@@TheDUIGuyPlus Wow. Interesting law. I don't know the law here in Texas, but I have read on some attorney's web sites here that anyone who refuses roadside tests or breathalyzers will NOT be helping their case, suggesting that drivers "cooperate". (Shaking my head).

The system has fallen into the hands of evil-doers, and it goes all the way to the top with the Deep State, and the SCOTUS allowing private interest money into the government (Citizens United v the FEC, 2010), which is supposed to be administering the affairs of and in the best interests of We, the People. The police, in 2010, were conscripted. They are no longer community based tasked with to protect and to serve. They are paid federally (90%) and are now a PRIVATIZED, PARAMILITARY security force like Blackwater, TigerSwan, or Ze (private hit squads, and this is going to become more and more apparent with time when the Weelaunee Police Training Facility starts pumping out thousands of state owned police, like the German Schutzstaffel). In other words, they have been bought off by corporate money and now work for the fascists, against us and our civil liberties (which the state governments are changing all of the laws behind our backs) to favor corporations and the rich. The police are being trained that we are the enemy; cockroaches (their word; not mine), and the police, as could be expected, are going to be loyal to whomever is paying them. We are going down.

I've heard a well-known sheriff in florida say that they don't do it because the cameras point at the public and violate our privacy.... I call bs. I would rather the officers have bodycams on.
No new cars, no new bullet proof vest, no new guns….no NOTHING until they are equipped with body cams, dash cams and cameras in every room of the department/jail. We the people NEED these cameras.

Even when a client's constitutional rights have been trampled on by the police, instead of using that to ensure their case is dismissed, they instead tell their client to take a plea deal, because it's faster and easier for them. Not to mention, they're doing less work for the same amount of money (ESPECIALLY, if they're getting paid from the state). Take a plea deal when the chances of him getting completely released is incredibly high??? I'm on disability and was attacked by a psycho new neighbor who was under the influence. Despite the fact that she came into my home and literally broke in my door to get to me, she was NOT arrested and I was arrested because I had the GALL to defend my own life with a small pocket knife. It's perfectly legal and my last option after trying to escape her multiple times (at LEAST 3 different times). I should also note that I have Chronic Kidney Disease and only took the knife out when she started kicking around my kidneys. Despite the fact that I was the person who called 911, the policeman never bothered getting my side of the story. It was only once he arrested me, which he did within 5 seconds of talking to me that he was willing to allow me to make a video statement. But if you've been arrested, you should never, ever make a statement. They don't care about the truth anymore. They only care about gathering evidence against you. Despite the fact that it is perfectly legal to use an object in your defense the Canadian police have chosen to arrest those who use the weapon and not arrest the other person despite them attacking first, so they can try to Increase the chances of the VICTIM getting convicted. I imagine the convictions are not a high number. In my case, after trying to force multiple plea deals, my charges were dropped one month before trial. I very much wanted to go to trial because I wanted to see the policeman and the prosecution get yelled at by the judge. Anyways, despite my lawyer not pushing any plea deal, I could tell that she wanted me to take one of the last 2 plea deals, but I was not willing to take any play deals whether or not it left me with a criminal record because I did NOTHING WRONG. Despite my charges being dropped, I was kicked out of my home and had to leave my town. I now have end-stage renal failure due to the stress of the attack and the arrest, etc. and I'm now getting dialysis and living in my friend's home.
You absolutely have no idea unless you have been through it or have had family or friends go through it. Even now in 2023 they can turn their cameras of at will when it benefites them. It is still scary as he'll. They can say you resisted for anything they want. IlImaginr being an actual good/honest cop and other police officers lying and doing what they want.
Thankfully in NJ it is criminal for the police to turn off or not have cameras on. Some still do it claiming malfunction but that doesn't help them much.
A police officer once told me, "We as police officers have the power to change your life" That chilled me to the bone because it is the absolute truth. You can only hope that the officer you happen to be interacting with is an honest, ethical human being.

I once had an officer heavily falsify a report including stealing evidence. I went to court to fight it and when the judge rolled in in a wheelchair while wearing a big giant cowboy hat, I remember thinking oh great I'm screwed lol but actually he was exceptionally smart and was able to see through the officers lies and dropped the charges. Best judge ever. And to top it off the entire department went under investigation by the state, it was very satisfying!

So would I. I had unsuccessful lumbar spine surgery and I have several other physical issues. Unless you have fairly strong core muscles, the tests are difficult. I'm glad they are supposed to ask if you have any conditions that could prevent you from performing them.
That’s because their rigged. A proper sobriety test should be conducted at the station and you should refuse all and request to be brought to hospital for blood test and stay silent if you are not under the influence. Them machines do not even get Calibrated so they are not accurate in the first place.
No department in America should be able to get any new vehicles or ANYTHING else until that department has been outfitted with body cams and dash cams and cameras in every room of a jail. Cops lie. Dude, in every state but one you have to do none of those tests. There is no law or statute....it would violate your 4 58:25 th. Im the son of a cop. There is no passing these tests....you're handing them more probal cause. If you were drinking give a lawyer a chance. Verbaly assert you're 4th, 5th, and 6th ammendment to have that lawyer present BEFORE any questioning. Meaning you dont have to say yes or no (absolutely required) when they say "do you understand these instructions" you remind them that you have asserted your 4th and 5th. Then be tough enough to let then do what they want. Go to jail and fight there. The cops will trip up...cant know every law. REMAIN SILENT COOPERATE GET OUT OF THE CAR. SAY ONLY I DO NOT CONCENT TO ANY SRARCH OF MY PERSON OR PROPERTY. IF YOU DONT Say it its not granted until after your arrested. You gotta give blood or breath at the station. Cops will intentionally word it in with the implied consent breath and/or blood chemical tests and make it sound like you can't refuse. And so the average person will just consent and do the tests not knowing they are just gathering more evidence and not actually ruling out dui
Seriously? He knows what he is looking for when conducting a field sobriety test, and that's what's important, not the specific names of the clues. This is so academic it hurts. No jury is really going to care, because we all know the basics about what they're looking for and no one would credibly question that of the officer unless he made an actual mistake in identifying a clue which was not presented. He simply couldn't name them.

