    You will NOT BELIEVE this case is real.
    I still don't.
    But it happened.
    These are the Closing Arguments and the Reading of the Verdict.
    Some pieces are missing, sadly, because the judge either forgot to turn on the record or the recording messed up. I apologize for that on their behalf.
    Background: Client was stopped for allegedly weaving in and out of lane. She was facetiming her husband. Gets pulled over and given field sobriety tests (she was crying and her face was red and puffy so the cop suspected something was wrong). However, she does well on the tests, and the cop sees that my client is not the smartest person in the world, so he takes a liking to her.
    This is a small town, and the cops have no body cameras, so the officer arrests her (without ever putting hand cuffs on her) searches her (during which he makes pit-stops by groping her breasts, buttocks, and crotch areas), places her in the back of his cruiser and takes her to jail.
    They make a pit-stop in a dark, abandoned building where he "claims" that she should "do a urine test" but she is frightened as all hell at this point because she feels sexual advances and declines because she sees no lights coming out of the building or any cars around. Then he takes her to jail.
    When they arrive at the jail, she asks to smoke a cigarette and call her mom, which he allows. After which he takes her phone and asks if she has any nude pictures on there or any pictures of drugs. She admits to having some nudes, but no drugs.
    He goes through her phone, finds the pictures and goes through them. He also finds a 1 minute 25 second porn video my client's husband and her recorded on their WEDDING NIGHT and WATCHES IT IN FRONT OF HER!!!!! Immediately after, he says he is going to give her his phone number (which he leaves in her property) and encourages her to call him BEFORE she leaves Kentucky.
    She is then booked and released. She fails to call him, and so he LIES on his report, writes that she ADMITTED TO BOTH "Smoking AND shooting methamphetamine prior to driving" which never happened, and forgets about the case.
    Luckily the jury saw through his bs and acquitted her.
    It is important to note, that after she testified, the cop NEVER REBUTTED HER TESTIMONY RE: SEXUAL ADVANCES. Which obviously means that he DID IT and ADMITS TO IT. During her testimony he was VERY ANTSY and his legs wouldn't stop shaking, so says my client.
    I still can't believe this is still going on in 2019, but I am happy she hired me and we got the truth out into the open.

    Sounds like a predator with a badge, if it's true.
    But he had no reason to give her his personal number.
    And 99% of the time the prosecutor ALWAYS favor the cops even when they're caught lying

    These cops get away with way, way too much crap. We the people tell the truth and prosecutors think it’s funny. Call us liars, plant frugs on us etc. it’s pathetic. I just went through a whole bunch of BS. Accused of stuff that was not true. Tyler Hitch did a wonderful job and all of my charges were thrown out! Thanks guys!

    I've never heard so much of Papers in my life LOL that judge acted like he didn't know what to do with himself, and or his microphone was way too loud. I'm glad your defendant was found not guilty on the DUI

    Also how can he say “she was driving under the influence of methamphetamine” when he had nothing proving that? Shouldn’t be allowed. He should only be able to say “the officer testified that she said this” but he shouldn’t be able to just claim that she was under the influence of meth without something showing that.

    I can agree with the jury, prosecutor did not prove she was on drugs at the time, but she admitted to no seat belt and to being on the phone distracted driving. I don't find the prosecutor credible and if anything he sounds nasty wanting to punish an American citizen.

    I understand how she felt. I had issues with a law enforcement officer in the past. I got so that I wouldn’t leave my home in the car by myself. He pulled me over every time I left my house. He never gave me a citation because I didn’t do anything. But he sure scared me. One time he told me that he pulled me over because the spare tire in the back of my truck was bald. Really??!!! My family has a large amount of law enforcement in it. It still scared me. To this day 30 yrs later I still get scared when I’m pulled over. I’ve only had 2 tickets in my life.

      the state is the one that brought charges that warranted a jury trial there for the state should pay not be added onto the fine for defendant!

      If the defendant is guilty of the charges that brought her to court then the defendant pays.
      I will agree with you here in this case, she already admitted the reckless driving and driving without a seat belt. But not the DUI.
      The state charged her with DUI, she was found not guilty of that charge, so the state should pay legal expenses.

