Especially of course new and small streamers. I know there is not a specific rule for how much one gets for a deal, but some numbers for orientation would be great!!

Lots of poured out truth here, there is a reason it's called a [ con - tract ], con = " to deceive or trick. tract= binding or joined as one". Start an LLC and sign ownership of your brand to these type of contract clauses. The LLC can (sub)license out your content and likeness to other agencies you do business with, like; brand collaboration, live streaming, appearances, marketing campaigns, etc. This way your LLC always own the exclusivity rights and have access to the brand. Then you can also control the limited partnership contracts that you agree to as the individual party.
Assuming I’m I understanding what you’re saying, I find it crazy how they set up easily to have their paycheck in deals scales on success of creators (referring to management fees), but when it comes to the creator/streamer it’s a more static amount where you have convince them you’re worth more. Understand it’s a business but pleasing the roster of streamers I think pay you back dividends in the long run.
Watched the video and here is an overview of what I thought was important to take away: What is an agency? -- an agency is a company that "represents" (AOR - agent of record) talent, business, another company, influencer, celebrity, anything in business deals. -- usually an agency will take a % of a deal. A fair deal will be between 15% and 20%. • Will make a deal with the brand. Agency and brand. - if leaving a contract like this, the agency will own all of the deals leaving the streamer with nothing. • An “LP” (limited partnership) sub-contract to an influencer/streamer/creator with deal terms. Exclusivity Clauses- who owns the rights? • License for an agency to utilize your likeness. • “Likeness” - face/personality/brand/content • They own your likeness indefinitely meaning all your deals will have to go through them first for the rest of your life. Employment Contracts - IP ownership • Anything you create will be owned by the company. • NEVER DO THIS RUN “Fees and extras” • An agency offers you 10% of a deal split. They are screwing you somewhere else. • Anyone who offers to take more than 20% of the deals they bring you is scamming you. • Anyone who is taking sub revenue or donation revenue in context of agency is scamming you • Management fees- a monthly fee on top of the % taken per month. THIS IS A SCAM. Fees are scaled to take more from creators. Management Companies: • Takes a % if total income and pays for a bunch of things and brings deals • When negotiating with management companies it is situational to give income. The 15% to 20% income still applies. Things to remember: • Any good relationship is objective/KPI (KPI - key performance indicator) - meaning a numerical value or assertion that stipulates exactly what you expect. • Too many agencies will over promise money and growth. • Verbal contracts mean nothing • Things need to have written confirmation • Written agreements that are notarized are the most legit. • Never take a starter contract. • Don’t do anything where someone else will make yourself big. You have to do it on your own. • Never underestimate a good entertainment lawyer to go over your contracts. These people should not be biased. Questions to ask: • What is the total deal value? • When the deal is done, who owns the contract? • Who owns the rights? • How many deals will you bring me a month? - a good deal will guarantee at least once a month.
This is honestly great life advice. There may be more than half of your interactions in life where someone is trying to screw you. There are a ton of people out there trying to rip people off.

I work at an agency that was founded by content creators for the exact same reasons devin is talking about, we are built on being fair to the creator cuz there are just to many greedy shady agencies out there
I strongly believe that a licens for someone's likeness should be deemed unconstitutional and barred from existence. I've known about such things for years, and thus is why I have never nor will ever sign with any agency unless I have access to read any contract in full. If I cannot understand the terminology of said contract, I will not sign. If anything is unclear or is not what I would accept, no signature will be granted.
As a digital marketing agency owner myself I can tell you some of the biggest scammers work in this industry I've had other agency owners admit to me that they play with numbers on their reports at the end of the month before they send it to clients. That being said the reason why agencies do the contracts with the companies as opposed to companies doing it with influencers, is because most companies don't have the time for relationships with influencers they'd rather the agencies take care of that. On top of that agencies invest a lot of resources to have good relationships with companies that investment is worth nothing if the influencers get the contracts direct. I don't think they should be taking 90% and then 20% on top of that, but you can't fault them for owning the contract.
The IP contract is usually there so a company can’t be screwed by you. Back in the day engineers would add personal libraries to code and now(as a result of something done in good faith) if they got fired or left under bad terms it was a HUGE problem. I know a few people who literally sold shit libraries to companies for 7+ figures just because they’d added them to the code way back and the company realized the potential liability.
The IP contract is not just or even primarily for personal libraries, it's for what you code at your workplace. That is IP, and you are the one creating it, the employer needs something in the contract to get ownership, or he'd have to license his codebase from his employees and ex-employees. I don't think it's unreasonable, not for the majority of software engineers at least (same for writers).

