"Church Member Questions & Attacks Photographer In Public" First Amendment Audit

  • I was in Brea Ca. capturing video & images from the public sidewalk outside this local church before Sunday service got underway. I had a couple of interactions at this location. One church member in particular who approached me on the sidewalk, hitting my camera phone out of my hand then proceeded to step on it, because he didn't like that I was recording his image. I tried to de escalate the situation , advising him to go about his day & walk away if he didn't want to be recorded. This time I had to initiate the call to police. In the process of checking my camera phone for damages just before police made contact with me, I inadvertently forgot to hit the record button on my camcorder, missing only the initial interaction with police. During that interaction with police, I offered an olive branch to the guy why attacked me. I let the police know that I would accept a public apology on camera in lieu of pressing any charges.

      completely agree, especially when forced and insincere, and it is not ruining someone's day ,but probably protecting some other innocent civilian from a future assault by education . it does little good to not hold them responsible for their actions.

      Why are people acting out si cringe about a camera ... ? I mean I am filmed when buy one bottle of milk, I do not care, nobody cares. Here We can film in public but we can not use thise images for commercial purpose, but we can for personnal use.
      Images taken for security means can only be released to police and law purpises.
      So a bit different in how you treat the image after taking them.

    As Furry taught us, now that you've got him on camera apologizing and admitting to assaulting you, you can successfully sue him in civil court for damages. I understand why you did what you did, but I still think these people should be charged. A little time spent in cuffs and jail, along with all their legal costs and fines, is the only thing that stands a chance of impacting them.

      In my jurisdiction it falls under officer discretion. Personally when I walk up on a situation like this I look at the people's waistlines looking for bulges that could be weapons, knife clips, stuff like that. After that it plays by the people involved depending on the call. Calls like this, I wouldn't care about it.

      It's not well done at all he screwed up majorly in two ways
      Screw up number two was not pressing charges, now the bully thinks he won because he thinks the cops forced you into letting him off.
      The bully will do this again to somebody, guaranteed.
      The cameraman is an enabler of bullies
      But the biggest screw up of ALL (number one) is not pepper spraying the bully when the bully attacked
      Exercising your rights is a dangerous activity and people have lost their lives doing this sort of thing so if the person behind the camera isn't prepared to defend their life against an attacker they will lose their life and possibly the life of others around them like that lady

    As someone who grew up in the United Methodist Church, I am horrified to see this absolutely vile behavior by this supposed Christian. He was looking for a fight from the moment he decided to pull into that particular parking space. He needed a long stream of pepper spray right in the eyes. By the way his wife reacted, I would guess she has seen this unhinged reaction from him before and/or been on the receiving end of his irrational and abusive behavior.

    You have documented some shameful behavior here by religious folk. If I were looking for a place of worship, seeing this video would make my list of possibilities one church shorter. I don't want to join a congregation that includes someone so uncontrollably violent. His apology was, of course, insincere, but it's worth something that he had to deliver it on camera.

      Churches are full of imperfect people. The entire church wasn’t rude or out of control, plenty of attendees chose to wish you a good day and let your freedom flag fly. Judging an entire church by a couple people is silly. Nobody should be judged by the behavior of a member of their “group”.

    Here’s an additional thought, I was recently at a roller rink and everyone was filming their kids skating, laughing, and all around good family fun. Not one person walked up to another person and said “stop filming me, you don’t have my permission to film me”. What’s wrong with people now a days. My thinking is usually who cares, they aren’t bothering me, let that dad film his kids, and put it in his family videos.
    Additionally if I saw some dude filming in the BMV, or at the court house, I would figure they’re tourists, or admiring the architecture, or maybe even a school project. All I know they aren’t bothering me, and it ain’t my business.

    I see many comments saying that he should press charges. Don't get me wrong. Charges are often warranted and it is our right to do so if we deem necessary. But these 1st amendment auditors are doing a great service to our society. Not just to those who support them-which I do- but, more importantly, to those who do not fully understand Constitutional rights and what they mean. Whether the apology is sincere or not is entirely up to "First Amendment Rights". But I laud him sending that guy on his way after the apology. That guy may have left cursing or he may have left enlightened. But, in my opinion, he left with a lesson on 'tolerance'. The beauty of the United States, and what sets us apart in the world is our ability to be tolerant; of not only those we favor, but especially for those we do not. I see these auditors as helping to further this founding principle. Tolerance is our best weapon against hate.

    You need to tell the cops you want to press charges and the guy is inside the church and let him get arrested so the whole congregation gets and education and learns that recording in public is LEGAL and if you dont want to be recorded park somewhere else or ignore them and go about your day. the lesson you learned was to NOT GET your phone SLAPPED OUT OF YOUR HAND. het a case for it when there is a loop on the back so it cant get knocked or dropped out of your hand.

    nah this is no good. you cannot allow someone that broke a phone to get away with no repurcussions. it was crystal clear that he thinks he did no wrong and STILL thinks that YOU are in the wrong and that YOU learned a lesson that day. i enjoy your style of auditing but this one was infuriating to watch. the next person that films him will suffer a similar fate. you could have taken steps to prevent that. extremely disappointing. 😕😕😕

You're standing on a public sidewalk... This is so frustrating to watch an aggressive moron walk away scot-free... I do know this much... If this had been an audit by certain auditors i normally watch... That idiot would've been on the ground screaming in agony after getting the "Hot Sauce" treatment... This guy now thinks that he can do exactly the same thing to someone else in the future... And he'll probably think that he can just offer a smug insincere apology and everything will be okay... What a joke. 😡

      Agree. His apology was merely a way to not go to jail. It was not sincere. That was extremely obvious. A spoiled brat not wanting g to get in trouble. Maybe a trip to jail is just what this guy needs. If he reacts to a camera in public in such an aggressive way, how do you think he responds to his wife and kids in private?

