Sadly although in many cases the Imperial powers have long since withdrawn, the natives continue the fighting to the death. The princely state of J&K became part of India on 26th Oct, 1947 after Maharaja Hari Singh signed the Instrument of Accession as per the British India Independence Act 1947. However, UK/USA/France continued to recognise the illegal occupation of Pakistan of Pok until 2001, and voted 7 times against India in the UN Security Council since India had close military ties with USSR. This immoral support from UK/USA/France gave a boost to Pakistan and it went to war against India in 1965 on Kashmir, followed by launching a large scale militancy in Kashmir Valley in 1989. Thus, in addition to the Kashmir issue not being resolved, the state of J&K (India) has been embroiled in military/terrorism since 1989.

Through out, the West (UK/USA/France) believes in the 'holding ' of the land physically, as the criterion for territorial sovereignty; for claim of a territory. This physical possession was (is) missing in respect of PoK. USSR was the only country that consistently supported & with commitment, that paved the way for 1971 war that clinched the issue with Pakistan - but not the Kashmir issue, simply because one can't do too many things in a limited time frame. Yet, we goofed up again to bargain with 93,000 Pak troops held as PoW s. At least an opening should've been found. Again the UNO & the various conventions secondarily & primarily the attitude of the Prime Minister (Nehru) was responsible for this global attitude. We (India) should (could) have taken this area, though there were limited opportunities. Any issue now, in (post War) international arena, is never confined between the two contenders in a dispute but acquires global flavour. Pakistan has managed the situation very well, with well-calculated moves, blunting any Indian initiative. India was never pro-active but reactive to Pakistani 'moves', every time. This led to a Pavlovian response, in matters pertaining to Kashmir. India has been reduced to a reactive (timid) country. What we claim ('de jure'), we must possess ('de facto '). The biggest reason why it happened is because India was a poor LD country (LDC) too, till almost 1991. The tide turned when India began becoming richer & Pakistan becoming poorer. Now the global situation is propitious for an Indian pro-active initiative & with a BJP government in the saddle. I tried & failed to educate my fellow Indians that an appropriate Indian 'defence preparedness ' shouldn't be misconstrued as an attempt at 'War making ', but as a mild deterrent. History taught (the West) that if peace is what one desires, he should be prepared more for war. It alone prevents a neighbour to attack a militarily 'weak' neighbour (instance is India). Military strength should be backed by posturing in foreign policy, that in turn supported by Economic strength. Hence, a poor country has everyone walking over it. Another thing is, in the name of J&K or Kashmir state, the people of the 'Vale of Kashmir' (eleventh in area, of the total princely state of Kashmir) were allowed by default, to dominate the whole princely state, oppressing the other regions. Now with repeal of '370' & reducing them to UT status after partitioning J&K, India owes it to General Zorawar Singh to restore Aksaichin till Demchok, while to its people for the restoration of PoK. Princely state of Kashmir isn't homogeneous but very heterogeneous.

Why you delibrately skipped 2 legally valid documents:- 1. Instrument of acession, verified by Viceroy office. 2. UN Resolution on Kashmir. India has not only rational, ethical and moral right but also legal right over land of Kashyap, Kashmir.
The Government of India Act, 1935, passed when British still ruled India, provided that any state may accede to India or Pakistan (or choose to remain independent) by an Instrument of Accession executed by the Ruler thereof. The Maharaja of Jammu & Kashmir signed an instrument of accession through which the state acceded to India.
The government of india act 1935 never said that. The act of 1935 after partition was basically an interim constitution for both countries to follow until their own are made. However the choice was actually given in the Radcliffe award in which the territories were divided and that option only went to to princely states not every other province or state. Plus the act of 1935 was passed in 1935 when Muslim League still hoped for a united india with muslims getting their rights, however this changed after the congress rule from 1937-1939 and then from 1940 Muslim League pushed for independance.
But that was against the people of kashmir because there are 85% percent muslims population and they don't want to be with india it's upto the people whether they want to be with india , pakistan or be independent

