    The wheel of Fortune that malfunctioned it was a jury trial and they awarded the person the $1.4 million jackpot. If you leave it up to a jury, they are never gonna side with a casino. I suggest an out of court settlement.

      That's such BS! What you're saying is that every trial then is left up the FEELINGS of the jury and every juror having that same exact response. That's just wrong! If what you're saying were true, our whole judicial system would never work and would be in shambles! You don't even know any of the evidence in that trial! Smh

      If the casino doesn’t have insurance for those kinds of malfunctions (which they absolutely should if these things do in fact occur) the casino should try and recoup that loss from the manufacturers of the machine, NOT THE PATRON!

    New sign should say "Malfunction pays out". These machines get routinely maintained by techs. If its on the floor the assumption is that the machine is fully operational, as its taking players money all day.

    New Jersey has very robust consumer protection laws/regulations. If I were IGT, I would offer to settle for $100k. If this goes to trial by jury, I have no doubt the gambler will recover the full amount. She'll have to stick out for like 2-5 years though.

    Can you perhaps do a video on what a person should expect to happen when he or she actually wins a huge jackpot. What rights do we have? What kind of paperwork do we have to fill out besides the tax forms, etc.

      I wonder if those games showing “must hit by” are basically the same visual tease. As the number gets closer to the “must hit by,” how much more money will the machine take in before it actually reaches that number? Just like the cracked fish bowl with the fat fish inside never seems to burst.

    It was a good explanation. However, the malfunction was not of her doing. The casino take the risk to put these machines on their floors for people to spend their money. I believe the casino and manufactures should split the cost to pay out on malfunctions. We, the consumer, should not be responsible for the tilt. Lemon cars are a thing. We bought the car believing it was built properly and when it’s not, there is recourse. The law needs to be changed. The casino and the manufactures should be responsible to pay out on malfunctions. That way it is their job to continue to do maintenance on the machines. Be attentive to manufacturing the machine and the casino for putting it on its floors to make thousands and thousands and thousands and thousands of dollars on a machine. They should take responsibility of its malfunctions, not the consumer!!!!

    If the game can has a feature that shows a winning amount, malfunction or not the win should be paid out. If the wheel malfunctions and lands on the 1m jackpot it should be paid out. If this is an issue with these machines the machines should not be on the floor. The person is paying for those features. The casino or the game developers should be responsible for Malfuctions. Even if it's only a visual malfunction and not technical. This was a traumatic experience for that lady. They should take those machines out and she should be compensated

    A player's interaction is Only aesthetically. That's what should matter! If the machine malfunctions in a way that shows the jackpot win to the player, that player should be paid the win. It's the responsibility of the slot machine's owner to ensure the machine is in proper working condition.

      And if the Kachina tilted, why wouldn't the computer still know that it was only a $350 win and only display that kind of win on the screen? I could see a tilt having the wheel spong to jackpot by accident but that should affect the actual computer system that knows what the true outcome was and should display that then instead of $1.2 Million win!

    • @kevinb4079
      @kevinb4079 2 месяца назад

      @@tombeh We don't know if once the tilt was resolved if the proper win was displayed. We are only hearing one side of the story and even then it was stated the casino took actions that seem to indicate they did just that. She's positioning these actions as the casino doing something improper when it sure sounds like they were just going through the usual steps to fix the tilt and get the machine to display the proper outcome of the spin. Keep in mind she was refusing to let them do their jobs (i.e. resolve the tilt) and she refused to accept the $350 that was the true outcome of her wheel spin. The only information we have is coming from the player and the media that has sliced and diced the story to serve their own purposes.

    How many times has a machine titled showing you lost when you really won, and you didn't know it tilted. If it shows a win you should pay it.

    • @kevinb4079
      @kevinb4079 2 месяца назад +1

      You clearly don't fully understand how these tilts occur and how they get resolved. A tilt can't go unnoticed and the true result can easily be determined in the vast majority of cases. Whenever the true result does not match the result displayed a tilt will occur, losing or winning spin. I had a tilt occur and the result was a small win once the issue was resolved. I was expecting it to be a losing spin.

    • @AnOnymous-go7kn
      @AnOnymous-go7kn 2 месяца назад

      A tilt occurs whenever what is shown differs from what it is supposed to show. So it could actually be the other way around. If the machine "decides" you have won the jackpot, but the wheel stopped at $10, a tilt occurs. A tilt can only be reset by an employee so tilts can't go unnoticed. In this case, you will actually be paid the jackpot even though the machine displays otherwise. In fact they can't do otherwise because the jackpot is reset (on all machines sharing the jackpot) so not only is it very difficult to hide, there would be a huge discrepancy in their books if the digital logs show a jackpot payout, but their bookkeeping doesn't. That would result in all kinds of trouble with the gaming committee and a hefty fine much larger than the jackpot.