The slight loss of balance on the first step of the walk and turn is not a clue according to the NHTSA manual. Which the defense lawyer points out. Also, how do you not clearly see the issue with an officer just disregarding the guidance from the governing body on how field sobriety tests should be performed, whom they should be performed on, and what constitutes enough clues to arouse suspicion? Or the fact that the officer was never even given a single refresher course in 16 YEARS. If I had been on that jury I would have had a huge issue with a Law Enforcement Officer not being able to name or describe basically any of the clues he is supposed to be looking for. It's his JOB to know them. If you asked a doctor to name symptoms for some common diseases would you really be okay with the doctor not being able name any of them? No because lives are on the line. It's no different with Officers of the Law. Lives and livelihoods are on the line so I do expect them to know this shit and so should everyone else.

The disturbing part of all this is that defending yourself from incompetent and ignorant cops costs thousands of dollars in legal fees, not to mention the time that must be dedicated.
I spent thousands to dispute an anti-diarrhea pill a cop found in my back seat floor board during a traffic stop for a license plate light out. Dude had the audacity to say I had intent to sell. I laughed because I thought it was a joke. It was one pill and it had dirt and hair all over it. And that's when he arrested me. I paid thousands to prove I was innocent. And it definitely affected my performance in school because I was being accused of a misdemeanor for several months. Our system does not work as it should. It punishes the innocent too harshly.
Well, when you win you can go after them for false arrest, court fees, etc. The system takes time, but a false arrest is a good chunk of money depending on what it's for and the severity.

If you hire a lawyer and win the case a portion of the fees should be paid by the department that makes the accusation. Or, benefit the defendants lawyer in some manner or even a tax deduction to the defendant themselves.
Shame on the judge for not dismissing the case! She should have been easily convinced that the officer was just looking for a case, a notch in his record. Nothing was mentioned about the fact that the officer said he approached on the passenger side, but then affirmed that he approached in the driver side. Then said he conducted the eye test but then said he didn’t. Shame on you judge. Judge NOT qualified to be in the seat. Protect the people! That should’ve been dismissed! Move on! Looking at the “Justice” system as a whole, it’s a extortionist bordering on entirely criminal system. They just need to keep up the facade so they’re not outright about it. Just the infringements on the constitution alone deem the federal court system as unqualified to be an unbiased party. But you gotta go back 200 years to study where it began. Most people think this is all normal cuz that’s all they’ve known. But when you see the history of Supreme Court justices and senators being bought and paid for all the way back in the railroad days, it makes more sense.

One thing I noticed: they smelled alcohol, did a field sobriety test on the husband, found nothing to suggest he was drunk (he was 65 so a FST should not have been done, and he only triggered one clue on each part of the test), but arrested him anyway. Then they let his wife, without a FST, drive the car when she could have been the source of the alcohol smell.

They aren't supposed to give a 65 year old a sobriety test because older people often fail when they're perfectly sober. Admitting to having had a drink is not the same as being over the limit. @@keemarie1 standardized training states that the smell of alchohol on or about his peron or the car is sufficient cause to initiate a reasonable suspicion the person is DWI, thats what the sobriety tests, and intoxalyzer is for...to prove or disprove that suspicion, and the man adnittedto drinking....
The lawyer said you shouldn’t perform a test on someone over the age of 65 but then changed to account should be taken for someone’s age as they may not be so capable of performing the test if over 65. If it’s you should take account of their apparent physical ability or it applies when you’re over 65 testing someone who is 65 isn’t going against the training guidelines. Also aren’t they just guidelines and you would be allowed to use your own judgement in possible borderline cases?

Yep. That's how 95% of cops operate. They decide you are drunk within first 10 seconds of the stop, if not BEFORE, and then just do whatever they can to FABRICATE evidence of that. They don't bother doing a real investigation because actual policework is hard, but making shit up based on your hunches is easy.

