To all the Luigis wondering, ROM Hacks aren't illegal at all (at least in the US). You're required to legally own the original game to use the ROM it's a hack up. That said, ROM hacks are protected by fair use and some other copyright laws, as long as they're not being charged for. Nintendo used to put in their manuals (nobody else read) saying "Backup copies of your games are not required to secure your game and are not authorized by Nintendo. As people didn't know law, they thought that not having permission made it illegal, but they're legal if you don't distribute them. In other words, if you download an IPS patch to put on your legal copy of Mario 1, it's legal. If you download a copy of the ROM Hack with the Mario 1 ROM, you're mostly covered but it's mostly illegal for the site to distribute the ROM. The site can host the patch legally, as it's private work, as long as it's free. If they had this for a way to patch Castlevania 2 to the "Redacted" version, more copies of the game would sell. Fair Use protects the consumer, but companies want to take that way by keeping us misinformed. People should know laws that relate to them, such as labor and copyright.
