- From the incident report: "On October 21, 2019 at approximately 10:47 hours, Lower Township Patrolman Danze conducted a motor vehicle stop on Bayshore Road by Miami Avenue in the Villas, New Jersey. Upon approach to the vehicle Ptlm. Danze made contact with the driver/defendant Breanna Gara and the passenger Matthew Britton. Ms. Gara appeared nervous and her hand was shaking. Mr. Britton appeared to be under the influence of C.D.S. During questioning, Ms. Gara gave inconsistent answers and continued to act nervous. During further investigation, Ms. Gara admitted to having hypodermic syringes inside the vehicle . Ptlm. Danze retrieved the syringes located inside the center console. Some of the syringes appeared to contain a liquid believed to be C.D.S. Also located in the center console were several small plastic containers with C.D.S. residue. One container contained a white power substance. Ptlm. Danze continued the search of the vehicle and located a green bag in the rear seat containing multiple hypodermic syringes and located a plastic vial containing suspected C.D.S. in her purse. Ms. Gara was placed under arrest and searched incident to arrest. Located in her front pocket was a clear plastic bag containing suspected "Molly" (MDMA). Ms. Gara was transported and processed, and the suspected C.D.S. and paraphernalia were entered into evidence."

I don't think there was probable cause to search her vehicle until she opened her mouth.
He suspected she was under the influence of something. He was going to create probable cause one way or the other. She just made it easy for him.
That’s the thing if someone is nervous they could just say they are under the influence. Even though in this case she is high, it wouldn’t matter if she wasn’t probable cause is another phrase for invasion of privacy whenever they want.

No, don't consent to a search. If they detain or arrest you and search the car, the evidence will be thrown out as improper search.

1) if you refuse to give them consent to search, that is not obstruction. That is exercising your civil rights.
2) If you refuse to answer that is exercising your 5th amendment right.
3) If they find something via K9, that is the ONLY charge they can get you on.

I will never forget this older female cop, pulled me over right after I left the dope spot. Had needles and a 10 dollar bag. That lady did me the biggest solid, treated me almost like a son. I had to dump the heroin on the ground and throw the needles. This was in Dallas. I was straight forward with her. She was an angel, and spared me a felony charge. I wish I knew her name because, fucking hell, she really showed me the most love.

That same exact thing happened to me in the 90's but it was beer. Me and my boyfriend were pulled over and we had a bunch of empty can in the back seat floor and a case of beer and also our open containers. Cop made us dump/pour our beer out in the street as he watched. Then we had to take the cans and throw them in the back of my bf pickup and drive them to a dumpster. Then head home. And we did exactly as he said. Biggest break ever.
I was stopped for speeding by a state trooper in Oklahoma, driving my wife and two kids to a state park for a car camp weekend. The trooper asked why we were in Oklahoma when we live in Texas. I was polite and truthful, telling him I knew I was speeding a little, but I wanted to get to the state park and get settled before it got too late in the evening. I told him in front of wife and kids I was sorry. He said he appreciated us visiting a state park in Oklahoma and said he very much appreciated my honesty and apology. He then said, "I want y'all to please observe the posted speed limit signs, come back and visit us again sometime, you're free to go, just watch your speed." I said, "Yes sir, and thank you for your kind understanding." He says, "Enjoy your weekend!" Case closed, no ticket. My family said, "He's a nice man." So, the moral of the story is... be nice to the officer, tell the whole truth, say you're sorry, and don't try to weasel out of anything. Believe me, police appreciate respectful honesty and some remorse. Don't ever lie to police and never run from them. Be respectful.
What disturbs me the most is when people say "I have a kid" like you buy one from the store. It's your child. Grow up.