Pay attention to the crosses examination where he is being asked about what symptoms he exhibited and what constitutes a pass for FSTs. Then come back and defend what you just said with actual facts.
That is exactly what Field Sobriety Test (FST) means. In 99% of the field sobriety test, a cop will make an arrest, even if you just had only a glass of water before. It is subjective and cops decide whether the person passed or failed the test, and not the test itself. That is why the law permits citizens to legally opt out of FST. Never give consent to FST
Exactly.. Its something I explain to everyone. But some people still insist that my advice would make a person look even more guilty or something along those lines. The police are there to look for any excuse to find you guilty for anything. You keeping your mouth shut both before, and after asking for a lawyer is what saves your butt. Its like the saying "Give someone an inch and he'll take a mile." ( I have seen plenty of innocent people get arrested, as well as jailed for crimes they have not done. )

I was wrongfully charged DUI Any Other Substance here in Alabama. I passed both breath tests, field sobriety tests, but failed a blood test for two legally prescribed medications and I had the bottles with me. In my state, DUI Any Substance only covers inhalants and does not cover legally prescribed medications. I kept begging for extensions trying to make the 1 year mark. I did, in fact, make it to 1 year by which a charge CANNOT be amended and had the charges completely dismissed. I held this secret saying nothing for a year and begging for extensions until the day came I stuck it to the prosecutor. Even the judge was totally amazed. The police are not our friends!
I just looked up local laws for TN thanks to your comment. Im facing a dui charge from october of last year, and my attorney has been postponing the court date every time it comes up. Im now scheduled for court the end of september. It seems like she's going for that 1 year mark as well which I didn't even know about, and honestly I've been ready to just face the courts and get my punishment started and over with. (I was also wrongfully charged. Asleep in my car, drunk but knew not to drive. Keys were out and in the floor so legally I was not in control of the vehicle at the time the officers woke me up)
I got charged for DUI for prescription medications also. Which I just had in my possession. I hadn’t taking any them that day but because they were in my possession they arrested me. Not one of them were missing out of the bottle. I fought it in court for almost a year. Blood work come back good but they purposely gave me the wrong court date the last time so I would get a failure to appear so that I would get a warrant and have to plead guilty to the charge. That goes to show you how crooked the justice system is. They don’t want to be proved wrong ever. It’s just crazy that if they did that to me imagine what they do to other people
I love how this DUI guy works his cases. He poses all the right questions and we are left thinking 'where is he going with this?'' but he knows exactly what he is doing. He pauses to have a drink, letting the jury have time to absorb the information they are being given and his calm and collected voice is simply flawless. He pulverized this cop's credibility.
If I, as a Walgreens pharmacy worker, have to complete routine training courses every year to maintain my knowledge and skill of practice, shouldn't this law enforcement agent also have to review his knowledge every so often? It is bizarre that he is allowed to go 15 years without any refresher courses.
He doesn’t need additional training…he a superior person because he’s a cop…and this whole trial is just an inconvenience…we should just trust him and let it go at that…I mean cops never lie or plant evidence or cover for other cops when they break the law. Yes! At my company we have to sit through tons of redundant state and federally mandated training every year. Like, how many times do we need to be reminded that racism, insider trading and securing customer's information needs to be said. Surely the city or county this man works for needs to be reprimanded and forced to do the same.
Recorded and breathalyzer. Field sobriety tests are design to fail and can be interpreted (lied about) by the cop. Stand on one leg to prove im right to charge you.

You are taught to speak slowly and clearly on the stand. For anyone in that position you should waite 3 seconds to think about your answer and not just quickly answer a question. Think first than answer clearly and slowly.

On the other hand, you see a bloke sufficiently drunk to urinate in public on a wall (instead of going inside the WC inside the carwash), you talk to the guy and he slurs the words, he does not keep equilibrium. You do not have a cam on you(the department had not issued one to you, presumably). You decide to have a objective alcohol testing at the station that the guy refuses (hello, usually something as trivial means something needs hiding)... bla bla bla, and 2years later you are being taught policing by a lawyer. That indeed is a messed up system.
It's a long story, but I represented myself in court once, and won. I caught the cop in a huge lie with his own words, and had an objection that was sustained. I felt like a king that day.
It’s their job. You can’t be a cook if you don’t know how to cook. Can’t be a mechanic if you don’t know how to fix cars etc… know the law if you’re law enforcement. That’s not asking much. All they’re teaching them is how to get headshots when shooting at someone, inflict pain on people and the rest is whatever they feel like doing? Too many cops do exactly that and the people continue to pay for their “ignorance” of not knowing how to do their job correctly. Peoples lives are at risk not to mention everyone who is also part of that person’s life. We should never have to settle for a sub par officer.

The real problem here is that judge, after hearing the prosecutions complete blundering of the case, the dismissal should have been common sense. The prosecution has no evidence whatsoever other than what that cop says and his personal opinion, that's not going to change next time this heads to trial.
Well if the case goes to trial the it is very rare that a judge will stop after the prosacuter make his opening statement. This lawyer is good I watch him all the time he is outstanding on DUI cases. This country has gone way over board with over zealous prosecution. The public for the most part doesn't even hear about these cases. The problem we have in this country is it is ran by lawyer's and most ether corrupt or don't have a clue 99% of lawyers make the other 1% look good.

The fact she didn’t dismiss is a shame. We go based off facts not assumptions. Assumptions can get you a charge, not a conviction. An assumption is all they have. Even the defense attorney for the police officer admitted they should dismiss.

Felt the same way. I was blown away when she said she would not dismiss. The officer nor the prosecutor could not produce factual evidence. Just assumptions. It was evident that the officer chose to ignore training. Qualified immunity is a joke. Imagine if doctors, fire departments, teachers or social worker had qualified immunity.