Don't get me wrong , there would have been charges guaranteed if I was injured or my equipment was broken . I used my best judgment for the situation. 👍📷📱🇺🇸

    First, I applaud the auditor for his work. This is by no means easy and he is risking grave bodily harm or death from individuals and police. So the following is just thoughts from someone not under the stress of the moment.
    I wish the auditor had said and done a few things to firmly establish that the guy is committing a variety of offenses like "harassment, assault, battery, theft and vandalism." It is a crime, harassment, to _repeatedly attempt to make contact_ with another individual once they have made it clear that the contact is _unwanted._ There is specifically a defense provided to cops that PERMITS them to _harass_ you. But there is no such defense for a private citizen. When the man first approached, I wish the auditor would have said something like, *"Stop! I do NOT wish to have any conversation with you OR any contact with you WHATSOEVER! Stay away from me!"* And I wish he had repeated it at least once. In that way, when the guy refuses to stop or says, "I don't care what you want." then he has unequivocally committed the offense of _harassment._
    An assault is merely a threat. The threat does not have to be _explicit._ If I throw a rock at you and it lands harmlessly on the street then that is still an assault. If you tell a cop that if he was not wearing that badge things would be different then that is an assault as you are _implicitly_ implying that you would otherwise do him some harm. All one needs to do to commit an assault is to do ANYTHING which could put another individual in "reasonable apprehension of harm." After telling the guy he objects to being harassed I wish the auditor would have said something like, *"Stop! The aggressive manner in which you are approaching me is making me fearful for my safety!"* And I wish he would have repeated this at least once. This is because a _reasonable person_ would stop and say something like, "I'm not threatening you. I just want to talk to you." If the guy acts reasonably and stops he is still committing the crime of harassment since he has already been informed that _no conversation or contact is desired WHATSOEVER!_
    But of course this guy isn't reasonable and he does want to threaten so he is committing an "assault." But lets assume for the moment he says, "I'm just using the sidewalk." as he menacingly approaches the auditor. Then the auditor should say, "I do not feel safe with you _approaching me_ so let me stop and get out of your way." Then the auditor should take 2 steps INTO the street and move in the opposite direction down the sidewalk. When the guy turns to approach the auditor again he has clearly demonstrated his desire to threaten and by stepping into the street the auditor is clearly demonstrating his _reasonable fear_ since he is willing to risk being hit by traffic to avoid the guy getting to within arm's reach of him. This is also something I wish people would do when cops start pushing them down the sidewalk. Stepping into the street is NOT a crime. But it does establish _reasonable_ FEAR and if the officer steps out into the street too then that makes the "threat" explicit as the cop is now literally chasing you into the street.
    Battery is simply "willful and unlawful use of force." It does not require physical harm to be inflicted it only requires PHYSICAL CONTACT. When the guy grabbed the auditors hand to rip the phone away he has made _physical contact_ and used _willful and unlawful_ force to take the phone. That is BATTERY. I wish the auditor would have said, "Ow! Let go of me, NOW!" Those six words establish that contact was made and that pain resulted. Anyone who has every tried to win a handshaking contest knows that it hurts when another squeezes your fingers in theirs. And any juror who has ever had that inflicted on them as a child will instantly HATE that guy and most likely vote to convict him. :)
    Taking the phone is "theft" since theft only requires one take the property of another in order to deny them the lawful use of it. The guy literally took the phone to prevent the auditor from using it to record which is a _lawfully use_ of it. And what should the auditor have said? Exactly what he did or even better, "Give me back my PHONE!" And finally the damage or destruction of an other's property is vandalism. And it would be almost impossible to claim that throwing ones phone to the ground was not an effort to _damage_ it. Likewise, one can reasonably assume the phone suffered some damage EVEN if it is invisible. Soldered joints and inserted chips may have been broken or come loose and the effect not immediate. They may only be detected using magnification. And the drop was likely recorded by the g-sensor and accelerometer and could result in the phone being out of warranty when it does fail. It is reasonable to assume damage occurred resulting from being thrown and that makes it "vandalism."
    I'll repeat this is in no way a criticism. This is all HINDSIGHT commentary from a non-lawyer. I just wanted to demonstrate what crimes were committed and what elements were present. And while one is not required to say anything to be the victim of these crimes certain statements can help to remove any ambiguity. It's a little hard for a defense attorney to claim there was no _reasonable fear_ when the victim has clearly said, "Stop approaching me. You are making me feel unsafe!" And it is a little hard for a cop to say, "There is no evidence he touched you," when you literally have said, "Ow! Let go of me!"
    Anyway, great audit as usual. These church ones reminds me of a time when our pastor resigned. Before he did, he invited a homeless man to panhandle in front of our church before services. The pastor watched as his "flock" repeatedly ignored the man and ultimately called the cops on him. His sermon was as scorcher! As it should have been.

    This is a perfect example of why I avoid organized religion at all costs. Well, that and the fact I'm a proud atheist. You are a much better man than I, as I would have insisted they charge that tyrant. The apology was given with a smirk that meant "I'm only doing this to get out of a criminal charge." Better hope you don't run into him when there are no cameras. Imagine what he would be capable of then? It would have been much better to have him go in that church and stand in front of the congregation and explain how he had assaulted someone outside and he wished to apologize. Lol He probably would have taken the criminal charges before he did that. 😂
