So even if Pointcrows video followed their TOS, Nintendo has reserved the right to take it down anyways. Again, sucky but still legal.

@@FerretyZebra modding isn’t just “an accessory” it’s actually going into Nintendo’s firmware/code and altering it. It’s a big violation of Nintendo’s ToS. And this is why Nintendo has some of the most popular emulators. Anything that's not brand new they just let die, and anything the fans try to do gets axed immediately.
But you guys still have to learn to respect that it's their intellectual property. Yeah but that's only because even after a decade Skyrim is still a buggy mess and Bethesda counts on their stupid fans doing their work and finishing the game for them. Which has worked so far. There are great games that get enhanced by community created mods. But Bethesda games of all examples you could have used is a really bad idea. Bethesda games are notoriously unplayable without mods.
I wish more studios had the Bethesda viewpoint on mods. There is just so many awesome things that can be done and can add easily hundreds or thousands of hours and enrich any game.

I LITERALLY HAD A DREAM LAST NIGHT ABOUT PLAYING A MULTIPLAYER ZELDA MOD. AND THEN THIS VIDEO POPPED UP WHILE I WAS SCROLLING. DID I JUST PREDICT THE FUTURE
The mod wasn't to an emulated version of the game. It was essentially a GameShark code that let 31 other players join a single player through their own copies, linked to the primary player's system. GameShark manipulated code from an external basis to essentially make it so you could do other stuff not originally intended by developers within a game. It is 100% legal as long as you don't make money from it. The catch for PointCrow was probably that Nintendo must have felt that his videos were encouraging piracy. Lots of aging game developers seem to believe that modding is piracy, while it really is not. One video took down by Nintendo, most likely was taken down because of a modded screenshot. Literally, normal gameplay linked to a photoshopped picture.

I love how you said "WHICH IS WHY" as your last words for this short. Very wise and epic last words
That's a crime tho, Nintendo can't falsely claim videos like that. it is an actual felony
And yet the government has never done a damn thing to major corporations for illegal use of copyright claims, see every movie studio that has used copyright claims on movie review and discussion videos
Well uh, its entirely legal since its nintendo's copyright. It still sucks though
Edit: Additionally, Nintendo has a clause in their TOS that gives them complete discretion regarding enforcement. So even if Pointcrows video followed their TOS, Nintendo has reserved the right to take it down anyways. Again, sucky but still legal.
They actually can since you can't upload videos of their games, they usually don't carebut when they do that happens
@@seanscott1308 they copyright struck videos he was legally allowed to post through their own terms of service
Unfortunately the copyright system in the US is extremely outdated and abusable. Video game publishers are within their legal right to claim or strike any videos that contain their IP. But all other publishers have realized that content creator is a healthy and beneficial thing for the video game ecosystem, so they allow it to happen unrestricted in most cases. Nintendo is an archaic corporation who somehow does not see it that way.

Nintendo abused it's power to undermine something technically legal but that they don't like, shocker.
I mean the modder did technically sell it to Pointcrow for 10 grand so technically it’s illegal but Nintendo are shitty for doing this nonetheless
@@requiem165 Them selling the mod isn't illegal. It just goes against Nintendo terms of service meaning that any mods for the game aren't allowed. The reason Nintendo went after this and not the rest is simply because this was popular.

@@FerretyZebra modding isn’t just “an accessory” it’s actually going into Nintendo’s firmware/code and altering it. It’s a big violation of Nintendo’s ToS. @@sorinsilverheart3200 Fun fact! Nintendo is the only console company to have modern emulators!

Yeah but that's only because even after a decade Skyrim is still a buggy mess and Bethesda counts on their stupid fans doing their work and finishing the game for them. Which has worked so far.

Kinda 🤷♂️
Oh no....
I'm glad I watched the videos when they were new
I'm glad I watched both the videos on it before it was taken down
They've been copyright striking a lot of videos recently about this
The mod wasn't to an emulated version of the game.
Literally, normal gameplay linked to a photoshopped picture.
nintendo is in their legal right to sue pcrow for the mod, since: why buy a $70 dollar game when you can mod a game that sold well and you probably already have, to revitalize that instead? in the eyes of the law that's a pretty damn good argument and while it sucks nintendo isn't abusing the legal system or anything like that