You know the one leg stand isn't a accurate test, especially if you have had a back injury b4 or leg injury..The Police try to trick you to say I couldn't do this sober etc.. need to say that you can't physically do that do to back injury or they kinda got you.. I got a Fake DUI in MD when I fell asleep in car after work,had heat exhaustion from index of 105 3 days in a row..I blew.000.. got arrested,when they shoulda called a ambulance,then police make jokes a hr or so later when I start feeling better in AC..Funny thing is in Maryland,you have to go to hospital for blood test..that's hard to do when they to ake your car and you have to get a ride at 130am after being there since 7pm.smdh,no food etc,have work next day..It's insane and should be illegal for anyone to have to give a blood test this way..If it's so important they should take your blood there,which they shouldn't be allowed anyway..It's a human right thing..Not sticking me with a needle after I've proven innocence,but you still get DUI for no blood test,so wrong..then U can't drive to work etc..messes &makes your life really hard..the police should have to take a breathalyzer &blood test everytime they conduct this to be fair..I've seen police drink and get in there cars & most likely have pulled people over that way..Fair is Fair
First off.. thank you for your services to the wrongly accused. It must be wonderful to cross examine a witness like this officer. It seems wrong for an officer to decide that NHTSA is wrong when it suits his narrative about intoxication levels and arrest. Peoples lives can be severely impacted by an arrest and worse when it's a wrongful arrest. By that I mean the officer heard slurred speech, performed the FS tests in a random order.. decided arbitrarily the amount of clues needed and also wrongly administered the tests to an ineligible citizen. Why does NHTSA even bother? Why do they offer refreshers? Christ, CPAs, mechanics etc ALL need to go to refresher courses but officers that can cage, arrest and kill citizens don't need refreshers is beyond me.
Cop knew he was gonna make a DUI arrest before he even initiated the stop. Cops make that decision without ANY evidence and then try to MANUFACTURE evidence on the scene. It's a fishing expedition. It almost always is, even when the person really is DUI. This one failed because the defendant was smart enough to get an attorney.
The dude was drunk. Period. Why else would refuse a test that could prove beyond doubt if you're a drunk piece of shit that cares more about themselves, than the safety of everyone else on the road. The only person that would refuse a blood alcohol test, is a guilty person. I think drunk drivers should have their license taken away for life, and lose a hand. That’s fact. I don’t consume any type of alcohol. I’ve been tried like this multiple times. Also stalked when coming out of subway, I had received a phone call and the cop literally, pulled his Patrol car over and watched me from across the street. I was literally talking on my cell next to my drivers door. Not blocking, the next parking spot. Because a car was already there parked. I’m Glad this POS is under the microscope, we need more accountability like this .

There's hours and hours of video for every court case. Not to mention multiple angles in every courtroom. Taping in 4k or even 1080p would likely be very expensive considering they need to hold on to these recording for a quite a while. It's just cost. And why would they even need 1080p recording?

This is so frightening. People can have their entire lives ruined by some overzealous cop when they are entirely innocent. This is one of the reasons I go straight home after work.

If you get a public defender, their entire job is to get you to take a plea because they get less than 15 minutes per case, on average. Not to mention our department has corruption, like most. Anecdotal, but one of my friends, at the time, was T-boned and charged by a cop who ran a stop sign without lights on and not answering a call. The entire system, from the law to the police, is an oppressive force that harms more than it helps. So, to your idiotic quip; they could be fun. The idiotic part of it is that you most likely wouldn't say to someone, "oh, you must be fun... You don't like fireworks because of a fear of playing "firework? Or shot...", at every loud noise." I am retired military law enforcement and was a certified breathalyzer operator in the state of Indiana. Concurrent jurisdiction, we followed the state rules. This should be shown in training academies as how not to do DUI enforcement. Looks like all he did correctly was the proper uniform and the swearing-in. There are thick books on how to defend DUI cases and attorneys have read all of them. No matter how much prep he could have done for testifying, the case was crap and the defense attorney revealed it easily. The prosecutors office deserves some shade too…they decide what goes to trial. Getting drunk drivers off the road saves lives and I’m proud of having done that. But, you have to do it the right way. This wasn’t it.
I have a speech impediment & have hearing issues that also cause my balance to be poor. I do not drink or use drugs, but I would fail most of the tests they administer as a field sobriety test. I also have problems with brain fog & it goes hand in hand with ADHD. It is very difficult for me to think clearly. I can be talking about something, even a subject I know well, & suddenly I am an uh, ahm; just trying to maintain a train of thought...I am also autistic (I've Asperger's Syndrome) I am very awkward with social interactions (I come across as nervous, because interactions make me feel just that). It does not take much to make me nervous. I have PTSD; If I feel threatened things are likely to go south fast! I am also Bipolar (when I am manic my friends say it's like I am higher than a kite; hyper) If that's not bad enough; if they check my vitals they're likely to find them not normal because of both health ailments & I am on a lot of medications from a few Drs; none of them can you get high, but they affect my vitals. Without the meds I am a threat to others, & also likely would die without the Beta blockers. I seem to always come across wrong/off. Honestly do not know how I would react if I encountered law enforcement. I do not see them as an enemy; I feel respect for them putting their lives on the line & serving the community. On a different note; Ty David for your service not only serving your country, but also as law enforcement.
Seems that more people die of drunk driving accidents every year. Obviously the current laws are working. You throw people in jail for texting and driving? How many lives does that cost each year? No, you give them a ticket, for them to text their friend about what happened as soon as they’re driving again. BAC is different for everyone. I hear ya but not quite true. They are there to enforce laws created by the administrative state. The administrative judges and prosecutors are there to adjudicate (prosecute) the said breaking of these unconstitutional laws.
He can't remember anything, there's zero proof of intoxication, he denied his Sargent being on site, he did everything wrong....and she declares a mistrial on something that should very clearly be dismissed. The judge needs a good knock down too. And she says she already said under no circumstances would she dismiss? Excuse you? So irrefutable evidence against this officer screwing the pooch, and she still wants to take it to trial. @@pamlemm903 It wasn't thrown out. The judge said she would not dismiss anything prior to the trial before even hearing anything. She declared a mistrial because the officer couldn't remember anything and kept running circles. That's a clear way for a dismissal, yet the judge refused simply to refuse. It's messed up. There's no evidence against the man, and the officer is a clear liar.

