Yup that’s exactly what happened. He found him guilty of dui and didn’t bother doing the actual steps he needed to do in order to prove that or investigate. The fact he called his buddy cop complaining about all the calls he had shows he wanted to get through this one as quickly as possible. I've seen narcissistic behavior rear it's ugly dangerous head far too many times within law enforcement personnel. It's dangerous behavior to all parties involved. Careful selection of potential new hire officers etc. has to be performed to weed out and prevent the narcissist applicants from advancing to a career in law enforcement. Further more any officers exhibiting narcissistic behavior with in the ranks of law enforcement should be assessed .There should be an on going policy/ process to evaluate with unbiased observation perhaps through independent evaluation .
That cop shouldn't be a cop. At the end when he's all, "well, I have military training and that's why I could decide whether he needed the hospital" was unreal. No, sir, you don't get to decide who does or doesn't need the hospital after they've been injured. That's NOT your job. And head injuries can kill.

I love the fact that he brought up being in the Military. Triage training states that ANY head injury MUST be reviewed by a medical professional. This is the same training for when the police themselves are injured.
In 1992 I was pulled over by a cop. I had a half a joint on me, he pulls me out of the car slaps me around a little bit cuffs me stuffs me. I get charged with resisting and possession. Didn’t have a camera didn’t have a cell phone. Neither did he. I didn’t resist and he got to push me around pretty hard. I plead out get a reduced sentence get on with my life. There’s lots of Gen Xers out there like me who had that experience and will never forget it and will never trust police again.

With his tours of duty he never saw a fellow soldier with head trauma that is off neurologically?!! Your client could have had a peti mal seizure that had caused the same presentation by the time the officer arrived. He potentially would/could not answer questions appropriately. As a nurse I’ve seen this. As on who had a grand mal seizure it was 4-5 hours before I knew I had answered the questions wrong. Looking forward to the rest of this series! I know someone who arrested for DUI, blew a 0.0% on the scene and the blood test came back with no mind altering substances. She went to the ER after being released on bail and her MRI showed she'd had a stroke.

i had the exact same thing happen to me a few years ago- 2.25 years of court visits and stress, and they had zero evidence as i refused all test. i had drank 4 beers before a sunday night football game (pregame in parking lot)- i finished drinking at 7, so 6 hours had elapsed. i got pulled over at 1am for taillight out, i made the mistake of telling the officer i'd had a few light beers but finished SIX hours ago (he said he smelled it, now i think he just said that to see what i said). i was arrested for dui. cost me thousands of dollars, lost job, lost wife due to that, lost my house due to not being able to get another job- lost everything and had to move back in with my parents... i eventually ran out of money for the lawyer and lost patience and signed a plea to reckless driving. 1 year probation and all that stuff. im still furious at myself for agreeing to it but my budget lawyer made it sound like that plea was a good deal- i didn't realize thats the standard they offer almost everyone for their first offense. that same officer had 2 other "DUI" arrests that night i was sitting in jail between 2-6 am. somehow no other cops made any arrests- only the one who "found" us. needless to say that completely flipped my mind on how i view our legal system- i lost all faith. been binge learning about law ever since and have watched DUI guy from the beginning. id really like to become a defense attorney thanks to this channel and my experience but i think im too old now. oh and a funny thing- on that final court visit after i'd been speaking with that lawyer and paying him for over 2 years while he was 'working on it', as we walked into the building that final day he said "this is your 2nd DUI arrest right? first one for drugs?". nope...? id never been arrested before i said. i should've handled things different then and told the judge i felt i had a bad lawyer lawyer, but i was so mentally broken by that point i just wanted it over with. anyways DUI Guy: thanks for doing what you do, love seeing cops squirm like that :D

Its amazing that officers can recall with crystal clarity the details of a conversation that help their case, but suddenly cannot recall anything said seconds later in the _same_ conversation that _doesn't_ help their case.
It’s interesting to see how this officer, who’s now on the stand, gets flustered and annoyed because he’s now being asked the questions and has to answer to someone else.
This officer isn't fit to hold a badge and should be removed, he should have checked on this person from the first point of contact, and when he was being transported in the back of his patrol car, there are lots of primary causes of false positives in field sobriety tests, he should have done a roadside alcohol and drugs test before arresting this person.
Problem here the individual has a head injury that definitely will make them not pass HGN. On top of that Mr. Edwards also has RA which will effect the rest of the FST’s!

I like that too. You shouldn't allow them to inject their personal opinions or narrative, and they will do that if you let them. I'm not a lawyer, but it seems to me that in a deposition, it's the opposite. I saw the deposition of some cops that arrested a armed guy near the Mexican border in Texas. He was pro se. He let them just talk after asking a question, and they just fell on the sword of self incrimination. Their complete lack of knowledge about constitutional rights became staggeringly obvious, and he barely had to do anything.
I think he was told to slow down by Larry because he teased the question before the judge ruled on his objection. Larry also snapped back to the prosecutor that he had already told him to slow down, as to defend his team against the prosecutor's ridiculous complaint of badgering.
@@scottmattern482 Yes. That is a good point. Another thing I would object to is the witness answering the question before he (and the prosecutor) was done asking it. That happened many times, and I think that could be the result of the rapid fire questions. It kind of sets a tone, and Mr Foreman does that masterfully. I don't think there's a correct style to questioning a witness, but he definitely asserted his dominance and control of the process, and I think that is important.