Im so grateful to be almost 3 years clean. Watching this is pretty triggering but man am i thankful. I almost died in 2020 from gerting sepeis due to reusing my dirty needles. Was in the hospital for 2 months and had to learn to walk again. I have permanent damage in my foot And every single day is a constant reminder of that time in my life. Im so happy and pray this girl has gotten help since this incident ❤

Outstanding! Just had four years myself. Addiction hits all types of people. I’m a 59 year old white woman from upper middle class family and got hooked on pain meds after two neck surgeries. I was totally functional and thank god didn’t lose my job, family or friends. Getting clean was brutal but so worth it! I hope she got some help🙏

Oh no..I was a needle user for years. Been sober for 4.5 years now. It’s so tough. It’s hard to see a young, beautiful person wasting her life away. I pray she gets the help she needs and gets away from the people that bring her down.

I worked in a warehouse with a really sweet gal. Unfortunately she had painful back problems, they were so bad that she moved in with a drug dealer. One day when she was at home, a sheriff knocked on the door to serve a warrant for her boyfriend. She answered the door with a weapon and killed the officer. A very sad situation for all. Sometimes health issues are the cause for drug use.
I was this girl. Its hard to watch..as the cop is just disgusted with the needles. When I was bad into my addiction driving around with a purse full of dirty needles and empty baggies...seeing this makes me so grateful for sobriety. If I got pulled over today the only thing the cop would find is a bunch of empty mountain dew bottles lol i hope she got some help..life is so much better on the other side
yes it is quite sad because we all have weakness and can give in and find yourself in her shoes ,its more sad to see the way a sick person is treated then thrown down a couple wrings in society and have to sit in jail vs a rehab facility where she might actually get the help she needs.

Something that has always annoyed the heck out of me is how police assume some sort of guilt due to folks being nervous. Just being pulled over for speeding will have me nervous as heck and even though I know the worse that's going to happen is a ticket. 🤔🙄
My ex was just anxious in general. So the couple times that we got pulled over, he always had us looking guilty lol. One Time I even tried explaining to the cop that he was just anxious in general and I got the feeling that he didn't believe me. He thought we (me, him and a friend) were either on or had something. We were all sober , the car was legal and had nothing illegal on us.

I cry every time I’m pulled over. I heard a cop a few cars behind me the other say “pull over” through the loud speaker and I nearly had a heart attack. It wasn’t for me, but I got that heart dropping, dizzy feeling when I realized he was talking to someone else. I think he’s trying to build probable cause to get a dog or search her car.
I know at least 3 local LEOs who, when they pull someone over who seems nervous, they ask the person what they are nervous about. If their response is anything like, I'm a nervous person or I'm nervous being pulled over, their responses are something like, I get it, cops can be scary. And, they are sincere. I respectfully suggest that you check out Friday's with Frank. He's an example of a good one who relates well with people and has a great sense of humor. I wish you a Merry Christmas!

It doesn’t matter if you’re rich or poor, doesn’t matter your ethnicity, religion, whether you’re a good person or bad. This can happen to ANYBODY! I grew up in an upper middle class family, 2 parents, fairly happy home in a nice rural town. But kids will be kids and teens will be teens, my friends started experimenting so I did as well. Within 5 years I was a regular heroin user. 4 trips to rehab and by the grace of God I’m clean now going on 11 years.
It can happen to anyone, keep an eye on your kids! Really good kids make really dumb choices sometimes too!

Imagine if she made it to her appointment to get that car inspected. Whoever was scheduled to do that inspection really dodged a bullet. Between the drugs and the uncapped used needles he may not have survived long enough to fail that biohazard she calls a car.
You cant OD from a poke even if the needle is contaminated with dope. It doesn't work that way.
What do you mean? Where I live we pull in and the do the inspection from outside of the car...to make sure all of your lights work and whatnot

Was she on the way to a burglary? Methadone does stuff you up. Suboxone is not worth the effort if you're looking to get high... that's how you tell the sheep from the goats. Methadone- stay stuffed up. Suboxone- better be ready to come off everything because it's not that pleasant at all. Because of the Naltrexone it blocks a lot of other drugs too. Not a party drug. Take my word. Or not.

