- The just-released video above is from the Florida State Attorney’s Office, supporting a judge’s ruling that a citizen who opened fire on a man attacking a Lee County deputy last year was justified in using deadly force.
David Katz, U.S. Law Shield of Florida Independent Program Attorney, said of the video release, “Normally, the police work to protect us, but as this video shows, an ordinary citizen had the opportunity to protect a law-enforcement officer under attack.”
Since the original incident, Katz said that nothing has changed regarding the legalities of the case, and that attorney James Phillips’ recap of the facts and the law (see below) were thorough and complete. He said he understood why ordinary citizens would be interested in seeing for themselves how the situation occurred and was resolved.
On Nov. 14, 2016, passerby Ashad Russell saw Edward Strother, 53, of Ocala, pin Deputy First Class Dean Bardes to the ground during a struggle on Exit 123 just off I-75 near Fort Myers. In the new video clips, Russell, who has a concealed weapons permit, can be seen walking up to the two with his pistol. He ordered Strother to stop.
Katz said, “Ashad Russell cautiously approached, gave the assailant an opportunity to stop the attack, then acted to protect the Deputy, likely saving his life.”
The new video shows that Russell approached the fight, drew his firearm, which he legally possessed, and he ordered the suspect to stop what he was doing multiple times. When the suspect didn’t, the good samaritan shot three times, resulting in Strother’s death.
U.S. Law Shield of Florida Independent Program Attorney James Phillips analyzed the shooting after the event, saying, Florida Statute 790.012 allows a person to use deadly force if he or she reasonably believes such force is needed to either prevent death or great bodily harm that is imminent to either himself or to another person, in this situation the officer.”

Ashad Russell: A man among men. Never, ever, doubt you did the right thing. You risked bodily harm and legal repercussions to do what you knew you had to do. Mad respect, sir, mad respect.
What a brave man. He saved the deputy’s life. Great ruling by the judge to justify him.

He looked quite traumatized for having to take another life. I feel for him, it could not have been easy. God Bless Him 💕

I'm glad this guy stepped up to the plate to help this Officer. I'm not sure if the assailant had a gun or not but he could have taken the policeman gun if he were knocked out of dead. This guy did a great job and he may have saved more lives than the policeman. Who knows what a desperate, dangerous, cop killer with a gun would have done next? Thank you Mr. Russell, job well done sir.

I would never have dropped my weapon. Once he saw that there were no more immediate threats, he should have just holstered his weapon or placed it back into his locked vehicle. Leaving the weapon on the ground unattended was a bad idea. I'm sure he just didn't want to have the weapon in his possession when the police arrived.

Sad part about this story is that all these people standing around taking videos not one called it in . I saw it on another video. It wasn't called in until after the man was shot. The man who shot the suspect was cleared and it was a justified shooting .

The deputy in this video that Ashad Russell saved was found dead in his home in January of 2018. Rest In Peace, Dean Bardes.

I just wish that more cops would realize that most of us gun owners would do the same... even if I didn't have a gun, I would help. I'm built for it (not in size, but attitude).

Well, most gun carrying human beings are actually the more trust worthy and dependable persons. Here in Canada, you voluntarily sign up for daily background checks as soon as you get your gun permit. Meaning you are on the RADAR for police daily. Which makes most of us a lot more conscious of our actions and what it means to bear arms. I trust a concealed carry person 10 times over a citizen without gun permit.
You like to see good people willing to step up and help a bad situation,but you gotta ask,why only him? The people closest to the cop/perp,what were they doing just sitting there?

Yes, you can be charged with Illegal possesion of a weapon, brandishing, etc...
Bottom line is: If you have a license, use it to defend yourself in and out of your house. And, if you dont have a licence, use it only for your house protection. US Law makes people to refuse being a good samaritan most of the times.

In Florida you don't have to have a permit to carry a gun in your car. Not sure about other states.
Sadly that depends on the state you live in.
This is the difference. Did this happen in my country, the man would end up in jail for many years, maybe for life. Although we're allowed to carry weapons after meeting set conditions, we're not allowed to substitute the police job.

The criminal was treating the cop the way some cops treat citizens without probable cause. They automatically see people as criminals. Glad the cop is ok and was rescued by a regular citizen.