The judge is awesome. She has the defendant’s rights in mind. She’s showing that he’s innocent until proven guilty. A lot of judges take the side of the prosecution in cases. Not just DUI cases but all their cases!!

Great young attorney you are working with. You guys are gonna be a great team. I see that he does need to know when to slow down and when to speed up. I got called for jury duty for a dui case. The defense was prepared and profesional, the prosecutors disorganized. I wasn’t selected but the next day I had coworkers who also weren’t selected. We decided he would be found not guilty. He was.
11 years since his last follow up course. Holy crap that's a long time. Wasn't worried nor did he write the second guy in the crash a ticket for no insurance, said he wasn't worried about that. Is it this officers idea that some things matter more than others even if they are illegal as well?

Not defending the officer, but a lot of times when they are testifying they are also on duty. So they come in straight from patrol out of their unit and into the court room. Just a little context as to why he has his vest on.

Possible that he was having a low blood sugar diabetic event. Breath can present as very fruity and smell of alcohol.

i had the exact same thing happen to me a few years ago- 2.25 years of court visits and stress, and they had zero evidence as i refused all test. i had drank 4 beers before a sunday night football game (pregame in parking lot)- i finished drinking at 7, so 6 hours had elapsed. i got pulled over at 1am for taillight out, i made the mistake of telling the officer i'd had a few light beers but finished SIX hours ago (he said he smelled it, now i think he just said that to see what i said). i was arrested for dui. cost me thousands of dollars, lost job, lost wife due to that, lost my house due to not being able to get another job- lost everything and had to move back in with my parents... i eventually ran out of money for the lawyer and lost patience and signed a plea to reckless driving. 1 year probation and all that stuff.
im still furious at myself for agreeing to it but my budget lawyer made it sound like that plea was a good deal- i didn't realize thats the standard they offer almost everyone for their first offense. that same officer had 2 other "DUI" arrests that night i was sitting in jail between 2-6 am. somehow no other cops made any arrests- only the one who "found" us. needless to say that completely flipped my mind on how i view our legal system- i lost all faith. been binge learning about law ever since and have watched DUI guy from the beginning. id really like to become a defense attorney thanks to this channel and my experience but i think im too old now.
oh and a funny thing- on that final court visit after i'd been speaking with that lawyer and paying him for over 2 years while he was 'working on it', as we walked into the building that final day he said "this is your 2nd DUI arrest right? first one for drugs?". nope...? id never been arrested before i said. i should've handled things different then and told the judge i felt i had a bad lawyer lawyer, but i was so mentally broken by that point i just wanted it over with.
anyways DUI Guy: thanks for doing what you do, love seeing cops squirm like that :D

Its amazing that officers can recall with crystal clarity the details of a conversation that help their case, but suddenly cannot recall anything said seconds later in the _same_ conversation that _doesn't_ help their case.
It’s interesting to see how this officer, who’s now on the stand, gets flustered and annoyed because he’s now being asked the questions and has to answer to someone else.
This officer isn't fit to hold a badge and should be removed, he should have checked on this person from the first point of contact, and when he was being transported in the back of his patrol car, there are lots of primary causes of false positives in field sobriety tests, he should have done a roadside alcohol and drugs test before arresting this person.

The driver declined to do a field's sobriety test ,,and rightfully so,,it's very subjective!
I can see why the cop thought he had it in the bag, the guy admitted to drinking and the way he was acting and the wreck. Where he went wrong is being lazy and just going off assumptions and thinking he is in the good ole days where cops were always believed no matter what. That is the definition of a tyrant.

I'm not a lawyer, but it seems to me that in a deposition, it's the opposite. I saw the deposition of some cops that arrested a armed guy near the Mexican border in Texas. He was pro se. He let them just talk after asking a question, and they just fell on the sword of self incrimination. Their complete lack of knowledge about constitutional rights became staggeringly obvious, and he barely had to do anything.
I think he was told to slow down by Larry because he teased the question before the judge ruled on his objection. Larry also snapped back to the prosecutor that he had already told him to slow down, as to defend his team against the prosecutor's ridiculous complaint of badgering.

Another thing I would object to is the witness answering the question before he (and the prosecutor) was done asking it. That happened many times, and I think that could be the result of the rapid fire questions. It kind of sets a tone, and Mr Foreman does that masterfully.
I don't think there's a correct style to questioning a witness, but he definitely asserted his dominance and control of the process, and I think that is important.

The judge is awesome. She has the defendant’s rights in mind. She’s showing that he’s innocent until proven guilty. A lot of judges take the side of the prosecution in cases. Not just DUI cases but all their cases!!

From someone that has had numerous concussions, it affects everything, speech, balance, thought, memory, etc.
I got called for jury duty for a dui case. The defense was prepared and profesional, the prosecutors disorganized. I wasn’t selected but the next day I had coworkers who also weren’t selected. We decided he would be found not guilty. He was.
Ive never even driven while intoxicated. I would want this man as my lawyer if i ever did get charged however!

Not defending the officer, but a lot of times when they are testifying they are also on duty. So they come in straight from patrol out of their unit and into the court room.