Yeah, that disconnect between creatives and business-mindedness is very far apart, and few people are good at both (or it could be argued, that you can never really be good at both, and thus harming yourself, by stirring too many pots in the kitchen at once.)
This is worse in the modeling/acting scene. Especially in Japan, where there are multiple modeling agencies with lots of foreign models and talent. So you get a job for an audition and they tell you the guarantee is $1,000, you have no idea what the agency is getting. Plus, you can't negotiate unless you are a top 10% talent where deals come directly to you. Now of course, the agency doesn't get money unless the brand picks you from your agency. However, this means the agency doesn't really care about you. They just want ONE of their models to pass the audition and they get the money. So if you are difficult to work with, try to negotiate, or anything, they have no incentive to help/support you. They will just say you weren't chosen for the audition/job without ever sending your portfolio to the client, because they have dozens of other models who will except the contract they sent out. All that said, models tied to agencies are screwed. Even if you try to get them to work on a side project or pay/work with them directly they have to say "no" because they've sold their soul to their agency.

It depends on which country and city you're from. You have to check if manpower laws take voice recordings into account and if your country takes rules and regulations seriously

I don't know how many times I've seen IP Ownership clauses in employment contracts in the IT world even for a standard help desk position all the way up to management.
Sounds right though given that the agency does all the work around a deal, while the content creator fairly often just invests the time for the actual shot which might be a day or two. While the agency negotiates for weeks with a brand and has a lot of their senior managers involved. The work the agency puts in is in almost all cases much higher than the work the streamer or RUclipsr puts into a deal.
Lol starter contract. My reaction to a deal like that would and is usually this, "no, you get 20% max and I get 80% and it needs to be transparent. If this cannot be met then we are done" simple. Easy. Done.

If anyone takes anything from this (content creator or not) is that you follow up any phone call or in face conversation, that requires you or someone else to do something, with a electronic message of some kind stating what the conversation was about. Preferably with read receipts if its email.
OMG!! So I just happen to stumble upon your older video about "How Ninja and Shroud Landed The Best Deal" and from there I've subscribed and liked several of your videos. I worked at a creative agency in Indonesia for 4 years and have been handling several deals for influencers on behalf of my client (brands). I want to ask if I approach those influencers / RUclipsrs (mainly to post in IG or to create a review on youtube) sometimes I asked them as a talent in our ads, is it wrong (in your opinion) to ask them how much they charged for those services (creating content) and then i go to my client asking the same number but with additional 10% as "Agency Fee"?

Sounds right though given that the agency does all the work around a deal, while the content creator fairly often just invests the time for the actual shot which might be a day or two.
While the agency negotiates for weeks with a brand and has a lot of their senior managers involved. The work the agency puts in is in almost all cases much higher than the work the streamer or RUclipsr puts into a deal.

Lol starter contract. My reaction to a deal like that would and is usually this, "no, you get 20% max and I get 80% and it needs to be transparent. If this cannot be met then we are done" simple. Easy. Done.

I think something like a probation time should be an industry standard, but I guess it doesn't do any good for agencies so it will never be a think.

If anyone takes anything from this (content creator or not) is that you follow up any phone call or in face conversation, that requires you or someone else to do something, with a electronic message of some kind stating what the conversation was about. Preferably with read receipts if its email.

OMG!! So I just happen to stumble upon your older video about "How Ninja and Shroud Landed The Best Deal" and from there I've subscribed and liked several of your videos. I worked at a creative agency in Indonesia for 4 years and have been handling several deals for influencers on behalf of my client (brands). I want to ask if I approach those influencers / RUclipsrs (mainly to post in IG or to create a review on youtube) sometimes I asked them as a talent in our ads, is it wrong (in your opinion) to ask them how much they charged for those services (creating content) and then i go to my client asking the same number but with additional 10% as "Agency Fee"?

RUclips is doing this across the board to creators. Only way for creators to turn it off is to do so individually video by video. Either that or disable monetization entirely across the board...

RUclips premium dude. I got it & no more ads! (Plus the creator still gets the ad revenue, afaik).
RUclips premium is basically a twitch sub to every content creator you like while letting you to not have to deal with adds. Plus there are other perks.
