  • The plaintiff put down a deposit for an RV the defendant was selling. He claims the title to the vehicle was forged, so he backed out of the deal. He wants his deposit back, so he’s suing. The defendant says he was selling his daughter’s RV and he never forged anything

      because he thought he had a sucker that would pay 18k for a RV only worth 10k at the most . nobody that knows anything about RVs is gonna pay more than 10 k for a 20 year old used RV .

    I truly believe the plaintiff had serious second thoughts about his ability to handle that RV. You see so many retiress with RVs for sale. It was their dream for their retirement to travel the country, until they have to maneuver it. They have difficulty maneuvering a small sedan, let alone something the size of a schoolbus.

      There really needs to be a special endorsement on the drivers license to be able to drive an RV. Some of these owners have huge RVs with a boat, a vehicle, and anything else that they can attach to it going down the road. A semi is shorter than some of these things, and depending on what is in them and attached to them, they weigh close to the same or more than a loaded semi and trailer. We don't allow Professional Truck Drivers to drive without a CDL, and bus drivers also need special endorsements to drive a school bus. RV owners should be no different, especially since most owners have never driven anything larger than a 4 wheel car or truck. RVs can be and are just as dangerous as any semi in the hands of an untrained driver.

      @@Sophie-mm7ow You are correct. Some of the RVs are the size of a commercial bus, which you need a special license to drive. Many are driven by retirees that can't back a small sedan out of a parking spot.

      Yep. My friend and her husband bought a nice RV. They might do 4 trips a year, but there is a monthly payment and insurance. Now after 4 years, trying to sell it

    Camping/RV isn’t the easiest thing for able bodied people. I am sure that his brain talked him out of it. Seems like the defendant was a great guy. I feel bad for both.

    In my decades-long experience with computers as both a programmer and a user, I've learned that when files being transferred to a machine "disappear," it's usually because they were saved to the wrong folder and the owner doesn't know that. They're probably on his machine somewhere ... assuming he's telling the truth.

    JM did not ask for proof the defendant sold it for $10K to someone else. Doubt it was coincidence he just happened to sell it for the amount that would allow him to keep the plaintiff's $8K. The defendant seemed to be a very upstanding guy, but that gave me pause.
    Perhaps he knew he could sell it really quick for $10K and not be out any money since he already had the $8K. Legally, I guess there's nothing wrong if he did that.

    All the Plaintiff had to do was take it to DMV to make sure the title was good. The Defendant coulda charged more for the RV.

    As the Judge pointed out, more people want to buy an RV before summer vacations than at the end. Defendant lost out on sales opportunities because he was holding it for the Plaintiff so he sold it at the end at a loss. The Judge was correct in her verdict. Yes, I feel bad for the Defendant, but it was his choice to put all that money down and then back out a couple of months later. Deposits are not refundable under the law per the Judge.

    Racism has nothing to do with this case. The plaintiff was making problems when there were no problems. The dad signed his daughter's name on totle, LEGAL! The dmv the plaintiff never went to dmv so how was that a problem?? The defendant held the rv for over 2 months with their 8k deposit, which is NON-REFUNDABLE. The plaintiff changed his mind so thats on him.

N he also admitted he signed his ex-wife's name and not the daughters on the form. So to correct it he would have to alter the document by adding the additional name. So isn't that an issue 😕 Bullshit ruling maybe cuz he was a black plaintiff 🤦🏾‍♀️ who knows either way it was a BS ruling

    The defendant is a great guy! He wanted this to be perfect for them, bent over backwards to help them. THIS is what deposits are for, to protect sellers from nonsense like this. The plaintiffs are deluded, selfish fools.

    Given the time between the deposit and raising the title issue, I do think it was a case of buyer's remorse. However - the seller says he ended up selling it for $10,000 looking like he sold it at a loss. He was able to sell it at the lower price because he kept the 7000. - the original asking price.

    Wow it sucks the plaintiff's lost their money like that. Technically the title is supposed to be signed by the owner. But the defendant although he lied about the price sold for without a doubt but he was acting on behalf of his daughter. Deposits are non refundable unless it's some shady business going on.

    He was sitting there shaking his head because he knew he was lying. I can't tell you how many times I've signed my parents checks, IT IS NOT A FORGERY, they told me to do it. He rightfully lost his money.

    Bottom line is the plaintiff changed his mind and wanted his money back. He didn't even do his due diligence in making the purchase. He was so unfair to the defendant who went out of his way to please this man.

    The defendant got over now only did he sell the RV for 10000 which I don't believe. But he kept the 7000 although he went over and beyond but still I think this guy should have got money back.

    Always write a check not a money order not cash a check always especially for $5000. You may run in this problem if you don’t always write a check always.

