      Look at the Kyle Rittenhouse trial and you will see that the prosecution had ZERO evidence of the charges brought because the videos clearly showed that the shootings were the "training video" examples of a self defense shooting. But the DA was DESPARATE to try this case on POLITICAL motives rather than the law and the facts. Same thing here. If the DA doesn't try this case, he thinks he will be considered useless in his position and not get elected next time around. They KNOW they don't have a case but piss away the people's money anyway.

      @@dennismood7476 Rittenhouse was totally political and totally innocent. This guy probably was intoxicated. The Cops should have had body cams or cams in the car. When the guy asked to take a blood test and the cop refused, the case should have been thrown out. I know Rittenhouse was innocent, because I can see it. This guy, I have no idea.

      @@rickjason215 The denial of the blood test alone was enough to convince me. But you have the cop's testimony, he saw absolutely NO impartment in his driving, and if the cop did he would have pounced on it. I will give the cop credit he didn't lie even if he was trying to twist his wrong conclusions and dazzle with his Boss Hog authority. As Larry has said it is NOT illegal to drive after drinking as long as you are not above the blood alcohol limit and are not imparted. If you have No ideal you must acquit in accordance with the "beyond a reasonable doubt doctrine".

    No body cam & no dashcam should just be an immediate dismissal at this point in our society. LEOs have proven time and time again that their testimony is not only unreliable, but often a blatant lie.

      As a juror I would tend to agree. Lawyers should really sit down and park on that point for just a few minutes, because the word of police officer isn't as absolute as it once was, especially in the absence of video to collaborate their testimony.

      I was called up for jury duty for the 4th time. To get out of it I simply told the truth. In the comment section on form for excuse from jury duty I wrote that the SCOTUS has ruled that cops can lie, and that cops who lie on official reports are rarely punished. I view all cops as liars. Guess who didn't get called up.

      As far I'm concerned it was the Prosecutor AND Preliminary Judges that should be held accountable for taking this to trial with NO evidence. They pursued it only to publish the driver for not playing their game. Everyone but the driver and the jury was being paid to participate in this farce. (Even our good guy Larry)

      Actually if they lie in court, they should be held accountable for perjury. That would be jail time and fines. No doubt it would cause an officer to lose their job when convicted. Of course the DA won’t charge them since the DA and police are bedmates. In addition, every arrest the officer made should be brought into question. That will cost the DA office even more time and money if they want to fight every case.

    A cop arresting someone for DUI with no evidence is bad enough, but the fact this was prosecuted with no evidence is even worse. Literally the only evidence was that the cop smelled alcohol from the car? Really? I like how he testified he smelled it from the guys breath, but never wrote it down, AND when asked, said "it's been several months since this incident occurred, I can't recall it off the top of my head." So he could recall specifically that he smelled alcohol from his breath on direct, but couldn't recall any other relevant or important detail not noted in his citation because it was several months ago? How convenient!

      Current DUI defendant here. I'm being charged in retaliation to staying silent on other matters. Was never accused of DUI during the initial arrest nor offered a blood/breath test at the time although the police report claims I denied 2 of them. I'm being charged based on nothing more than the cops statements alone. My trial starts next month in PA. I'm probably going to lose. The system is fucked

      Maybe he has a problem with smell? Or a problem with thinking he can say anything & be believed. Is rubbing alcohol considered against the law? What about mouthwash? How far do you follow someone driving drunk? Then, tell them to drive further & pull into a parking lot? Seems very logical, right?🙄

      He definitely seems like he’s not worried about getting in trouble, he’s pretty confident with his ability to lie and get away with it or at least the knowledge that it comes with no consequences. You can’t give someone that much power over people without keeping them in check. This is disgusting to watch and I only wish there were more attorneys like Larry to call out the utter BS happening in clear sight of everyone.

    The cops says that performing a field sobriety test isn't an admission of guilt but exercising his Right to not take those tests got him arrested? If taking those tests doesn't make you guilty, not taking those tests does ?

      Agreed! Too much corruption & feelings of power. Seems body cams would be beneficial. Although, videos are “edited” quite often. Citizens are going to have to have own videos. Most police depts aren’t equipped with body cams or dash cams. But, seems new vehicles are a must!

    Let me get this straight. He was charged with DUI because the officer "smelt alcohol" near him and he said "I had a beer", and even though you refused a requested a blood test which would have been the most accurate measurement possible to perform? No signs of impairment at all and he requested a blood test, you charged him with a DUI?

      Yes. The Ride is what's important, the police don't care about the law. They barely study law at the "academy" and in fact, train more on firing their weapons than the law. Getting citizens in cages is what it is about.