My brother has an misaligned knee from a football injury. Balance is hard for him as well. Both of us could be perfectly sober and fail a field sobriety test. It’s not a sobriety test , it’s an agility test.

Why did this case go to trial? The cop testified the reason for the traffic stop was he saw the defendant urinating by a trashcan not because he was swerving or committed any traffic violations. Isnt that an illegal traffic stop? If so all evidence gathered during the investigation should be thrown out. Not to mention the defendant urinating was never discussed let alone brought up during the stop.
If someone was observed urinating in public (which is clearly illegal in all 50 states) and they immediately got into a vehicle and drove off the there is PC for the stop on that vehicle.
@@jacqueline3782 Yes the detainment for the offense that they observed can be extended over to a vehicle once they start moving and are mobile assuming they took a piss and jumped right in the vehicle. The detention is not negated simply because they got into a car.

I’m all for cops getting their asses handed to them in court but as far as what you just said, that’s not an abuse of power. He’s talking about the breathalyzer. If you blow over the limit, you get arrested regardless of whether or not you’re walking and talking just fine. His point was that the suspect refused the breathalyzer so he had to go strictly off of what he saw during the field sobriety test.

@@jimibones178 he did refuse the breathalyzer but that was after he was arrested. before he was detain for drunk driving the cops game him a test following procedure and he passed the test according to the standard so there would have been no reason for him to even need to be arrested or take a breathalyzer at all and the only reason he was offered to take one was because the cops concluded he was drunk with no evidence to support that claim other than his instinct and he need something for the charge to stick

It's Lion county NV. That's to be expected. I still remember when highway 50 got a daytime headlight stretch in silver springs and they had a cop car in front of the sign and pulling people over who didn't know to put their lights on. For about 2 weeks the judge started court with "Anyone who got a ticket for not having your headlights on, please leave." It was a total shit show. I guess that's what you get in a small peaceful town with quota's.

I don’t & will never understand why it is so hard for people that work in law enforcement to accept the fact that they are human & capable of making mistakes/getting things wrong like every other single human being on this earth. Furthermore, a LEOs opinion shouldn’t be taken with anymore or any less weight than anyone else. If they want to charge someone or secure a conviction in court they should have to have the facts & evidence to do so. There are too many rouge, tyrannical & just down right bad cops in this country for their opinions to be taken as fact with nothing to back it up. You are correct. The lawsuits do not matter if the money does not come out of their own pocket. The tax payers pay the price. Think about it, we pay the cop to do a bad job, then we pay again when they have to pay out on law suits, such as court cost, attorney fees, etc. It just gets old and they are not held accountable.

Not to mention, they're doing less work for the same amount of money (ESPECIALLY, if they're getting paid from the state). I'm on disability and was attacked by a psycho new neighbor who was under the influence. Despite the fact that she came into my home and literally broke in my door to get to me, she was NOT arrested and I was arrested because I had the GALL to defend my own life with a small pocket knife. It's perfectly legal and my last option after trying to escape her multiple times (at LEAST 3 different times). I should also note that I have Chronic Kidney Disease and only took the knife out when she started kicking around my kidneys. Despite the fact that I was the person who called 911, the policeman never bothered getting my side of the story. It was only once he arrested me, which he did within 5 seconds of talking to me that he was willing to allow me to make a video statement. But if you've been arrested, you should never, ever make a statement. They don't care about the truth anymore. They only care about gathering evidence against you. Despite the fact that it is perfectly legal to use an object in your defense the Canadian police have chosen to arrest those who use the weapon and not arrest the other person despite them attacking first, so they can try to Increase the chances of the VICTIM getting convicted. I imagine the convictions are not a high number.
In my case, after trying to force multiple plea deals, my charges were dropped one month before trial. I very much wanted to go to trial because I wanted to see the policeman and the prosecution get yelled at by the judge. Anyways, despite my lawyer not pushing any plea deal, I could tell that she wanted me to take one of the last 2 plea deals, but I was not willing to take any play deals whether or not it left me with a criminal record because I did NOTHING WRONG. Despite my charges being dropped, I was kicked out of my home and had to leave my town. I now have end-stage renal failure due to the stress of the attack and the arrest, etc. and I'm now getting dialysis and living in my friend's home.