    • @tombeh
      @tombeh 2 месяца назад +1

      @AnOnymous-go7kn I've never see or heard of a machine showing you lost a spin and then an attendant shows up to pay you cux you actually won! And the machine should show a tiny if that's the case and I'd bet to say that is unheard of!

    • @AnOnymous-go7kn
      @AnOnymous-go7kn 2 месяца назад

      @@tombeh just because you've never heard of it, doesn't mean it doesn't happen. In fact, someone here in the comments had it happen to him. The machine showed he did not win, while he had won (albeit a small amount) and he was paid the amount. However, the chance that this happens with the jackpot, is of course smaller than winning the jackpot itself.

    • @kevinb4079
      @kevinb4079 2 месяца назад +1

      @@tombeh A tilt error is going to lock the machine. There's no way you wouldn't know and a slot attendant would have to show up to correct the tilt and get the machine to show the proper result. You don't hear about the tilt resulting in a win because it's not newsworthy just like all of the other wins that go unreported. Let's pretend this story was reversed and this woman found out she won the jackpot after the tilt was resolved. How many people would be on here saying she didn't deserve it because the machine malfunctioned? How many people would be praising the casino for paying the jackpot out? Practically no one would be. Most would just think...."good for her" and move on to the next story. This story only has traction because it feeds the confirmation bias so many want to prove their belief that the casinos are cheating players.

Same way if you sign a contract that says "I will pay Bob Thompson $100,000,000 by next week!" just because you signed it doesn't make it actionable. The law deals with practicality.

    I see your point to a degree, Mark. However, the average player doesn't communicate with the internal computer, and firmly believes what they see on the screen is what they're winning. Why would think think otherwise? There's no warnings on the machine to tell them that, is there?? The machine essentially LIED to her and gave her false info due to no fault of her own.
    The casinos make enough on these machines to where there shouldn't be any mistakes. The casino SHOULD honor mistakes if and when they're made. They can build (or buy) a better machine if they don't like it.
    She took a risk when she made the bet, the casino essentially told her she won the bet and then it denied it to her. It should be considered a verbal contract in a way. You commit when you put your bet in the machine, they should commit to their communications to her.
    Even if she's technically not owed the money, she should sue the crap out of the Casino for mental anguish if nothing else. Especially if it can be proven that the machine told her she won $1mil + dollars.

    Now that I know what happened; based on your followup video, the woman didn't win. I feel bad for her, but fair is fair.
    The Walmart analogy used is kind of funny, but I had that exact scenario happen to me but it worked out in my favor. Last summer I visited our local Walmart and saw some expensive ice chests priced at $17. I was a little surprised because these ice chests are typically priced at around $50. I picked one up and when the cashier rang it up for $52, I told her the label on the shelf had them listed for $17. She had me show the manager where the ice chests were stocked. When I showed the manager, you could see the frustration on her face. Whoever had stocked the shelves, put the ice chests in the wrong location. The manager walked me back up to the front and sold it to me for the price listed on the shelf, $17. I think a lot of that had to do with my good-natured attitude over the situation. I am sure that whoever stocked the shelf got an a$$ chewing over it.
    I kind of felt bad when I left the store. I knew there was no way that Walmart would ever sell a nice ice chest for 66% off, but it made for a nice summer.

    As someone who's worked customer service for over 20 years, I'm betting the slot attendant only said, "Get it in your head, lady..." after she kept arguing and making a scene that she won. They still shouldn't have said that, but I can see it happening. I read another report in which she was asked to leave the casino, which again makes me think she was causing problems.
    I'm also sure the rules say that the jackpot isn't eligible for 2X's pay, so since that lit up, you know she didn't win the jackpot.
    Another thing is the casino wouldn't pay out that much money. Doesn't ITG pay it? And doesn't the machine lock up until a higher authority gets there to verify the win?

    The woman in question who's claiming this jackpot is owed to her definitely doesn't subscribe to Gamble Smart, where people are told it's best to avoid playing Wheel of Fortune. Pouring hundreds, even thousands of dollars into one of these machines in hopes of hitting "THE BIG ONE!" is just plain senseless. Not even the base game has decent line hits. (K.I.S.S.) Keep it simple $tupid. Go old school and build that bankroll before heading to the Wheel of Misfortune, in this case.

      I've experienced a tilt where the actual result was a small win. Even in this case the player was paid what the actual result was. They did not void her true win because of the malfunction. I assume you know this but want to be sure others don't get the wrong idea that something like that could actually occur.

    In California if any item for sale or on sale in a retail store is marked incorrectly the store must sell it at the price on it. They can not change the price when you are checking out. So a TV marked $299.00 for a $2990.00 TV they must sell it for the marked price. It's very clear in the business and professions code. That said not sure about her win, why don't they play back the security footage?

