  • The plaintiff claims her neighbor, the defendant, had her car illegally towed, so the plaintiff is suing. The defendant argues the plaintiff blocked his driveway with her vehicle, so he called the cops. After that, the city towed the plaintiff's car away.

    Even if it was intentional, so what! You don’t have the right to block someone’s driveway and they are not obliged to call you when they want access to their property. 😡

      Furthermore you don’t have to be 100% correct to get someone towed, but you ought to be willing to live with the consequences of your decision if you do… some things are so worth the cost.

    To the plaintiff, if your brother doesn't reside with your mother and is only visiting, he has NO business parking, blocking the defendant's driveway. Sounds like entitlement.

      @kyled2329 The defendants were splitting hairs when the picture clearly showed their driveway WASN'T blocked. Did you even pay attention to the case? BOTH sides are petty, but the defendants were in the wrong in getting the plaintiff wrongly towed.

      If its blocked even 1 foot its blocked.
      I had this happen to me a few months ago. Literally could not get my car out of my own driveway. I had another car that was not running in the other spot and someone parked behind my running car.
      Endded up finding the neighbor that did it otherwise I would hsve had it towed.

    Regardless of the legality of the driveway width, the plaintiff CLEARLY is blocking the driveway. And she knows it! Just because she knows someone down at Town Hall doesn't mean it's ok to use that connection to harass the homeowners.

      I agree. I'm looking at the picture at 3:58 and she's so far into the driveway it even ticks me off and it's not my home lol.
      The entire front wheel well is into his driveway. That's between 3 and 4 feet blocked, maybe more, and the other vehicle is maybe half a foot in.
      Many states have laws that you cannot park within 5 feet of the edge of a driveway. I believe the smallest allowance is 3 feet.
      That amount of clearance is crucial for line of sight and maneuverability.....especially onto what appears to be a narrow one-way street in this case.
      That means if she parked at the very edge of his existing (too wide) driveway, it would allow the legal 9 feet plus 5 feet clearance.
      I'll bet that's why the case against him was dismissed. Not that "he got lucky" like JM said.
      JM made it sound like he was being stupid and petty, and he's clearly not.
      If people parked on her driveway like that so she couldn't see oncoming traffic and had trouble turning onto the street, there would be BIG problems for them.

      There is no "regardless".
      She can't be in violation of blocking a legitimate driveway that is technically not up to code (because it's too big).

      JM was trying to make it clear that if the guy didn't call the tow, his driveway wouldn't be in question (again) - being the exact thing that prevented him from winning because it's not up to code.
      Because his driveway has the wrong dimensions, you can't prove the car would have STILL been in a violating spot.

    The neighbor could have called them to move the car. How about her have the courtesy of not blocking a driveway and not stirring up an issue? Then to top it off, she calls the city to site them because she got mad for the tow. She's not as innocent as she claims.

    The plaintiff still shouldn't block the defendant's driveway then expect the defendant to track her down and call her every time he wants to get out.

      ​@@fitnessfocusedI think they will lose in court this time, now he's had somebody towed and she has that judgement they will have to look more carefully at it. In the UK nobody can cut the kerb, the pavement is always owned by the county council and you would be sued and they'd bring in contractors and charge you a fortune to put it right. Here you have to get planning permission or as you guys say a permit to do that, without it you will be paying a lot of money for the time you managed to use it.

    It was thrown out the first time , all they need to do is take that paperwork to prove it. Also, their real estate agent should be held accountable for not disclosing the 'illegal' driveway. That is a material fact that may have deterred the defendants from purchasing the house in the beginning

      It was thrown out the 1st time but also notified it was an illegal drive.
      The previous owners may have purchased it not knowing it wasn't legal and had no issues to let them know. If there were issues and they were made aware yet did nothing, then I would pursue something against them. There should be records with the city if they were ever notified.
      All these owners had to do is call the car owner. She still has no right to block it though. Legal or not.

      Well if it's not legal she clearly does have the right as she just won. Now he really messed up, because he had her towed and therefore could do it again the court will look at it more closely and this time may do more than just tell them it's illegal, this time they will probably be ordered to put it back how it should be.

      If the driveway is illegal and shouldn't be there then what? In the UK people have say a single driveway and then pave over part of their front lawn to make a bigger driveway. I can absolutely park by the kerb on the added driveway as they can only legally enter and exit by the dropped kerb. I would guess this time they will lose in court as it's causing an issue.

      Yes and thinks due to her "sick" mother she's entitled to the space. Where I come from, blocking a drive way is a tow a huge fine, you aren't even permitted to block your own

    If she wasnt in violation, then the cops would not of issued her a ticket. they decided the car could be towed, not the defendant bc thats not how it works, u cant just have someone' car towed for no reason, it has to be illegally parked. so, she was obviously in the wrong, so why do they have to pay HER tow fee? unfair judgment in my opinion.

      The police can only go by what you tell them. They haven't got time to go look up the street plans and see who was correct. If the driveway is illegal, which a police officer is not able to determine, and you got towed illegally then your redress to get your money back is what the plaintiff did. The defendant was really stupid for losing his temper like this as this time he will probably be ordered to restore the kerb. A judge won't like him ordering a tow and involving police all the while knowing the court had warned him the driveway was illegal. So the first case wasn't exactly tossed out as the judge made them aware of which bit was illegal. I presume the judge felt that would be enough to stop the parking issue, now they will have no choice but to order it to be restored if the defendant is going to call for illegal tows.