I once had an officer heavily falsify a report including stealing evidence. I went to court to fight it and when the judge rolled in in a wheelchair while wearing a big giant cowboy hat, I remember thinking oh great I'm screwed lol but actually he was exceptionally smart and was able to see through the officers lies and dropped the charges. Best judge ever. And to top it off the entire department went under investigation by the state, it was very satisfying!

So would I. I had unsuccessful lumbar spine surgery and I have several other physical issues. Unless you have fairly strong core muscles, the tests are difficult. I'm glad they are supposed to ask if you have any conditions that could prevent you from performing them.

A proper sobriety test should be conducted at the station and you should refuse all and request to be brought to hospital for blood test and stay silent if you are not under the influence. Them machines do not even get Calibrated so they are not accurate in the first place.

There is no passing these tests....you're handing them more probal cause. If you were drinking give a lawyer a chance. Verbaly assert you're 4th, 5th, and 6th ammendment to have that lawyer present BEFORE any questioning. Meaning you dont have to say yes or no (absolutely required) when they say "do you understand these instructions" you remind them that you have asserted your 4th and 5th. Then be tough enough to let then do what they want. Go to jail and fight there. The cops will trip up...cant know every law. REMAIN SILENT COOPERATE GET OUT OF THE CAR. In most states you may refuse the field sobriety test but refusing the breath test also will likely deprive you of the license on spot.

No jury is really going to care, because we all know the basics about what they're looking for and no one would credibly question that of the officer unless he made an actual mistake in identifying a clue which was not presented. Also, how do you not clearly see the issue with an officer just disregarding the guidance from the governing body on how field sobriety tests should be performed, whom they should be performed on, and what constitutes enough clues to arouse suspicion? Or the fact that the officer was never even given a single refresher course in 16 YEARS.
If I had been on that jury I would have had a huge issue with a Law Enforcement Officer not being able to name or describe basically any of the clues he is supposed to be looking for. It's his JOB to know them. If you asked a doctor to name symptoms for some common diseases would you really be okay with the doctor not being able name any of them? No because lives are on the line. It's no different with Officers of the Law. Lives and livelihoods are on the line so I do expect them to know this shit and so should everyone else.

The disturbing part of all this is that defending yourself from incompetent and ignorant cops costs thousands of dollars in legal fees, not to mention the time that must be dedicated.
I spent thousands to dispute an anti-diarrhea pill a cop found in my back seat floor board during a traffic stop for a license plate light out. Dude had the audacity to say I had intent to sell. I laughed because I thought it was a joke. It was one pill and it had dirt and hair all over it. And that's when he arrested me. I paid thousands to prove I was innocent. And it definitely affected my performance in school because I was being accused of a misdemeanor for several months. Our system does not work as it should. It punishes the innocent too harshly.
Well, when you win you can go after them for false arrest, court fees, etc. The system takes time, but a false arrest is a good chunk of money depending on what it's for and the severity.

If you hire a lawyer and win the case a portion of the fees should be paid by the department that makes the accusation. Or, benefit the defendants lawyer in some manner or even a tax deduction to the defendant themselves.
Shame on the judge for not dismissing the case! She should have been easily convinced that the officer was just looking for a case, a notch in his record. Nothing was mentioned about the fact that the officer said he approached on the passenger side, but then affirmed that he approached in the driver side. Then said he conducted the eye test but then said he didn’t. Shame on you judge. Judge NOT qualified to be in the seat. Protect the people! That should’ve been dismissed! Move on! Looking at the “Justice” system as a whole, it’s a extortionist bordering on entirely criminal system. They just need to keep up the facade so they’re not outright about it. Just the infringements on the constitution alone deem the federal court system as unqualified to be an unbiased party. But you gotta go back 200 years to study where it began. Most people think this is all normal cuz that’s all they’ve known. One thing I noticed: they smelled alcohol, did a field sobriety test on the husband, found nothing to suggest he was drunk (he was 65 so a FST should not have been done, and he only triggered one clue on each part of the test), but arrested him anyway. Then they let his wife, without a FST, drive the car when she could have been the source of the alcohol smell.
Did you not listen to the begining...smell of alchohol, slurred speech, 2 failed sobriety test, and an admission to drinking to this very officer.

The lawyer said you shouldn’t perform a test on someone over the age of 65 but then changed to account should be taken for someone’s age as they may not be so capable of performing the test if over 65.
If it’s you should take account of their apparent physical ability or it applies when you’re over 65 testing someone who is 65 isn’t going against the training guidelines.
Also aren’t they just guidelines and you would be allowed to use your own judgement in possible borderline cases?

Yep. That's how 95% of cops operate. They decide you are drunk within first 10 seconds of the stop, if not BEFORE, and then just do whatever they can to FABRICATE evidence of that. They don't bother doing a real investigation because actual policework is hard, but making shit up based on your hunches is easy.

