  • What is going on everybody, this is TGA, in today's video, I head down to Kingswood with the intention of filming Avon and Somerset Police, I head inside a public building, and security tries to trap me inside and falsely imprison me, this was shocking, I'd like to see what you all think as well. Enjoy.

    Clearly the council have been caught with their pants down on a serious issue like this and a full investigation needs to be open up on this breach and on the security of this building. What is really worrying is how many councils are operating like this?

    Kingswood civic centre mangement will have to act on this incident.
    The SIA will also have to act if it is reported to them.
    The lady who asked the security guard to detain you is a prime candidate for dismissal. And the other lady needs training on GDPR to continue in her job...Follow this through Gwent Auditor...

    15:00 Stopping a person from moving where they want is unlawful detainment. Common law allows a citizen's arrest but it has to be for an indictable offence. Detaining someone whilst waiting for the police for something so minor and so obviously not a indictable offence is an offence in itself. The police won't do anything in this situation since it won't be in the public interest to proceed with a prosecution. However that doesn't absolve his employer from any liability from his actions, especially if he was told to detain TGA.
    Not much violence other than physical contact (assault and battery) so not not a high claim, but still worth claiming a few hundred with a simple letter before action setting out the situation, the evidence you have, the evidence you require from them (CCTV, written policies, etc) and the damages you claim for the offences and the mental stress that you suffered.

    27:30 Doesn't sound like he's so convinced that he's right since if that was the case he'd have no problem in giving his SIA number. Hiding it means he knows he's fucked up, big style. And he's hoping that by not showing it he won't get any issues. However he's stupid since it just harms his defence and sending a picture of his face to the civic centre and asking for his details as part of some claim before action means they are legally obligated to divulge that information. So hiding the SIA number gets him nowhere.

    As soon as that security guy put his hands on you, you should have pushed him away and warned him not to assault you and that you feared for your safety, If he touches you again you have the legal right to use reasonable force

      Don’t be silly. That’s terrible advice. He was in no physical damage. It was not an assault to cause injury. Responding physically should always be a last resort. GWA handled it perfectly… he helped calm down the situation.
      Just because you may have a legal right to use force in self defence - it’s all in the “may”. That’s a legal definition so you better be sure you know when a forceful self defence is legal.

      If a security guard touches you or tries to stop you and you have done nothing wrong it is classed as a false or wrongful arrest and you can use reasonable force against it .
      Pushing someones hand off you or away from you can not be seen as excessive force when they are breaking the law by detaining and assaulting you!

    Bloke with a one week £500 training course and laminate badge with his name on it really shouldn't be going hands on with random members of the public and ordering them about. The outcome could have gone horribly wrong for both parties.

    This is pointless, you either use reasonable force on the no-mark of a security guard or just keep following his directive like a lost puppy. You told him to stop giving you orders, yet when he says jump, you are totally compliant.
    You call him the rights abuser, yet you’re quite happy to let him. Either bundle him out of the way, knowing he has no rights of detainment or just do what you did and let him walk all over you.

    I am very glad that they are all very worried about what you are going to do with the data that they have already let out into the public domain. Shutting the stable door after the horse has bolted and trying to lay the blame at the auditors door when it lays firmly in their hands.
    The main problem with GDPR is that the people who are responsible for it are the ones that don’t fully understand it.

    Hi T G A, good work as per usual!, I do wonder if the computer screens you can see from outside are actually displaying protected data, GDPR only applies to particular personal information, it is possible to have all sorts of other non-confidential information on screen without breaking any rules.
    The new worker at the desk tells you she cannot answer your question because she is so new there!, has she not had any induction training?. Regardless she does seem to be a very much more sensible person than many, presumably she is not inclined to feel paranoid and suspicious of cameras.
    The same cannot be said of the demented Carlos, I would be tempted to tell people like him that you do indeed have permission to film there, your mother told you it is perfectly O K!.
    The manager woman is polite enough but does not understand that it is their duty to protect private data but they cannot do that by proscribing the activities of members of the public.
    I do hope that as a result of your good work here today that the staff there will do a much better job of finding out what they are allowed to do, how and why.
    Not only do security workers have no powers of arrest they have no powers at all out-side the building.
    The woman then tries to explain herself along the lines of her lack of understanding, what puzzles me is how does she think that is any concern of yours!. I am sure that subject to a sensible contractual arrangement you might be inclined to explain it all and train her her properly but there is no good reason for you to do it for nothing.
    As it goes she does appear to be listening to and understanding what you do say and I still hope she will learn from it.
    The last one also tells you that you are not meant to record inside, as well as repeating the same nonsense about the visible screens. The general levels of ignorance and stupidity are breathtaking!.
    I do so love the way people that dispute what you tell them just say that they accept your difference of opinion when you are actually explaining matters of fact!.