      The seller of the RV ended up selling it for way less because the buyer held up the sale for 2 months.
      Seasons matter in the RV market. I'm the spring, they're a hot item. End of summer, not so much. I'm the spring people are getting tax refunds, the weather is getting nice and people want to go camping.
      Not only are deposits non refundable, but the seller also had to sell it a lesser amount because he held it all summer for that guy to back out. His deposit covered the difference in the sale price, too.

    judge says the plaintive said the title thing was the next day, but that's not what he said. He said it was the next day after he got back from vacation

    If you sell any vehicle that involves DMV, exchange money at DMV and get out of your name. It's worth the time to do this exchange.

    Plaintiff made excuses. They got back from vacation, had rethought it, and came up with a BS reason to try and get out of the deal.
    It's really suspicious that he neither has any texts of their conversations, nor does he have the supposed evidence of the forged document.
    And damn, the defendant is a good fucking dude

    It sounds like the man is actually selling the ex wife's camper. Why does he keep saying its my daughter's middle name anyway. It's supposed to be your daughter's name not her mom's. The defendant is lying.

    I’m not sure if the plaintiff actually sold the RV for $10,000 or if he went with that number because …well, Judge Judy would’ve told him that he made more than what he was selling for if he actually sold for more than $10,000 in addition to keeping the deposit…but I could be wrong. I do believe the plaintiff asked if he could come with him to the DMV and he said no because he knew it wasn’t necessary. This was an interesting case.

      He was selling it originally for $18k. He got an $8k deposit. Held it for 2 months. At the end of summer when he tried selling it again, he only got $10k for it. So the $10k he sold it for plus the $8k deposit, totals his original asking price. He even said he had someone else willing to buy it in early summer for $16k as is. This guy was willing to pay the full $18k asking price. Then backed out. The seller didn't make more than he was originally selling it for.

      I agree, I'm suspect that he just so happened to sell it for the amount he knew would allow him to keep the full $8k. Because if he had sold it for more, he would have had to return that overage amount to the plaintiff. I also believe the plaintiff asked him to go to DMV, but he wouldn't. But the plaintiff should have called the DMV and asked how to handle it if the defendant signed on behalf of the daughter.

      The judge should ask for proof of the sale of the RV. For all we know he sold it for 19k. He should also prove that he lost money
      Not saying that the plaintiffs were right. Just saying that taking the defendant's word for it doesn't make sense

    So who here believes the "photos" just disappeared when he tried to transfer them..?? Unless you didn't read, selected all the photos, then deleted them, I don't think the older generation realizes it's an easy way to tell you're lieing.

    That's messed up. The easiest $8,000 that defendant ever made. I feel so bad for the plaintiff's. The defendant was even selling it for $18,000 & because he already had $8,000 of the plaintiff's money, the defendant ended up selling it to another buyer for $10,000. Defendant made out, if you ask me.

    I'm. Always suspect when someone says they don't have pics, texts, or call logs from a previous phone. It's almost impossible in 2024 to lose info from one phone to another or to even delete stuff

    Did I hear this right? The plaintiff paid $7k down and then changed his mind. So now the defendant keeps the rv and the $7k? Wow, I need to get in that business. I thought he would at least get his down payment back since the defendant is not a dealer.

      The plaintiff spent two months fricking around when the owner could have sold it to someone else. He basically cheated the defendant so he lost his deposit.

      I think that was wrong the guy sold it for $8000 less. But he tried to sell it to the older guy for 18000. So the guy keeps 27 1000 down payment and plus he sells it for 10000. Who's to say he sold it for that amount. Judge I think that was wrong I think the guy should have got some money back...

      Right. I also thought it suspect that he is forging his daughter's name. Seems like the judge would've frowned on that, but she says it's not illegal with authority. How would someone know if he had authority to forge the name? He should not have been able to keep all his money. I feel like sometimes the judge makes her own rules when it comes to following the law because if it were the other way, she would be saying why did you accept it if the title didn't look right.

      @@cynthiaprice3528Judge Milian didn’t make up her own rules in this case and the ruling was proper based on the information provided. In law, there’s a concept called “agency”, which is essentially when one party gives another party permission to act as their legal representative in specific circumstances. In this case, the defendant was acting as his daughter’s agent, so he could legally sign for her on the title.
      Also, the plaintiff admits that he did not even attempt to take the title to the DMV to see if he’d have any problems with registering it, which was his duty to prove his case, which Judge Milian explains to the plaintiff.

    I agree with the plaintiff, it seems there’s something else going on with the defendant. Like he was gonna flip it and couldn’t so tried to back out. I mean, the plaintiff went above and beyond for the defendant, and for the guy to wait and wait and then say no when summer was half over. Come on.

    I think seller is honest and trustworthy. I'm only halfway through I don't know what Madame judge is going to say but I do think Douglas is very well-mannered.