      The defendant's wife is extremely nasty. I'm absolutely positive, she's behind a lot of the problems that exist in their lives. Her husband is a simp, who already knew his driveway was illegal "before" he called the tow truck company.

    Judge Milian was wrong in this case. The plaintiff was blocking the driveway and whether it was too long had already been throw out of court once. The plaintiff should park somewhere else, even if she has to walk a little bit.

      I agree. If I had been ticketed and went to court and then it gets dismissed, what am I supposed to think? I would think my driveway must be fine then or at the least the city doesn't have an issue with it. And I'm sorry, that small gap between the two cars would make it very difficult to get out of and still be able to see the road is clear to back out into.

    I have to disagree with the judge on this one. They only called the cops, the cops came out and made the assessment to ticket and tow. The should either correct it or spray paint a line for the 8 feet allowed. Every time after that I’d be calling the police on her. How obnoxious is she to think she is entitled to park their just because the previous owner didn’t mind.

    The plaintiff was parked too close. Point blank, no one should have to fight to get out of the driveway. Unfortunately for them there was an issue with their driver way but that was too tight with the other car on the other side.

      @@ultimatecouponlady Legally, you're supposed to park 3-5 feet away from the edge of a driveway, depending on which state you're in.
      So even if his driveway was the legal 9 feet wide, she was too close. She didn't leave enough clearance for him to see oncoming traffic or turn out safely onto a narrow street.
      If he was driving a 7-foot wide truck, she left about one foot of clearance on either side for him to pull out. That's not 3-5 feet, so it's not safe.

    4:25 Car DOES NOT FIT because the road itself is not wide enough to be able to turn in/out. You would hit the side of your own car trying to turn without then having to drive over the curb on the other side. JMM must not be a good driver.

      There was plenty of space to get out of the driveway. The defendant even stated that everyone in the neighborhood parked like that. The curb cut was way too long and thus illegal. The defendants knew that also. They just really disliked her and wanted to get her ticketed and towed. Now the plaintiff gets her money back from the ticket and tow and the defendants has a citation for the illegal curb cut. And they will have to pay money to get it corrected. All because they wanted to cause problems with the plaintiff. .

      @@laurielester9437 I’d like to think that we are out here (the compassionate ones) we will make a bit of difference one child at a time. I also work with children and pray I make an impact any way I can. I’ve learned over the years surviving out here. That I have more positive outcomes being positive. Coming from someone who has experienced things I wouldn’t wish upon anyone. I chose to keep compassion no matter the hurt I’ve endured. I will share it until my last breath. Not everyone is born or taught the tools needed to share compassion but I will never stop. We’re out here I promise !

    Everyone hates the plaintiff but I’m down with her. The judge explained the situation perfectly. The driveway is illegal and it doesn’t matter how annoying someone is.

    At the start I thought the plaintiff was going to lose as that's usually how these cases go. But this case was different. Creepy neighbors. I loved the plaintiffs interview with Doug. SHE was in control of that interview! A strong righteous woman.

    Wow, the defendants knew they had an illegal driveway but called to have the plaintiff towed because she was blocking their driveway, even though it was an illegal driveway! Make it make sense! Lol. Now, not only do they have to go to court again regarding this issue, they may have to incur costs to do construction on their driveway to make it legal.

    The plaintiffs attitude and demeanor is the number one reason I only lasted 3 weeks in NYC. I can not stand that personality and it is way too prevalent. Just annoying, pushy and dull.

    Another bad wig! I can't understand why people think cheap fake hair looks good. Maybe it's better than what's under the cheap fake hair. A lot of macho business going on here. Stubborn vs Stubborn. Even if the defendant called her or sent a carrier pigeon to her house with a message tied to its foot, this woman would not have moved that car. She's a difficult neighbor. The defendants are just as bad. They just like to butt heads.

    Wrong verdict. Judges decision based on feelings not law. Regardless of legality of driveway she parked in front of it and should be towed.

    If the court says the driveway could be legal, they can sue her back for a refund for 2 separate matters and for emotional distress. She didnt win yet, even the judge has mentioned that the driveway matter isnt resolved yet. Plus, they can sue a previous owner for hiding the information about the property if an inspection was not conducted prior to a purchase. This matter seems to be ongoing ...

      Yu must not know how the legal system actually works. At this point the driveway issue is between him and the city. Not her. So cant go after her for her reporting something and then police deciding to give ticket. The police have the final say so on the ticket. So no way to sue her and nothing to sue her for. Also after they sign the contract on a home, unless it is perfectly laid out in written words, or be able to prove the previous owners knew themselves the driveway was illegal. For most things when you buy a house you buy its problems as well as its pluses. Harvey might be annoys but he does have a law degree so can usally call it from outside. Which he did in this case.

      My reply was general suggestions, as you can see.
      I do not have their paperwork to read.
      Also, if a property was purchased within 2 years or so, it depends on the rules in a state and a contract itself, there could be hidden surprises.
      Paperwork always speaks in court. Some came to court here, not very prepared, but there is still a lot that was questionable.
      The judge did say that the neighbor may not be in violation - meaning it is still disputable !

    The law will not glove dirty hands. The driveway is illegal thus the illegal width is not protected under the law.
