opened the driver’s side door to make the arrest and ordered Gordon from the vehicle five times before transitioning to his Taser. The officer drew his taser and ordered the driver out of the car eight more times before holstering his Taser in an effort to de-escalate.
    The officer returned to hands-on with the driver and ordered him five more times to exit the vehicle, injuring his own leg in the struggle. It was only when Gordon emphatically stated “No!” to the officer’s many orders, that Officer Driskill made the decision to deploy his taser to gain compliance and effect the arrest. After using the Taser Officer Driskill had to order Gordon ten more times out of the vehicle. Once Officer Driskill finally gained compliance the use of force was immediately ended, and Gordon was safely handcuffed. Gordon was moved to a seated position to prevent positional asphyxiation and to await the arrival of other officers and paramedics.
    Attempting to couch the incident as a matter of racial discrimination, Gordon’s attorneys claimed during a March 18th press conference that Gordon had no background or record of involvement with law enforcement, and previous to this incident had “no interaction with officers.” In fact, Gordon has had multiple interactions with law enforcement over the years. Since 2014 he has been stopped and questioned by Coffee County Sheriff’s Office, Murfreesboro Police, Grundy County Sheriff’s Office, and the Collegedale Police Department just 2 months prior to this incident. In 2017, Gordon was a suspect in a domestic assault in Murfreesboro.

    As a black man in Texas, I've gotten out of many traffic infractions by just being cordial and cooperating. Most of the time they don't even want to do the paperwork, just be cool. If you have an issue, address it in court.

    I’m a black woman and I’ve been pulled over for speeding before and I find that it goes a lot smoother if you just cooperate. I had an officer give me a warning just because I didn’t give him a hard time. Every interaction with a cop doesn’t have to lead to this…

      ReadyWriter, Exactly, but you'd think it's common sense . In my younger days I got pulled over a-lot, and even a few times when I justifiably deserved an infraction, I was let go with just a verbal warning. For the couple of times that I did get a ticket, oh well, at least everyone goes home safely.
      There was one time that I did have a bad time with a cop( nothing violent though) and the cop had an attitude for literally nothing I did, his partner put him in his place though. I still stayed respectful through the stop, and I was sent away with an infraction that was later dropped. The place to fight an injustice is in court, not in the streets.
      Most of these profession victims are just looking for a payday or something . The way I see it, once you escalate a simple traffic stop, you deserve whatever happens next.
      This guy could've easily avoided all this, It would've been cool though if the cop delivered the food order, it would be a new meaning to "protect and serve", lol.

Should he have just handed over his license? Absolutely. That could have saved him from it coming to this. However the cop escalated things fast. He asked for a supervisor for whatever reason but that doesn’t really matter. He asked for one and right after the cop lost it

      ​@@Materialgirl_3 Not sure how this moron idea is now thought of as truth that if you request a supervisor, everything stops, the cop is now in time-out and can do nothing until a supervisor responds. You can request all you want. The officer has no obligation to call for one. And this is also the idea that whatever a supervisor is doing, he has to stop and now respond every time some goof-ass on the side of the road wants him to come to his location.
      If the OFFICER thinks he needs a supervisor, he'll call for one. But the goofs on the side of the road don't decide what the supervisors do, where they go and when.
      That being said, if you really want a supervisor, just get a use-of-force situation going, like this fool did, and a supervisor will respond immediately!
      This guy should be happy now!
      Got to ride the lightning, be handcuffed, sitting in the back of the car heading to jail, and have the sergeant show up and ask, "What is it you wanted?" Winning!!

    Just yesterday I got pulled over for going 70 on a 55....no ticket, no nothing...except a nice chat with the trooper. He saw I already had ny license and registeration for him...didnt even looked at it...he only advised me to slow down. But my demenour and respect for him were on the mark. Thats it.

      I jad the same thing happen to me except it was a Deputy Sheriff. Had all my onfo ready but he jist looked at my license. His partner asked of ibjad a body in the trunk as they could heae a big thump from my car going over RR trax. I said no, no bodies transported on Wednesdays. He then asked if he could look in my trunk. I said sure. I was just a big toolbox that thumped. We all laughed and be said to slow down and parted ways.

      I was pulled over doing 77 in a 55. No ticket, let off with a warning and told to slow it down, only took my license didn’t even ask to see insurance. Complying is so simple.

      Problem is these people watch videos on how to lawfully refuse to comply, but think it's applies to every situation. If there are reasonable grounds for an officer to detain, arrest, serve fines or investigate, you can't just talk your way out of it. Protesting your innocence is done through the courts.

      Almost pleasant if you treat the officer politely. I was given a break when I was 20 over the limit. They wrote it less to save me criminal charges. I apologized. I was indeed speeding and I thanked them for keeping us safe. I was wrong.

      use of a taser is for people that are a potential threat to the officer or people within the proximity of the subject, or if the subject is within reach of a weapon. or resisting arrest. in this case you can argue he was resisting but it wouldn't be valid due to the fact that the officer should have never opened his door and tried to forcefully pull him out of the vehicle for asking questions and to speak to a supervisor. this officer should have calmed down got his supervisor and let him or her handle it. no mater which way you flip it the officer is th agressor and is wrong in this situation

      take note to the fact that it took the officer exactly 50 seconds from the officers first words with the driver to become aggressive with the driver. after being asked for proof and to speak to a supervisor. this is not mentally stable behavior when handling someone that is not a threat.