      @@SnakePliskin762 In custody you are entitled to a copy to read. However the legislation states that a copy must be available at any front desk for any member of the public at any time. The legislation was written before the internet and the world wide web but its still in place so the police must follow the law and have a copy available and not just fob someone off by saying "Google it".

    As a general rule, then, it is legal to film people (including children), buildings, signs, brand logos and events from any public place without having to get permission from anybody. Many people believe they have to give their permission to be filmed but that is not the case!

    Truly incredible and fascinating how these fools cannot see this issue at heart. This ain’t a criticism of you, but I’d love to see you and all others simply refuse to engage with them saying “we’re worried about the data you have captured on your camera and what you will do with it.” and only reply with “your worries shouldn’t be what I’ve captured, but what anyone can view from your constant data breaches that I have documented today. I have seen what anyone coming and going today can view. You should be worried about what one of all those individuals could do with the information, not auditors who are overtly documenting for the sole purpose of stopping these breaches.”
    Even here, the first woman sounded concerned but her ‘contacting her manager’ gave suspicion that she was less bothered about their wrongdoing and more bothered about your camera and it’s documentation of that! And of course that’s exactly how it panned out…

      Exactly because if someone if someone who's data that is sees it or the cammer contacts that person explaining the situation can land them in bigger trouble if the persons whos data has been breached also complains to the ICO with evidence or heaven forbid if someone with malicious intentions sees it and acts then they are in even deeper trouble.

    well done; will go there later to track down that guard and mock him. Mebies you should have allowed him to wrestle you tut ground and then made a compensation claim.
    Kingswood is only under south glos council - not n/somerset.....Bristol boundary is about half a mile away from k/wood. N Somerset border is maybe 5 miles away.

    I used to live right by this building and I had to go there to sign up to the housing benefit department and I was at the point volunteering for the salvation army and a local hostel in South Gloucestershire Bristol there was a sign poster on the notice board advertising helping people with drugs and alcohol problems I innocently wanted to take a photo of the notice board and in the second of doing so I was gripped by the security who aggressively pushed me out the building they were very abusive acting exactly how they were in this situation disgusting behaviour #pinac keep up the good fight for excerising your rights 👊👍❤️

    Hey Gwent, I've worked in both industries that have abused you and I want to give you some advice.
    I used to work in retail security and I know that a security guard can't hold you unless the suspect you of committing a crime and only then they have the same citizens arrest powers of any other civilian like you or I.
    I also worked in finance for a merchant bank dealing with GDPR as part of my duties.
    The complete onus on confidential data is the data handles, IE in this case the council. If you've managed to record any confidential information, I would without delay hand it to the ICO the information Commissioner Office.
    If you have been recorded by any recording device whether it be body worn cameras or internal cameras, put in an SAR or a Subject Access Request for the footage.
    Also report the security guard to the SIA and to the police and hand them the footage you've recorded as it's a criminal offence not to have his badge on display at all times.
    They'll probably not do anything about it, but it's worth trying.

    Has the law been changed on filming inside public buildings? I saw this on a police website ""There will be places where you have access as a member of the public, but will have to ask permission or may be prevented altogether from taking images. These could include stately homes, museums, churches, shopping malls, railway stations/airports and council/government buildings""

      Hmm, I’ll have to look in to this, but then again it’s not law. Railway stations have guidelines on the Network Rail website regarding filming that is not on behalf of a company. Government buildings are paid for by the public and they are open to the public, surely anyone can film somewhere like that, same as being stood on the pavement

    Sadly the first security guard hasn’t a clue and in fact committed an offence of common assault and freedom of movement of the auditor was restricted. Maybe it’s because he’s a foreigner I don’t know but, he doesn’t know the law. Also the second security guard started off ok, then sadly showed why the public have little sympathy towards taking them seriously as he didn’t know that filming in a public building or a publicly accessible building is the same as filming outside in the public…it’s perfectly fine and not against the law. GDPR sensitive material has to be covered up from the public, not the other way around. Sadly this Council and these employees are pathetic.

    For a person trained in GDPR, which all public employees should legally be, its actually a prosecutable offence under GDPR to misquote, incorrectly apply or even try to incorrectly GDPR. As such all the security & other employees in this vid should be reported for breaches of GDPR and be facing prosecution accordingly.

    That One Stop Shop manager needs to be sacked first, she gave the security guard illegal instructions to keep the auditor in the building and make sure he does not leave.
    The guard would not have done what he did if was not instructed to do it.
    The guard also needs to be sacked for gross violation of his SIA conduct and his One Stop Shop security duties.
    No doubt also an investigation will be opened by the Council in regard to their staff's data breach.

    I hate to point out that at about the halfway point of your video when the security guard asked you to come across the car park and stand closer to the building, what he was doing was trying to get you closer to the CCTV cameras in order to capture your image for their records. This is clearly in an attempt to either identify you or to attempt to ban you from the property as an uncooperative individual. I would suggest that you contact the property manager and ask for their reasons for this action and to request that they give you control of the footage or delete all such videos that you are pictured on.