After partition, India and Pakistan both were trying to woo the autonomies to join their countries. 3 states, namely Jundagarh(Guj.), Hyderabad(Telangana) and Kashmir. Both Junagarh and Hyderabad decided to be a part of India. Kashmir said that it would decide whether it wants to be a part of Pak. or India, and till then, both countries should give Kashmir 'independent' status, and then sent the letter to each country. Pakistan SIGNED that letter. India asked for a talk but complied. However, by the time India complied, Pakistan attacked on Kashmir suddenly. This made Raja of Kashmir ask for India's help. India said, if you want us to help you, you should become a part of India,as we would be sending our soldiers and risking their lives. Raja agreed and SIGNED that Kashmir be a part of India. End of discussion. Pakistan should've been more diplomatic if they wanted Kashmir. At first they agreed, then suddenly they attacked. No professionalism,just violence. Partition was done on the basis of religion. Muslim majority regions became Pakistan and hindu majority areas became india. Kashmir was a muslim majority area so it should have been Pakistan legally and India's occupation is illegal.

yes Nehru Ji is very unfairly criticized for the Kashmir problem. During that time India was newly independent country with great turmoil, instability and without any proper administration or governance. If you consider the circumstances at that point of time and think rationally it was the right step to take the issue to UN to resolve it in a diplomatic and peaceful manner. The UN or Western powers of course tricked India and decided on a plebiscite. They knew that given the partition and animosity between Hindus and Muslims , the Muslim majority Jammu and Kashmir would vote to go with Pakistan. Thereby they created an ever lasting problem for India. Instead they should have decided what would have been the best for the people of J&K and then moved towards a agreement. Given India's cultural diversity, its size, its decision to remain secular and the fact that even after Independence the vast majority of Muslims living in regions that formed independent India chose to stay back clearly meant that the better future of J&K was to remain with India. And India magnanimously offered J&K administrative sovereignty which of course was misused by Pakistan and vested local interests within the state to promote separatism and terrorism. Actually India should have repealed article 360 almost 20 years back.

Plz correct ur video. India didn’t simply claim, J&K was attacked by Pak and Maharaja joined J&K with India and signed. Please know the facts first.
But the truth is that during partition it was stated that states will be distributed on the talks of people and 85% were Muslim in Kashmir.

The princely state of J&K became part of India on 26th Oct, 1947 after Maharaja Hari Singh signed the Instrument of Accession as per the British India Independence Act 1947. However, UK/USA/France continued to recognise the illegal occupation of Pakistan of Pok until 2001, and voted 7 times against India in the UN Security Council since India had close military ties with USSR. This immoral support from UK/USA/France gave a boost to Pakistan and it went to war against India in 1965 on Kashmir, followed by launching a large scale militancy in Kashmir Valley in 1989. Thus, in addition to the Kashmir issue not being resolved, the state of J&K (India) has been embroiled in military/terrorism since 1989.