But just think about the pain and desperation injected with this needles. Maybe the high is cool for 1-2min than the addiction kicks back inn and the never ending cycle of getting high and running after drugs goes on.

@Jody Owen legit stop...she was visibly impaired which is enough in it's own, and as soon as she blamed her drifting on lighting a cigarette, then when he asked her if lighting the cigarette caused her to drift and she said no, asking her to get out of the car was the right thing to do. She admitted needles. At that point any search is justified.
She's lucky if her words didn't end up in her grandmother's house getting probable cause searched too.
Jody Owen I don’t think you realize that it’s an officers job to keep roads safe... it was a simple stop so he could make sure she wasn’t impaired which is dangerous to everyone on the road. Her jumbled story, shakiness like she was impaired and her passenger’s slowed speech gave probably cause for search, but before that she even gave consent for a search because she admitted she had needles. Stop talking nonsense

Recovering addicts here clean for over a year had been using for 14 years of my life IV user like to use just about everything just a regular old trash can my heart goes out to all of the people in this comment section who have dealt with and are dealing with addiction and it is possible to recover. Addiction is a cunning enemy it is the devil and it is the hardest thing that you will ever have to go through in your life. Sobriety is so much better than being in the drug game. I have been like her I have carried needles around with me when I did not have dope I used to shoot up water because I loved the needle that much. Even after I quit shooting up I kept my needles for quite a long time before I finally had the courage to throw them away. God is good and he does Grant Miracles and in my case he granted me a miracle and that is that I got sober and that I am happy living my life and I still have my health and my family. Police officers are just trying to keep the public safe and unfortunately people go to jail and lose a lot of things in life but the one thing that you can always have is sobriety if you really want it that bad. God bless all of you God bless this woman and her boyfriend and I pray that they are healing
According to Public Records, she was sentenced 6 months for possession, and 5 years of probation.
I mean. They should have made the poor girl go to a rehab. Idk what state this is because I haven’t been paying that close attention but in my state any drug other than weed is a felony for possession. Why ruin her life instead of getting her help. So dumb.

Not really I got pulled out of my car for a ticket because we were on a busy road and the officer didn't want to risk either of us getting hit or being in the way of traffic, 45 seconds later I was back in my car going to where I was headed

I was driving in Montana when i was 25 , this was 20 + years ago . I idiotically had the cruise control on , icy roads. I slid out of control around a curve going 60 . Started these big long fishtails and then flipped around and the back of my truck hit the median , at a right angle to the passing lane. The truck wouldn't start and the next car stopped and they helped me push it over to the side of the road . Truck still wouldn't start so they took me into the next little Montana town to the cop shop and the cop drove me back out to my car . He was a cowboy cop with a mustache and a cowboy hat . He knew what I didn't know , that there is a fuel shutoff switch in those Ford Rangers that shuts off the fuel line in a collision. There is a button in the glove box that turns it back on . He opened that passenger door to push the button and a beer can fell out that had been made into a weed pipe. He bent down and picked it up and turned around and looked at me and he said " I don't have time for this shit right now " and then he threw it out into the field. We got my truck running and he told me that he was required to report and damage that was over , I think $800. He asked me how much $ worth of damage there was and I said about $600 and he said "Thats about what i think too " Then he told me I could leave. He said he didn't think I was impaired but he was going to drive behind me . He followed me for about 2 miles and that was that ..

In Grand Rapids, Michigan where I am from its legal to carry needles if you have your needle exchange card, which anyone can get and its free. We have a place called the Red Project tgat gives away boxes of needles and of all sizes. They promote safe drug use. You can also get safe snorting kits and char for smoking crack and they give away narcan kits. Then they give you a card. Im a heroin addict that has been struggling fir the past 6 years. Ive been in and oit of rehabs and have been prescribed to suboxone kmand everything. Im so lost in my life. Idk what else to try. Ive been pulled over and had needles, but I didnt have drugs. The rigs were still in the bags of 10 and were all caped up. I presented my needle exchange card and was on my way