    4:54 He smelled alcohol and suspected the driver could be under the influence but he asked the driver to stay behind the wheel and drive to another spot. How stupid is this cop? I am just at this part now, so I don't know what happens.

    When I say the rich can get away with murder I say this because it is hard to find an attorney worth hiring and when one is found the cost normally is very difficult for the average person to afford. I would argue the matter is too important not to get the best but honestly, if I was pulled tonight I would not have the money to be represented properly.
    Larry, you are a credit to the profession and I love watching you turn the screws on not just the police officer but in many cases the prosecutor as well.

    cops know they can lie in contacts on the street, and they do. The worse problem is the suspicion that cops also lie in court under oath even, as this cop seems to have done. Is that not purjury, and is it not a criminal offense, and should this cop not face those charges ?

      @@nini_noone3351you’re equating small town people with small town police forces. That’s completely illogical. Small town people are often on the receiving end of tyrannical small town policing. I’ve lived in various areas, from a population of 700 to a population of 1.5 million. Small towns are much more friendly and do look out for their own more than big cities, in my anecdotal experience. That has nothing to do with the type of ppl who are attracted into LEO.

      NEVER take the tests no matter what. The tests are specifically designed to make you fail. I have year round hayfever/allergies and 3 banged up discs in my back. I would have NO chance with them based on their criteria. I'm 11 years sober. And they'd have me in a cell.
      NEVER talk to the police unless it is the absolute bare minimum that offers NOTHING. And if you have nothing to say, PLEASE KEEP YOUR MOUTH SHUT. The COPS tell us this.

    As someone who hasn't had a drop of alcohol in 32 years and hasn't driven since 1997, rhetorically speaking, why do I get so excited when you win these cases?? Whatever the reason may be, you're a real professional and I love these videos!! Saw the livestream the other day, during which you and the former cop were commenting on various videos. It was really entertaining, except for the poor girl who was killed at the beginning. That was horrendous!!

    The guy refuses to take a road side test or a breathalyzer because it's "he doesn't have to" but is willing to take a blood test which is more accurate and intrusive. The cop doesn't want to give him a blood test because "he doesn't have to" give him the blood test.

      the road side test is pointless. if the cop wants to arrest you for DUI, it doesn't matter how good you do on the test, or even if you do it perfectly, he will arrest you for it (it's often done so the cop will have an excuse to arrest you).
      he should have agreed for the breath test, if he was in fact clean (and I'm guessing he was, because he wanted a blood test).
      good for him that he got out of the dui, kinda strange that the cops didn't come in with any evidence for alcohol.

    they stop you and the more charges they can pile on the better for their career...he had a valid DL and the cop proved it...he wasn't driving on a suspended DL, he just forgot it at home...which almost everyone has done at some point in their lives...shouldn't get a ticket or arrested for that...especially these days when they can prove it in a minute on scene

      I also thought you were allowed to produce a valid DL within a certain amount of time in case you forgot it. All they really need is your name and DOB and they can prove in their system that your DL is valid.

    These days, prosecutors have a very difficult time getting a jury to convict if the case relies primarily on law enforcement testimony. Even if one were to stipulate that cops are sincere and of good moral character, they demonstrate that they are sloppy in their work and only have a superficial understanding of how the law applies.

      The last time I was called for jury duty I was told that the only evidence was police testimony and asked if I could convict on that (or something to that effect). “No”. I was excused.

    You don't need to and shouldn't answer any questions from an officer on a traffic stop. They are fishing for reasons to arrest you. Why would you help them, especially when you aren't required?

      In my experience with LEO'S if they want to arrest you, they are gonna do that regardless if you answer their questions or not. REMAIN SILENT AND RESPECTFUL AND FIGHT IT IN COURT. NEVER INCRIMINATE YOURSELF IF BEING QUESTIONED. THEY ARE NOT YOUR FRIEND EVEN IF YOUR 100% INNOCENT

      The best is the closing arguments with groves come off and gentleman manners are abandoned as Larry calls a lying cop, a lying cop, and a corrupt prosecutor, prosecuting a nothing case. Then the prosecutor has to try to convince the jury of he and the lying cops are righteous and honorable men despite what the jury saw them to be.

    My sworn testimony today is that I can't say that he was driving carefully because I don't know what was going on in his head. For all I know he was doing everything in his power to drive recklessly, but he might have been so drunk that it was imparing his driving to the point that everything he did was completely safe. *blink blink*

    Usually I only a play a lawyer on Twitter, however after learning the Forman method, I feel prepared to defend DUIs in Kentucky as long as defendants never consent to any tests. My prediction is that Larry Forman will be responsible for Kentucky finally getting around to requiring body cameras so these prosecutors don't have to keep going through this same humiliation time and again, lol.

