- The plaintiffs purchased a boat from the defendant, but as soon as they put it in the water, it sank. The plaintiffs are suing for a refund. The defendant says the plaintiffs purchased the boat without putting it in the water first or testing it out. The boat was in great condition before he sold it, according to the defendant.

The mechanic stated they hit rocks. Not it hit rocks before it was sold but from this ride. The boys damaged the boat it is clear.

So, they purchased an As-Is boat, and literally didn't even bother do to a pre-inspection before putting it in the water, much less all the maintenance that is required on a boat that has been winterized.

Definitely get the impression that the defendant sold them a boat with issues and is using the 'ran great when parked' excuse. Having said that, the plaintiff/plaintiff's went out of their way to buy that thing as wrong as they could. No inspection, no test drive, no getting in writing it's seaworthy-ness, etc... Seriously, that boat was what, 25 years old and in their infinite wisdom they just plopped it into the water and were ready to go? It doesn't work that way.
Right. It’s still a good price to invest another $1000 to make sure it’s safe on the water. 😂 But at the very least test the thing on the water!

The mechanic report stated physical damage, and the rubber bellow looks torn and worn out. I think they hit something underwater that caused the damage.
To hit something and have it damage parts inside the hull the rock would have to tear through the hull

it was the exhaust bellows and the mechanic stated that damage was caused by striking a rock. the mechanic did fail to state that the whole shop laughed at the idiot who bought an old boat and didn't get it checked out until after he had it in the water. every boat owner I know gets it inspected and repaired each season before they take it out but don't bother after the last use, because there's no reason to do maintenance before it sits unused for 2/3-3/4 of the year since you'll be doing it regardless at the start of the following season
$1900 is dang cheap for that boat seems to have a nice trailer that's worth a few pennies right there

As a boat owner, I would definitely disagree with you. With that size a hole in the Bellows when the boat was sitting in the water, the water would've came right through the Bellows into the engine compartment, and then ultimately flooding the boat.

she read out the mechanic report and it stated there was damage from hitting rocks, plus they never brought it to a mechanic until after they put it in the water a full week after buying an as-is product from a private seller.

Regardless of the outcome, I’m not entirely convinced the defendant is telling the truth when he says he had no idea the boat was unsound. But, as they say, “it is what it is”. At the end of the day, they didn’t test it in the water or have it inspected, and they couldn’t prove the defendant was fraudulent about anything.

And the mechanics report says, "hit rocks"...so its possible that the Larry, Curly and Moe, did what all young males do after a few beers..they try to do some boat tricks and hit a pile of sharp rocks. Or it could have happened with they try to put it in the water.

Test driving a boat is hard, especially if body of water is more than an hour away
If test driving is too inconvenient for you then don't complain when it doesn't work after you buy it

@@ZovaBe I'm not complaining, I'm just saying it's hard. I've had two boats, didn't test drive either of them because our closest lake is 2 hours away. But I was lucky and there was no problems with either.
@trander2293 I agree, I've sold boats, once out of state to a guy on the other side of the country. But I was honest and trustworthy. Even called the guy to discuss how to winterize and do other maintenance. It's a shame people lie like I'm sure the seller did in this case!
@@davidpurvee9225 yeah ... Both we ran wirh the bunny ears and we inspected the engine and the hull and pertinent systems and they both work out great. Still have the second one . For 20 yrs. she still runs good.

A bellows for exhaust can blow out because of an engine backfire that is the most likely thing here, usually caused by someone not using proper starting procedure the plaintiff has no case, backfires will happen on startup if the fuel is not primed right
Dad doesn't like to let the kid speak for himself. Shame, too, because (based on the petulant face the kid was making after the verdict) I bet Doug could have gotten an all-time best reaction of of the kid in the exit interview.

@@calvinthedestroyer. The mechanic failed to see a lot of things in the report. It was very ambiguous. Starting number one looking at those Bellows from the photo they look like they were pretty dry rotted. They don’t don’t look like they were put on a year prior. Number one and the mechanic never said anything about that. So why would he say, anything we can see that the hole was in the Bellows. I don’t think we need a mechanic to say if there’s a flat tire when it’s completely obvious. Durrr

I was thinking that too. They forgot to plug the bung. Lol. When my dad bought his first boat i drove the trailer away and noticed him waiving frantically in the mirror. I stopped then heard him yelling come back. We reloaded the boat, drained water and mever forgot that plug again. Lesson learned.

My daughter would have told me to stay at the side if she would have been in such a situation, instead of taking ‘pole position’,like the Dad did here.
She would gladly accept any help upfront and have me nearby, but she is independent and confident enough to do a hearing like this by herself!
Her strength is one of the many, many things that make me so PROUD of her!!

Why do people buy cars and boats “as is“ and still think there’s some type of warranty or the right to return it? “He said it runs good” is not proof of anything. Sellers can say whatever they want.- doesn’t make it true.
Not all as is purchases are final purchases…. The judge said if his mechanic could prove the defendant is lying he would have won. False advertisement still exists. 👍

I understand that as is laws are different than buying regular things. But it seems really messed up that something that could cause injury and death, doesn't have the same return policy as a regular thing at a store. If you buy defective item at a store, they have to give you your money back and accept that and back. If you buy a defective item that's used, and it's as is, you don't get your money back at all. Doesn't make any sense their lives were in danger too.

Buying used is all we do. But we ALWAYS have a mechanic check it out and prefer to buy from someone we know so we know the history of the vehicle including how well they have maintained it. Also you can buy from a reputable place that provides a temporary warranty on a used vehicle

When you see something "as-is" you know there is something wrong with it. So you make it your mission, to figure out what that is and if the repair still makes the deal good enough. (and buy a warranty when you purchase a used car or something - I always buy a warranty, a bit pricy, but ultimately will save you a lot of grief.)
If he spent the $1000 for the repairs he would have had a good solid boat for $2900.00 which is very cheap.

Every time they got a bigger one. They can suck the
finances out of you. Our last one was a 36 foot Christ Caft.
I personally think the defendant is shifty, and knew there were problems which is why he was trying to unload it. However, the buyer was too stupid to test, and too eager to purchase so legally, the defendant prevailed. But while unprovable, I strongly suspect he knew all about that that bellows damage. Hopefully, next time, the kid knows never to trust a seller, even the honest ones, and thoroughly check out the item.

Look, i understand everyone blaming the kid for not testing it, but that dude completely lied and ripped the kid off! Bellows are not a maintenance issue, they don't need to be replaced annually. The other dude very specifically said in his ad that he would start it with muffs but clearly didn't want to put it in water because he knew it would take on water. His ad went on and on about how good the boat was then added as is at the very end. He is a liar and cheat.
That being said, the judge ruled correctly given the evidence presented.

the plaintiff does not know about boats, if have been out of water for a long time always put it in the water slowly while it is still on the trailer, leaks are common after a winter storage probably just needed a 20 dollar seal no need to sink the boat, just stupid, always get in the boat and look for leaks while a friend backs it in slowly that way you can pull it back out if water comes in
The boat seller is full of it!!! He knew the boat was messed up..that's why he only had it for 1 summer..noticed it damaged.put it up for the winter.and then come summer.he found a sucker to buy it!!!