    I had a machine malfunction, and not pay what I thought was the correct amount at a Washington casino. The machine did malfunction, but it did not hit the pay line I thought it had. They were able to run the recent spins, and I was able to see the record for myself. I was satisfied, and they put the machine out of service. My supposed win though was only $50. Not worth getting upset about. This lady is just hoping she gets some sort of "out of court" settlement. Hot McDonalds coffee on your lap syndrome. 🤑

    hey marc i just got back from a 2 night comped deal at hollywood hardrock casino and i was playing a penny slot, $1.50 max bet on quick hit platinum machine, was playing it for at least a half hour getting some pretty nice quick hits and then the machine screen went out then went blue and then it looked like it was reprogramming. is had some words on it that said " call attendant" but there was no call attendant button on the machine and i looked up at the machine light and it was not flashing. so i can't just leave this machine so after about 15 minutes, the machine finally went back on with my money in the machine so i was back to playing it. i did notice on the machine that it read "all jackpots will be denied because of malfunctions"! so my question to you is do all machines have this
    all jacklots will be denied on malfunctions?

    • @kevinb4079
      @kevinb4079 2 месяца назад

      Yes, but not all tilts, errors etc are malfunctions that would void a payout. Like in this example, the player was denied the jackpot because the actual result of the spin was displayed incorrectly. However the player was not denied the payout on the true results of the spin. This scenario is why every game has this somewhere in the rules. There are bound to be malfunctions with any electromechanical machine and/or where software is involved. But again, not all malfunctions void a payout. If the true outcome can be determined the player will be paid what the true outcome was. The true outcome almost always can be determined.

    What would happen if the RNG meant for a spin to land on the Jackpot slot but it tilted and landed on a lesser spot? Do you think the casino would honestly issue the jackpot? I have my doubts.

    • @kevinb4079
      @kevinb4079 2 месяца назад

      A tilt error would have still occurred because of the mismatch between what the true result was and what was displayed. The wheels spun, it looked like a losing spin but then the tilt error occurred and locked the machine. The reels just continued to spin after the tilt. The attendant "reset" the machine, when it came back up the game replayed my spin and this time it landed on small line hit and I was paid the credits just as if the tilt never happened. This is how most reel tilts play out. There is at least one video I've seen where the replay of error spin was indeed a jackpot.

  • @1967Camaro
    @1967Camaro 2 месяца назад +1

    Can you clarify? Where did the reel land? When did it say tilt? Did it say tilt and then did it land on jackpot, in that order? Did it land on the jackpot, and then did it say tilt right after?
    What confused me was that she hit the call attendant button? If a machine tilts, can you hit the call attendant button? I thought it freezes upon tilt until it’s opened and unfrozen from within?
    I suspect a settlement will occur.

    • @GambleSmart
      @GambleSmart  2 месяца назад

      Yeah, there are a lot of unknowns and inconsistancies in the story. I suspect that while the bonus wheel up top was spinning, it tilted and just happened to land on the Jackpot wedge. The tilt would have shown up the INSTANT something was wrong with the wheel. I also don't think she had a "coin shower", as her win meter showed 0.

    Your analogy with the pricing "error" at Wal-Mart was not a good one. It is the responsibility of the store to honor the pricing that is on the package or posting. I bought a dryer at Sears and an employee had placed the price $100 less than what it should have been. The employee said they would not sell it to me for that price. I asked for the manager and he staged that yes, she will get it for the posted price. that dryer is still working hard at my home. There has to be honesty with both the merchant and the purchaser. Mistakes are made, but that just means the company must hire more watchful employees or they themselves must do and check the work.

    I don’t think so, even if it tilts and lands on the wrong thing the odds of it landing where it did is still incredible. And dude your wrong your examples with a TV versus a slot machine is totally different. Even if there is a possibility of a tilt and the producers of the slot machine know that then they are responsible. Why wasn’t the machine maintained properly?
    And you can see her playing in the video she did nothing to make it tilt. If it really was a tilt and not a programming glitch.
    If you knew there was a possibility it could tilt would you play it? Knowing the casino won’t pay you or the slot company? The answer is no why would you even play the machine? You may be a slot technician but that’s how you make your living of course you’re not going to agree.

    Speaking of RNG and it deciding what I already am supposed to win when I hit the button. On cases of a Bonus round wherein there is an opportunity to do a Match 3 wherein you can either win a Mini / Minor / Major / Grand by matching 3 identical symbols. Does it really matter then what buttons / coins I choose? The reason that I ask is because when I watch multiple channels, it seems like no matter what buttons / coins most people pick on the Match 3, it still always winds up being the lowest jackpot. Your thoughts on this?

      Those types of bonuses are predetermined in most cases where you are picking for a progressive. The RNG has already determined what you won before you start picking.
