- 35% Free Fungible compulsory to be given to Rehabilitation members of CHS - Landmark Bombay मुंबईतील गृहनिर्माण संस्थेच्या पुनर्विकासा मध्ये सदस्यांना 35% फुंजिबल व 15 % incentive FSI अनिवार्य High Court judgement : Architect Shivaji Patil & Salil Rameshchandra - President - Federation of Grantees of Govt. Land The Bombay High Court has given a landmark judgement wherein they have ruled that existing members have to be given 35% free fungible area on existing Built-up area. This area cannot be used for any other purposes. With this judgement, it is now for the Municipal authorities viz. the Building Planning dept., builder/Developer and the CHS committee members - to ensure that this area is given to the existing members in the rehabilitation area. Otherwise they will be liable for contempt of court. There is another 15% Incentive FSI or 10 sq.m. per member, whichever is more, that has to be given to existing occupant member. Mr. Salil Rameshchandra, President - Federation of Grantees of Govt. Lands and Architect Shivaji Patil discuss this judgement. #fungible #fsi

Auxilarry area is 60 %then how much area should be given to existing members.In Mira road if you taking 60%Auxilarry area then how much rea existing members will get.

Nowadays developer in Mumbai Island is using combination of 33(7b) with 33(20b) regulations of dcpr2034 for revelopment of noncessed chsl and show fsi of 5.4 inclusive of fungible.

Yes if it is not feasible for him to give the fungible area free of cost due to high construction cost or specific demand of tenants regarding location of their flat or amenities

If already 3 times FSI used in the 30 years old building in vasai, Virar area, then any chance of getting extra Sq.ft
If 3 times is already used in Virar 30 years back then it must be illegal one. In that case nothing much can be done except cluster scheme. Which needs min 10000 sqmt of plot area.

Sir! Ours is a tenanted building (9 flats with 500 carpet per flat) in Pune City. All tenants have been residing more than 54 years (from 1970) owner cum developer wants to redevelop the building. As per UDCRP 2024 and DCPR Pune. Developer should get 50% of plot area as incentive and all tenants are to be rehabilitated free of charge up to existing carpet area or maximum up to 700 sq ft But developer says he is neither getting any incentive and asking us almost market rate and also not giving alternative accommodation/ compensation during transit period of construction. Plot area is 5850 sq ft. Can you advise us in this case? Thank you.

We are 14 members and consultant is giving only 12 members flat. 2 members are at a loss. Ours is a old house. Do we have to agree with him

He is lying about the incentive area. He will get 50% of existing rehab area and not entire plot area. But issue is your plot size falls under small plot so feasibility is issue in small plots.