    It's really hard to believe with the huge advancements over the past 20 years in video and audio technology that a government building would have video and audio equipment this bad in 2022. If this were the 90's or early 2000's I would expect it, but there's really no excuse in 2022.

      Really my states systems are extremely old our Dept of Labor, DMV, ect are old, we just learned how old after breaches, The 51-year-old mainframe uses F-COBOL, a code that was around before Combined Business-Oriented Language, or COBOL, the language created in 1959 by Grace Murray Hopper, was standardized. Yes you heard that right 51 year old system finally taken out of service as a Dept of Labor mainframe. Because they had a breach of 180,000 people losing bank acct information and social security numbers, our states population is under 650,000 so it definitely covers a large percentage of the population. You'd be surprised how many state controlled branches including the court are just as old and outdated.

    I think it's ridiculous that they give a time limit on trying to contact a lawyer. Most lawyers are not going to answer the first time you call if after hours. And of course they don't allow you to receive a call back to speak to your lawyer or if your lawyer were to come down to the jail would they allow him to speak to you. Your rights don't end after 10 min of having representation. This kind of statute should be fought at the highest level of court.

    So wait, he smelled alcohol on his breath, thought he was impaired, so he... told him to keep driving? Down a street, through a traffic light, into an intersection, around a corner, and into a parking lot? 🤔
    As far as taking 30 seconds to open the glove box, Tesla frequently updates the car and changes the location of where certain functions are on the UI. On top of that, it can be configured with a PIN.
    One thing I'm wondering, as a lawyer, following a jury trial, are you given the opportunity to ask the jury what exactly they found compelling abou lt your arguments or what facts of the case were essentially slam dunks? That would be interesting to learn after each verdict.

      This Po-lice was jealous that this man was driving a Telsa .I had a childhood friend, we grew up together, attended school together , then he became a Po-lice and that was the end of a 25 year friendship, the things he told me they ,the Po-lice did to people wow and he was part of it .he said that they stopped this man with this 2 hundred thousand dollars sports Benz for speeding and the guy said it's only 5 miles over the limit could you give me a break , he said you could smell the leather in this rich man car and I would give him a break I found two other things to ticketed him for. I cut ties with him and never spoke to him in 30 years. Scumbags.

    what I would say. Q: you refused to road side DUI test, answer yes. Q: why is that? answer : I belive those test are made for you to fail.
    Q: how so?, answer I`ve seen alot videos of cops deny those test in same situasions, if the cops who do those test say so. I belive they have more experiense to say so.

    And this is why you refuse every test offered by police, even when they threaten that by refusing you MAY lose your licence. All the tests are designed to elicit more evidence against you which is why almost every copper, to a man, refuses to participate in any tests. They are not designed to prove your innocence but are to help them build a case against you.

      The problem with refusing a blood test is that, not only can you lose your license, but then the cop can get a warrant for a blood draw in a few minutes from a judge. All they have to tell the judge is that they have "probable cause" to believe that you are impaired.
      You should definitely refuse all road side tests and not answer any questions!

    Seems that our judicial system today - police officers, city and state attorneys, even judges - are actively and enthusiastically “on the hunt” for supposedly PRESUMED INNOCENT citizens!
    Seems to me a better and more faithfully adherent to - if not the letter of the Constitution, then at the least, “spirit” of it - would be for those government agencies and agents to observe the average, hard-working American citizens struggling to make a living with calm and overall “trustful” eyes. It should be well understood that our Founders had VERY LITTLE trust in governments and their agents, which is why they put in place the supreme law of our land, the Constitution and The Bill of Rights!
    They knew full well of the ravenous nature of governments and its insatiable hunger it has for its citizens, having recently experienced such tyranny, going so far as to spend the blood of thousands of those same citizens fighting its ambitiously “policing-hungry” evils.
    America was birthed for the very purpose of eradicating such hostile degradations and centralized depravity toward regular everyday people, bringing about in their place God-given Liberty and Justice!
    In view of such realities and our hard-won history with wildly over-reaching federal, state, and local agents such as police, judges, and prosecutors, I believe the afore mentioned should practice restraint with regard to a voracious and overbearing “drive” to, in want of a better term, “preying upon” the American citizen.

    the citation does not need to be an accurate adaptation of what happened it is an approximation if the prosecution is happy taking a man's livelihood and possibly his home on an approximation, that is totally unacceptable (approximately).