    She caught a reckless and a seatbelt, but managed to avoid the DUI/DWI, so congrats thats a huge win. i am shocked that there was zero footage anywhere though... what kind of police have no station footage or body cams these days?!?

    dayum! that court bailiff looks like he gonna keel over just walking from the bench to the jury room! do they not have to be physically fit to do that job? he looks like a liability to the tax payers that pay for his health insurance! where does his chin start and his neck start or end?

      She should file a civil rights lawsuit against him for going through her phone that’s against the fourth amendment . he should lose his qualified immunity because it’s a civil rights case of illegal search and seizure.

    The judges orders to the jury are prejudicial. He states you will find the defendant guilty if this evidence is present, or words to that effect. How about you will find the defendant innocent if the state has not proven its case beyond reasonable doubt.

    This is a great example of how the judge, prosecutor and cop protect themselves and each other. The phone number that the sleazy ball cop gave the lady, should have been called right then and there, infront of the jury, on speaker, to prove that it was his number. That’s all the foundation you need.

    This prosecutor illegally introduced evidence post trial. He should be reprimanded by the court as the evidence when the ticket was entered was not admitted.

    I so knew that they were going to split the baby on this one! So if they didn’t believe the cop on the DUI why did they believe him on the reckless driving and seatbelt violation. This should never have been filed as reckless driving in the first place. It fits the definition of careless driving but not reckless!

      She basically admitted to not seat belt and driving while crying on the phone. If she never mentioned being on the phone and instead said she swerved to avoid a squirrel I'd say ok. But she painted a picture of herself driving distracted.

    Congrats on the victory. Forfeitures and specifically DUIs are a profit center for a municipality. Just to speculate, this appears to be a 'value added' charge which this police dept. might routinely add to minor infractions to increase the profitability of judicial proceedings.

    That was the right result. She admitted to driving whilst video calling her husband and whilst being emotionally upset - which was reckless driving.
    The DUI was a his word against hers and therefore a lot of reasonable doubt. Even if she was lying, the cop and the commonwealth did a terrible job of gathering evidence. To the extent that they and the prosecutor were jokers for bringing this to trial.
    And I personally found her testimony to be more credible than his.
    If only she had some form of concrete evidence to back up her claims and get this cop convicted...
    But of course the cop was too cunning for that - this time. And his supervision is too lax, because there's a real possibility he's been a serial sleazebag and there's no check nor controls to catch him.

    Fair result I guess for the Dui, I think the only reason for the reckless was because of initial traffic stop and lack of seat belt, still unsure how he saw the lack of seatbelt from behind the 18 wheeler truck. Why did he not take her into the building so they could do bloods and urine. Why would he produce his own cup??

      I think the reckless driving was for facetiming while driving, when she was admittedly very upset. I think Larry's plan was to admit that and just fight the DUI charge, because that charge alone could have destroyed her ability to operate as a trucker.

      He should be closely watched by his supervision, even extending to them setting a honey trap on him.
      If they gather sufficient evidence to prosecute him, he should be fired and jailed.
      Until then he's innocent until proven guilty.
      The trouble is: the cops are hopeless at investigating the cops. There's far too much of a thin blue line them and us culture.

    I’m not sure, but I think in Pennsylvania if you get a reckless driving charge with a CDL, you lose your CDL for a certain amount of time

    The way the prosecutor reacted by defending the cop's honor in his closing argument was one of the least persuasive things I've ever seen. I think it's all he had to go on, though.

    Dude did she have any documents to show she couldn't read because of some medical issues i.was really looking for some documents that said because of a brain injury due to accident when she messed up.her knee
    Was there enough evidence to investigate the officer for his sexual advances was there any video in the jail area that could have helped he story

    In this day and age it is inexcusable not to have a video recording as an officer. The only time there would be an exception is if the officer has a body camera and that body camera has a bullet hole in it from a weapon that doesn't belong to the police force.
    Also, to have no footage even when taken to the station is just plain and simple a case of destruction of evidence, by the police.
    Bring in the FBI and close the whole district down and charge everyone who could have known that this happened. Not just the ones that did know, but the ones that should have known.
    No video as an officer or government official? You are sent to prison!
