When the original anti-monetization rulings were added to the EULA and the threat of a global ban was present. The server network owner collaborated with other network owners. If someone has the time, Im sure theres some law that could be pinned on Microsoft for allowing these servers to have a gambling mechanic and therefore, could have a class action lawsuit lobbed at them. Not only would it most likely pay out to all owners of a Minecraft account, but it would force them to do something about the servers after they loose some 10's of millions of dollars in a lawsuit.

    • @sold8215
      @sold8215 Год назад +1

      if that was a thing it would have already been done, lawyers are like sharks when it comes to big companies, and this would have been found. The one exception to gambling laws is that if there is a free way to obtain the "key" to a gambling crate/lootbox/method, it doesn't even count as gambling. Also, the loophole here is that microsoft is not at all responsible for what servers do, and while they have their own guidelines (eula) they are not at all obligated to enforce them.

    • @GregHolland368
      @GregHolland368 Год назад

      @@sold8215 Not really, theres more lawsuits to be had than time to do them. It would take someone to bring about the lawsuit. There are many lawsuits filed that address 10 or even 15 year old problems of oversights, just no one has brought about one here. Although Microsoft doesn't own the servers, they provide the capability for other to do so, but through Microsofts service. Not "technically owning" the servers has not won companies lawsuits in the past, they still have legal responsibilities to abide by. Furthermore, their choice to ban the severs, but then unban them while the servers have not fixed the issue shows negligence and/or intent on Microsofts part. As for gambling laws, some servers may not technically classify as "gambling" but others certainly do and one major issue many of the servers have that do violate laws in regards to the lootbox systems is they either do not have posted odds, or the odds posted are intentionally incorrect. It wouldn't be a clean easy win, but there is a case and it has legs.

      @@GregHolland368 The problem here is that it can easily backfire, sure lootboxes with invalid odds are sketchy and could be striked down in court but ranks that are not chance based are actually entirely legal, it's just a microtransaction.
      EULA is not law and rules in it can in fact be completely unenforceable in court, in the example of Minecraft, the servers are not hosted by Microsoft and blocking them for EULA violations while they break no law in the country they operate in can be seen as anti-competetive behavior and actually land Microsoft in legal trouble.
      It sucks but this is kind of like if MS decided that you cannot install software on windows that is entirely legal but violates their arbitrary EULA rules, it likely wouldn't stand in court and might even lead to those rules being removed from EULA.

      mojang doesn't do anything to help host the server.
      there isn't even a server list to choose servers from you gotta direct ip connect.
      they have NOTHING to say about what happens on a private server. only blanket banning ALL private servers, wich are. all servers and only single player would be left

    It’s so dumb because people are just mad they aren’t good and can’t make money like the smart people behind pay to win servers, I play a ton of p2w I enjoy it, you shouldn’t care what I do with my money, if you don’t like it there are plenty of other servers that have the same gamemode just not p2w.

      I agree with this. I don't like the idea of Mojang policing servers that they don't actually run themselves.
      I get the thought process behind it, and I don't like P2W servers (or anything P2W in general,) but I'd prefer if it was just left up to individuals to decide what they want to play on.

    What i'll never understand, is why it matters? If you dont want to play on a pay to win server, dont play it? Why do people go out of their way to block people just having a bit of fun. Nobody is forcing you to buy anything from these servers or even play on them...

    Clarification for viper:
    So I played viper in 2021 and I'ma clear some things up. So the owners actually made a non p2w realm called "Community Realm" which didn't have ranks or keys, but that realm died in a week. The thing about HCF is that it isn't kids playing it, it's actually mostly high schoolers who work part time or are spoiled. And people liked the p2w world of viper.

    I played on Desteria for a long time, it was blocked by Mojang for being pay to win.
    There was a bypass for the blocklist on 1.8.9 literally hours later. Since it was a factions server, it never updated past 1.8.9, and therefore never saw any repercussions. It was pay to win until it shut down.
    For a little bit they tried skirting around the eula by making you "call in" your pay to win items, so "everyone has a chance to get it." Basically, you type a command and can click to summon your rank or items. This had to be done in the warzone around spawn, and would announce a message in chat. After 10 seconds, it'd spawn a chest that paid out your stuff. The warzone was about a 300 block radius, so all you had to do was get on during a non peak hour, summon your stuff at the edge of the warzone, and pick it up before anyone else had even left the spawn to come after you for it.
    It was fun to spam the chat with it, my faction won a $30 coupon in a giveaway, then the black friday sale happened, knocking a large amount off the store prices. We bought 100 common crates and spawned them all at once, it was great.

    The thing is the people who make these servers generally aren't bad. They have staff to pay, bills to pay , maybe kids to feed, etc.
    Second: they were reinstated because Mojang was losing money. People only buy alt accounts for multiplayer servers. No servers, no alts, less revenue.

    • @ricethetacu

      and their own version of multiplayer flopped. Mojang tried to do away with servers entirely in the past and failed. so they are trying to control the servers and the income from them (if we can't make money off this you can't) is how i look at this.

    Hot take: If you don't like that Mojang is banning players for typing out swear words because "they are trying to dictate what I can do!", then you also can't be against Mojang banning servers that are breaking the EULA.
    If you think about it, both are arguing about the same thing: Mojang isn't hosting my server, so why should they dictate what can I do with it?

    It's sad how most minecraft servers nowadays are generic opfaction/survival/skyblock servers that have no real quality and just milk the money out of their playerbase. The servers with so much better gameplay are left to wither with noone recognizing them even though they can give you one of the best minecraft multiplayer experiences.