That is exactly what Field Sobriety Test (FST) means. In 99% of the field sobriety test, a cop will make an arrest, even if you just had only a glass of water before. It is subjective and cops decide whether the person passed or failed the test, and not the test itself. That is why the law permits citizens to legally opt out of FST. Never give consent to FST

I was wrongfully charged DUI Any Other Substance here in Alabama. I passed both breath tests, field sobriety tests, but failed a blood test for two legally prescribed medications and I had the bottles with me. In my state, DUI Any Substance only covers inhalants and does not cover legally prescribed medications. I kept begging for extensions trying to make the 1 year mark. I did, in fact, make it to 1 year by which a charge CANNOT be amended and had the charges completely dismissed. I held this secret saying nothing for a year and begging for extensions until the day came I stuck it to the prosecutor. Even the judge was totally amazed. The police are not our friends!
I just looked up local laws for TN thanks to your comment. Im facing a dui charge from october of last year, and my attorney has been postponing the court date every time it comes up. Im now scheduled for court the end of september. It seems like she's going for that 1 year mark as well which I didn't even know about, and honestly I've been ready to just face the courts and get my punishment started and over with. (I was also wrongfully charged. Asleep in my car, drunk but knew not to drive. Keys were out and in the floor so legally I was not in control of the vehicle at the time the officers woke me up)

I got charged for DUI for prescription medications also. Which I just had in my possession. I hadn’t taking any them that day but because they were in my possession they arrested me. Not one of them were missing out of the bottle. I fought it in court for almost a year. Blood work come back good but they purposely gave me the wrong court date the last time so I would get a failure to appear so that I would get a warrant and have to plead guilty to the charge. That goes to show you how crooked the justice system is. They don’t want to be proved wrong ever. It’s just crazy that if they did that to me imagine what they do to other people

I love how this DUI guy works his cases. He poses all the right questions and we are left thinking 'where is he going with this?'' but he knows exactly what he is doing. He pauses to have a drink, letting the jury have time to absorb the information they are being given and his calm and collected voice is simply flawless. He pulverized this cop's credibility.

Yes! At my company we have to sit through tons of redundant state and federally mandated training every year. Like, how many times do we need to be reminded that racism, insider trading and securing customer's information needs to be said. Surely the city or county this man works for needs to be reprimanded and forced to do the same.
I worked in a call center that did routine training courses every year and that is a bs job that doesn't effect people's lives the way the police can.

The real problem here is that judge, after hearing the prosecutions complete blundering of the case, the dismissal should have been common sense. The prosecution has no evidence whatsoever other than what that cop says and his personal opinion, that's not going to change next time this heads to trial.
Well if the case goes to trial the it is very rare that a judge will stop after the prosacuter make his opening statement. This lawyer is good I watch him all the time he is outstanding on DUI cases. This country has gone way over board with over zealous prosecution. The public for the most part doesn't even hear about these cases. The fact she didn’t dismiss is a shame. We go based off facts not assumptions. Assumptions can get you a charge, not a conviction. An assumption is all they have. Even the defense attorney for the police officer admitted they should dismiss.

Felt the same way. I was blown away when she said she would not dismiss. The officer nor the prosecutor could not produce factual evidence. Just assumptions. It was evident that the officer chose to ignore training. Qualified immunity is a joke. Imagine if doctors, fire departments, teachers or social worker had qualified immunity.

I got a Fake DUI in MD when I fell asleep in car after work,had heat exhaustion from index of 105 3 days in a row..I blew.000.. got arrested,when they shoulda called a ambulance,then police make jokes a hr or so later when I start feeling better in AC..Funny thing is in Maryland,you have to go to hospital for blood test..that's hard to do when they to ake your car and you have to get a ride at 130am after being there since 7pm.smdh,no food etc,have work next day..It's insane and should be illegal for anyone to have to give a blood test this way..If it's so important they should take your blood there,which they shouldn't be allowed anyway..It's a human right thing..Not sticking me with a needle after I've proven innocence,but you still get DUI for no blood test,so wrong..then U can't drive to work etc..messes &makes your life really hard..the police should have to take a breathalyzer &blood test everytime they conduct this to be fair..I've seen police drink and get in there cars & most likely have pulled people over that way..Fair is Fair

First off.. thank you for your services to the wrongly accused. It must be wonderful to cross examine a witness like this officer. It seems wrong for an officer to decide that NHTSA is wrong when it suits his narrative about intoxication levels and arrest. Peoples lives can be severely impacted by an arrest and worse when it's a wrongful arrest. By that I mean the officer heard slurred speech, performed the FS tests in a random order.. decided arbitrarily the amount of clues needed and also wrongly administered the tests to an ineligible citizen. Why does NHTSA even bother? Why do they offer refreshers? Christ, CPAs, mechanics etc ALL need to go to refresher courses but officers that can cage, arrest and kill citizens don't need refreshers is beyond me.
Cop knew he was gonna make a DUI arrest before he even initiated the stop. Cops make that decision without ANY evidence and then try to MANUFACTURE evidence on the scene. It's a fishing expedition. It almost always is, even when the person really is DUI. This one failed because the defendant was smart enough to get an attorney.

Also stalked when coming out of subway, I had received a phone call and the cop literally, pulled his Patrol car over and watched me from across the street. I had a bad case of agoraphobia after a string of cases I had to take 2 years probation for because I couldn't even *risk* fighting them. That's what they rely on. People being poor and weighing the gamble. Your own lawyers will tell you it isn't even a matter of guilt or innocence. If you get a public defender, their entire job is to get you to take a plea because they get less than 15 minutes per case, on average.
Not to mention our department has corruption, like most. Anecdotal, but one of my friends, at the time, was T-boned and charged by a cop who ran a stop sign without lights on and not answering a call.