    Just because you ask for a supervisor doesn't mean that the officer needs to stop HIS job because of it, and the suspect doesn't have to follow any of the directions that are being given to them. This whole " I want to speak to your supervisor, I feel scared or I'm going to have an anxiety attack " is NO reason for you to not cooperate because you're just adding more drama to the situation. These people now a days are on a whole different level of thinking they are in charge and can control the situation they are in. It needs to stop, and the police need to enforce the law a little more forcefully when it is required.

      While lawful this is asinine to say its morally or ethically okay to yank someone out of their property for a minor traffic violation of no victims and failure to provide identification. This is incredibly remnant of modern day china or 1942 Germany. "You dont provide us your plastic "rights" card we take you to concrete cage." "We heard you might be a jew and you cant provide identification otherwise were ganna have to take you to the camps until you can." People are far to obedient these days to government power. This is America, a country founded by rebels who fled their governments to start a new land of god given rights, free from this type of questioning and tyranny. There is a big difference between legal and what's right. Stop pretending our governments are perfect and every single law is designed to protect you.

      @@georgejackson7798 That's not true. DA's dismiss charges all the time. That's why there is so much crime in America now. Lawbreakers know they're not going to get in any real trouble. They can get bailed out of jail for a small amount of money, then the DA ends up dismissing.
      If anyone harassed someone here, it was the driver who was speeding. This driver wanted to harass the police. He could have just given his license/insurance/registration to the officer but he wanted to cause trouble. Maybe he wanted a struggle so that he could file a lawsuit.
      Requiring officers to wear bodycams has helped the police. All these people claiming police brutality can no longer falsely accuse officers because everything is recorded--well, actually they do still try to claim abuse by screaming during encounter that the officer is choking, punching, kicking them. But when the video is reviewed, it shows they were lying.

      My fave is asking for proof before he even gives up his info, its dude no the trial is at a later date you can dispute the evidance. Those are my faves though I have beat a ticket before, you just corporate don't talk shit especially with a body cam take the ticket show up to court with your evidance judge gets to decide. Yes it sucks you got do that, but you can't have the proof upon request from the cop at the stop. You can get that info before your trail date though.

And maybe it did for them I have seen it work its just stupid rare, if you calm down and play dumb and polite they might let you off with lessor charges or a warning. But were body cam age so it doesn't work as well now. I mean shit my dad once sucker punched then broke an off duty cops jaw in the 70s and got off on it, because a judge decided "boys will be boys" He gets drunk to this day and brags about it, and how he got away with it, how he even started fight but told the judge he didn't and since both been drinking and he had his brother vouch for him and cop had no one vouch for him he got off with a warning to not fist fight near bars again.

    I'm trying to teach my kids that life isn't about "what you feel" all the time. My parents and grandparents era, feeling were something you kept bottled up. In an effort to resolve many of the issues THAT caused, we now have swung the complete opposite direction. "I don't feel comfortable" and "I don't feel safe" are valid feelings, but become a problem when you try to use them to circumvent laws and regulations and use them as ways to get out of something you don't want to do. Drives me crazy....

Instead, he decided to ask some dumb questions (e.g. if he can see proof) and poorly tried to make the officer look bad. I don't blame the officer for getting him out that quick since the suspect just didn't have any idea that he is in wrong.

I guess I’ve watched to many of these videos with police because all they need is a reason like let’s say a infraction like putting your cigarette ashes out the window once they have that they can ask for your ID and then if you refuse you’re failing to ID, which is breaking the law.     Supreme Court has already ruled on this (Pennsylvania v. Mimms, Maryland v. Wilson, etc.), if you are being detained during a traffic stop, an officer is permitted to order you out of the car. You can go ahead and REQUEST a supervisor (they have no legal obligation to come), but either way you still have to follow lawful orders if awaiting a supervisor arrival. Being a DoorDash driver or speaking softly is also not a legal defense to literally anything, though I am sure that doesn't need stated.

      @@jojo-gy9pp Whether you agree with it or not, "safety reasons" can simply be the officer being more comfortable with his safety and feeling more comfortable with the person not being in the vehicle. This has held up throughout case law, I am unsure if there has ever been an instance where an officer ordering a person out of care during a legal detainment has ever been deemed "unlawful".
      If it helps knowing my perspective, I am by no means a fan-boy of law enforcement, and are as critical as any reasonable person should be, hence I have made myself familiar precisely where my rights begin/end in such situations. This simply is not one of them, the officer was well within his legal authority to order him to exit the vehicle. There is practically no scenario where this is not true that will stand up in court, assuming the initial detainment is lawful, which it was in this case.

    - Police officers can tase you on a traffic stop.
    - Police officers are not required to comply with your request to call a supervisor.
    - Police officers can forcibly remove you from your vehicle on a traffic stop, without your consent, if you fail to follow their instructions. This includes opening doors and breaking windows.
    - Being a "good person" does not release you from the law's requirements.
