Yes, that's the problem faced by many, when they complain to registrar. And society office bearers knows this well, that's why they behave in adamant manner as per their whims and fancies, detrimental to the interest of members and in a way exploit the members.
Law & rules are in book only. Physically and practically the law & rules are toothless & never implemented as mandated. Qualified audit report is never addressed by the registrar. What's the use of audit in housing society when no action is taken by the registrar
Very nice information. Inspite of amendments there are many areas where in the Society dispute arises. Sir I request u to take one session to discuss the problems before members of housing societies. Please let me know when u will arrange such discussion.
I agree. the deputy registrar does not take any action against the managing committee despite complaining about serious irregularities. They simply close the files or allow them to continue in the office

Any rules about AGM Video Recording for Member shall member gave Any types of Affidavit. This Video Recording is private or Public Documents for that particular society
The co-operative Court order of March 2023 of Jal Vayu Vihar society should prevail mandating AGM video recording and provision to members due to the current vacuum of No circular by co-operative commissioner or legislature regarding AGM Video recordings of Housing society
@MurtazaVideos for getting this Video Recording it is mandatory to member to give Affidavit to the society that members should not temper the video Footage
Because in other movable assets, physical custody can be temporarily taken by Nominee & once legal heir is identified, Nominee has to physically transfer assets to Legal Heir, but in case of immovable assets, the Transfer is just a symbolic custody till legal heir is identified. Nomination is never the final document for any asset but always temporary till identification of legal heir.
@ranganbuxy2692 all nomination forms specify % AND in MFs now one can nominate 10 nominees and our judiciary calls it temporary custody. Need a wake up call. To avoid litigation in 5% cases we make 95% suffer. Property registration system remains one of the most corrupt eco system
@jasujavs Percentage of Nomination is fixed because sometimes the Nominee maybe the bereaved Spouse/Child who may have to encash the assets for their own needs like Children's education, loan repayment, etc. System is corrupt but the laws are brought out after taking into consideration all situations.
Happy Diwali. If chairman resigns from his post but remains managing committee member. Now he appointed associate member, can that associate member become managing committee member? Second committee member also appointed associate member, and he wants to be managing committee member. Can we do this. Please advice.
No. Once Chairman/2nd Committee Member resigns means automatically it is taken as resignation of Associate Member also as all rights of AM is tied with the Original Member

The court has not put any conditions of affidavit to be obtained from a member while availing the video recording
Only if expenditure of AGM Video Recording is shared by General Body or GB agrees to accept Video Recording of AGM recorded by another person.