Through out, the West (UK/USA/France) believes in the 'holding ' of the land physically, as the criterion for territorial sovereignty; for claim of a territory. This physical possession was (is) missing in respect of PoK. USSR was the only country that consistently supported & with commitment, that paved the way for 1971 war that clinched the issue with Pakistan - but not the Kashmir issue, simply because one can't do too many things in a limited time frame. Yet, we goofed up again to bargain with 93,000 Pak troops held as PoW s. At least an opening should've been found. Again the UNO & the various conventions secondarily & primarily the attitude of the Prime Minister (Nehru) was responsible for this global attitude. We (India) should (could) have taken this area, though there were limited opportunities.
Any issue now, in (post War) international arena, is never confined between the two contenders in a dispute but acquires global flavour. Pakistan has managed the situation very well, with well-calculated moves, blunting any Indian initiative. India was never pro-active but reactive to Pakistani 'moves', every time. This led to a Pavlovian response, in matters pertaining to Kashmir. India has been reduced to a reactive (timid) country. What we claim ('de jure'), we must possess ('de facto '). The biggest reason why it happened is because India was a poor LD country (LDC) too, till almost 1991. The tide turned when India began becoming richer & Pakistan becoming poorer.
Now the global situation is propitious for an Indian pro-active initiative & with a BJP government in the saddle. I tried & failed to educate my fellow Indians that an appropriate Indian 'defence preparedness ' shouldn't be misconstrued as an attempt at 'War making ', but as a mild deterrent. History taught (the West) that if peace is what one desires, he should be prepared more for war. It alone prevents a neighbour to attack a militarily 'weak' neighbour (instance is India). Military strength should be backed by posturing in foreign policy, that in turn supported by Economic strength. Hence, a poor country has everyone walking over it.
Another thing is, in the name of J&K or Kashmir state, the people of the 'Vale of Kashmir' (eleventh in area, of the total princely state of Kashmir) were allowed by default, to dominate the whole princely state, oppressing the other regions. Now with repeal of '370' & reducing them to UT status after partitioning J&K, India owes it to General Zorawar Singh to restore Aksaichin till Demchok, while to its people for the restoration of PoK. Princely state of Kashmir isn't homogeneous but very heterogeneous.
There isn't anything like INDIA OCCUPIED KASHMIR.

The Government of India Act, 1935, passed when British still ruled India, provided that any state may accede to India or Pakistan (or choose to remain independent) by an Instrument of Accession executed by the Ruler thereof. The Maharaja of Jammu & Kashmir signed an instrument of accession through which the state acceded to India.
The government of india act 1935 never said that. The act of 1935 after partition was basically an interim constitution for both countries to follow until their own are made.
However the choice was actually given in the Radcliffe award in which the territories were divided and that option only went to to princely states not every other province or state.
Plus the act of 1935 was passed in 1935 when Muslim League still hoped for a united india with muslims getting their rights, however this changed after the congress rule from 1937-1939 and then from 1940 Muslim League pushed for independance.
But that was against the people of kashmir because there are 85% percent muslims population and they don't want to be with india it's upto the people whether they want to be with india , pakistan or be independent

India said, if you want us to help you, you should become a part of India,as we would be sending our soldiers and risking their lives. Raja agreed and SIGNED that Kashmir be a part of India. yes Nehru Ji is very unfairly criticized for the Kashmir problem. During that time India was newly independent country with great turmoil, instability and without any proper administration or governance. If you consider the circumstances at that point of time and think rationally it was the right step to take the issue to UN to resolve it in a diplomatic and peaceful manner. The UN or Western powers of course tricked India and decided on a plebiscite. They knew that given the partition and animosity between Hindus and Muslims , the Muslim majority Jammu and Kashmir would vote to go with Pakistan. Thereby they created an ever lasting problem for India. Instead they should have decided what would have been the best for the people of J&K and then moved towards a agreement. Given India's cultural diversity, its size, its decision to remain secular and the fact that even after Independence the vast majority of Muslims living in regions that formed independent India chose to stay back clearly meant that the better future of J&K was to remain with India. And India magnanimously offered J&K administrative sovereignty which of course was misused by Pakistan and vested local interests within the state to promote separatism and terrorism. Actually India should have repealed article 360 almost 20 years back.

Jammu and Kashmir including Pakistan- and Chinese occupied Kashmir,gilgit and baltistan has,been is and always will be part of India since 1st civilisation 10,000s of years ago. There is no dispute. India has the instrument of accession and is secular - the exclusive moral and legal prerequisite. If people don't recognise instrument of accession that's fine with me too...then entire of pakistan has... no right to exist as this is how it was illegitimately carved out of India the mother country in the 1st place. So now - if people on this land want to be Indian we embrace you and are ready to help you as brothers and sisters. If not get off the land you are occupying - its not yours - and go to a land that was made for intolerant ones like you (and give back your identity card, our aid we give you (10 times that of bihar) and go earn your food from somewhere else). Why don't you try pakistan and see how they treat you like they treated 3million bengalis (at that time pak citizens).