I am retired military law enforcement and was a certified breathalyzer operator in the state of Indiana. Concurrent jurisdiction, we followed the state rules. This should be shown in training academies as how not to do DUI enforcement. Looks like all he did correctly was the proper uniform and the swearing-in. There are thick books on how to defend DUI cases and attorneys have read all of them. No matter how much prep he could have done for testifying, the case was crap and the defense attorney revealed it easily. The prosecutors office deserves some shade too…they decide what goes to trial. Getting drunk drivers off the road saves lives and I’m proud of having done that. But, you have to do it the right way. This wasn’t it.

I have a speech impediment & have hearing issues that also cause my balance to be poor. I do not drink or use drugs, but I would fail most of the tests they administer as a field sobriety test. I also have problems with brain fog & it goes hand in hand with ADHD. It is very difficult for me to think clearly. I can be talking about something, even a subject I know well, & suddenly I am an uh, ahm; just trying to maintain a train of thought...I am also autistic (I've Asperger's Syndrome) I am very awkward with social interactions (I come across as nervous, because interactions make me feel just that). It does not take much to make me nervous. I have PTSD; If I feel threatened things are likely to go south fast! I am also Bipolar (when I am manic my friends say it's like I am higher than a kite; hyper) If that's not bad enough; if they check my vitals they're likely to find them not normal because of both health ailments & I am on a lot of medications from a few Drs; none of them can you get high, but they affect my vitals. Without the meds I am a threat to others, & also likely would die without the Beta blockers. I seem to always come across wrong/off. Honestly do not know how I would react if I encountered law enforcement. I do not see them as an enemy; I feel respect for them putting their lives on the line & serving the community.

She declared a mistrial because the officer couldn't remember anything and kept running circles. That's a clear way for a dismissal, yet the judge refused simply to refuse. It's messed up.

My brother has an misaligned knee from a football injury. Balance is hard for him as well. Both of us could be perfectly sober and fail a field sobriety test. Why did this case go to trial? The cop testified the reason for the traffic stop was he saw the defendant urinating by a trashcan not because he was swerving or committed any traffic violations. Isnt that an illegal traffic stop? If so all evidence gathered during the investigation should be thrown out. Not to mention the defendant urinating was never discussed let alone brought up during the stop.
Seems like if you witnessed a suspect urinating in public, it would be the first thing he would talk about.
To be fair, public urination is a perfectly valid reason to detain, but the account doesn’t seem credible.
If someone was observed urinating in public (which is clearly illegal in all 50 states) and they immediately got into a vehicle and drove off the there is PC for the stop on that vehicle.

Dude, you know the guy was drunk. Otherwise he wouldnt have refused the breathalyzer. If the guy wouldnt have gotten pulled over and instead ran over one of your kids you'd be blaming the police for not pulling him over.

@@jimibones178 he did refuse the breathalyzer but that was after he was arrested. before he was detain for drunk driving the cops game him a test following procedure and he passed the test according to the standard so there would have been no reason for him to even need to be arrested or take a breathalyzer at all and the only reason he was offered to take one was because the cops concluded he was drunk with no evidence to support that claim other than his instinct and he need something for the charge to stick

It's Lion county NV. That's to be expected. I still remember when highway 50 got a daytime headlight stretch in silver springs and they had a cop car in front of the sign and pulling people over who didn't know to put their lights on. For about 2 weeks the judge started court with "Anyone who got a ticket for not having your headlights on, please leave." It was a total shit show. I guess that's what you get in a small peaceful town with quota's.

The thing about this video that blows me away the most is the fact that in 2022, a courtroom is unable to afford to upgrade its cameras.

It’s funny how cool calm and collected the majority of cops are in court talking to their bosses.
I don’t & will never understand why it is so hard for people that work in law enforcement to accept the fact that they are human & capable of making mistakes/getting things wrong like every other single human being on this earth.
Furthermore, a LEOs opinion shouldn’t be taken with anymore or any less weight than anyone else. If they want to charge someone or secure a conviction in court they should have to have the facts & evidence to do so. There are too many rouge, tyrannical & just down right bad cops in this country for their opinions to be taken as fact with nothing to back it up. You’d think the amount of money paid out in lawsuits today to innocent people who’ve been mistreated in someway by law enforcement or our justice system that would be common knowledge & procedure. It’s scary that it’s not.

The lawsuits do not matter if the money does not come out of their own pocket. The tax payers pay the price.
Think about it, we pay the cop to do a bad job, then we pay again when they have to pay out on law suits, such as court cost, attorney fees, etc.

I work in an aged care facility, 65 years old, retirement age and made to stand on one leg for 30 seconds, outrageous.
I know some 65 year olds that are in better shape than guys half their age.
I’m 60 now but I haven’t been able to stand on one foot or walk straight for years. I’d be screwed.
body cams should be MANDATORY for every police station. it’s dangerous to not have them and we have seen many reasons why….

The lawyer revealed that an officer arrested a man using a test he was trained in 16 years ago, that he didn't keep up on training, that's he can't remember the specifics, and used it on a person the training explicitly said not to use it on. Also, he believes his experience overrides the training.
